I was looking for Weight Loss sites and clicked onto this company. Boy, was that a BIG mistake! Received the trial sample I ordered for $ 4.99 on 2-6-09 and to my surprise my credit card was charged $79.96 on 2-26-09. Red flags should have been raised when my bank left a message on the day I ordered to see if I o.k.'d this purchase for $4.99. Since everything is automated I just approved the charge and forgot about it. HUGE mistake. I should have checked further into it. My bad. I was lucky to find a 1-800 number under "complaints" when you Google their web site. Called the number - waited forever for a representative - finally talked to "Marvin" who informed me that yes, I did sign up for my account to be charged $79.96. I asked where did it say that and he told me that it was in my e-mail confirmation and I informed him that I have my e-mail conformation and it said no such thing and the packing list I received with my order also said nothing about canceling anything. An even bigger surprise was that "Marvin" told me that I also signed up for "Fit Factory" AND "Cost Smashers" when I "agreed" (NOT!) to sign up with them. I asked him to cancel my "membership" and he also canceled my "membership" to the other 2 companies. I also informed "Marvin" that I would be filing a complaint and contacting my credit card company at once. He said he was going to go ahead and "credit" my credit card with the $79.96 that I was charged. I got conformation #'s for that, my "membership" to Natures Acai, Fit Factory and Cost Smashers. After reading other complaints I feel pretty lucky that I was offered a refund. As of yet my credit card has not been credited but I will keep a close eye out for that and any other unauthorized charges to my account. Like they say "There should be a law!" This is downright FRAUD! Do not get sucked into their scam. I will never EVER order anything like this again!

Nature's Acai

Credit Card Scam

Nature's Acai

After responding to an internet ad for a free month supply of Nature's Acai, for which I was charged $4.99 for shipping, I received 2 more charges of $79.96 and $85.91, for product that I did not order or receive. Both of these were charged to my credit card within one month of my original purchase. I have filed a complaint with their Customer Service department, but have had no response.

OVER $200 DOLLARS IN UNAUTHORIZED CHARGES for programs I didn't even have any knowledge about. Like almost everyone else posting here, except for the sanctimonious few that feel that we all got what we deserve because we didn't "read the fine print", and the lone rep for the company trying to put a positive spin on the unethical, fraudulent company they work for (get a new job!), NATURE'S ACAI along with multiple other internet companies are deceiptful, fraudulent and a SCAM. DO NOT BUY FROM THEM! And if you did, and scammed like myself and countless others, even though you did read the fine print! Don't let them get you! Also, any reputable company would not make it a herculean effort to get ahold of them. This company does not supply the consumer with any information when they ship the product. There is NO phone number or contact information whatsoever and when you finally find a number the customer service is HORRID! You can't understand the rep you are talking to and you are put on hold forever! I held for 40 minutes but I wasn't going to let them get away with these unauthorized charges. Don't let them take your money. I know it is a pain and a huge inconveinence but be persistent, threaten legal action, demand to speak to a surpervisor and DEMAND your money back. If you don't get your money back the first time, call back and speak to someone else. Keep calling back until you get a refund. BE RELENTLESS AND YOU WILL GET A REFUND! Then get ahold of your bank ASAP and request to file chargebacks! VERY IMPORTANT.

CONSUMER BEWARE! This is a TOTAL SCAM or at best unethical and deceptive marketing practices and should be under review by whatever regulatory agencies are suposed to regulate this kind of thing! Companies like Nature's Acai get around disclosure by saying that all the information was or is on their website at the time you order their trial sample. While it is there you have to hunt and peck all over for it as it is not easily available because most consumers in their right mind would not even try the stuff if they knew they only had 21 days to try the product and if they knew that subsequent bottles of the stuff would be $80.00! You can get Acai products for considerably LESS locally just about ANYWHERE! Also, any reputable company will send paperwork with the trail offer outlining the terms and conditions of the trial and contact information. You get NOTHING from Nature's Acai. Absolutely nothing and so you have to search and search for a number or anything to get in contact with this company if you want to call and cancel. I might add, Nature's Acai is not the only company that uses these deceptive marketing practices so beware any company offering trials of anything. Your best bet, consult your local health food store and buy from them!

