Acai Berry Unauthorized charges

This is a total scam.

The 'pay only shipping for a free trial' is bogus. What they do is charge $74.00 for membership and $5.95 shipping for a small bottle of pills. You then see $79.95 on your bank statement, but you had better be quick because you only have 14 days to cancel your subscription.

Yes.. Subscription, otherwise, they continue to charge you $74 per month for the next 30 day supply. Unless you closely monitor your account, you'll see this charge hit a second time before you cancel.

Now, canceling is a story in itself. To cancel, they tell you to send an Email. But there is no proof that you actually got canceled. They have absolutely no intention of answering an Email let alone giving you the difference when you cancel. I had to cancel the credit card that the order was made on.

I am in the process of going VERY public with this information. One last thing. It looks like Acai Berry has bought up some interesting domain variations, so be aware of all the variants.

this is a hoax, they have been told to stop sending me the product, and i have been charged again this month and never received the product in November, now i have a change in December and there is no product, each time the price has gone up. i will go to Better Business Bureau...with this complaint. I think you would like to resolve this immediately. I made a call to them in November to cancel, they stated that they would take care of it and never did.

Noticed two charges on my bank statement one was NEWACAISUPREME in which I did order and now canceled, and the other MAXACAIBERRY. Both charged $5.95, I did a research on both of these companies and they are both located at the same location.

I spoke to customer service about this, and they claim they do not know who MAXACAIBERRY is which I find odd since they are both located at the same place. Needless to say they are a fraudulent company steeling from people.

I hate to admit it but I too have been scammed by this fake company.

I received a junk email offer about Acai Berry Max on November 17, 2008. Aside from all the wonderful benefits the advertisement said you would gain from taking the product, the website stated you could try the product on a trial basis for $5.95, which covers shipping and handling. I figured I'd give it a one time shot.

I received the first shipment in early December. Tried the product, but saw no results. So I was done with it, so I thought! I received another shipment of this product, unexpected around mid-January 2009. Checked my account and there was a withdrawal on 1/17/09 of $85.90 from Acai Berry Max.

I immediately started trying to find contact information on the company, but to no avail. Two days ago, 2/16/09, I had another withdrawal on my account from Acai Berry Max for another $85.90.

I went back and checked my email and found the original junk email message. That is where I saw their email address, contact@smartreachmedia.com. Sent an email today explaining my situation and requesting a refund. I also checked for the website and found another company's name listed, not Acai Berry Max or Smart Reach Media.

This is totally frustrating and I am willing to do whatever it takes to bring the person or people being this scam to justice.

I was on the Racheal Ray web site and there was a promotion for Acai Berry (a weight loss supplement). Racheal Ray, CBS, Fox News and some others had positive comments on the product. I thought I would give it a try. A one week free sample would be sent to me for only $3.95 shipping & handling charge. I received my bank statement and had surprising charges on my account. I was charged the $3.95 from the Diet offer store, $29.95 from Fit factory and $89.31 from the Diet offer store. I looked up each of the Business on-line and found a contact number. I was able to get a credit from Fit Factory who told me they got my information from Acai Berry (AKA - Diet offer store). I called Acai Berry and told them of the charges they told me that I would be receiving the product in a week and I do not receive it then I should call back to receive my refund. I originally called in the middle of November of 2008. It is now March 6, 2009 I have not received the product and they refuse to give me my money back. I have talked to Joseph, Barbie, Chris (Jr. Manager) and some lady named Princess? They all have given me a different story about my account. If you look up the Acai Berry web site it clearly states 100% guarantee satisfaction. I don't have any satisfaction dealing with this company. I have opened a claim with my States Attorney General and I don't think they are having any luck with them.

Please do your research about a business before doing business with them on line. They may just be fraudulent as Acai Berry.

I just ripped off by them, but hoping to get the money back through my bank by disputing their transaction, IF they don't give my money back by the end of this week.

I went for the free 15 day trial (this one being called AcaiBerry Detox), sent an email to cancel subscription after 12 days, only to find them cancelling it 6 days after my request to do so, thus charging me a ridiculous subscription fee.

Clicked on a facebook advert in the first instance, ultimately goes to globalcustomersupport.net for payment.

Yeah, there's a lot of different things they try to get you to subscribe to through different adverts, and they treat everyone the same way, it seems. Take ages to reply, and when it is to cancel something, they decide it's better to go by their reply date, so they can take your money, instead of going by the date you try to cancel.

Personally wouldn't trust them with anything.

these people are thieves.the same ### happen to me and i swear i willr sue them. i will evn call any magazine company to report them.they're messing with my money well i will f****them up.i will also find out who can i contact and what's the process to close them out.this is a complete fraud.

Thanks for all the comments on how the billing works with this company. I have a solution to avoid all the reoccurring charges ect. what I did was go to any major check cashing place like Ace Check cashing, there you can get a prepaid visa card for free, it will have your name and account # just like your bank card. Put $10 on it get the product trial work it for 14days from the day you receive. If it works put more $$ on card and get your next month's subscription your good to go. If it does not work send an email on the 14th day canceling your order and forget about it.. They can try to take unauthorized payment all day long and guess what .. no harm done. If you need another product get another card remember its free... Sorry to all you people who had to get ripped off. But hopefully this will help the next person...

Actually, I did call the number listed on my statement and spoke with not ONE, but TWO, of the so-called representatives; the actual CSM and his supervisor. As I am in the Customer-Service field myself, I know how much it sucks to have customers take out their frustrations with your company's product(s) on you. However, I also know that when someone asks you a direct question and you tell them everything else BUT the answer to the question you were asked that it makes them that much more frustrated with you. I explained to both the CSM and his supervisor that the site I purchased the product through was not the product homepage but one I was directed to after clicking on a "true testimonial" advertising banner (by a woman named Maria Lopez) on the CBS website. I further explained that this new site that I was redirected to mentioned NOTHING about this being a SUBSCRIPTION - repeating charge. It only mentioned that this was a trial offer for $5.95 S&H and was limited to a 30-day supply. Naturally, being overweight and looking for a more efficient/easier way to shed the pounds, I jumped at the chance. this was back the end of July.

Because the first shipment didn't arrive until the middle of last month, it's taken me a bit of time to react. The reason I didn't use the product at all is because what I was sent was not the advertised product but another product. The site advertises something called MAX ACAI BOOST. What I received was a product called ACAI BERRY DETOX. The lovely pamphlet that came with it advertises a completely different product called ACAI BERRY X3. The product names are different, the labels are different, and the company reps were less than helpful.

That coupled with the two charges of $86.42 within two weeks of each other, prompted me to double check my statement and call the first number listed. After a bit of verbal tousling I was informed that refunding my money would take approximately two weeks. However, as I have no intention of waiting on them to be honest and follow through on this I have already contacted my financial institution.

they got me for $1.95 so far i reported my card lost or stolen. i just ordered it tonight and came accross this page after ward. so i contacted them and this is what they said

YOU SAID, the membership/subscription you signed up for is a LEGAL binding agreement. If Acaiberrymaxx.com wanted to they could send your name to a collections agency and be perfectly within their rights to do so. Cutting up your credit card is a way to stop the loss of the monthly subscription but that does not take away your liability as a buyer of the product. For example, if you buy a car and have a monthly payment due, discontinuing the bank account that your monthly payment comes from does NOT mean you don't owe money for a car anymore right?...

