Ocwen horrible comapny

I have been an OCWEN Loan servicing company since 2005. I have had nothing but horrible service from them. The company has a very confusing and misdirecting phone tree that leaves incomplete options, and when you do get a human being, they are in india, unable to assist and unable to direct you to a supervisor. Apparently there are no live american associates in the company who you can direct your frustration too. They have a horrible bbb record with numerous complaints and do not seem very responsive to their customers. If I had to do it all over again, I would never have used a Mortgage broker who ultimately sold my loan to the wretched company. As the economy continues to falter, I have no choice but to ride this out until I can successfully make a change to my mortgage holder.

I CAN'T MAKE A PAYMENT. THE WEB SITE SAYS MY LOAN # AND SS# DOESN'T EXIST. THE PHONE PAY SAYS THE SAME. INDIA (FOR A 19.00 FEE)IS EXPERIENCING TECHNICAL DIFFICULTY. DOES ANY BODY HAVE A CONTACT NUMBER TO SETTLE THIS MESS

ever since ocwen took over for homeq, our lives have been a nightmare. They changed our numbers when applying for the Hamp program and when questioned about this they said they always deduct or add certain figures that we submit. we were denied because we were over because of this. But we were approved for their in house program that was almost double. They then said they had other loan mods they approved us for and we had to wait 30 or 40 days because it was in review. I kept asking about a foreclosure date that my attorney said was real while they said no such date existed and said we are in the review process and they dont foreclose in this period. What a shocker when we were told 3 days before they are foreclosing and they were sorry for any inconvenience. All the time dealing with people from India who i barely understood. We filed bankruptcy a day before to stop the sale, then received a mod offer after filing. The offer was incredible but the date on it was already expired. We were told to sign it and send money and not worry about that expired date. Even though the contract said if not received by that date the deal is null and void. Whats going on here? Can we do anything? Can anyone help?

Ocwen trustee fee's after reinstatement

My loan was was brought current october. I have a copy of my reinstatement quote and wire transfer. I have made every payment on time since. Now on my march payment they are coming up with trustee fee's over $ 650.00 due on the 1st. For fee's they should have charged my on the reinstatment quote, almost 4 month's later. To me this is a way to get me in forclosure again. I owe $200, 000 on a home that still apraise's over 350, 000. I feel they will do any thing to get my house, there is too much equity for these guy's not to try and stell my home

My husband and I are about to loose our home on 2/7/2011 because of the mismanagement of Ocwen. We had been in a modification with Saxon then our mtg. Was sold to Ocwen where we continued our payments then out of the blue we were informed we were in foreclosure. We spent months trying to straighten out this mess and we finally gave up and engaged an attorney from CC Brown. It looked like we were going in the right direction then we informed Ocwen won't approve a modification because we never went through a trial modification for 3 months. We did successfully with Saxon. Ocwen said they couldn't validate my income...how is that possible, I have been lucky enough to be with the same company 6 yrs.? Ocwen then verified my income but said I made too little. We are confused, if you make too much you don't qualify for a modification? How is it we were in a modification one minute then out the next? We need help!

Ocwen ocwen forclosure

Last year I lost my job after 7 years of working as a media and advertising executive. At the time my mortgage loan was being serviced by taylor, bean, and whitaker. They were more than happy to enroll me into their loan retention program. Well after 3 months of consecutive trial payments they out sourced me to a company called sparta. At this point the decision was suppose to be made to re-modify my loan. Well on august 7th taylor, bean, and whitaker announced it's bankruptcy and my loan was sold off. To bank of america. Immediately I contacted bank of america, who I do all my personal banking with and they assured me that they were fully aware of the terms and conditions which I left my previous provider with. I was told to expect contact from them sometime in the near future. On august 12th I received a letter from owen loan servicing that they had purchased my loan from bank of america and that my statement would be mailed out before the sept 1, 2009. And if I had any concerns they would be available to discuss them at the 1-800 provided. Now when I called them I got an automated message for customers who's loans were recently transfered to ocwen. On august 18th I received my first mortgage statement that said my payment would be due in full september 1st, 2009 in the sum of 8, 000 dollars judging from the outstanding payments that I didn't make while I was working with taylor, bean, and whitaker. Immediately I called ocwen to inform them of my situation. They told me that I needed to resubmit my application for hardship only I had to fill out their paper work instead. They told me to submit all paper work in full and my application would be considered. They said if for some reason that I wasn't approved for the application I would be contacted via email or best contact method. Well surprise, surprise 2 months go by and no contact has been made. I get a foreclosure papers in the mail from ocwen telling me my home is now being moved to foreclosure status. I call back in to ocwen and they tell me my application was denied 45 days ago because they would not consider unemployment a source of income. Now it's 30 days before the sell of my property and they tell me the only way I can save it is to get a job and submit the offer letter. Just 5 days before the sell date I land a full-time job working for a cell phone provider. They push the sale date back another 30 days and tell me that I have to submit at least two paycheck stubs. On december 23rd, 2009 they send a notice that they are waiting for 2 more documents with my signature they tell me that I must have the documents signed and turned in along with it's original email no later than january, 22nd, 2010. I turn the paper work into them by january 14th. On january 18th, 2010 I got a new mortgage statement and I see where they have reset my loans and started me on a trial payment plan. On tuesday february 2nd, 2010 ocwen auctioned off my home and it was sold. Hello! How can they foreclose when I have already made the first payment. Now I have notices coming to the house saying I must vacate my home and ocwen has my money, won't answer the phone, and won't answer my emails. Meanwhile i'm trying the stop the real estate agents from forcing their way into my home. Why is ocwen doing this to their customers? I can assure you one thing is true, they have outsourced business to india and you get the same voicemail every time you call and never a live person. Ocwen must be stopped.

Update... So Ocwen LLC is now claiming that they have not entered our Loan Modification into there systems yet.

Are you kidding me! It's been over 4 months. OCWEN offered US the modification which WE signed, dated, had notarized and sent in our payments. To which they accepted and makes it a legal binding contract, yet they are still going forward with the auction of our house Dec. 1, 2010 because OCWEN has not entered it in their systems... They even ADMIT on record that it is their mistake...Oh Ocwen... What are you doing

Ocwen is as dirty as they get.

First off I want the make people aware that we have many of the most important conversations with Ocwen recorded so there is no we say/they say.

We were offered and agreed to a loan modification from Ocwen signed and dated in June 29, 2010. We sent in the down payment/first payment at the end of June per our modification agreement.

On july 16 we received a letter from a local attorney stating that Ocwen had referred our home loan to them for foreclosure for a default on the loan. My Husband called Ocwen and asked them why they started foreclosure and they said that the modification would be entered into their system and the correct information would reflect in our account soon. We replied to Ocwen's attorneys office and sent them all the information needed to dispute this error made by Ocwen. We them called the attorneys office to see if they had received all the information and they had. The attorney's office told us that they could not reach Ocwen and asked us to try to have Ocwen contact them. My husband even made a conference call between Ocwen and their attorney's office and was told by Ocwen that they could see that a mistake was made and they would get it resolved.

We have a screen shot of our account online taken on July, 19, 2010 showing a message that our modification and payment had been received. The screen shot shows the information about our loan before the modification but shows the next payment due according to our modification.

We made our Aug. mortgage payment over the phone in Aug. 2010 and it was accepted. We made our payment in the form of a personal check for the amount due according to the modification in September. They sent the check back claiming it wasn't enough to satisfy the default. We called Ocwen and the claimed that we did not have a loan modification with them. My husband again told them that we have in our possession a loan modification agreement with them. They conveniently found our modification agreement in a matter of seconds after we gave them that information. The home retention specialist told us to wait a few days before sending the September payment back so that the same thing wouldn't happen. He called my husband back like he said he would in a couple of days and said that everything had been straightened out.

