Acai Berry Credit card charged with out my permission

I paid 3.95 for a trial bottle of acai berry and was billed 2 additional charges of 87.13 without my consent. I received a trial bottle and an additional bottle that I have since mailed back to the company at the address on the packaged label. I researched the address and found that there is no such address as 3007 Greene Street, Hollywod, FL. Therefore, I will probably be getting the product back and have to return it to another address. I have called this company everyday since 02/08/09. I ask to speak with a supervisor and each time I am placed on hold for long periods of time without a supervisor ever coming to the phone. I was told by representative Terri that I will get an e-mail from the refund department concerning my refund. I have not received an e-mail and have not received a return call from a supervisor. I have filed a dispute with my credit card company who will try to get the company to refund the money to my card.

This product is an absolute rip off. It is worthless. I called within the time and still could not get a refund from the Acai Berry, FWM Laboratories. They advertise a 30 day free trial everywhere, but come to find out it is only a 12 day free trial. This is the 12th day and they charged my debit card $87.13 today. I talked to a supervisor "Jeff" ID #3244169, obviously an Indian telemarketer. He basically said kiss my you-know-what. He said everybody is cancelling. The Bromalite people were very nice and reimbursed my debit card today in the amount of $69.95. WORTHLESS, WORTHLESS PRODUCT.

The same thing happened to me, same company, same exact story. They only charged my account once, but they told me it was refunded on 01/29/09, but of course no such credit has been made to my account. Everytime I call they tell me the same story about having to email the refund department and I always ask for a supervisor. They always put me on hold and the last time I was on hold for 50 minutes and finally gave up. I have spoken to a "supervisor" once or twice, but they always tell me the same thing about emailing the refund department. I haven't cancelled my account--it's a checking account, I used my debit card--do you think I should?

I recommend closing your account at your bank or this freakish company will continue charging you. It's a bad experience and I've been there. Good luck. I had to close my account.

Acai Berry UnAuthorized Charges

I've had my bank account tapped for nearly $100.00 at least once (that I know of) which caused my account to overdraw and then charged me several insufficient funds charges from my bank (Wells Fargo) - when I called the bank they took down my information and canceled my bank card.

I investigated myself calling the number (866.225.2886) that was listed on the charge in my account. A woman answered identifying herself only as a customer service representative (give them a call, it's a freaking joke) and wanting me to provide personal information (banking info, etc.) so that she could "look up my account" - here is the kicker, she refused REFUSED to identify the company IN ANY WAY saying that they were obligated to respect the company's privacy and NOT divulge that information.

Not divulge the NAME of the company. Seriously?!?!?

So, I refused to give my information and requested a supervisor, mysteriously (and conveniently, I might add) all the supervisors were called to an emergency meeting.

Then she hung up on me.

I called Wells Fargo back and spoke with a Lisa in the Fraud Investigation Department. Lisa was rude, unprofessional and basically told me there was nothing they could do because whether I liked it or not, I had an account with the mystery company and the charges were MY problem because I had agreed to auto ship delivery.

How she knew that when neither of us knew who the company actually was, is beyond me. Until I spoke with her supervisor, Dominic who informed me that they have NUMEROUS (as in DOZENS, he said) of calls based on this AcaiBerry scam.

I explained to him that I have been making purchases on line for YEARS and have never had this problem. I invited him to look through my account and note that not only had I never (Before this) purchased a sample of anything, but that I had also never had this issue before. I believe might have gained a bit of credibility from him when I told him I do have items on auto ship from a company out of Boston, MA - so I am fully aware of how auto ship works and what a typical auto ship agreement looks like. I'm well-versed in reading the terms and conditions on websites BUT! (big but) I purchased this from a pop-up window that had no links on it, I received no receipt, there was no Terms and Conditions box just some small, fine print at the bottom of the window that did NOT indicate membership, phone number, or any information regarding an auto ship agreement. Maybe other sites have this - but I KNOW this one DID NOT.

With that he agreed to reverse my charges and submit my claim to Visa, however, he indicated that if the merchant company responded to the complaint from Visa within a 45 day window that I would be stuck with the charges at that point.