Actually not the same Gideon you already have the car and therefore possession under law, thus responsible for paying for it, not the same as receiveing something you didn't want or mean to order, and where your order form does not clearly state what you are ordering, this must be on actual page that authorizes the oder and payment by you.

Under contract law
there is no legal binding agreement, or contract, if the page that you authorize on, (ie sign) does not have a date, and does not say exactly what you are authorizing, right on that very page, (in other words above your signature so to speak) the fact that the information is buried on the site, that you must look for and find a terms and conditions click link usually in small type at the bottom of the landing page, which also does not have one word about a contract or agreement for other than a trial, all these under contract law denote an invalid with no "force in law" agreement or contract.

So the company is committing fraud by charging your credit card without authority.

Acai Berry scam

I orderd acair berry, from a so call business fwm laboratories.
I have tried calling this damn place for the last 4 business day's
im am sooooo pissed. They have deduct 3.95, tiwce in 3 days from
my credit card. I knew then this was a scam. I tried to contact the
fake business and never got and answer only music. I was on hold
for 10 & 15 mins. I never received my free trial of acair berry.
I then did some research found out this was a scam. I immediately
contact my credit card company and they shut my credit card down. I can assure you this will be under further investigation.

Acai Berry Negative Option Scam

This company adverstised a "free trial" for Acai Berry Supplement (pay for shipping only), which, given all the hype I decided to try.

Buried in all the fine print is a negative option, or perhaps I should say a multiple level of negative options.

When I saw what the product really was designed to do...keep your system "clean" (essentially an emetic), it went in the trash. Ok, so I found out something for $5.99.

But when my next card statement appeared, I saw a subsequent charge appear for $88.62. By the way, the same item can be purchsed from a reputable vitamin/supplement dealer for $20.

I immediately tried to contact them. That was a daunting adventure because the call went to a voice response system, then to a dead line repeatedly. On the 20th attempt (no exaggeration) I finally reached someone and cancelled the account. Sadder and wiser, I reminded myself that I really should have known better. (This was done on 12/8, a fact that they acknowledged in a subesquent call). When I checked my credit card after Christmas, I saw a subsequent charge, this time for Acai Berry Tea (this time for $94.57) that was charged on 12/24. Merry Christmas!

This time the first call was to the credit card company to dispute the charge.

The second was to the SFL Nutrition. This time I got through on the first try, only to be informed that, while I did cancel one of my accounts, the other was still active. I told them that was nonsense, and that I wouldn't agree to that. I further told them that the charge was in dispute and would not be paid.

They told me that they would reduce the charge to $62.00 (I had to pay for the shipping and handling). Of course I refused to agree. Eventually they agreed to reverse the charge in 3 to 5 business days.

All of this transpired in an Asian call center, so I had to replay all conversations several times to reach agreement.

Beware: If you get involved in these "free trials" it takes a lot to become disentangled.

I had the exact same experience with Sheer Cover makeup. To this day they have not refunded the overcharges to my card. I was charged for products that were "piggy backed" on to my original order. Because I actually had ordered the one product I couldn't contest the extra items. They would take them back if I paid the shipping. After more calls than I can remember to what sounded like an India based call center I gave up. I even wrote to Guthey Renker to protest but to no avail. I will never buy anything associated with that company again and always find what I need at a store right here in America where if I have a problem I can speak to the manager. Things are not better because Oprah or some other personality endorses it. I've learned the hard lesson.

Acai Berry Charged no Product three times

Ordered trial product for $4.99 received nothing, call two weeks later and come to find out that 12-19-08 my acct. was charged $81.17. So I call and was informed that because of x-mas that product was still in rount. Then on 12-20-08 another $78.81 was withdrawn from my acct. Have called them every day and they all say I will be reimb. but it only not the same amount they took. Today 1-2-08 I call to comfirm my call on 12-29-08 and come to fine out they are only going to reimb. me $34.98 because thats what they show to took. When asked to speak with a supervisor they are never available. So how do we get our money back, and didnt Opha speak highly of this product. Does she know whats going on with the India customer sales peolpe.

Acai Berry credit card charged, no product received

Ordered free trial on 11/30/08. Free sample product mailed on 12/01/08 and received on 12/03/08.

Called several times to cancel, finally reached voice mail on 12/9/08 and left message at 2:07 p.m.

Did not feel comfortable with that, so called back several times on 12/10/08 and reached a rep at 4:50 p.m. After much harassment, I was finally able to convince them that I wished to cancel. Spoke with J. Peterson?

On 12/16/08, my credit card was charged for $78.81, no product was received and I had cancelled on 12/10.

Finally able to reach someone (Gage or Bage?) on 12/29/08. Advised them that my credit card had been charged even though I had cancelled timely. Again, after much harassment, I was told that if I returned the product, I would receive a credit. I told them that I had not received any product, only the trial bottle. She said that I would receive one. Told her again, that I had cancelled and did not want the product, not to send me anything - just credit my account for the erroneous charge. She just kept repeating that I had to return the product (the 2nd bottle, which I never received) in order to get a credit.

By then, I was so frustated I did not know what to do. How can I send back something I have never received and how can they charge me after I have cancelled?

I then went to the website and clicked on the "contact us" to send them a message. Following is the message I received from them: (their exact spelling)
Please be adviced that your data could'nt be pulled up be very limmited information. Please provide you Order number, and the last 4 digits of your credit card. Please feel free to contact us if you have any additional question. Sincerely, Marry-SS

I attempted to send a reply, however it came back undeliverable.

Is there anything I can do to get this money back and prevent them from putting any more charges on my credit card?

I ordered a 'free' sample for the shipping charge of $4.99. Then two weeks later they charged $78.81 for products that I did not order. The second charge was out of the UK.

Watch out for these guys. They offer you a trial for $4.99. Stupid me...I ordered the free trial THEN went online to research reviews about them. After finding a bunch of negative, I called them 15 minutes later to cancel the order. The representative on the phone was rude and wouldn't cancel my order. He said that it was sent directly to the shipping center and he was customer care so he couldn't cancel it. I told him to transfer me to whoever could cancel it. He said that no one could. He said I would have to wait for the bottle to arrive, then call back and then I could return the bottle to them at my own expense and they would refund the $4.99. Even after shouting and repeatedly telling him that I don't want their product he just kept repeating himself. I am disputing the charge on my credit card, but oh what a headache. I should have known better and hope someone else will be deterred by my experience.

Huge SCAM! - I read where you could get a free trail for the Pure Acai Berry Product from Advanced Wellness Research. All I had to do was pay $4.99 for shipping. Seemed harmless. I had 30 days to return product for a full refund if unhappy for any reason. This is posted on their website. After receiving the product within 5 days of having the product my debit card was charged $78.81. When I called to inquire they stated I had to cancel within 14 days. I explained that wasn't on their website it clearly stated 30 day money back guarantee. I explained they needed to cancel any future shipments which they fully intended to send without my authorization because I was not paying $78.81 for any 30 day supply of pills. Not to mention it does not work. Please do not fall into this scam. I still don't have any refund of my money.