I totally agree. I am in the middle of filing a chargeback claim. I ordered a months free trial. A couple of days after the month's supply arrived I got charged $79.96. Made numerous calls, was told to call back, I was transferred around and then they hung up. 17 days later I am charged another $85.91. So, before my "free" months trial is even over I've been charged $165.87. Total rip-off!

JPintoYou, I agree with you however, from some people what happened to some and yes, they read the fine print...the product were not delievered until AFTER the trial date or near close to the date and were told nothing could be done about their charges. Either way, for some victims they could not do anything and yet were being charged. Personally, I was charged not for Shipping and Handeling they charged me the full price and this was before I received any product, not right.

Laws broken, well from the state I am from AND the connecting border states in the south...yes, they did break a law or two.

THOSE OF YOU SCAMMED KEEP ALL YOUR DOCUMENTS AND CONTACT YOUR BANK, BBB, FEDERAL TRADE COMMISSION AND ESPECIALLY YOUR ATTORNEY GENERAL'S OFFICE! YOU NEED TO FILE A LEGAL COMPLAINT AGAINST THE COMPANY OR COMPANIES INVOLVED AND START UP THE CLASS ACTION SUIT AGAIN! YES, AGAIN. So if no laws were broken or not scamming.. why are they hiding and using other names of companies to avoid legal actions?

Even if you read the terms, it is still risky. For instance, I DID read the terms and it said you have 2 weeks to cancel further shipments (and thus further charges). However, I received my first bottle in the mail on the 12th day! I immediately called and cancelled, being aware of the terms, because how is one or two days enough time to know if you like the product enough to continue ordering it? That is exactly what I told the company. They did cancel my account. But, what if I had been living further away than I do and the bottle hadn't arrived within the 14 day period? That's very sketchy.
I think that if they wanted to be as above board as possible, they would give you the "free trial" for the 2 weeks it can take to receive the first bottle, PLUS the month it takes you to try the initial supply to see if it "works" or if you like it. So, give it 45 days.
I won't order something like this again because I want to deal with companies that are WAY above board where my health AND my money are concerned.

I was stupid enough to order my trial acai berry from your company and then because of cardiac issues I called to cancel just 5 days after receiving them, well within the 14 day trial. Then I get my charge card bill and there was a nearly $80 charge the next day! So I call and get another foreigner who was very insistant that I called AFTER that 14 day trail...and the $78.81 charge was appropriate! I am fuming, because of this horrible scam! I never got another bottle of acai berry for that near $80 charge and he told me that 14 day trial bottle was that charge! This is a horrible way to conduct business, and I am about to get the law in the middle of this situation.
I will tell everyone who will listen about this experience which I see is typical after reading many testimonial from those who also have had this experience!

This is BAD NEWS! Mrs. Brenda Gilbert in Kansas

Natures best Acai

No product shipped after charges

After ordering a "free" trial of Natures Best Acai Berry in January, it took me 3 calls ...none of which was professionally answered...to finally cancel all the hidden parts of this order and stop future charges to my card. After insisting to speak with a company supervisor, I was told that he couldn't refund the 79.86 charge because the product had already been shipped. That was over six weeks ago. This company hid behind "small print" to charge me for a product and then failed to ship anything at all! On subsequent calls to the company I was informed that no supervisor were available. I will be looking to press some kind of legal action...certainly with the Better Business Bureau, small claims division, etc. Hidden charges are poor business practice at best but taking money without providing service is a criminal offense.

Misleading - Bait & Switch

Nature's Acai Berry

Phone: [protected]

This company is a scam. They are pulling the old "bait and switch" scheme and signing people up for recurring charges. They are unapologetic and difficult when dealing with their customers. This company gives all legit online businesses a bad name. My credit card company was more than familiar with them when I called about these charges.