I can't believe for a second that this company is not doing something illegal somewhere. I received NO RECEIPT and NO INVOICE / RECEIPT with my sample.

Not to mention they acted in a shady manner on the phone.

Acai Berry Fraudulent Company

Ordered the "free trial" had a reaction, contacted them to return was told to return pills, did so and they refused the package! Called and called and called both day and night, constant recording that they were busy call again another time. Went through my bank and canceled my debit card quickly and now they will not be able to hit me with the $78.oo as the number they have is not active. Was just curious about the one month idea of cleaning the system and knew there was no quick fix for weight loss but a sham is a sham is a sham! Total sham! Hope more people find this page before they order anything at all from them! I only ordered it because it showed a local girl in my little town as having done it and been successful. They probably have a software program that can read where your ISP is from and it pops up with a "supposed" local person happy with their results. BUYER S BEWARE!

Am having the same sort of problem, with a complication. Somehow, though i never placed an order with this outfit, the outfit has accessed my credit card and has billed me $213. 16 for their product, the delivery of which i refused when the package arrived. Interestingly, they had marked on the label of the package that it could not be returned to them, but post office officials told me that the company could not order usps not to comply with someone's request that an unopened package be returned to the sender. I am, of course, disputing the credit card charge. If anybody has any further info on this outfit, which appears to have a high sleaze quotient, please post it. They need to be shut down soonest.

Dito - working on disputing this myself. This is a complete joke. Wish I would have been notified of the auto-debit continuation thing before I received my product. They charged me the day after I received the bottles. I called but got no-one. It even kicked me to voicemail a couple times after holding for 45 minutes! Emailing their support gets you an auto response and that's it.

I got through 2 days later after 2 hours of holding and they cancelled it but now I can't get my money refunded even after sending them back their product. I am apparently beyond their 30 day trial even though I only had 1 day to send it back!

I am in the saem boat. I called their support line many times only to wait 30 minutes with no answer. I sent numerous emails attempted to get an RMA number to return the unused pills. Now, I am disputing the charge with my credit card company.

I canceled my bank card before they were able to withdraw the money from my account. I was on hold for over a half an hour to get a return authorization number and I also canceled my membership and they gave me a cancel confirmation number. Hopefully this will work. I think if they have access to your information they're going to keep trying to send products and get more money, but if the information is changed maybe they won't try, I hope.

Acai Berry Withholding Refund

Ok here is my story, in December I ordered the free trial of the Acaiberry product and only paid the $5.95 shipping and handling, that was all I was asked to pay (because well, it's a free trial product, duh). I got my bank statement for January and they had charged $87.13 to my account without my knowledge because supposedly I signed up for a membership when I ordered the free trial product, that makes no sense to me, the purpose of the free trial product was to test out the product and see if I liked it, that makes sense, right?

So anyway, I called the Acaiberry company/FWM laboratories [protected]) to tell them I did not not want to receive the product any more, so they canceled my membership which I was unaware of having, and did not agree to sign up for and told me they would refund me for the that charge of $87.13, I also sent back the free bottle I received and never received any product from them again. It is now the middle of February and I still haven't received my money back for that product they charged me for that I did not receive.

When they charged me the $87.13 it caused my bank account to go negative because I was unaware that they would be charging me monthly and I was not prepared for it and if I had known they were going to do that I would have never even tried the free trial.

I also ordered the free trial of the herbal pills that came with it from another company all I paid was the $3.95 shipping and handling that was asked, they granted me my refund of $99.86 that was charged to my bank account the same way Acaiberry charged me, but how come the Acaiberry company won't refund my money? I have called the FMW laboratories several times and they said the refund was given back to me on the 29th of January and that it is my bank that is holding on to the refund, it is now February 11th and my bank has NEVER taken this long to process a refund. I also asked the FWM laboratories the last time I called about this (which was less than an hour ago) if they could send me a hard copy letter stating that they have processed my refund on their part but this is what I was told by the FMW/Acaiberry representative named Alex "It is not in my interest to so, I can not do that for you, but I assure your refunded has been processed on our part."