Back in January of 2009 I tried the "FREE" trial of these pills for the shipping and handling charge of $4.99. Then why was I charged a random $0.15, which is odd, but it was $.15 so who cares right? Then the
$78.81 was charged a couple of weeks later. That is my mistake for not clearly reading the fine print, nice trick I'll bet that is one of the ways those people make money, stealing from innocent trusting people like myself, but then there was another charge of $2.36 which I also don't understand. The rude man on the phone was trying to tell my that those charges aren't even from them, when it clearly shows the same information on my bank statement as all of the other charges on my account. Then just the other day after numerous phone calls, hang ups, emails, and website complaints I got charged $83.80 again! How is this possible?!? How i this leagal, I've canceled, I've called, I've emailed. What more can I do to get them to stop taking y money! So I called again, after 3 times being hung up on I got through, explained my situation and got a refund only for the last $83.80(supposedly, I haven't seen it in my account yet.) And the whole time the same rude guy on the phone is trying to tell me to give it to my friends, buy some more for my friend at a discount?!?!? WHAT? Just exactly how slow does a person have to be?
So, In conclusion Happy Customer and 100% satisfaction, NOT SO MUCH!

These people are scammers. I am fighting a $79.44 charge right now from them. I fought the same charge with them last week then they removed it from my debit card. Now this week, it is back under a different company name.
The company is located in INDIA.

BEWARE-They will steal your money.

I was told I could not return the product because it was past 30 days since I ordered, but I had just received the bottle the day before! I wish I had seen all the complaints before I ordered, I definitely would never have tried this! It is a scam and I am going to tell everybody I know!

I was very interested in these products after seeing them glorified on national television. I took advantage of the 30 day free trial offer and paid for the shipping and handling charges of $4.99 for the acaiberry product and $5.95 for the cleansing product. I received the trail samples and then noticed that 16days later I had a charge of $78.81 and 14days later a charge of $78.84 for products neither received nor ordered. I attempted several times by telephone to contact the businesses to no avail. I have refused to pay these charges on my credit card.

Acai Berry Acai Berry &Free Trial& Scam

I ordered the "free trial" of Acai Berry Detox and shipment was received & refused on 12/22/2008. Never opened the box; obviously having the product in front of your person for ten seconds so one can inform the postman one doesn't want the product = "trying" the product for slightly less than 14 days, right? More like... I never accepted the package... so I never owned it. Today, I notice my bank account has $87.13 on hold, so I called and was informed it was the acai berry detox. I called the toll free number and waited on hold for approx 15 mins and spoke with some rep named Kyle (did not provide me his agent number) and explained the situation to him. Kyle tells me he will refund my money and this refund process will take approximately 7-10 business days. Clearly, as I never even owned the product - that was unacceptable so I requested a supervisor... and he left me on hold fifty minutes. Called back and spoke w/ Jacky ID #1027010 and she told me it was "impossible" to refund my money any faster. I explained to her that since the "free trial" is alleged to be 14 days in length and I never even accepted delivery and still *somehow* wasn't fast enough, it only follows that if one actually accepts the package - opens it - takes one pill - ships it the back within 24 hours (one day, anybody?) obviously that person would *inevitably* be charged the $87.13. Ergo, this is no "free trial" of which to speak, er, advertise. So, I asked Jackie to explain how this "free trial" were even possible, on a scientific level and... she had nothin'. Ordered Acai Berry Detox online for free 15 day trial Dec. 11, 2008, paying $3.95 for shipping only. Dec. 23, 2008 called and cancelled because I did not receive free trial. Received Acai Berry on Dec. 27th. Was charged on Visa for $3.95 on 12/12/08 and on 12/30/08 for $87.13. Had not received the second bottle. Called again on Jan. 14, 2009 and asked why wasn't it cancelled. Got the runaround. Told her to cancel and gave me a confirmation number and her name. Said she would refer it to billing for credit and e-mail me back. No reply as of 1-27-09. Received another Acai Berry on 1-18-09 which was mailed on 1-16-09. Then received another one on 1-26-09. Have not opened. They again charged my credit card on 1-14-09 for $87.13. Can not get through yet on the phone. Credit card company said to submit complaint though www.myorderhelp.com. It's not so much the product but the way they operate. Will never do this again. Saw this ad when I was looking for something on Oprah Winfrey.com. Thought it would be safe.

I did the same thing I cancelled my account before the 14days recieved the packaged never opened it and put on there the RMA# they gave me and put return to sender on the box. My mail lady that comes everyday at 1. I personally handed it to her ans she said she sent it back that day. I have called them and I spoke with a girl I didnt get her name she gave me the RMA# and told me what to do and then I called and said what happened to my refund, a gentleman answered and said mam I will put you on a refund list wait 10-30 days I waited and nothing, I called again a girl answered then she gave me her supervisor and monique said you are on the refund list and here is the billing email billing@fwmlabs.com and I emailed them and they said do you have a tracking WHY would i have a tracking number if i never even had the package but put a RMA number on there so i saw it for 10 seconds, never opened it. They have not contacted me since.
They are going to tell me we cant tell if we recieved it well if they work like ups, DHL or FEDEX when they scan the package in after they recieve they should have it on our account saying when they sent to us in the first place...SCAM SCAM SCAM they charge 84.00 to my account so now im going to the police saying FRAUD and signing an affidavit to get my money back.

For those people you cant cancel there account online call there [protected]. (customer service)

This thing is definetely a scam I would not encourage no one to order it, I ordered it back in October and cancelled it during the 14 day "FREE TRIAL" which is BS. They are are charging $130.50 dollars to my account I went to my bank and told them to block acai berry and I even had to cancel my debit card.

Guess what? I'm the newest victim. I placed the order online and used my checking account. Per the website, you will only be charged $3.95 for the shipping charges, and I'm quite sure it said you had 30 days before being charged the full rate. I was charged the full rate $80.00 approximately 10 days after receiving the product. I immediately returned the package by certified mail. The next day I got an email that said I will be refunded within 5 - 7 business days. I'm still to receive my refund. I've called every week. The last time, I chatted live with a rep (which I saved), she told me it would take 30 days, the next time, I was told my refund was already sent back to the account that expired 9/11. Remember, I did not use a credit card, my checking account does not have an expiration date. Today, I was told that because I paid by check, it will take 45 - 60 days to receive a check. I wish I had seen this complaint site before ordering the product. I have to find out if they cannot be reported the state where they do business, or the BBB.

i am glad to read the comments made here because i am now in a similar situation and you have confirmed my concerns. instead of going to the company (and wasting more money) i have decided to cancel my credit card and start again, i am just not comfortable with this company having my details, perhaps that would be the way others could handle it to. My bank was only too happy to accommodate my request but i have to admit this experience has made me very weary about online purchasing, especially from overseas. i will stick to the companies i know within the country i live :):):)

I read the fine print right after I placed the order for Max Acai Weightloss and Colnx, and I canceled immediately afterward. For the Colnx, I received an email confirmation that my account has been suspended, and Max Acai gave me a cancellation number. I wrote this down, but feeling nervous about it being a scam after reading all of the complaints on the web, I called Acai again and asked for an email confirmation. I got it around two days after I asked for it, and I still have it in my files.
The trail bottles have arrived, and I've been taking them.
Since I've canceled the subscriptions, I've been calling back every day making sure that my account has been canceled. Hopefully, I don't get a charge on my credit card because I've repeatedly asked them whether my account has been suspended, and each time they've replied yes.
Any one else get through on the number and canceled successfully? After you canceled, did they charge your card or were they true to their word? I'm getting very nervous and am considering whether I should cancel my credit cards or not.

These complaints are right on. I have been on hold now for at least 45 mins. I have no doubt that I will not be put through to anyone. I just noticed the $83.00 debit on my bank account today. If I get my money back I will be very happy, but doubt that it will happen.

I believe i had it hard, i got over six bottles, even when i called to cancel they kept sending and charging my account. I've cancelled my acc. today i have learned my lesson. Your right that ### does sound like Packistan, she had the nerve to even give me cancellation no. and said the product was cancelled.