I want my $79.96 refunded!

Related Companies

Nature's Acai Berry

Nature's Acai Berry, Ultra Slim XS, Pomclear, and AcaiPure all share the same practices. Charge ridiculuous amounts of money for a product that can be purchased at Walgreen's for $11.95. I have cancelled the debit card I used for these companies. I am starting with dispute charges at my bank and if the monies are not returned, I will file a police report for fraud. The fine print is suppose to be a disclaimer for the product itself, not a statement that more money will be charged if you don't cancel the trial. And for those who have cancelled and still been charged, you really need to contact your local police and file a fraud statement. We all are out at least $100, not including the shipping and handling fees. This is the reason that some people refuse to purchase on the internet. Let's stop this. There has to be a way to put a pop up on their site to not purchase from them. If what they do it legal, the way to prevent them must be too.

I orderd a free sample for 4.99 shipping. 15 days later they charged my account 79.96 . I had to get to my bank and stop this charge as well as cancel my card and order a new one to prevent further charges from this company. They are selling a caffeine pill with very little acai berry in it. It made me so nervous and jittery that I only used one of them. The company I beleive has changed their name and price within a few cents to make us think these are different companies. I think they are tied together. Should you try to contact them GOOD LUCK. Don't they have an obligation to disclose future charges? I am not the kind that goes for a subscription to any monthly fee or service charges against any of my accounts. I have spent to much time trying to get this charge reversed. I HAVE BEEN HAD AND DON'T LIKE IT!

I ordes free 30 day trial and paid shiping of $1.99 but a week later I was charge $79.96. I send them a E-mail and this is what they said.
The add an the web said 30 days not 15. I try calling but they keep me on hold for one hour and a half.

We are sorry if you felt unaware of any membership fees; we do our best to ensure any fees are disclosed and made well-known before you are billed.

When you ordered Nature's Acai you entered in to a free trial period for 15 days. Several times in the process, you were told that, if you did not call us to cancel future shipments within the Trial Period, your membership would continue and you would be billed $79.96 for future shipment as long as you desire to receive it (until you call to cancel.)

nature acai berry - Billed before the trial period

by: nick

The information that they are referring to is listed "only" in their legitimate website. If you ordered by clicking on a link in an advertisement titled something like "As Seen on Oprah or Rachel Rae" that information was not present! It doesn't matter if you did attempt to cancel within the first 15 days - they will only allow you to cancel by phone and therefore you have no proof. When I finally spoke to a customer service rep and requested a confirmation of my cancellation, they completely diverted the question. It is very important that you file this with the Internet Crime Prevention.

From: Beware
It is important that you file charges. It's sad that they can get away with this Crime but that's why they do what they do because they no they can. That's including people in other Countries, but the Market online as far as scamming people is so rediculously so cruel and so open they are laughing about it and continue making easy money off of Consumers because they have been doing it for so long.
All you need is a Computer, then run off somewhere else so don't get caught stealing from innocent Consumers.

Count me in as another who got duped. The website gives you the impression that there is nothing else to do, other than pay a $4.99 shipping fee for a free bottle. There is no asterisk * or small print near the offer that draws your attention to the links that give the "Terms and Conditions" that will apply once you place an order. I called to cancel and return my unopened package. I first spoke to a woman who hardly spoke english, so I asked to speak with a supervisor. Once I did, she did cancel my "membership" but said I was S.O.L. when it came toreturning the unopened package. I said that it was received within 14 days. Her reply was the clock starts ticking when the order is placed. I insisted I wanted my $$$ refunded, but she refused. Her assertion that the website CLEARLY states the terms is a bunch of Bull$#!t. I'm writing any organization I can think of to try and get my $$$ refunded. I did receive 3 e-mails stating that my "membership" to their scams were cancelled. I notified my bank that any other withdrawal attempts from these clowns should be denied. I filed a dispute with my credit card company. This agency is out of the US because we are being taxed a foreign tax on both products as well. Before my trial was up, this company charged my credit card $87.13. I had received the product 7 days with 7 days remaining. The colonix, I received 17 days later. I had called and cancelled way before the trial period ending.