So, from what I am hearing, I'm getting a told a big fat lie by this company and I'm really pissed. If they issued the refund then they should have no problem sending me a letter stating they did so, and proving to me that they did give me my refund.

If anyone else is having this problem or any trouble related this this company

please email me at: [protected]@yahoo.com

I am pretty positive that I am not the only person who is going through this with this company.

I would really like to talk and I need to find out how to go about this situation, because I'm about ready to file a lawsuit on this company. Also, I can never find anyone in that company that speaks good English, it's very frustrating, no offense to people with poor English language, but as far as this company goes, it seems like they do it on purpose so they can turn my words around on me. They are keeping my money illegally, and I want my money back now, they don't deserve to keep my money and I'm am NOT going to pay for anything I didn't receive.

From what I have read from other people, no one is getting any of their money back. So don't count on it. I'm going to have to go to my bank and get my debit card shut off and get a new one, I am still in the red over this mess, I hope this company goes to hell.

Update by Concerned Citizen
Feb 10, 2009 10:43 pm EST

Amen to that, and I'm also working on getting this company put out of business, I do NOT want any other people going through all of this like so many of us already have and are still dealing with now. FWM laboratories is like a bad nightmare that will haunt you forever it seems like. I'm going to get my money back, I'm not going to let them have my money that they do not deserve, and I'm also going to put all of those idiots out of jobs and maybe into jail. This is ridiculous.

Update by Concerned Citizen
Feb 10, 2009 10:30 pm EST

In regards to the 6 months you mentioned, does that mean that they will try to charge me again after the 6 months? I am going to get this card completely shut off once I get the red back into positive, in the meantime I'm just going to let the bank know to close the account, I guess that's all I can really do. Hopefully this company will get shut down.

Update by Concerned Citizen
Feb 10, 2009 4:45 pm EST

Ok, I will. I've already gotten a hold of my bank and told them to close my account, it still remains open but only for me to pay the debt off. I will keep checking though because scammers are good at what they do and I wouldn't put it past FWM to try something cute.

Also, I just finished filing with all of the places you mentioned, hopefully it will help.

Update by Concerned Citizen
Feb 10, 2009 4:18 pm EST

Oh wow, thanks for the help! I sent everything back to them because I didn't want them to come back and tell me they need this and that before I can get my refund, ugh I am getting so tired of this headache with this company.

I will do what you mentioned and thanks!

Oh and I purchased the item with my debit/credit card and I am STILL in red over this so I can't cut up my card or anything or close out my account, I will however tell my bank not to allow any kind of purchases with this card and see what they say.

Update by Concerned Citizen
Feb 10, 2009 3:56 pm EST

I am planning on filing a lawsuit against this company, I have just registered with lawyers.com and posted my story on there hoping someone in the law field will read it and be able to help. This is so aggravating and maybe if they get ENOUGH lawsuits it'll shut down their company for good so no one else has to endure this kind of frustration.

I also was duped by Acai Optimum! I am not 100% sure that it is the same company, but I bet it was. The charges on my account were listed as being from NTR*acoptimumcs .com. My product was shipped from Phoenix, AZ. I thought I was signing up for one bottle of acai optimum and a one-time fee of $99.96 with a mail-in rebate dropping me down to $1.19. Three weeks later I received two bottles of acai optimum and no other information. When the second charge for $99.96 showed on my account, I contacted Acai Optimum to cancel and try to get a refund. At this time I had not yet filed for my rebate because I still had not received my e-mail confirmation, but I had, luckily, printed the receipt that popped up after they got my money the first time. I was told by two associates that I was out of luck and should have paid more attention to the "terms and conditions." I had read the "terms and conditions" and it said nothing about a second charge. I told the associate that and he explained that the "terms and conditions" in "fine print" told of the second charge. The associate told me he would send me a copy of the "terms and conditions" via e-mail. I asked him if these would be the same "terms and conditions" I had previously read. He actually told me that the company policies change often! Needless to say, at this point I was extremely irritated and upset. I told the associate that I was not pleased and this was not the end of this, have a nice day and hung up. I then found this complaint board site and read some previous complaints, many mirroring mine. I also was fortunate to find the information given by one person to call [protected] for a refund. I did and was finally treated with some respect. The gentleman, Blu Jefferson tl11, listened patiently to my complaint and located my order. He then told me he was putting through a full refund, including for shipping, and gave me three refund transaction numbers. I asked about sending the product back and he told me that there was no need. It would just cost me more money. I will have to wait 3-5 days to see if I am blessed with a full refund! I have high hopes! Thank you l57e! You may have just saved me more than $200 and nsf fees!