Acai Berry scam

This is a scam! DO NOT ORDER! I ordered a free sample and had a series of charges long before I ever received a product. I tried to call several times and was put on hold until the phone disconnected. I finally talked to someone who, after taking a long time to "find" my account, promised to cancel the order and refund my money but I only had MORE charges. I talked to someone else who also had difficulty finding my account and kept questioning if I were calling the correct company, even though I assured him I had dialed the number on the product invoice and was reading the name of the company on that same piece of paper. He said he would refund my money if I could tell him how much I had been charged but then denied that the charges I was reading out to him were from his company. Then he said IF he could find my account he would cancel it. BIG MISTAKE. EXPENSIVE LESSON LEARNED. I am now going to cancel my bank account so they can't steal any more money from me. This free sample has already cost me over $200.

ALWAYS ASK FOR CUSTOMER SERVICE NUMBER BEFORE YOU GIVE A CREDIT CARD NUMBER!

I received a phone call from a (201) area code number regarding a work at home project. I told them I was not interested and to remove my name from their call list. Oddly, three days later, I received a call from the SAME number, and when I answered in order to tell them that they needed to remove my name (again), it was for the asai berry product! The woman wanted my credit card info, but I asked for the customer service number first. She was hesitant to give it to me, then finally did. I put her on hold and called the number and got some clinic somewhere. When I told the woman what had happened, she put me on hold, came back, and said "I don't understand your concern." I told her to remove my name from the list and I have contacted the Better Business Bureau.

Acai Berry Overcharged on credit card

My story is the same. I did order the sample for $3. 95. They automatically took the money and did send the sample but then charged me $87. 13 for a second bottle that i did not receive. I now learned that unless i cancelled the order they were going to automatically send me a new bottle and charge me every month. I called to cancel, but could not find anyone who would debit my account. They just kept saying that they would put a ticket in and when they did transfer me to a "supervisor" i was put on hold for 50 minutes and then got an extention was not available to leave a message, which i also did.
I was also told to email their cancellation dept. At [protected]@gmail.com which i did and still didn't get a return email. I got a ticket #from the first person i spoke to, summer; i spoke to alex on 1 / 15; ren #896368 on 1 / 19; miles #14256 and vicky #1029270 on 1 / 21.

All of you who are ### and whining about how you got scammed need to seriously shut the ### up. Just because you were too stupid to read the fine print doesn't give you the okay to cry like little women in heat. If you ordered from the website there are very clear instructions that state that if you do not call the company to cancel this product with in 14 days of your original order date that you WILL BE BILLED $87.13 for the next months shipment. Each shipment including the "trial" sample comes with a months supply of whatever miracle ### you ordered. Stop being ###tards and learn to read you ###ing idiots.

I too have been ripped off by this company. I received the $3.95 trial product on Wednesday 2/4 and was billed $87.13 on Thursday 2/5 for the second bottle. I called and spoke with Chezpa about the 14-day trial period. She informed me that the period starts on the day you order not the day you receive the product and that my 14-day trial expired on 2/5/09. I asked to be transferred to a supervisor because Chezpa insisted on putting in a "ticket" to review my request for the $87.13 to be refunded. No supervisor ever picked up my call.

How can we warn others about this scam of a company? They are even using Oprah and Rachael Ray in their ads!

I ordered this product on a free trial and they caharged my account $87.13 for another other I didnot request and won't refund my money. They said I was to cancel prior to the 15 day trial period being over. I ordered on the 1-4-09, product arrived on the 13th, 15 day trial period over on the 18th, I only had 5 days to try the product not enough time to evaluate.
I only tried it because of Oprah and Rachael Ray. Some one needs to stop this company from false representation and stealing honest people's money.

Acai Berry Unathorized Charges

I received a call today in morning from by bank. They said there was a purchase made with my card today for the amount of $36.79. The only information my bank gave me had DRIREG.NET had charged me $36.79. I googles drireg.net and found nothing under that doamin. The sad thind is that I didn't purchase anything for $36.79 but I did make a purchase with my credit card at midnight I registered for a free trial of Acai Berry for $5.95 and Bormalite for $5.95. I was wondering, did any of you purchase these products on the internet? If you did this means this company is selling our information to a fraudulent company or they are ripping us off. FYI ~ those of us that are complaining more than likely cancelled when we saw the charges! I was able to check my bank account online and called immediatley only 7 days after placing my first order with Acai Berry letting them know that I was charged for RUSH shipping & still have yet to receive the product I ordered on December 12th & now have been charged $69.95 again for a product I DID NOT REORDER and still have yet to see my refund for RUSH shipping and the first product! And bull to you Customer Service manager YOU ARE NOT avaiable every day all day.. I have called about 7 sevens and 3 of those 7 times your computer system is down and am promised a call back, YET I DO NOT receive one, so I KEEP calling you! This is the biggest scam and you should be ashamed of yourself! Please tell us as consumers how to get a REFUND!

I placed an order for a free trial of Natures Acai Berrry and Bromalite and was responsible for $4.99 shipping on each bottle. I just received my credit card statement which shows 8 different charges from two different companies for a total of $380.61. Costumer Service told me that I failed to cancel my subscription and therefore was liable for all charges including a charge of $85.91 for a personal trainer. They said these charges were final and could not be removed. I told costumer service that I was going to contact my credit card company and dispute all charges and file a complaint against their company for fraud. After arguing with them for over an hour, my credit card was credited for all charges except $69.95. Don't be fooled with free trials, nothing in this life is free.

I ordered the Pure Acai Berry Pro and Bromalite and of course it was the free trial. I started reading up on it and found that not only did I order some Acai that is NOT associated with Rachel Ray or Oprah, but the small print apparently says I owe them $78 every month unless I send the "Free" Trial back. I am glad that I used a pre paid credit card and I will be terminating that card or not putting anymore money on it. The customer service I got was coming to me from INDIA, CALCUTTA, where ever that is. I am so disappointed. Where do we go to get the real deal?

Acai Berry Accounting discrepencies and lies about free trials

I ordered under a free trial for 30 days of 2 products offered. The Acai Berry Cleanse and the Life Cleanse. I received the product 7-10 days after the order. Twenty days after I signed for these my bank account was charged. The trial was not complete and the amount charged was different than the add had stated. I was told my account would be charged $79.86 for the product after the free trial period ended. I was charged $87.13 twice. I have contacted the company about my refund and canceling any subscriptions. It is difficult to locate the original web pages because the sights and the amounts are always altering. Each product that is offered has a different web page. Lipaphen.com is available now 12-28-08. They sell Lipaphen-RX, Acai Berry cleanse, and Life cleanse.

Hi All,

I know I said all of this before about going to a store instead of buying online but, I found myself unwell enough to try and use online services. I asked for the free sample and never got it. The thing is I rang them to cancel any further orders even though I didn't ask for any. I know that by the time they are packaging up your sample they are already setting up your next order and taking your money. Again I didn't receive anything.
I contacted my bank cause my son noticed $150.00AU coming out of my account every month. My bank tried to trace them and the bank gave me back every penny this company took from me unauthorised.
So, if this has happened to you then call your bank and hopefully they cover you for this kind of fraud, as mine did.