About two weeks later, my husband received a call from their collections department stating that they were trying to collect a debt and that the September payment had been rejected again. It was the collections department again having no knowledge of the modification. He asked to be transferred to the home retention specialist. The specialist then said he didn't know why the payment was rejected again and that he would again call back after he had figured out why this was still happening. Again, he called my husband back a day or so later and said that he could then send in the payment again, but that it needed to be certified funds. He also advised that my husband wait a week or two before sending in the October payment so that it wouldn't be confused with the September one.

On November 1, 2010 I found a Notice of Trustee's Sales set for December 1, 2010 taped to my front door. We haven't received any payments back, yet as of today, November 2, the September (certified funds) payment has still not been accepted/cashed nor has October's payment. We have been calling Ocwen all day and so far we can not reach our loan specialist.

Ocwen has left us no choice but to get an attorney and fight them.

HAMP ISSUES WITH INSTRUCTIONS AT THE BOTTOM:

OHIO person your State Attorney General has filed a class action suit.

My husband has a mortgage he took out before we were married. He always paid early with an automatic bank draft and for more than what was due. He had never been on government assistance in his life and had perfect credit. After unexpectedly loosing his job in June of 2009, we found out that we qualified for HAMP. We started out with TB&W and sent in “verified” information to qualify for HAMP. 3 trial period payments were sent in to TB&W who shut down during the trial period process. At the advice of Freddie Mac, my husband put his credit on the line and was told that it would be cleaned up in a few months once the payments were capitalized on and the final was complete. Cenlar took over TB&W’s loans and held our file for 6 months. During this time, they cashed our trial period checks and claimed they never received the money. They would not return phone calls. They threatened foreclosure even when we were paid up on the trial period payments. Cenlar lost all of TB&W’s paperwork. Cenlar asked us to send our copies of the paperwork 5 times (documented). Freddie Mac told us they would escalate the matter and sent paperwork to Cenlar on our behalf.

Freddie Mac finally told us to ignore Cenlar and that Cenlar did not handle HAMP files. Why then would Freddie Mac ask us to send our HAMP paperwork to Freddie Mac to escalate the matter for us? Why would Cenlar ask us to overnight, mail and fax the HAMP paperwork to them 5 times if they did not handle HAMP? Why would CENLAR cash clearly marked HAMP checks? We also sent emails, letters, and made phone calls to all parties involved. We tracked down a skeletal crew for TB&W and got the tracking numbers of the information that TB&W had sent to them.

Freddie Mac told us not to pay Cenlar that they had found a servicer named OCWEN to take over our loan. We were told by Freddie Mac that OCWEN agreed to capitalize on the payments and bring us current in January of 2010. There was just the legality of sending over our file from CENLAR. It is May and no one has our file. I again sent copies of our paperwork to an onsite Freddie Mac rep at OCWEN who did not give our paperwork to the correct parties. This new Freddie Mac rep also lied to us stating the our file we sent was being looked at by underwriters in India. Then when we checked back with him the file was being reviewed by the Treasury. Then the file was up the chain at Freddie Mac. He lied and is now working for a bank in California. When we called Ocwen, Ocwen said that this was all up to Freddie Mac to decide. Freddie Mac claims it is all up to Ocwen to decide.

Here is the long and short of it. Any chance of my husband finding a job in the line of work he had performed in the last 26 – 27 years is over due to following the advice of Freddie Mac. In his line of work he had to have great credit. Freddie Mac reps knew this all along. We would have not chose this path had we not been guided this way. My husband has a 401K that does not come into consideration when applying for HAMP because it is his retirement. We could have bought some time and put the house on the market by using this money. We did not want to lose our home, which is what HAMP is made for. We used my small salary which would be enough to pay the modified payments on the home. Remember, I am not on the loan and they all knew this. According to HAMP guidelines, I can contribute part or all of my income.

First Ocwen states that we did not send in the proper documentation. This I proved not to be true. I also showed them that the person making the decision is confused as to who is on the loan and who is not since I, a female, continually am addressed as “he” in their interoffice memos.

They then tried to blame Taylor Bean and Whitaker saying TB&W signed people up illegally only using “stated” income and that was how we got signed up. I then had to prove that TB&W went overboard with me and made me send in “7” pay stubs as opposed to the “2” that is standard and my pay was “verified”. By the way, at the time we qualified, “stated” income was allowed and really should not matter until we do the final mod just to verify my income is still the same. I also told them TB&W used 2 negotiators instead of one to come up with our payments. I then asked where all of the original paperwork was at to clarify the issues since TB&W used Freddie Macs worksheets to come up with our payments and to qualify us. Our paperwork is still lost.

Now all of a sudden, Ocwen is saying that I can not contribute but 50% of my income and that is not enough money to pay the payments they claim. They did not alter the loan to the 2%, they did not stretch the loan out for 40 years, and they did not do the NPV to adjust the principal. These are all listed as steps they are supposed to do. We had to tell Ocwen and Freddie Mac what the guidelines stated because they have no clue or they are playing dumb very well.

From what I have gathered, all of these loan servicers are conveniently losing files. I wished there was a way to file a class action law suit for missing files. I know that there is a protocol that has to be taken for the storage and care of people’s financial information and I have been told there are 100’s of thousands of files missing! People are being disqualified after being qualified for HAMP for trumped up reasons like all of a sudden “not enough income” or “missing paperwork”. A lot of people are giving up and walking away. Others are taking stands. The Urban Justice Center in NY [protected] has filed suit against a large bank JP Morgan or Chase I think, for 3 people who were lied to. The National Consumer Law Center in Boston has filed a Class Action Lawsuit also.

If you are going through the same issue, here are some things you can do:

File a complaint with your State Attorney General (states are gathering complaints)

Contact your representatives and congressman

Contact your States Financial Regulations department and file a complaint (states are gathering complaints)

Keep documentation – I have recorded phone calls and emails from Freddie Mac with their guidance

There are a few lawsuits going on across the Country

Go to www.hmpadmin.com and do research to see what fits your criteria.

Read the directives at the HAMP website. Q1222-01 is a great one!

Call Freddie Mac’s corporate number and when it asks for a person’s name, ask for the CEO.
File a complaint.

Send a complaint letter to Freddie’s Mac’s CEO

Address complaints to the loan servicer on your loan’s President of the Company (in some instances these are the only ones that get through)

Ohio’s Attorney General is filing a class action lawsuit against some servicer regarding HAMP (maybe your state will follow soon if enough complaints are made)

Arghhh...This is what I had to email Cenlar since I can not speak to a human for either company.
I have paperwork and have spoken with multiple account representatives that stated my account would not be negatively affected because Taylor, Bean and Whitaker owe my $18, 887l.53. I recently made TWO months payments and called to make another two TODAY to get caught up, but now my loan is with a debt collector? I tried to contact a CENLAR person in person (phone), but each que kept hanging up on me since my account was transferred.

I tried to call OCWEN (it would really help if that name and website were spelled out on the phone). I couldn't even speak to a real person at OCWEN...each que there hung up on me after stating I owe "zero dollars" and my last payment due was "January 2010". I would REALLY like to pay my loan.

Before TB&W lost my loan modification paper work twice and then went bankrupt, I used to be 3 months ahead on my mortgage. Now I can't even PAY my mortgage?

I can totally relate to all these complaints against Ocwen. THEY ARE TAKING MY HOME that i have lived in for 20 yrs! Tried working out modifications with these scam artists for several years that were fair and reasonable and not upside down! I have suffered sever anxiety and sleepless nights due to this predatory lender! They were supposed to be working on another BETTER loan mod. for me and said not to contact them for 30 days while they were reviewing my financial documents ...so i didn't. Then on Feb.18th i receive the notice of the sheriff's sale that is set for 4 DAYS LATER! Faxed in all paperwork they requested on Jan. 18th and i didn't contact them and 1 month later to the day i receive the sheriff's auction papers! I have so many other complaints with this co. that it is too much to type. I did also receive another person's loan modification from a different state that was sent to me via email. So i have all this mans' personal and confidential business such as the terms of his loan mod., his address, the bank where his checking accct is all hsi acct. Numbers, etc! I felt horrible about this!Not to mention the fact that how do i know my information isn't out there sent to other people. That is one instance of their bad business ethics! I don't wanna lose my home! Can someone help me? I live in Ohio

I am going through the same thing. They have not forsclosed on me yet---looks like it is coming. Is there not anything anyone can do. When I finally got to speak with a woman, who actually spoke english, I was so frustrated I was in tears. She stated, I don't know why you are so upset--its only a house. I have actually spoken to a couple of people, no one has given me the same answer. I have submitted paperwork on 4 occassions, still don't know anything. She said they would not consider a modification unless I was 3-4 months without making a payment. This has been a living nightmare!

