Re: Formal Demand for Restitution – Exploitation of Disabled Consumers (Kaleigh Plano and Brelyn Cardwell, Euless, TX Club)

Dear Corporate Compliance/General Counsel,

I am writing to formally demand full restitution and a complete accounting of all funds withdrawn by EōS Fitness and its billing processor, ABC Fitness Solutions, from the accounts of:
   •   My daughter – autistic, intellectual disability.
   •   Her friend – significant physical and mental disabilities, requires a walker, reliant on Social Security disability benefits.

Both young women were pressured by staff at the EōS Fitness club in Euless, Texas into signing long-term contracts for memberships and recurring personal training sessions. They were told the services were “just to try out” and that they could cancel within three days. When they attempted to cancel, staff refused, claiming no one was available and later asserting they were locked into binding agreements.

Timeline of exploitation:
   •   My daughter was charged for approximately one year, losing her savings.
   •   Her friend was charged for two full years, and her limited Social Security disability income was wrongfully taken throughout this period.

Charges included:
   •   ~$39 monthly for membership
   •   ~$88 every two weeks for personal training

Both were terrified, confused, and believed they would “get in trouble” if they stopped paying.

When I called the Euless club, I spoke with a staff member named JT, who was rude, dismissive, and ultimately hung up on me. This reflects the lack of accountability at the local level.

After multiple interventions, EōS Fitness canceled Kaleigh’s contract but refunded only $300 of the thousands taken. No full accounting or refund has ever been provided for either Kaleigh or Brelyn.

Claimed loss: One of the kids around 1200 and the other one probably close to 2500 or more

Desired outcome: Full refund from the time these two girls with disabilities walked into the club. They not only do this to people with disabilities. They scam people without disabilities. This seems to be an ongoing thing you can check with the BBB.