If you have been victimized by this company, please file a complaint with the Internet Crime Prevention at http://complaint.ic3.gov. As we are only dealing with 40.00 - 90.00 charges, the only way that this agency will take us seriously is if enough people report it. It is also important for everyone victimized by them to know that if they purchased this free trial from an advertisement on a blog which appeared to be started by a regular Joe - that the information within that ad DID NOT state the 15 day trial clause. That information can only be found if you purchased your trial directly through their website. If your purchased your free trial as I did, you were given a phone number that is not a working number.

This is very obviously a scam - because even when you call the correct number to cancel your subscription - they refuse to acknowledge any requests for confirmation of the cancellation - and they refuse to allow you to speak with a Manager. In addition, even after cancelling your subscription, if you call again, you will find that your subscription is still "active". You have no way of proving that you cancelled it as they do not accept "letters" for cancellation. Thier policy states that all cancellations must be done by phone. How is anyone to prove that they called and cancelled. I would advise holding on to your phone records. That is the only proof you will have.

all u have to do is go to rite aid or any drug store- in the vitamin section find acai berry also a bottle of green tea extract and maybe if its bad constipation, add stool softener-trust me they work! it takes acouple of weeks but stick wuth it i ordered the the same "cleanse" and never even used the restroom! also, there is many cleanses in rite aid, natrol is a brand its in abox -a 7day, 14day or a weekend cleanse $10each! and they work! or if you need something once in awhile that works there is a tea the brand that works the best is "china slim tea" all natural no caffiene& it works in 8 to 12-hours i take it every sunday morning, usually its working that nite or next morning-depending on you. im on medication that constipates me all the time- the ingredient that makes this tea work so well is senna leaf- ALL NATURAL! it say on the box its a dieter's delight, all i know is it works- thank god! i finally found everything i told u about to work and it all very inexpensive! good luck-melissa

I also ordered from this company - don't tell me it was stupid, I know that. Within the cancellation period I cancelled, no more charges so I thought everything was fine. It is now 8 months later and another charge has shown up on my credit card from a different company - detoxifree. I contacted my credit card company and they told me that they could not reverse the charge because of the original online agreement which said that the company or its assigns could bill me. They told me I should have gotten the original cancellation in writing - that doing it over the phone was not good enough. I have emailed "detoxifree" at the address provided but it was returned as undeliverable. I phoned their number but it is outside of office hours - I will try that again tomorrow. Anyone has any suggestions on how to get satisfaction?

I am also a victim of this fraud. I ordered just a 15 days trial period and got charged automaticaly for the next period of 30 days (they advertise 15 days risk free trial period without mentioning, that afer 15 days it automaticaly turns on monthly delivery). I tried to cancel my order and claim the money back guarantee, but on the number, that is given for customer service, there is no answer - the operator says, that this number is not in use! It is definitely a fraud. Lucia

I cancelled within the 14 day trial I ordered it on the 27th of Sept. and Cancelled Oct. 5th and I still got charged I just cancelled my check card. I'm filing a claim with my bank if my money isn't returned.

Hey, just wanted to let you all know that you don't have to go through all of this nonsense. These companies are probably all set up by the same people. When you have trouble with one they flick over to another company name. Stop trying to get something for nothing, it'll never happen.
Do what I did, just go to a health Food Store and pay the full price and you are the only one in control of your finances. I took a good look at these sites and very nearly did the same as you. The only difference was, that I listened to that little voice in my head and said "No." Sorry guys, I know you're all in trouble but you have to tune into that little voice or you will really be in big trouble one day.

I LOVE that they say for immediate service go on line to our custer service chat room. After waiting like an idiot for a half an hour watching my computer to see if I cannot get a response to my free trial...No one ever came on to chat...I will try some of the suggestions and if necessary have my bank investigate this fraud...

I was just about to purchase the acai berry detox and the Life Cleanse for trial offer with reduced shipping so I would only be paying $2 for each. Thought I would try but then thought it sounds to good to be true just check the internet. I am SOOO glad I did. Now I can avoid the whole double billing and problem with cancelling etc. THANKS! Acai Berry Unauthorized charges on my card

I answered an ad for acai berry with a payment of 4.95 shipping only. I received the product and an additional charge of $79.95 was made on my bank card on Dec. 10, 2008. I tried to reach someone to reverse that charge, but hit a dead end. After that, a charge of 19.95 showed up on my bank statement on Dec. 16. I talked to someone at fitfac and was told that charge would be removed. It's still there. Today another charge for 79.95 showed up on my bank statement. What recourse do I have to get those charges removed? Please help. My next step will be to contact my state's Attorney General's office. thanks

Acai Berry Fraud charges

BEWARE...STAY AWAY from AcaiBerry Supreme, Fit-Factory and Bromalite "free" trial offers.

I ordered a "free" sample of the AcaiBerry Supreme and agreed to pay $4.95 S&H. I received the product, and then I received my credit card statement and AcaiBerry Supreme had not only charged for the S&H, but for the product, which I later found out was only a 14 day trial. Plus they has also enrolled me in the Fit Factory www.fit-fac.com for $19.95 per month. So I called my credit card company to notify them that the fit-fac charge was a fraudulent charge, which was not directly authorized by me. They removed the charge immediately.

So after doing some "after the fact" research, it seems that if you sign up for AcaiBerry Supreme, free trial offer, it's a 14 day offer. If you don't cancel within 14 days they will charge up to $88.95 for the product and if you don't cancel after 30 days, they will automatically send another month's supply of product and charge your credit card or bank account. Also, if you don't cancel after 14 days, you "agree" to a Fit-Factory subscription. There is no information on the home page of their website. All the information is hidden in their Terms & Conditions section on their website. I called the company and was on hold for about 30 minutes trying to get this whole mess resolved. I have to wait for my credit card statement next month to see if membership to these products has ceased.

I have been reading others' posts, and I am having the same problems canceling my order with this company. I cannot reach a representative, and the answering service--when I can reach it--says the office is closed and to call back during normal business hours. My last few calls have also been cut off after 12-14 seconds.

Luckily my bank tagged the charges as fraudulent and have not approved the charges. I will have to now cancel that card and get a new number, however, this is worth it if it means I won't pay close to $200.00 for a product that is impossible to cancel. And I'm not real sure it works.

For those of you out there who are going through the same thing--my main worry is that something will come back to haunt me legally. If anyone has thoughts or shares my concern about this, please let me know. I'm assuming this company is bogus and won't pursue me if I don't pay more than $5.95.

Good luck to you all, and I hope no one else falls for this apparent scam!

I fell for the Free 30 day supply of Deep Cleanse and Weight Loss product for only shipping and handling of $5.95. Bought the product with my bank debit card. Received the product and then found out I was charged another $88.16 from my bank account and didn't know why. It seems that I was supposed to call them to cancel or be charged and shipped the product every month. I didn't know this. I tried to call numerous times day after day and always found a busy signal on the phone. This just isn't right. I wonder if anyone else has remembered that when we checked out this product, which came to us via e-mail, the big name that endorsed it as the best product out there was none other than Oprah Winfrey. I wonder if she is willing to reimburse everyone for the money they are out from this scam.

I did the free trial for this product and also found that it was not what I had expected. I tried numerous times to call the phone number on the bottle to no avail. I then received my credit card statement and found that I had been charged for another bottle at full price! I have yet to receive any more product from this company. I just called the number and was told to go to this site. For what, so I can type my complaint like so many other patrons have done. What is this company going to do for me, give me a refund, I doubt it. Probably foreigners trying to make a buck in someone else's country. GO HOME!