Ocwen poor customer service

Admittedly behind on my mortgage payments due to job loss in 2009, and being a new customer to ocwen due to my saxon mortgage being sold to them, I am trying to get a loan modification. They sent me a package of documents to complete, which I did and faxed back 25 pages of information. At that point, they e-mailed a letter to me, saying they were missing some information. Two of the things they asked for sounded like forms, which I asked them to send me. They have not. I've spoken to two different people on the phone - both of whom told me they'd send the forms via e-mail - still nothing. I've e-mailed them, asking for the forms - still nothing. I've tried to call them, and when I finally get through all the automated bullsh— and press 0 to speak to a customer service representative, I get voice mail telling me they are working on my loan modification, please leave a message and they'll call me back within 24 hours. They don't do that. Today I received two certified, return receipt requested letters - both exactly the same - that were notice of default letters. I'm afraid i'm going to lose my home, but i'm trying to comply with their requests. After reading some of the complaints here, i'm even more worried about this. I've contacted the florida state attorney's office, hud, and have the name of a real estate attorney that I will contact on monday to see what my next step should be. If anyone has any suggestions, i'm open to them. Thanks -

I Had the same situation and I suggest file chapter 13 bankrupcty yourself not with a lawyer do it yourself to stop the foreclosure only when they send foreclousure papers. it can give you 6 months to a year

Ocwen right hand missing, left hand is lost

Sorry for many typing errors. Key board is acting up. Just like Ocwen doing as it pleases.
What I didn't say earlier is that all my efforts to resolve the issues with Ocwen intailed many frustrating hours on the phone with clueless customer sevice people that have no more business talking about my mortage than my 13 year old son. The biggest problem besides dealing with clueless idots is that the right hand doesn't have any idea what the left hand is doing. Understand the Hazard Claims Dept. has held this check since Dec.18th 2009. Supposedly they were waiting to see if I was going to rebuild. Yet this is the same dept. that had me write a letter stating why I did not want to rebuild. They were also the people who told me to contact the Loan Retention Dept about refinancing the balance. In the mean time my loan is going into default with out my knowledge. How long will this be allowed to go on before some one does something to stop it. Mean while the customer suffers the consequences of bad credit from being forecloed on. Ocwen obviously knows there is nothing te customer can do about how they were treated. Otherwise they would have mae change a long time ago. They also know there is no one to hold them accountable for their actions like the FDIC does for the banking industry.

If Ocwen does not do as they told me they would do, I am going to get a lawyer and have a lawsuit against there [censor]. I am also going to have a forensic audit done to investigate them. They are stupid idiots don't they know we have not thrown away any receipts from day one of being sold to them. They need to get some english speaking representatives. How could you be so stupid to foreclose on someone's house you are losing money yourself. It is going to be even worst when you have to pay the money to fix up the house. Ocwen please stop being fools you are only hurting yourselves.

Ocwen has no intention of working with any loan modification programs. They are holding out to see if the Federal government will come up with solutions more financially beneficial to them.

If you live in a state where OCWEN cannot come after you after foreclosure and you are upside down in the equity of your home, you need to realistically sit down and consider STRATEGIC FORECLOSURE. If you
are more than 10% underwater, it will take you 10-68 years just to recover to the equity you had in your loan before the Big Recession hit. Do the math and start thinking.

Ocwen will promise you one thing, but they lie. They also distort the truth to make whatever decision they make about your home into what they need in order to justify it. They ruled we were ineligible for HAMP because we were no longer living in the home. We were. We had lived there more than 19 years. We had
notified them in writing of this, and have the evidence to prove it. Nevertheless, OCWEN foreclosed on the home, lying about the fact that we were not living in the home.

OCWEN actually did us a favor. We are renting at more than $300 less than what the mortgage was, and have much more room and a better quality home. We are only minimally impacted by the foreclosure.

If you stop and think, it makes good business sense to walk away from an upside down mortgage if you can.
And it sticks it to OCWEN who created the mess in the first place.

I have been in foreclosure for about a year now due to my employer cutting our wages and laying off drivers. I have asked Ocwen for help in this matter.
I have submitted a Hardship Affidavit for the second time. The first time they claim they did not receive. So I sent it certified mail this time.
When I asked why they didn't let me know they did not receive it. They had no answer.
To sum it all up. I am getting the run around. In the mean time I have gotten my finances in order so that I can pay my mortgage.
When I try to call I can rarely get through to anyone. The times I have gotten through I get someone that cannot understand me or I can't understand them. They are usually in India or Paraguay! PARAGUAY! Are you kidding me?
Well I have had it and do not know what to do anymore. I have done everything this company has asked of me and they always seem to want something that they never wanted before. I am ready to tell them to keep the house.
They call and I answer and it's a recording. I call back and get nowhere! I have left messages for ext. 6403 and never get a call back.
I guess it's hard to call from India! Does anyone have an answer?
I need help and not another scam!

My dear friends from Honey Dew California are going through the VERY same 'delay' process and now their home is very close to being lost. I've been trying to help them all year. We hired attorneys, who also kept sending us their endless monthly forms to have to fill out, just to have more and more and more dumped on us all over again. It was stalled and stalled, delayed and delayed until now at a year in and the company is now going into foreclosure.

We really want to join the class action law suit. If anyone knows the web site or phone number of the attorneys, would you mind posting it? Thank you very much!

Ocwen is a specialist in adding mysterious fees to your account. Anyway, please keep in min that those fees can be postponed to the back of the loan term. This, if you're below 90 days due. If your due time is higher, then yes, those fees have to be paid in order to reinstate the loan.
Furthermore, Ocwen's fees can be assessed after the motion, property valuation, etc., have taken place.
Ocwen's biggest failure is in efficiently communicating with customers. I was a Supervisor with them and now run my own business against them, helping homeowners the way they should.

We filed Chapter 13 to save our home and each statement we receive from Ocwen has a new total on it each time. They keep billing us for fees but never tell us what they are for. The new statement has a $200.00 fee for some motion. How can there be a motion when we have already been discharged?

Want to join class action suit against Ocwen. After a 1+year effort to modify loan they gave us a "take it or leave it" offer that was complete Bull. They tacked on all of our back payments plus the interest and fees to the principle so now we owe more than the original loan and they changed the term to 40 years! We are in our late 50's...and will never be able to pay this loan off and own this home let alone see any equity so that we may someday sell this property and retire. We are currently 75K underwater, probably should walk away.

Ocwen loan modififcation program

I applied for a loan modification with ocwen,. The offer they returned was higher than my monthly mortgage payment, I tryed calling ocwen and no responce, all you get are automated recording and leave a messoage with someone who cannot say their name clearly, I tryed to talk with the ombudsman office held on for 40 minutes and finally I faxed ocwen and the ombudsman office with no response. People seeking mortgage should not go to ocwen they will let you down, raise your monthly payment telling you it is due to personal property taxes, this is a truth. Toles, c

Ocwen sent us TWO different modifications - both being higher than our original payment, extended the life of our loan by 10 more years, and did not drop the interest rate. We have been battling with them from the very beginning and are now in a Chapter 13 to try to get this cleared up. But they have now hit us with all kinds of fees and charges to pay back over 5 years PLUS raise our payment close to 400.00 a month for our escrow account. They are unbelievable. Our lawyer can not figure out where Ocwen came up with the extra 400.00 a month they are asking for!