They lied and said they did no such thing as charge for the product prior to ending the 14 day trial. I never received an email confirmation on either orders. I printed out the first trial purchase online, which showed a $2.00 shipping fee. I never ever received a confirmation email and online confirmation. Their server said order failed, retry. I'm no fool just in case my credit card is charged twice. I did see a charge immediately for both products. They kept telling me they charged $3.95 on both products. Nowhere does it show up at 3.95. Thank goodness my credit card company reversed the charge.

Welcome to the club of have been dupped...

In a scheme called "negative option" advertising, dozens of companies nationwide offer "free" trials of acai diet products, claiming endorsements from Oprah Winfrey, Rachael Ray and others, but then charge month after month unless the consumer cancels the order, according to the bureau.
"BBB [the Better Business Bureau] can't speak to the restorative or weight loss properties of acai-based products, but we are taking companies to task for their misleading sales and marketing practices, " bureau spokesman Steve Cox said in a statement.
"Many businesses across the country are using the same selling model for their acai products: They lure customers in with celebrity endorsements and free trial offers, and then lock them in by making it extremely difficult to cancel the automatic delivery of more acai products every month, " he said in the release.
The endorsements are also misleading, according to the bureau, and some celebrity lawyers have already gone after these online companies.
"Consumers should be aware that Oprah Winfrey is not associated with nor does she endorse any acai berry product or online solicitation of such products. Attorneys for Harpo are pursuing any companies that claim such an affiliation, " said Don Halcombe, spokesman for Harpo Productions, Winfrey's production company.
Consumers can check www.bbb.org to get a "reliability report" on particular companies before purchasing an online product.
"These companies are simply abusing general acai berry endorsements from well-known, trusted celebrities by using it as a tacit endorsement of their company and products specifically, " added the bureau's Cox.
"Consumers trust Oprah and unfortunately, if they are tricked into believing that she is putting her stamp of approval on a product then they are definitely more likely to purchase it, " he said.
In my opinion, the BBB can only give these bogus Companies a bad name, you have to file charges to get these crooks off the internet!

Fit Factory

Unauthorized charge

I recently noticed a charge on my account for 29.95. I checked into it and it gave me a web address to go to. I typed in the web address and it gave me Fit Factory. I didn't recognize this company. So I asked them why they charged my account? I never got a response and hey aren't answering their 800 number either. Somehow they are linked to this acai berry. Anyways there are a lot of clomplaints of fraud against this company. Why isn't anybody doing anything about this?

WWW.NATURES ACAI.com

non authorized debit charges
I also thought I was receiving just a $5 trial and I have been charged 3 different charges that I did not authorize first charge was $29.95 for a magazine, 2nd charge was for 69.95, and 3rd charge was for Acia 79.96. I did get the other 2 charges refunded but Acai refused stating that I had 14 days to cancel. I tried to talk to a supervisor who was very rude and repeatedly told me how I had 14 days to cancel. I feel that I was scammed and this company should not be allowed to continue to rip people OFF!

The "sample" sent for @$4.95 for P&H required a credit card, although the
"product" was a free trail. That was a ruse to get a hold of your credit card
and continue to send the "unholy" product. Two Dr's have advised me NOT
to take product, it is another form of "speed" advertised as good for you!
This is a major scam. No phone # included to ask questions or voice concerns
or heaven forbid attempt to return product. RETURN address means little--
A.S.N. LLC 20100 Vermant Ave. Torrence, CA 90502. I have sent numerous
requests by mail (no response) to stop using an anauthorized credit card, to no
avail-no response. Sending notices to Atty Gen. of Ohio, have notified TV
stations in NE Ohio to alert viewers. They hope to be on the air with this in
several weeks after their so far futile attempts to reach them.3
