Selene Finance review: Fraudulent foreclosure

I had a forensic audit done on my mortgage last April and found that my note was sold to Fannie Mae Remic Trust... When loan was transferred to Selene I informed them of my findings and asked them to prove to me that they had the note in their name... the only note they could provide to me was my original note with my original lender.
I recorded my affidavit from the forensic audit on the public record for all to see.
Whenever Selene provided me with any response they included my recorded affidavit proving to me that they were aware of the fraud. The never challenged the fraud.
I live in a non-judicial state so Selene proceeded to hire an attorney (RAS Legal Group) to facilitate a foreclosure. RAS proceeded to run an add on the public record informing the public that they were foreclosing on my property. I proceeded to publish and add disputing there claims.
I tried to go ahead and pay my past due so I could stop the foreclosure but they wouldn't let me. They said they would send me a balance via mail but all they did was send me a letter with a single point of contact but when I called to speak to the person she was not available, I tried to leave messages but they said they didn't have the ability to do that.
My house was foreclosed on March 4, 2025... There are NO rights for the people these big corporations can do whatever it is that they want to do and there's nothing we can do about it.

I am in receipt of your written communication threatening debt collection, a copy of which is attached for your convenience. Contrarily, your correspondence is without merit as:

● Your client sold the alleged debt to a third-party prior to your involvement.

● Your client does not own any debt obligation or have right of title to my property.

● I served your client multiple notices regarding the sale/conveyance of the mortgage debt to said third-party, thereby affording sufficient opportunities for objection.

● To date your client has offered no response or refutation to my notices, and consequently acquiesced without objection, via “Course of Performance”, into an agreement/contract whereby it authorized and tacitly signed a “Release of Mortgage” (a copy of which is attached for your convenience ) regarding my property in accordance with the Uniform Commercial Code § 1-201, 1-303.

Uniform Commercial Code § 1-201(3):
“Agreement”, as distinguished from “contract”, means the bargain of the parties in fact, as found in their language or inferred from other circumstances, including course of performance, course of dealing, or usage of trade …”

Uniform Commercial Code § 1-303(a):
“Course of Performance” is a sequence of conduct between the parties to a particular transaction that exists if: (1) the agreement of the parties with respect to the transaction involves repeated occasions for performance by a party; and (2) the other party, with knowledge of the performance and opportunity for objection to it, accepts performance or acquiesces in it without objection.

As a result of said “Course of Performance”, your client established a binding agreement that resulted in the contractual obligation to tacitly sign and authorize said “Release of Mortgage.”


Uniform Commercial Code § 1-201(12):
“Contract”, as distinguished from “agreement”, means the total legal obligation that results from the parties’ agreement.

● The alleged mortgage you rely on for said debt collection has been released by your client and memorialized with the recorder of deeds.

● WHEREFORE, as your client does not own any debt obligation associated with my property your written communication is frivolous and devoid of standing.

Accordingly, your attempted debt collection constitutes your knowing participation in your client’s fraud, theft by fraud, mortgage fraud, and a host of other crimes. If you proceed against me or my property, I will not hesitate to file a suit at common-law in an Article III court, seek your disbarment, and institute any other lawful sanctions against you and the principal agents of your firm.

BE ADVISED, your ignorance of your own laws will never be tolerated or serve as a mountable defense to excuse your repugnant actions against me and my property.

Therefore, please govern yourself according to the future reaction you desire from me.