I to have been fooled by ocwen, they put you in for a modification and then never answer the phone or give you an answer to a question that is so realivent to the situation they have had my mortgage since 8/2006 and I have had nothing but problems. now they have my home up for sherif sale 3/2/2010 and I was never told this company is a fraudulat company and someone needs to take them down and believe me when I say I'm trying my best I hope I don't lose my home in the process. Other people should do what I did call your local news station and report this as quickly as possible, Go on the news and put Ocwen where they belong. People let companies like this one get away with this stuff without fighting back it's time everyone fights back, no-one deserves to live like this not knowing if they will have a home.
Everyone who is dealing with this company and live in South Philly or and part of Philly call channel 3 and let them know your story I did I'm waiting for a call back but, if others call Ocwen will not stand a chance and maybe just maybe the Federal Government will finally take them down and we could live Ocwen free and breath again before we got involved with them.

Ocwen lies

Ocwen agreed to work a loan modification program with us on 8/20/09. We heard nothing from them. I wrote them in early september 2009 about the current situation, the condition of the home, and offered to provide anything they needed.

On 9/23/09, they sent us a letter stating we were not eligible for hamp because we were not living in the home. On 9/25/09, I fax'd them and told them we were indeed living in the home and had been all along.

Unknown to us, a private "invester" offered ocwen more money for the home, and ocwen went ahead and foreclosed the home without any notification to us as of 10/1/09.

On october 5th, a "cash for keys" man showed up and was appalled because he had been told we were no longer in the home. He told us we had 3 days to get out.

What kind of monsters do these things to people? Ocwen should be sued for its indecent treatment of people.

Ocwen they are forcing a forclosure

We purchased our THIRD home in 28 years on Oct 10 2007, Unfortunately we were referred to a lender that was less than ethical. Our 1200 dollar a month payment was originally said told would be 750 per month, until after they had us. Taylor Bean and Whitaker was our mg company, thney have gone out of business as of 8-09. We aspplied for a modification with TB&W FOUR TIMES, we sent FOUR APPLICATION PACKETS OVERNIGHT FED-EX as advised by loan officer/representatives at TB&W. I have all of the tracking and receipt #'s and have compiled a file on TB&W. We've contacted the Florida Atty General as well as the Pa atty General.

TB&W transferred our loan to OCWEN in 8-09 after stating by phone that we were approved for a modification and " agreement papers' were on the way. This was a blatant LIE... they never intended to modify rather they transferred us to become OCWEN customers

OCWEN is now trying to force us into forclosure, they are now sending payments back to us, while stating they are modifying our mortgage. We are not eligible for the home affordable loan because it is a investment property. However I've contacted the AG and congressman in our district who assured us that mnodifications are for EVERYONE AS WELL AS INVESTMENT PROPERTIES.

Ocwen is returning payments...UNHEARD OF? We intend on paying in full and getting a modification elsewhere but first we are having a FORENSIC AUDIT done to investigate OCWEN and their practices.

12/29/10 I TOTALLY AGREE WITH EVERYONE AGAINST STINKIN OCWEN. THEY WOULD BALLOON UP OUR MORTAGE PAYMENT ALMOST EBERY MONTH UNTIL A 750.00 PAYMENT WENT TO 1500.00 A MONTH. WE FELL BEHIND ABOUT 3 MONTHS AND WITH THE LATE FEES AND THEIR ATTORNEY FEES WE OWED AN EXTRA 5000.00. SO THEY FORECLOSED ON US AND WE LOST OUR HOME. MY WIFE WENT OFF THE DEEP END AND HAD TO BE HOSPITALIZED AND IS STILL ON ANTIDEPRESSANTS AND THAT WAS 4 YEARS AGO. i HATE OCWEN AND I HOPE SOME DAY THEY WILL GET THEIRS.

We were told by Ocwen that HAMP is approved only if it is in the best interest of the Ocwen and giving us the HAMP was not in Ocwen's best interest, so we were denied.

HAMP ISSUES WITH HELPFUL ADVICE AT THE BOTTOM: My husband has a mortgage he took out before we were married. He always paid early with an automatic bank draft and for more than what was due. He had never been on government assistance in his life and had perfect credit. After unexpectedly loosing his job in June of 2009, we found out that we qualified for HAMP. We started out with TB&W and sent in “verified” information to qualify for HAMP. 3 trial period payments were sent in to TB&W who shut down during the trial period process. At the advice of Freddie Mac, my husband put his credit on the line and was told that it would be cleaned up in a few months once the payments were capitalized on and the final was complete. Cenlar took over TB&W’s loans and held our file for 6 months. During this time, they cashed our trial period checks and claimed they never received the money. They would not return phone calls. They threatened foreclosure even when we were paid up on the trial period payments. Cenlar lost all of TB&W’s paperwork. Cenlar asked us to send our copies of the paperwork 5 times (documented). Freddie Mac told us they would escalate the matter and sent paperwork to Cenlar on our behalf.

Freddie Mac finally told us to ignore Cenlar and that Cenlar did not handle HAMP files. Why then would Freddie Mac ask us to send our HAMP paperwork to Freddie Mac to escalate the matter for us? Why would Cenlar ask us to overnight, mail and fax the HAMP paperwork to them 5 times if they did not handle HAMP? Why would CENLAR cash clearly marked HAMP checks? We also sent emails, letters, and made phone calls to all parties involved. We tracked down a skeletal crew for TB&W and got the tracking numbers of the information that TB&W had sent to them.

Freddie Mac told us not to pay Cenlar that they had found a servicer named OCWEN to take over our loan. We were told by Freddie Mac that OCWEN agreed to capitalize on the payments and bring us current in January of 2010. There was just the legality of sending over our file from CENLAR. It is May and no one has our file. I again sent copies of our paperwork to an onsite Freddie Mac rep at OCWEN who did not give our paperwork to the correct parties. This new Freddie Mac rep also lied to us stating the our file we sent was being looked at by underwriters in India. Then when we checked back with him the file was being reviewed by the Treasury. Then the file was up the chain at Freddie Mac. He lied and is now working for a bank in California. When we called Ocwen, Ocwen said that this was all up to Freddie Mac to decide. Freddie Mac claims it is all up to Ocwen to decide.

Here is the long and short of it. Any chance of my husband finding a job in the line of work he had performed in the last 26 – 27 years is over due to following the advice of Freddie Mac. In his line of work he had to have great credit. Freddie Mac reps knew this all along. We would have not chose this path had we not been guided this way. My husband has a 401K that does not come into consideration when applying for HAMP because it is his retirement. We could have bought some time and put the house on the market by using this money. We did not want to lose our home, which is what HAMP is made for. We used my small salary which would be enough to pay the modified payments on the home. Remember, I am not on the loan and they all knew this. According to HAMP guidelines, I can contribute part or all of my income.

First Ocwen states that we did not send in the proper documentation. This I proved not to be true. I also showed them that the person making the decision is confused as to who is on the loan and who is not since I, a female, continually am addressed as “he” in their interoffice memos.

They then tried to blame Taylor Bean and Whitaker saying TB&W signed people up illegally only using “stated” income and that was how we got signed up. I then had to prove that TB&W went overboard with me and made me send in “7” pay stubs as opposed to the “2” that is standard and my pay was “verified”. By the way, at the time we qualified, “stated” income was allowed and really should not matter until we do the final mod just to verify my income is still the same. I also told them TB&W used 2 negotiators instead of one to come up with our payments. I then asked where all of the original paperwork was at to clarify the issues since TB&W used Freddie Macs worksheets to come up with our payments and to qualify us. Our paperwork is still lost.

