Mr. Creedon:
I am 83 years old, severely physically disabled, a retired state law enforcement officer and lawyer, and I have more than 40 years experience before the Superior Court and the Courts of Appeal and the Supreme Court of the State of California, and the U.S. District Court for the Northern District of California, and the U.S. 9th Circuit Court of Appeal in San Francisco, and the U.S. Court for the District of Colorado, and the 2nd District Court for the State of Colorado in Denver.
I have artificial hips and bone on bone on my left ankle and I can only walk a short distance with great pain. I use as compensation to accommodate my mobility disability an electric scooter, exactly like a wheelchair and instead of a wheelchair, to transport me, and when I am standing and walking a few steps I need to use the scooter to balance and support me exactly like a walker.
Both of these accommodations are authorized by the Americans With Disabilities Act Title 42 United States Code Chapter 126 and your company is required to allow customers like me to use our electric scooters in your stores.
My scooter has a slow walk speed and I'm very skilled and experienced the use of it and I can almost balance standing still and when I am using it I have complete control of it, and I have never had any kind of an accident, or a collision, with anything or anyone with it, and I can demonstrate this proficiency to anyone at any time.
At approximately 3PM, Friday, 9 October I tried to shop at your store at 10565 W Colfax Avenue Lakewood, CO, 80215, and I was prevented from using my scooter by your manager "Christine," who was EXTREMELY RUDE, INSULTING, AND DISRESPECTFUL, and had a VERY IGNORANT AND MALICIOUS ATTITUDE.
I bought a few things I desperately needed for which I had made a big effort to get to your store, but I was forced to leave before I finished shopping because of the pain of having to walk with my scooter.
While I was in the store I needed to urinate and when I asked to use the restroom, Christine was once again very disrespectful. She sped off ahead of me on foot and I lost sight of her because I could only hobble very slowly leaning on my scooter with great pain, when I got inside of her standing at the restroom she was very pointed a living at her watch as though I were wasting her time.
I demand that you immediately correct your employee and that you inform me that you have done so. It would only take me half an hour to prepare the papers, without cracking a law book, and to file an ex parte application for temporary restraining order, preliminary and permanent injunctions, court costs, and attorneys fees, against you, and your company, and her, in the United States Court for the District of Colorado at 901 19th St. Denver, and if I do not hear from you promptly I will do so without any further notice to you.
There is no excuse for this employee's ignorant malicious unlawful conduct and a person which such poor moral character is unfit to be a manager of a store.