Wow... Anyone here have TCFBANK? Wish I had read these post before placing the trials with these companies. My creditcard company call me right after the day that they charge 5.95 shipping fee. They also deactivated my card to prevent future charges. So I guess 5.95 and couples of other shipping fee charges were all they got.. sike.. Goodluck people... I can not try on the products since I'm nursing my baby.

Extreme acaiberry
Acaiberry power 500
green tea

their email add is customerservices@nubodi.com

i used to work as a supervisor for this company and if you need infos maybe i can help out. i know everything and every details about this company. their affiliate companies are PRICELIMBO and FitFactory.
we base everything by the script that has been provided. some of the instructions that we base on is that we need to stick to our terms and conditions and that we are on a NO REFUND POLICY, BUT if the customer is irate and will file a complaint to the BBB or Attorney General we would then offer the customer half the refund. If they insist on the full refund then we refund the customer the full amount. BUT...it is still up to the corp. office if they will issue a refund or not. Customer service will just assure you that you will be refunded 14 buss days starting from the day that you called. Note: Bank does not process that long. Its just to buy time for them to refund about hundreds and hundreds of customers. As i can remember there is only one person that does the refunds. So that's the reason why some of the customers refunds takes a lot of time, some even wait for months to be refunded. If you waited that long you need to call customer service to follow up your refund. BE IRATE AS POSSIBLE. All calls are recorded and you can use it against them. Try to write down important details such as the reps name and id, supervisors name, and the dates that you called. Their customer service is located at the Philippines, you can take them down anytime since they don't have the idea about American laws and stuffs. Try to threat them..its their weakness as customer service. Our motto is not to leave customers unhappy. Still in the end they will refund you as long as you try to THREAT them. SAY NO to what they have to say, as much as possible they will try to upsell, send you a free bottle, offer half the price. GO GET YOUR FULL REFUND. If you say NO to theses offers they will in the end give you the refund. pls email me for more infos at annmoral@yahoo.com

The product is working I have lost six lbs in two weeks, but I found the same products at the health food store for $100 less. I called two numbers to cancel my membership that I apparently didn't read about when signing up for the free sample (economics 101, nothing is free!) The number for the Acai Berry is [protected], the nice lady was happy to cancel my membership and explained I agreed to it in the purchase agreement (guess I should have read it a little closer). I asked her about the Life Cleanse if this would cancel that product also and she told me no. So I called [protected] the number on the bottle, guess what, they are connected my membership was canceled there already. Now I will take my bottles and go to the health food store and purchase the same cleanse for $60 less. I will look for the Acai Berry at a lower price. What is interesting is the products come from Nevada and Florida but our money is going to the UK and we are being charged extra for a foreign purchase that was made here in the states.

14 days later (they stated if do not cancel the order in the 14 days since you ordered the free trial) you will be charged the full amount. Even if you have not received the free trial they will charge your credit card.
That's what a customer service person stated to me back in January 2009., I contacted my bank and they are looking in to it, did anyone noticed that when the product arrived it had no invoice inside from fwm laboratotories?...I f anyone has returned the product please post the add, since I'm going to the post office and send it back.