Now all of a sudden, Ocwen is saying that I can not contribute but 50% of my income and that is not enough money to pay the payments they claim. They did not alter the loan to the 2%, they did not stretch the loan out for 40 years, and they did not do the NPV to adjust the principal. These are all listed as steps they are supposed to do. We had to tell Ocwen and Freddie Mac what the guidelines stated because they have no clue or they are playing dumb very well.

From what I have gathered, all of these loan servicers are conveniently losing files. I wished there was a way to file a class action law suit for missing files. I know that there is a protocol that has to be taken for the storage and care of people’s financial information and I have been told there are 100’s of thousands of files missing! People are being disqualified after being qualified for HAMP for trumped up reasons like all of a sudden “not enough income” or “missing paperwork”. A lot of people are giving up and walking away. Others are taking stands. The Urban Justice Center in NY [protected] has filed suit against a large bank JP Morgan or Chase I think, for 3 people who were lied to. The National Consumer Law Center in Boston has filed a Class Action Lawsuit also.

If you are going through the same issue, here are some things you can do:

File a complaint with your State Attorney General (states are gathering complaints)

Contact your representatives and congressman

Contact your States Financial Regulations department and file a complaint (states are gathering complaints)

Keep documentation – I have recorded phone calls and emails from Freddie Mac with their guidance

There are a few lawsuits going on across the Country

Go to www.hmpadmin.com and do research to see what fits your criteria.

Read the directives at the HAMP website. Q1222-01 is a great one!

Call Freddie Mac’s corporate number and when it asks for a person’s name, ask for the CEO.
File a complaint.

Send a complaint letter to Freddie’s Mac’s CEO

Address complaints to the loan servicer on your loan’s President of the Company (in some instances these are the only ones that get through)

Ohio’s Attorney General is filing a class action lawsuit against some servicer regarding HAMP (maybe your state will follow soon if enough complaints are made)

Yes, I believe they are frauding the Government. Ocwen is horrible, sorry to hear they bought your loan. They have been giving us the run around on the presidents modification for almost 6 moths now. First we are approved, then not because of missing paperwork. Then they stop accepting our checks. We get mail every day saying we owe different amounts of money. My online access has been frozen and they refuse to reinstate it so that I can see exactly what we owe and why. Customer service calls are a joke. I receive atleast 3 hang up calls from them a day, I am assuming so they can say they tried to contact me, but I answer and they hang up. We have finally contacted an attorney to stop this before they try to forclose on our home. Good luck to anyone dealing with Ocwen, beware, they are crooks.

This sounds very familiar. Our original mortgage company was Saxon Mortgage, and after 4 years of on-time payments, no problems, etc., we were facing financial difficulties due to a layoff and other economic crisis based woes. We called Saxon Mtge, who had sent us a letter (I presume they sent the same letter to all their borrowers) stating if we anticipated future financial difficulties, etc. we should call to determine if we were eligible for modification or refinance under the "President's plan". We did call. After answering all their questions, faxing them a lot of documentation, and waiting several weeks, we called them to determine the status of our "application". We were told then that we did not qualify for the modification program, and our paperwork had been submitted for the refinance program. Less than a week later, we received a notice from Ocwen that they would be servicing our loan. That was in August, 2009. While we have not yet had any difficulties with Ocwen, after reading these complaints, we know to expect difficulties.

It appears to me that many mortgage companies are taking HAMP applications from borrowers, but instead of processing them, they are using the information garnered from those apps as cause to sell off "high risk" loans to the first servicer they can find. I am curious to know or determine if the mortgage companies are in fact receiving money from the government for all Hamp apps submitted to the feds. I can picture them telling the feds "oh yeah! We're gonna modify this loan under the program - send us the money for doing so!" then turning around and telling the borrower their loan was not eligible, or alternatively, selling the loan down the road after they received the payment from the feds.

I have spoken to others who received HAMP assistance from more reputable lenders, and the time it took for them to receive approval and permanent modification or refinancing was about 3 months. Is it just coincidence that 3 months and two weeks after we sent in our HAMP app, our loan was sold to Ocwen? I'm betting the mortgage companies ARE defrauding the government, and counting on the massive influx of paperwork being handled by the government, together with the sale of loans to other companies, and the government's inability to track the loans to make sure the mortgage company has modified or refinanced the loan as they promised the feds they would, and that, in the end, they will GET AWAY WITH DEFRAUDING CONSUMERS AND THE FEDERAL GOVERNMENT. They are banking on it - I am quite convinced.

:( My loan was originally w/taylor bean & whitaker; the feds locked them down 8/3/09 for criminal investigation; my loan was transferred on 8/14/09 to Cenlar who I made modiification application with which they rec'd on fri. 9/17/09 according to my return receipt card; i frequently contacted cenlar re: the status of my modification and repeatedly told "it was being reviewed"; I was notified in november that my loan was going to Ocwen because cenlar is 'only' a servicing company, cannot to changes to the original loan; it is now fri. 12/4/09, I was called this afternoon by an "arron" w/ocwen who informed me that I had to resubmit ALL of the docs I had previous submitted for my modification w/Cenlar; I informed her of a few things ! I contacted a superfivisor (in INDIA!) W/OCWEN who after having me on hold for over 25 mins concurred /arron that I had to resubmit all I had done before. I asked "if it was good enough for Cenlar, who had the modification crap for 60 days and decided I qualified for something of the modification WHY do I have to jump thru hoops again?" I ended up telling him I was NOT submitting a more dam piece of paper to them, they were nothing but crooks, they were going to send my loan off AGAIN just to keep from having to do the modification and that this is nothing but a damn scam by the banks and mortgage companies and I was not playing! I also told this yahoo that I was contacting both my U.S. senator Chornyne and Rep. Grainger and getting a congressional investigation into their company and to also listen to the talk radio shows because I would contacting ALL of them and blasting Ocwen! ALL of this sounds just like Taylor Bean & Whitaker and the way they treated all of their borrowers; even the hold music at Ocwen sounds like TBW's--wonder if they are "connected"? let me hear from someone nukedboomer@hotmail.com

Ocwen fraudulent loan servicing

We just received notice that the servicing of our mortgage loan was transferred from cenlar to ocwen. After looking online for information I am extremely concerned about dealing with these people on a loan modification. Are they any suggestions from other people in similar circumstances about our options or how we should proceed within this first 60 days?

Ocwen are thiefs. We are fighting to get money returned to us that Ocwen was not authorized to withdraw from our account. The total that they stole was $5000.00 + dollars and now our account is in the red bacause of bank overdraf fees that are still piling up.

Check your Account Payment History very carefully. If you have an escrow account, look for any tax or insurance disbursements that were made more than once during any year. Also, look for any instances where escrow account funds were placed in "suspense" account and later applied to principal, interest, or late fees. These are improper transactions that demonstrate fraud. If such is the case, file a complaint with the Florida Office of Financial Regulation as well as the Attorney General's Office.

Check your Account Payment History very carefully. If you have an escrow account, check to see whether any disbursements for insurance were made more than once during any year. Aslo, check whether escrow funds were place in "suspense" and later applied toward principal, interest, or late fees. These are improper transactions and demonstrate fraud.

Good luck! I've been battling for a modification for several months now. About a month ago, I was told by a rep that their system "generated a modification for me and that it would be reviewed by an underwriter." They proceeded to tell me that if the systems generated a modification once all of my info is put in, there is a 95% chance or better it will be approved. I never heard back from anyone. When I called again about 2 weeks later to get an update, I was told my modification was denied and that if I wanted to I can resubmit the entire application again.

This is a circus act. Unless you at risk of foreclosure, there is a slim chance of getting assistance. And even with that, they will push to offer you their "Deed-in-Lieu" or "short-sell" programs before they help you out. They way they see it, they would benefit more by having a short sell of your home and getting guaranteed funds (even though it's reduced) than bearing the risk of dealing with a homeowner who may not be able to pay in the months (years) ahead.