I completed about one hour of research on this company and didn't find any problems with it. I signed up for the free trial offer of the AcaiBerry Supreme for me and my husband. I was to pay shipping and handling of $5.95 x 2. I reviewed the charges on my credit card and became suspecious when one of the $5.95 came from one company (AcaiBerryPow) and another $5.95 was charged by a different company (MyACAI Super F). I looked a little further and found numerous complains about them.

I immediately called my credit card company. THEY TOLD ME THAT BOTH CHARGES CAME FROM A CITY IN ISREAL... NOT BOCA RATON, FLORIDA as the website states. I, of course canceled my credit card.

The website said a free sample bottle for just a 5.95 shipping charge. At no time did it mention that I would be charged $89 with in 15 days of shipping. Money back guarantee, that's a load of crap. When I called to cancel my order, I was on hold for almost 30 minutes and only then did the operator mention that the order had to be cancelled within that 15 days or my card would be charged the full amount.
Stay away from this site! You will get ripped off!

I placed an order for a free trial to pay only the shipping fee and was informed that I would be sent information that if I was not satisfied with the product I would be sent a contact phone number to call and that never came. Now I am being charged $88.62 for a product that I did not authorize to purchase. I called to cancel the order and was told that a refund was not possible because I did not call within the 15-day trial period. Now I'm out the $88.62 plus the shipping fee. I called the # that was listed on my credit card bill and asked to speak to a manager and was told that they were all in a meeting.

I ordered the Acaiberry Supreme for a trial period. I thought I would keep it because it seemed to work the first couple of days. Well, after a couple of days I realized it was just a diuretic and everything in my body dried out. My skin dried up, my eyes, even my bowels. It did not clean me out but just the opposite. So I tried to call and cancel, the number doesnt work. Couldn't any way to get ahold of these people although they were able to still take money from my account. This is a scan! Do not order this product, it's a rip off!

Acai Berry Charged full price

Advertised as a 14 day trial for $5.95. I was billed $78 after only 7 days and can not get any English speaking customer service rep to cancel my orders and return the money to my account.
Fraudulent Company should be shut down and sent to jail. My last purchase over the internet.

I ordered Pure Acai Berry from Advanced Wellness Research. That day the advertised price was only $1.99. The next day they called saying my credit card number did not come through on the Internet. I argued with them, and after many assurances that this was really Advanced Wellness, I reluctantly gave them my number
Big mistake! I called the company and they assured me that the call was legitimately from their company. The next day the company called telling me I would be charged $72.00 for the product if I did not cancel in 14 days. I cancelled in 10 days, but they charged my credit card with two charges of $78.18 on top of the two charges for $1.99. Then before I received the credit card statement, I received another bottle of the product with a charge of $83.80 on the bill. I called immediately and they denied having a record of my cancellation by phone. However, since I had had a bad reaction to the product, they in good faith cancelled any more product and refunded my money from my credit card. When I called about the other two charges of $78.80, they said their system does not permit refunds! This definitely appears to be a fraudulent company.

This company sells everything from teeth whitening to grant success kits. It was originally founded by Depak Pujari an official of the Indian government. Their company it supposedly in Florida but is actually somewhere in India, hence the reason you will be charged an out of country transfer fee. Unfortunately because they are out of the country they will claim that a lot of our laws do not apply. The best solution is to talk to your bank about the refund. Most will refund your money in full I made a claim with my bank and they refunded my money and are performing a lawsuit this is the best solution.

PLEASE== I canceled the order befor the trial perid as it broke out my skin like rosy coller. but a new bottle came in 3 days later. I called about this, a charged was put on my credit card for $78.81 plus the trial charge of$4.99, they said for me to send it back .I did this, but another bottle came this was sent back. This company after I found out it would be 80.00 after 14 days I said NO I don't want it .. don't charge my card and don't send it... well they charged my card and sent it. I called to cancel yesterday and they told me to send it back (at my expense) and they would cancel it... I am totally pissed. I told them at least 4 times DO NOT CHARGE MY CARD DO NOT SEND IT. They need to be shut down! They broke the law by charging my card when I told them not to repeatedly

I ordered the Acai Berry product 2nd day air and paid the $14.99 for faster delivery. When called to check on my shipment after the 3rd day they said give it one more day the next day when I didn't come again I called and got the same run around. Finally after 5 days it arrived regurlar mail. I called the following Monday and tried to request a credit for the postage not being 2nd day air and ended up on hold for a long time and when I did get a represetative he did not speak very good english. After telling him what I wanted he said he had a bad telephone and to call back in 1/2 hour.
I immediatly hung up and canceled the card I used to purchase the product so that they could not charge any additional to my account.
Upon calling back and just trying to cancel the order I spent 15 -20 min on the phone before getting completley angray and telling them to cancel my d_ _ n order and give me a confirmation #. I had to pay to ship the product back!

Acai Berry Unauthorised charge to my account

After being charged 87.13 for a product that I did not purchase or receive. I was unable to contact the company via the # the bank gave me. It eather was busy or the mail box was full. I also was sucked into this fraudulant scam. I paid the 3.99 shipping charge on 12/8 and received the product on 12/20, some priority shipping, plus the actual shipping charge was 1.66.to boot they charged my credit card 87 .13 on 12/20.tried all the telephone numbers to no avail . called credit card co. They had numerous complaints also. they cancelled my account and reopened a new one. and sent it to fraud services. this co. is hitting people with numerous charges before they get caught . you will be reading this fraud in the news when theycatch up to them.you will be part of one of the biggest scam in history

I ordered a sampel for 3.95 shipping chargerd 39.97 . They called me and said they would send me a free trial of acai berry and also a colen clense. Said I would not get billed and that I would receive a confermation email. also a free trip to bahamas. Never received product. never recievedd email. when I called to complain man on phone said i ordered it After about 30 min and being put on hold with a different answer every time he cam back he finally said they would send me a form to fill out and gave me a confermation number. Still have not recieved the form and charges still on statement. I am fighting with credit card company to stop payment. DO NOT ORDER THIS PRODUCT.

I, as so many others obviously, have been subjected to a rip-off scheme. I have the exact same problems, being charged for "free samples", continuing to charge after I called them and wanted the $83 credited and another $40 that they illegally charged me. I called and got to talk with a real person and demanded my money back. The person assured me my account would be refunded. Well, that hasn't happened. I tried calling again, the # is no longer in service. I found another #, the mailbox is full so you can't leave a message. I think we need a class action law suit against these rat ba----ds! This is making me so angry! I am going to try to find a different phone # but I bet they have skipped town or whatever.

I suckered into a free trial of the Acai Berry and was told I would receive a trial period of 14 days in which to try this product. The product never arrived and my account was billed for $87.83 plus postage. I was able to reach a representative of this company who told me I might have money taken out of my account whether I had received the Acai Berry or not and had 14 day's to complain. Which by now my trial period was of course over. How do I know if I like the product and want to return it if I've never tried it. She said I would receive a full refund within three day's and no other charges would be taken out of my account. Who knows? I intend to follow up and do what ever is necessary to get my money back. Thanks to a lovely person on this site I was able to reach them in the first place. Please BEWARE of these people who prey on others.

I ordered a FREE 15-day trial bottle of the acai berry pills and was to pa $3.50 for shipping. Next thing I knew I had a charge for $83.13 taken from my bank account. I called the company and told them I did not authorize it and haven't received any pills and he told me that because I did not cancel after I received the trial bottle that I didn't meet the cancellation. I was not aware that I signed up to have future orders shipped to me when I only ordered the free trial. I spoke with a a guy by the name of Justin Anderson (and I'm not sure this was his correct name because you could definitely tell he was a foreigner) and he told me that I could cancel future shipments (which I haven't received anything yet) and was very rude to me and was yelling at me. He did give me a cancellation number for what that is worth. I am convinced this is FRAUD and something should be done about it.

