a living man under the jurisdiction of the Most High and the laws of
honor, equity, and commerce, do hereby solemnly affirm the following facts and claims
as true to the best of my knowledge, understanding, and spiritual discernment:
On the morning of July 3rd, 2025, between 7:50 a.m. and 8:55 a.m., upon leaving LA
fitness place of fitness and discipline, I proceeded with goodwill and peaceful intent to
the Publix Supermarket located at:
3171 S Orange Ave, Orlando, FL 32806 .United States
with the purpose of executing a lawful return in full accordance with Publix’s published
Return & Refund Policy.
The Items Returned Were:
1. One full salad, appearing unwashed and unsuitable for consumption
2. Trident Cotton Candy Mints, found to contain artificial coloring not disclosed
prior to purchase
3. Grapes within a hot soup cup, which had a foul taste and were unfit for
consumption I was accidentally charged for due to me not notifying the cashier.
4. One unopened 13-count box of chocolate chip cookies, appearing expired upon
inspection
• (Item 4 was not on the printed receipt but was returned in full capacity)

LEGAL CLAIM:
Publix’s publicly posted Return and Refund Policy constitutes a
unilateral contractual offer. I, the consumer, accepted this offer by
meeting all requirements:
• Timely return
• Valid proof of purchase
• Items in original and full condition
Publix then breached that duty by denying the refund without cause
or justification.
This Is a Violation Of:
• Contract Law (Foundation Principle): A valid offer was made,
accepted, and then breached
• Consumer Protection Laws (Florida Deceptive and Unfair Trade
Practices Act - FDUTPA): Failure to honor a posted policy is an
unfair and deceptive practice
• Promissory Estoppel (Equity Doctrine): Publix made a promise
through its policy. I relied on that promise. I was materially and
emotionally harmed. Therefore, remedy is demanded in equity
