Worsham MarineBreach of Contract

We contracted with John Worsham of Worsham Marine Inc in Houston, to build a 400' retaining wall around our lake property. We chose him because of his BBB rating and recommendations. The total cost of the project was $40, 000, including $37, 000 to Worsham Marine, and $3, 000 for dirt work. The project was completed in November, 2010. Two months later, the wall started to collapse. John kept reassuring us that he would come out and fix it as soon as he was done with a large project. But in March, he quit taking our calls and would not return calls. I then spoke with the supplier of the materials, who recommended Worsham Marine to us. He called John and was told that the reason the wall was collapsing was "because we had deepened the channel" - nice excuse but not at all true! He also told the supplier he was no longer handling this project as he had turned it over to his insurance company. That seemed like a strange action, since he is not bonded by any insurance company! Needless to say, we have lost a significant amount of money, and now have a huge eyesore, that we will need to throw more money at, just to get back to start. We are senior citizens, and my husband is disabled, so it's not like we can spend more years in the workforce to make up for our bad judgement in hiring this company.