We have Ocwen and it has been horrible. After our first few payments of $985 they raised our escrow, and payments became $1, 015. Next, we received 2010 escrow information and the payment stayed the same. Now our 2011 escrow statement states we are in the negative and owe them over $4, 000 for back payments and a 'cushion'. That made our payments increase $375 a month. Just wonderful! Comparing 2010 and 2011 there was actually a small decrease in 2011 for the escrow. Now I ask how did this change matters if it is the SAME as last year? One of two thoughts came to mind...1) This is a con to raise payments beyond our means or 2) they incompetent. So Ocwen, which is it? Either way we have been taken to the cleaners in an already stressful part of our lives.

well good luck to eny one who has eny dealing with ocwen they are a co.under millions of dollars of lawsuites they have lied and made fraudglent claims you never get the same story twice or talk to any one that speaks good english . they will not call you back they have tried to raise my payments the first month they had the loan i could go on and on but in short this company is a nightmare IF at all possible have no dealings with them they are under investigation by the FL. Finance and Administration. AR.as well DO NOT EVEN THINK ABOUT BUYING STOCK IN THIS COMPANY. THEY HAVE LOST MILLIONS AND WILL LOSE A LOT MORE !

We were with TB&H, Cenlar bought TB&H. We got behind on our payments with Cenlar and asked for a modifaction. Next thing we know, OCWEN has our loan. They told us to send all the info. We sent all the info and was told to make sure the payments were on time. We sent the payment in with a 10 day grace period. We have been getting 1 or 2 letters a day saying they are going to forclose on the house. They have held my check without cashing it because they call and say we need to pay by phone but it is going to cost $40.00 more dollars. This company was sued several years ago for the same reasons. Look up OCWEN in wikipeadia and there is a copy of the lawsuit. We are about ready to walk away and move. They threated us every day with phone calls saying they are going to forclose. We are trying to play there game but they change the rules everyday.

This company sucks. They need to get people that can speak english. Also I have been waiting for the past 60 days for my first trial period and nothing yet. But yet I have left messages after message for the agent that is handling my modification and yet to recieve a phone call. Finally I called and found out my agent.JOESPH CORREA is on a leave of absent. WTF...And just the other day I recived paper saying I need to fax more stuff...

my loan also was given to Ocwen by Taylor Bean and Cenlar, OH MY GOD, i am trying to keep my home but Ocwen have made it a nightmare. It has taken me 5 months to get to the period of getting into a trial period with this company and i am still having trouble with them. They gave me a due date of Sept 1st for my 1st trial payment, then it was Sept 30. I made my payment on Sept 15 and now they are telling me it really was suppose to be in Sept 1st so my next payment is due Oct 1st without a grace period which is impossible because I dont have the money. They have made me think about just foreclosure. I love my home and am very proud of the fact i have one but to deal with a company who cares nothing about you or how they deal with you make me want to just give up the fight.God bless the people who are dealing with Ocwen for the first time, God have mercy on you.

Ocwen propery theft

After signing purchase agreement and loan documents. Ocwen contract out a company to mow my back yard and take away the debree such as cloths planted in the grass. My pool sweep I took to get fixed and left the hoses. Mind you they hired thiefs they came to the house to mow and broke every sprinkler in the back yard along with the debree went into my pool in which they had drained and refilled as requested after I signed loan docs know my pool is green and gross. They stole my pool sweep hoses (Cost appx 369.00) the bricks that where there and took 1/2 of the cabinets out of my garage. Along with the planters from my yard. Also if all else said. I had tools and new water hose, friends yard tools and ladder and misc new stuff. Also I purchased this house as is with these items there. I have got the run around with amit, poonam, tara, and spoke to selva I have been promised call backs and that this issue would be resolved. I sent emails pictures and still never got a call back

I feel that Ocwen pulled a fast one on me and now I no longer have my house. I was told to send 1, 000.00 in which I did in december of 2008 and fax papers back in which I did and was told that because the papers and the monies didn't arrive at the same time my house had been foreclosed on and sold so now I have no home and am still being jerked around by a realtor whom says she works for the mortgage company and her story changes everyda. Can someone contact me with some idea as to what might have happened. Whether I get my home back or not maybe someone else can be helped with my story. Ocwen worst company ever

March 2009 my husband and I applied for a home loan moidication under president obama plan. Weeks and months went by we hear anything and when we called we were put on hold for more than 30 minutes every time. I decided to hang up and I called again the customer service was very rude with very heavy accent and asked me why I had called and I told hime I would like to know if your received my packets and faxes and he didn't say anything and put me on hold again. About three months later we received letters after letters stated that they didn't received all paper and missing signuter. The letters we received was so confusing they sent letter date 7/20/09 and my documentation needed to be mail by or fax by 7/18/09, then couple day later we received other letter form ocwen again letter date 7/22/09 and my documentation needed to be mail by or fax by 7/18/09 on and on. Finally, we submitting documentation after documentation as requested.

On august 2009, we received a letter from ocwen that we qualify for loan modification, but they offer us three months trial for $1513 and after that they would work with us. The letter didn't explain much what my future payments would be and we refused to sign the contact. My husband called ocwen the next day to explaning the situation that we couldn't afford the payment and finance solution we are experiencing and my husband asked to see if they have any other options or help. Ocwen reply that they going to sent us a new packet for a loan modification.

10/05/09, we received certified mail from ocwen stating that we own $16k and we have to pay by the end of oct 31th, 2009 or my house would be foreclosure. I couldn't sleep all night because I was to depressed and kept thinking where am I going to ge $16k, if I can not afford $1513. The next morning I called a program hope for help and explaning my situation and hope was on the phone with ocwen and their going to sent me other packet for a loan modification.

Ocwen is the worst company claming to help homeowner and the worst customer service ever. If we all complain your voice will be heard ans we can make a difference to take this ocwen down and file a class action lawsuit.

I have lived at my home for 5 years and my mortgage has been sold off time and time again, But OCWEN is the worst I have ever seen in my life! Every time I call- there is no documentation in their system of the previous conversation, I only talk to Foreigners, and no one seems to be able to get it together there! I pay my own property taxes every year just like I have for the last 5 years. Well OCWEN wants to escrow my taxes into my payment- resulting in a $600 increase a month! It totals over $7000 a year! For what! My taxes are $2100. I have faxed all the necessary documents to them at least 15 different times and every time I send it- they claim no one ever receives it- even though my fax machine gives me confirmation that it was received! I call and call and all I ever get is generic scripted answers! You can't ever talk to a supervisor or an American for that matter. Not to mention I applied for the HAMP modification myself, and was denied because of a mathematical error and am on my 2nd attempt to apply again. I seriously believe OCWEN is out to steal peoples homes from them! They aren't even in this damn country so why would they care about us! My ADVICE IS TO STAY FAR FAR AWAY FROM OCWEN IF YOU CAN HELP IT.

They will have the ability to verify what the status of your account is with the courts. I got plenty of scary bogus letters and varified via same plus other resources that most of it was not: Find the best applicable lawyer near you for INITIAL FREE counsel regarding your rights. It took me a year of due diligence via phone, repeat applications, a journal docuimenting all of my efforts, and emails to get my HAMP agreement after I was refused once and sent an in-house bad deal whihc I refused. My orignal loan was sold 3x in 6 months! I talked to an ombudsman along with several different alleged Ocwen departments, 2 lawyers, and several realtors to aquire info regarding MY rights. I finally got my agreement, it is noted as rec'd (certified and on web) but all other info is skewed. So far...so good. DO NOT LET THEM SCARE YOU. Defend yourself in all ways imaginable! Ocwen they don't give a damn about their customers

My husband had a loan through People's Choice Home Loans, who subsequently sold it to Ocwen. About 2 years ago we were solicited by a 3rd party debt counseler, someone who called himself Professional Credit and Forefront Financial Services, located in West Hartford and Cromwell Connecticut. Long story short, he scammed us, promising to negotiate with our lender to secure a loan modification, to which he never did. In fact what he DID manage to accomplish was filing a pro se appearence and bankruptcy on my husband's behalf, FORGING the documents and his signature, and putting us into strict foreclosure.
Because the law day has passed we keep being told that there is nothing we can do, and apparently Ocwen doesn't care if you've been scammed or not. In contacting the Attorney General's office today (9-14-09) I was informed that there IS in fact a pending criminal investigation, and that really all we can hope for is to be placed on a list of other people that this guy has screwed. While it offers little consolation that he's done this to others, we're still out any money that we could have hoped to used to move or hire an attorney, forcing ME to represent us, starting with a motion to reopen the judgement of strict foreclosure. Evelyn Pierre at Ocwen is the woman I spoke with, and quite frankly she was very VERY rude to me, and the last time I spoke with her, convieniently enough she has no record of such conversation, when I asked for her supervisor, she HUNG UP ON ME. They sure as hell don't seem to care that while my husband is self-employed, he works here at home, as an auto mechanic, so if they take our home, they take away his source of income.
If anyone has any ideas on what avenue I can take now, please PLEASE let me know. I can't let my family become homeless. We have children here, and they can't end up out on the street.

