On 6/1 we received an accepted offer on the property located at W5568 Meadowlark Dr., LaGrange, WI 53121 a couple of hours after it was submitted. On 6/4 I emailed the listing agent and his assistant asking for an update on well and septic because according to the contract they were due the next day (it was a quick close so quick turn around). I did not initially get a response so later that evening I email them both again. At that time the listing agent responded; “The offer was just accepted, there’s no way this CJ tingendy should have not been adjusted and we should have countered. Common sense is required and they have been ordered.” I reminded him that the contract reads 15 days prior to closing to which he stated “As stated in my original email, the deadlines written in the contract are unrealistic based on the timeline. Nonetheless, they have been ordered and we will get them to you when we receive them. There is no need to remind us of the deadlines, we can read the timeline as well.” After this our buyers requested an extension to close due to the fact that they had not yet received the well/water and septic results. We got no response initially from the listing agent. When I emailed him a second time he stated that the more logical thing to do would be to extend the well and septic deadline which he had already breeched. At that point extending that deadline would not resolve the issue that the buyers would not have the allowed time to review the documents prior to closing. No amendment was ever signed or rejected. I can not be sure he shared it with his sellers. Eventually the lender requested an extension as the buyers are both self employed. We attempted a second time to get the amendment signed. At this point well/septic documents still had not been received. John requested the lender information which he was given. Per the lender they played phone tag at which point John left a threatening message on his voicemail which I do have and would be happy to share. The lender would not respond back to him after that for good reason. Along this line as we were still technically scheduled to close on 6/20 an attempt was made for the buyers to access the property for a walkthrough. This was requested for 6/18 which fell under the contract time line for a final walkthrough. It was denied and we were told that we would not have access until we had loan commitment which actually was not due until 6/19. Again, we still had not received the well and septic documents that were due 6/5. Our buyers really wanted to complete the transaction but were getting very frustrated and therefore on 6/13 they contacted their attorney. All of the documents, emails, voicemails were forwarded to their attorney on 6/14 for review. Our managing broker attempted to reach out to him on 6/14. She got a text message back on 6/14 which again was very inappropriate, unprofessional and threatening. She told him they would talk Monday and he was notified at that time that the buyers had reached out to their attorney. At that time, she did a full review of the documents and the MLS listing and noticed that there was an amendment to the RECR that noted foundation issues that was uploaded on 6/11. We were never notified of any issues. It was very concerning since he had on several occasions blocked us from accessing the property. I emailed him this am (6/16) asking why we weren’t made aware and he claimed that they were planning to notify us today (6/16) 5 days after the document had been uploaded and most likely longer since the listing agent had been made aware of the problem. Our broker and Carlos attempted to have a phone conference with him the morning of 6/16 but he was again unreasonable and unprofessional. Repeatedly accusing Carlos of lying to him but he couldn’t not tell him what he had lied about. Eventually John hung up on both Carlos and Nicole. We are still in the process of working this out with our buyers and their legal counsel is involved. I will also file ethics violation with GMAR. I have included a couple of emails but I am happy to share more as well as text messages and voicemails including the one that he was threatening the lender.