Somebody needs to further investigate this scam, because this is not right for hard working people to have to deal with. We earn our money truthfully and honestly. To bad others don't have the dignity to earn their own money honestly without scamming people! I honestly feel sorry for these people, Why not just stand on a street corner with an empty coffee cup begging? You all are losers!

The same thing happend to me.
First thing i did was called my credit card company. They put in a fraud alert and took it off my card.

I just found a number posted on the internet - - this is a new phone number.

It is [protected] the company has a new phone number the one on the card was [protected] that 0ne is dis - connected.

If you call this new number - you will get someone who will credit off the charge.

She tried to pull the line that after 14 days - - no way because i called the same day that i ordered this free
Sample when i noticed they were going to charge after 14 days.

So she told me they are sending in a credit. - - - note get her name and a confirmation number just in case

Also the name of the company is fwm labs - - address is fort lauderdale fl 33312
Hope this helps all of you. Even is you get the name and conf. Number you should still file a claim with your credit card company.

Acai Berry misleading trial, unauthorized charges, no refund

Much the same as others. I signed up for a "risk free trial" and provided credit card to cover $3.95 S&H. Was charged $3.95 the same day by "NETPURCHASE [protected] UT". Eight days latter there was a charge for $29.95 from "www.fit-fac.com [protected] NV". Eight days later there was a charge for $89.31 from "IP-SUPPLEMENTS4MYBODY [protected] KNA". Four days later I got the "trial" pills (14 pills) in a bottle in a bubblepack envelope with nothing other than the pills inside. Return address was "Fulfillment 4650 SW 51st St., Bay 711, [protected], Davie FL 33314. On the envelope was the ship date, which was one day *after* the $89.31 charge appeared. Two days after recieving the trial, another package appeared with 60 tablets. Return address is the same.

Called the AcaiBerry number on my credit card statement and got through. They agreed to cancel future payments, but refused to accept a return of the unopened bottle, even though the trial bottle was shipped *after* the charge for the full bottle was made - so you essentially have no way of cancelling the full bottle before after you've given the product a try.

Then there is the fit-fac charge. It turs out the AcaiBerry folks shared the credit card information with these folks and they were going to charge me $29.95 a month for something I'd never heard of before. I still don't know what their service is. Fortunately they agreed to refund the money and cancel future charges.

Beyond disputing the charge with the credit card company - who also advised me to send the unordered bottle back to the return address on the original shippment and has told us not to pay the disputed amount - I have also filed a fraud complaint at the government's complaint.ic3.gov web site.

Acai Berry CLASS ACTION LAWSUIT

I ordered the product on the 15 day free trial. I never received the products and my credit card was charged $88.62. As most everyone else, the call in number disconnects every time -- even after waiting for over 1.5 hours I was disconnected by the rep. I finally got through to the live chat -- again after 2 hour wait - and was told my credit card would be credited within 3-5 days. Well, that never happened -- who knew! I have researched the registered business and principle owners of the business. I will be traveling to Boca Raton, FL in January 2009 to begin legal action against these SCAMMERS. If you are interested in joining in a class action lawsuit, please send your name and address to my personal email at [protected]@aol.com and I will compile a list to provide to an attorney. I'm not sure how these class action suits work, but I'm going to do what I can to stop these people. I'm also attempting to contact the Oprah Winfrey show, Rachel Rae and Dr. Oz to let them know that their images and names are being used to promote this SCAM. I'm pretty confident that they will not tolerate.

I hope we get enough people to join in the fight to put these SOB's out of business!

They offered to send a trial sample, all I had to pay for was the shipping & handling of, $5.95. I never even used the stuff, I never even opened the bottle, and yes this offer is attached to a trial offer of the Acai berry and how Rachael Ray used it and lost so much weight. That too was to just pay for the S & H of $5.95. I did. I haven't received anymore Acai berry but did get another bottle of the Total cleanse. Charged $84.79. Called the toll free number, its no longer in use. I called my credit card co. to dispute it and they are giving me another credit card and I am not paying for the illegal charged, they told me to send in back and to request a receipt and to keep any bills. I ordered AcaiBerry free trial from welb advertisement in Boston Globe on 1/9/09. Didn't receive the product until 1/24/09 although package indicated it was shipped 1/20/09. The packing slip indicates only 15 days to cancel order or automatic shipments will be made and automatically charged. I called the numbers and used the website - with no response from anyone. I contacted my charge account company and they told me that the company charged me twice for the $9.95 shipping and the charges were currently pending. I told the charge company I wanted the company blocked so they couldn't do automatic shipments. The Website has a "live chat" system that doesn't work and they don't respond to. The phone numbers don't work. I just tried again an this time an "operator namedSherri" got on the line and told me to try back in an hour. When I tried to ask a question she hung up. So it looks like they have it set up to send me more shipments that I can't cancel. They won't accept any cancellation without a "Return Merchandise Authorization" number, but you can't reach them to get one.

I noticed the website that pulled me in is still on line. In fact it is at the top of this blog. Unbelieveale. I hope this goes forward and all who've been scammed gets justice.

I too was scammed. I won't go into details, because they're very similar to the stories above. But why isn't a lawyer chomping at the bit to start a class-action on this one? This company is clearly fraudulent, and I'd love to see these people get what they deserve.

I joined the free trial, as well, and then immediately charged the $87.13. I called the company, was hung up on, had to wait for an unreasonable amount of time, was told a confirmation number but it didn't stop the crazy billing. I had to close my account and start a new one so they couldn't keep charging. I sent the pills back immediately then was told I owed $200.00 because they received the merchandise. What the hell was the $200 charge for when I cancelled.

Now they are telling me they are going to turn me into a collection's agency. This company is a nightmare.

Has it showed up on anyone's credit report, yet?

I fell for the crap. I ordered my 'free trial' on 9/29, canceled on 9/30 (after my credit card company called me to warn me about them), and just received my product yesterday.

I wasn't even mailed until 10/13 (which is the day they should have received it back from me per their online terms of cancellation), which in itself constitutes fraud.

I hope someone gets this lawsuit going.

I recently purchased a bottle. On the 15th day I was charged for $89.00 and ended up with bounce check fees of $271.00. I went to the bank and cancelled my card completly so that they don't charge my account again. I tried calling the phone number but I was hold forever.

I will very disappointed and disgusted by these people.

I would like to join this lawsuit as well. For one, how is it REALLY legal to advertise a 30 Day Free Trial, but put in fine print that you have only 15 days to try it & cancel? I think the claim was that you usually see real results in 1 to 2 mos (or something like that). But that's not my whole argument. I never saw a charge for the Acai trial bottle on my account (for 99 cents + shipping & handling). I just got charged for a full bottle in the amount of $86.42 (before I EVEN RECEIVED a bottle). Finally, in the following week, I received 2 bottle in separate delivery (which I assumed was my trial bottle and the 1 bottle I was billed for). I also ordered the trial bottle of Colon Cleanse at the same time. I actually got to talk to an account representative at their number to cancel my account. The second phone call I made was to Acai Berry to cancel my account with them. All I got was a pre-recorded message telling me that this account had already been closed, this was on August 19th, 2009. Just 3 days ago, I was billed another charge of $86.42. I, unfortunately, have to go to my bank Monday morning to close all my accounts because I was told that this company could come after any exhisting accounts within my financial institution. I am also contacting my local news paper & TV station today, September 26, 2009. We need to stand tall together & overcome these SOB's!