Ocwen loan modification

I was told I didn't qualify for a loan modification because my income went down and my current payment is more the 31% of my current income. I have a interest only loan with an ajustable rate that I have found out was not done right or disclosed completely at the time of the loan 3 years ago. My payment has jumped $500 a month since I recieved the loan, and if my income had not gone down I wouldn't need the modification. My loan is the type of loan this modification is suppose to be helping. Something has got to be done about the mortgage company not helping like they are supposed to be.

I tried to work with Ocwen also to adjust my mortgage payment even though I was current. After sending in my info at least 4 times, I finally received a denial letter stating that I was current and that I had assets (my 401K and retirement funds); like anyone is going to cash in those before it's time and have it cut in half just to make a mortgage payment. This Home Affordable program was supposed to be for those people who were currently current with their payments, however could foresee problems keeping up in the near future. So, don't bother trying to get help with them unless you are late with payments. Even then, don't look for much help. I have chosen to walk away from my mortgage as I'm paying $3, 000 for a 2-family home in Brockton, MA which is filled with foreclosures in this city. I was willing to keep paying at a reduced (and more affordable, current rate scale), however they would prefer to take my home and let it fall apart while trying to sell it in this distressed market. I am going through "YouWalkAway.Com" to assist me with this process and guide me along the way. More & more people have chosen this route as I owe $350, 000 on my home and it is only worth $216, 000. It will never come back in my lifetime to be worth $350, 000, so my husband & I had to make a financial decision. Although I've been in this house for 52 years, grew up in it, and love every inch of it, (many wonderful, happy memories with my family), I purchased it from my now deceased parents; however, Ocwen doesn't seem to care about anything but the bottom line. I wish them luck trying to sell it! This government program may work for some, however it didn't work for me at all. I've had to make drastic decisions and only hope that I can get past it and live a more "debt-free" life. Best of luck to all of you going through the same thing, and if anyone has any info on the foreclosure timeline for Ocwen borrowers in MA I would greatly appreciate some info! God Bless!

Ocwen short sale

I had a short sale going on with ocwen. They denied the first offer, then the buyer raised the next offer. Ocwen denied it and never informed me or the agent that they denied the offer and claimed that they send be a letter notify me, which to this day I have not recieved. I did call for a month and a half strait and did not get any return calls. Finally I spoke to the lady handling my case just to hear that the house is up for forecloser the first of september. She was not nice at all. So i'm here waiting for a loan modification package to come. Been waiting the whole week!

I am also working with Ocwen on a short sale and it has been very difficult. I do suggest that you stay on them and call them every day. Unfortunately that is how they operate. They will tell you one day that they have received all necessary documentation and the next day they will say they are missing something. Meanwhile, the auction date gets closer and before you know it, you are backed in a corner with no options. Remember, you are dealing with employees that are in India and do not have a clue about what is going on here. They have been trained to say the same thing to everyone, but not really helping anyone. Good Luck!

Ocwen loan

Our loan is now being serviced with ocwen (Previous'ly with taylor bean/sparta). We modified our loan in may, made all of the payments on time, and ocwen says "we might honor your modification", "in the mean time your loan is in forclosure! What are we supposed to do? We had no idea taylor bean would do this to their customers... They have taken us from bad to worse! I can't get anyone from taylor bean / spara to respond, and ocwen won't answer our questions either!
Any suggestions?

When I got my loan with this bank was great, till i found out the bank atty lawyer never paid off the sells loans and i had to pay three mortgages to keep my house then lost my job Stop paying the other two loans and called ocwen when i had both other banks foreclosing on my home. the house went to foreclose by the other banks and ocwen sold to HSBC bank and then they for closed on me. th money from the first closing still at lawyers office. or did it go back to the president of Ocewn and HSBC banks. I lost my home and was on the streets with two children one with cancer and they dont care> i dont trust lawyers or banks all are fraud. who got 120, 000.00 from my loan i got for closed on. the seller had to pay his loans off too. Run from this bank and hsbc and bank of america too.

Ok. I am also trying to get a loan modification. Also told so many times that they dont have what they need even when I sent bank statments, taxes court orders. Then told me they did not get the right paper work so I dont qulify for the goverement loan. Only Ocwens loan modification? I am lost mad and sick of sending things over and over again.

I have a mortgage loan with Ocwen. It was transferred when Taylor, Bean & Whitaker was shut down by the government. They started sending me correspondence that I owed almost 4 times what my mortgage was. I could not believe I went from bad to worse. I started writing Better Business Bureau. The complaint went back and forth between Ocwen and BBB. Mysteriously the money that Ocwen claimed I owed starting disappearing! I went thru the BBB in Florida where Ocwen is located. Maybe they don't want to loose their credibility with BBB, but it did help me.

Ocwen terrible company

9/11/2001 my children and I left our home across the street from the World Trade Center and never returned. During the next 4 years, we moved 5 times, due in part to the aftermath of 9/11 and to difficulties involved in a difficult divorce. In 2006 I found a house to purchase. My children and I would finally have a permanent home and we were so hopeful for our comfort and safety. I purchased this home with a loan that I did not like but signed on the advice of trusted bankers, lawyers, and realtors. I was assured that I would be able to refinance the loan immediately and that it would not be a problem. I have been trying since then to do just that. A year ago, I had renewed hope when the state of Connecticut instituted the Connecticut Families Program to help families renegotiate their loans. I was denied participation in this program on the basis of my federal tax filing due to issues involved with my status as a self employed person. In October 2008 I filed an application to renegotiate my loan through Acorn Housing. In February I was told that my lender, Ocwen Loan Servicing, LLC, refused my application stating that I made too much money to qualify for renegotiation. Within 2 weeks I applied again this time through Neighborhood Housing in Waterbury, CT. This time I was told that I made too little money. Next the broker for my mortgage got me in touch with someone at Ocwen. I was sent a package of application materials for loan modification for the President’s plan. I immediately filled in the required documents and submitted them by fax and express mail May 15, 2009. I was told at the time, by Valerie at Ocwen, that I would have a response within 20 days. After the 20 days I began calling Valerie. I only was able to reach the voice mail for Mr. Robert Probil at Ocwen. I left messages nearly daily until. After approximately 1 month I was able to reach Mr. Probil on the telephone. He told me that I needed to send in additional verification to qualify for the Obama plan even though these documents were not on the list originally sent me. I submitted these. Mr. Probil told me I could call him back any time and he would be happy to answer any questions. After submitting these documents I again began calling Mr. Probil to follow up on my application. After another 2 weeks of calling every day, I finally got Mr. Probil on the phone. He did spend an hour on the phone with me asking me questions about my application which made it clear that no one had even looked at my application in these past 2 months. At one point he told me that clearly made too much money to qualify, then he told me I did not make enough. At other times, he told me that he was going to help me, that my loan is a terrible one, that I should not have been given this loan. He also promised that I would be able to get him on the phone, that he had been traveling but that now he would be in his office. He also told me that he was going to make some inquiries and would get back to me by the end of the day. That was July 9, 2009. I have yet to hear back from Mr. Probil and I have not been able to get him on the phone. I have received a new form from Ocwen asking for more information, all of which is a repeat of the information that Mr. Probil received in our phone conversation one week ago. Mr. Probil is the only human being, other than the bevy of “service representatives” in India, who have no authority to help in loan modification. Ocwen does issue a dedicated phone number for consumers wishing to modify their loans which is answered robotically and essentially states that there is no reason to speak with anyone at Ocwen and that consumers requesting modification will just have to wait. There is no opportunity through that call of being transferred to a human.
It is quite clear that Ocwen has no intention of modifying my loan. Their intent is to continue to play cat and mouse with me, teasing me into believing that I can escape their claws and while Ocwen continues to sink their claws in until I am dead.

I am seeking a modification of my current mortgage. I want a 30 year fixed rate with the current market rate of approximately 5%, in keeping with the current Obama guidelines. I would also like my mortgage company to forgive the 2nd mortgage they hold.

OCWEN added redundant and fraudulent foreclosure fees, changed my payoff several times to add more fees that are not even on their fee schedule and more than 45 days after payoff in full AND release of deed they are holding $1, 300 in overpaid interest "for 60 days for more fees"! This company has been a nightmare to deal with, and is the leader in sub-prime ripoffs. I ended up more than $7, 000 upside down on a property JUST DUE TO OCWEN's bogus fees. Do consumers have no rights anymore? I did the right thing and sold my home as low as I could to get out of foreclosure, and they get to add on unlimited fees? It's just not right...

I would like to see OCWEN go bankrupt. The goverment can protect them forever with all of the other financial problems in the country. For thoses of you that had parents who lived through the great depression. it was a time where the banks could not keep up with the withdrawl on the saving accounts of their clients. Within 90 days they, Ocwen could be belly up, like aminal we've all seen along the roadside.
My complaint; I had the fortune on getting my loan modified through Ocwen. However the last three months they have called, daily, leaving me a message that there has been a change to my loan status. when I call the 800 number to inquire about the change the Ocwen representive tells me that their is NO CHANGE. They state the reason for the call is to find out when I am going to send in my payment. I have to repeatedly remind them that I have never been late with my payment and if they call again I will call them everyday until the day that I die letting them know that one of their loved one may have been in an auto accident. Both situations are about equilivent to the flustration that i've experienced with their messages left on my answering machine. Where in the heck do they think scare tactics work. There dealing with a 61 year old man who has nothing else to lose than his house. oh well there loss could be greater if they continue to torment the people who's notes their sitting on.

I'm going through the same exact thing! I’m shocked a companies like Ocwen can still exists in this day and age. Their unscrupulous business practices know no bounds. From outright lying to making up fees. Worse still the US movement aka Freddie Mac chooses to do business with them! We had a modification with them and were told there would be no additional fees and subsequently charged 12k multiple in erroneous fees. They will not win my attorney is a bulldog and a close friend. My Dad.

Sorry to hear of your troubles. I aggregate class actions lawsuits into one database. I did a search on mortgage foreclosure class actions and found 7. Sounds similar to your situation. GOod luck.

Ocwen awful company

I am reporting ocwen for not having good business practices and having me sign a document fraudulently. We have owned our house for just under three years and have had nothing but problems with ocwen. We have escrow included in our mortgage payment every month. We were actually paying extra when we first got the loan to try and make our principle go down quicker. Unfortunately ocwen did not apply the additional to the principle but instead applied it wherever they wanted. Our home owner's insurance went up after a big storm so they raised our escrow... We paid more each month to cover this. However we get a letter saying that our escrow is short. We end up paying extra to make sure that it is brought current and everything seems fine.In january of this year we get a letter stating that we are being offered a modification to our loan to cover a shortage in our escrow of $900.00. We are concerned and call them and ask how this is possible. We were advised that it was possible because our taxes went up... Ok so our options are... Sign the modification or send them and extra $900.00

The problem that I have is that I work for a mortgage company and have dealt with modifications before. The agreement they sent us was date 1/13/09 and was received on 1/23/09. We had until 1/28/09 to return the signed document agreeing to the modification of lowering our interest rate a little and lowering the payment a little to make up the difference in the escrow over the next three years. My concern was that the modification was to go into affect on 1/1/09 but I received the document on 1/23/09 and had already made my january payment more than what was stated in the modification agreement. I called and advised them that their agreement was not correct in that I could not sign something agreeing to something in the past as that would mean I had already breached the agreement by making a different payment amount than I should have. I advised that the agreement should be effective 2/1/09 and not 1/1/09. They advised that they had sent out a bunch of these letters and that I was the first person to voice concern. They advised that they would correct it and send me a new document... Remember it is in ocwen's best interest to do this because they can earn a higher interest for the month of january by correcting the document.

The other issue with the document was that it said my payment amount would only be $xx. Xx (The principle and interest portion only with no escrow included. ) it did not reference what my total payment each month should be including principle, interest, and escrow. Therefore I could send in my payment and still be behind if I was not aware of this since it was not spelled out in the letter. Luckily from my work experience I knew this amount could not be correct and continued to send the amount I had been paying for the past three years.

I never received the document of course. I called back on january 28th and advised them that I was concerned that it had to be returned that day and that I hadn't go the corrected on after being promised it for 5 days. They advised they could not correct it because once a modification is offered it can not be offered again or modified in any way, which I know is false because the company I work for does this all the time for people to actually work with them.

They advised that my only option was to either sign the document or send them the $900.00 and continue to pay the higher interest rate. I decided to sign the document, even though I legally should not have. I had the document notarized showing the date that it was signed and also sent a letter to them again voicing my concerns of the document that they were forcing me to sign fraudulently since I had no other option and no time for an attorney to get involved.

Of course I have heard nothing in regards to my concerns voiced in the letter. We are hoping to be able to refinance with a different company soon to be able to not have to deal with ocwen ever again.

Did you know that you can have a Forensic Loan Audit done on your mortgage? This will really get your lender angry. 83% of loans originated over the last 5 years are in violations of RESPA, HOEPA, TILA...I used ALMG they negotiated the fee with me to $500.00 provided me with the results from the audit and even approached my lender with the results and now I am paying $900.00 a month on a $347k loan over 30 years. The audit revealed all types of violations and they did not want to be taken to court. I could have gotten all the money i ever paid them including my downpayment all the interest and principal i paid over the last 4 years returned in the courts. Ocwen terrible company

Ocwen wanted our house so bad in 1999. that their lawyer pushed the case for foreclosure. It went on sheriff sale twice, but Ocwen removed it. In 2000 they took the house back and left it in disaray for ten years. They didnt take over the ownership nor do they admit that they own the house. For the past 10 years they have not made one payment in taxes. There has been squatters living in the house for the past 4 years now. They destoyed the house and that is only the outside! Ocwen's lawyer cant find the records, but they keep looking into our credit report every 6 months. Now Ocwen is incontrol of Freddie-Mac? What is our govt thinking? I bet not one person on this board have my problems with Ocwen. They stuck us with a house that is sinking and damaged!

We have had owcen for about 5 yrs. So far so good.
They set us a 2 page loan rereta enpion, I think thats what the lady with the strange accent told us to fax.
Without refinacing they are dropping our rate to 8.9 to 5.1 without refincing. I am thinking is this to good to be true. OUR PAYMENT IS 1400.OO NOW AND THIS WILL TAKE OUR PAYMENT TO 856.10 THAT INCLUDED TAXED AND INSURECEN .
THIS IS NOT REFINCING Is this to good to be true. I HAVE ALWAYS REACHED OWCEN WITH NO PROBLEMS.Plus talkin to a real person. Is this to good to be true, or a blessing from God