I feel for the order online free trial. Two days after i ordered the crape they charged me 5 times some 3.95 charge inthe same day and have charged me several time from .12 each time. I think that is when they call me. Sometime they would call and just hang up. Not even allowing the phone to ring once. NOW they have over draft my account almost 300. Charged me for a different product for 39.95 and i havent even recieved the product.

Acai Berry Fraud

I recently purchased a free trial of acai berry slim, or so I thought, but I was sent acai berry cleanse. Two weeks later my debit card was charged 87.53 I did not cancel because there was not a number sent to reach them at. My bank just gave me a number of [protected]. I find it interesting to see on my transaction history Sleep Once Again listed instead of FWM laboratories. I hope I get my money back. I was given a cancellation number. What a lousy time to screw around with people. During the holidays. I have lost so much money to scam artists and never got any of it back.

[protected]...that shows up on my checking account...as I have been charged now $87.13 because they have sent another...I cannot get anyone tno answer the phone to cancel..find an address...to return or talk to anyone. I am afraid I may have gotten caught in a scam...

I order a free sample for $5.95, my account was debited for the $5.95 then $88.62. When I try to reach the company at [protected] all I get in a recording that all operators are busy and to hold. I stayed on hold for 30 minutes before hanging up. How can I prevent these crooks from charging my account again? I am writing the BBB and notifying my bank.

I ordered a free trial and was billed and sent another package of this product. I have not opened the package, as I am returning it to the company unopened. I understand from other complaints, that the price charged is anywhere between $78-$88 . This is an illegal practice in my eyes. My simple solution is to cancel my credit card and have another one re-issued with different numbers. This company is deceitful and greedy!

Febuary 13, 2009 I called [protected] to order the Acai-Berry Cleanse. And while I was still online after ordering. I notice it was another website with Acai-Berry cleanse scams. So, what I did was called and told them to cancel my order. In the meantime my husband and I get our bank statement and it was overdrawn. These people took the money out of our account anyway and I never recieved the product. It was for the fifteen day trial for $4.95. I think that with the economy being the way it is that people of this nature should be hung by there toenails upside down for doing this to the American public. I am going to file a complaint with the BBB and the States Attorney's office regarding this matter. On our bank statement it's $221.94 overdrawn. I'm not paying a dime of this !

I ordered the acai berry cleanse. (FREE TRIAL) NO obligation to purchase anything else. Did not say anything about sending another order AT THAT TIME. All I needed to do was pay shipping and handling . Then when I called right away to stop this the number would not go through. It disconnected everytime. Before I could get to my bank another authorization has been added. I did not even get a 30 trial to see if I wanted to purchase the acai berry cleanse. I want the charges to stop and my money returned.

Acai Berry Negative Billing Option - Charges to credit or debit card

BEWARE

I recently signed up for a free Trial of Extreme Acai Berry. I used my credit card and received my trial product. I thought I read the terms of service but obviously I didn't pay close enough attention to it. You can't imagine my upset when my credit card showed billings I hadn't authorized upon it. I was charged $89.31 by IP-SUPPLEMENTS4MYBODY and a further $8.51 by PriceLimbo.com - there is a 3rd company affiliated that I seem to have been missed by which is Fit Factory and they charge you $29.95 and then a monthly charge after wards of $1.17, if you do not cancel within the first 14 days. I caught this early and was able to cancel with only a one month charge.

When you order you only have 14 days to call and cancel or you have agreed to have them continue to bill you and send you product. They use the negative option method... meaning if you don't do anything it is assumed you agree to continue receiving and being billed for their product. If you get caught in this I have included the terms which have the phone numbers for cancellation to stop this. Good luck.

CAREFULLY READ AND AGREE TO PURCHASE TERMS BELOW BEFORE ORDERING:

I understand that by ordering Acai Berry Power 500, I am agreeing to receive Acai Berry Power for a 14-day trial period (days of availability for actual usage could be less depending on shipping time) beginning on date of order. Consumer purchasing items on the Internet should read and understand all the terms and conditions, privacy policy and other "small print." In addition, consumers who pay via check, debit card or by giving the numbers at the bottom of your check have no recourse if the company is not willing to refund your money. There is protection if you pay using a credit card, you can dispute the charge. Some credit card companies offer one time credit card numbers, which consumers can use when they are doing business with a company they are unfamiliar with.

There are companies that hide fees in the terms and conditions, including monthly fees which could total hundreds of dollars.
Nutritional Supplement Company
The BBB suggests that consumers review claims themselves and ask for copies of clinical human studies that support any claims that products can treat or cure diseases or ailments. Any claims that a product can cure or treat diseases or ailments should be reported to the BBB immediately.

Federal law through the Food and Drug Administration (FDA) allows for some claims, if scientific evidence is available. The FDA does not review or authorize claims. MY FIRST COMPLAINT IS THAT THE FREE TRIAL IS A GIMMICK. AFTER PROMISING ONLY A $4.95 SHIPPING FEE THE COMPANY AT THE VERY END CHARGES YOUR ACCOUNT THE FULL AMOUNT. THEN IT HAS BEEN 2 WEEKS AND I STILL HAVE NOT RECEIVED MY ORDER, WHEN THE SITE TELLS ME 7-10 DAYS. THEN WHEN I CALLED THE RECORDING SAYS THE WAIT TIME IS 79 MINUTES AND 55 SECONDS. I HAVE NEVER HEARD OF SUCH A THING. IS THERE ANYONE WHO HAS RECEIVED THEIR PRODUCT AS OF YET.

I had the same results.I fanally managed to get a refund after two months of e-mails, then they sent and billed me for another order of the product.I have returned the product but not heard back from them -of courdse.
Has anyone filed a complaint with the BBB?

The "free" trial is bull&*^%. I immediately canceled my order after I hit sent after I looked that you had to go to a different screen and you only had 14 days after they sent it to cancel. PLUS, you had to return the product. I was charged $39.99 plus the $4.95. I did speak to someone and cancel my "subscription". I noticed the same ad - "AS SEEN ON OPRAH" now uses a diffferent distributor for the acai pills. I wonder if Oprah, Dr. OZ and Rachel Ray know their names are being used for scams.

This company is totally a scam in fact but don't take my word for it the ATTORNEY GENERAL OF AZ is after them.

They start charging your card immediately for 39.95 a month and if you don't monitor your card you could be paying a lot of money to these bums. Cancelling the product is even worse. They won't stop until you send the product back. UNHEARD of in legit companies.

SCAM SCAM SCAM. Watch out America this is the bad part of our country.

Yes, I did receive my "free trial, " but only after waiting a month. This company is a scam! They are going to charge you $29.95 for the "weightloss program you signed up for." Then they are going to charge you $38.95 and $39.95 for some other bogus thing. If you google fit factory you will see, literally hundreds and hundreds of complaints about this company.

I want to file a class action lawsuit for this. It is very, very wrong. I'm researcing right now how to do that. Oh yeah, when you call to say that you only wanted the free trial offer, they of course have this rebuttle script that they never divert from saying that "you signed up for our..." and then they will rattle off all the things you DIDN"T sign up for.

I've never been the one to file complaints and suits, but it's just plain wrong.