This company has a no refund policy that is very crooked because they show a gauranttee that would refund but say they only would refund half and they are not authorized to sell drugs by the gov. they will tel you that this item is meds and that is their reason given to me over the phone why it cannot be refunded, they continue to make charges to my charge card even when they told me they canceled my account they gave me a confirmation number when they canceled my account it was [protected] on 01/05/09 by a rep named Zack at phone number [protected] at this time and date they told me that they can only refund me @89.31 to my account for and order that they shipped to me on 12/24/08 and I would lose @89.31 for the first shipped order that was shipped to me on 12/03/08, I am so confused because I have a funny feeling that they are still shipping orders to me and still billing my credit card account for some thing that I dont want and not ordering please help us all that are and have been scammmmed thank you kindly

I ordered the trial for 3.95, there was nothing else on the add, no fine print - nothing. Then I find a charge from them for 89.95, and 2 charges from some fit-something for 29.95. I called both and was told they would be canceled and money returned. The 2 charges of 29.95 were returned immediately, this was in November. I kept calling Acai Berry and they told me they shipped a bottle to me and that I had to return that to get my money back, when I FINALLY got the bottle, I immediately returned it, that was in January. I have repeated called for my money back and was given 2 cancellation numbers. Now, when I call, the number immediately disconnects. The web site is no longer up, and other numbers I find for them on the net also disconnect.

If anyone still has a way to contact them, please post it. I'm not just gonna let them have my money like that without a fight.

I bought the ssam of the 3.95 for the 14 day trial.. then lost my job. The day I went to call in about cancelling they already took the 89.95 out of my account and I havent been able to get ahold of them on ANY number that I have been givin.

Is cancelling your current card and having another re-issued the ONLY way to stop them? I cant afford to loose anymore money and lame ### scams for my health.

Please let me know if there is any other way to stop them .. going through and changing all account info is time consuming and a headache.
Thanks

When I get the free trial & paid $1.00 shipment on line, I did not know this company will automatically ship & charge my card monthly. I called the customer [protected]) until now I could not get hold of them to cancell the automatic shipment & charge.

Can you help me get hold of this company . The confirmation order for the free trial # 2700733. It does not state that there will automatic shipment.

The product is shipped through UPS. Address:

I ordered a free trial and paid for shipping and handling on December 12/7/2008. I had 14 days to call and cancel if I did not want to receive automatic shipments of the product, Acibiberry, in the future. On December 16, I called and canceled as directed. On December 23, the company, under the name of Fastment, charged my bank account $$89.31. When I telephoned them, they refused to refund my money. I told them I was returning their product and contacting my bank to dispute the payment made to them. They refused to give me the name or address of the company, they would only give me the address of the warehouse in Florida, as shown above.

I have since seen several complaints on the computer from people who have been ripped off also.

Ordered so called 14 day free trial and then realised they were going to take money from my bank account each month ($89.31). No contact address, only an international phone number which I cannot afford to use.

Trems and conditions certainly NOT clear at time of order. I am a pensioner and cannot afford such things. I have had to cancel my bank card to try to ensure no more payments are taken when not authorised. As today is 12 Decembr and I am unlikely to get a replacement card for 7 working days, my Christmas food shopping and everything will have to go on my Credit Card or involve me in going to my bank for cash payments.

Try to ensure these people are stopped. Have now discovered hundr4eds of other victims of this scam. I am fuming and ver, very upset.

I have ordered the FREE trial of the Extreme Acai Berry. Along with the product there was a printed noted indicating this:
"I understand that unless I cancel by calling [protected] within this 14-day period, beginning on the 14rth day my credit card will automatically be charged eighty nine dollars and thirty one cents (Free Shipping) for a 31 day supply of Acai Berry to be shipped at that time to my door."

Here what happened: I received the bottle that says TRIAL on it. I received the product and that very day I received it, I call [protected] and the woman with had my information, and she gave me a cancellation confirmation number, this transaction took place before a day before Thanksgiving, Nov. 26, 2008.

I notice on my bank statement I saw that I was charged $89.31 on December 25, 2008 and January 2, 2008.
I was charged twice on the day of January 2, 2008 for $89.31. I immediately tried calling the customer service to investigate as to what was going on. I could not get anyone to help me, I was put on hold and then they hung up the phone. I called again and the telephone recording says, "We Are Unable To Received Calls from Your Area". I tried calling and searched for an email to contact them and I could not.

I went to my bank and filed a fraud and theft, my accounts are now closed.
I have made a police report and will contact my lawyers to clear up this matter. Extreme Acai Berry is bad business people and they are hurting people out there. They have no code of ethics in operating their business.

People have the right to refuse products and services. People have the right not to give authorizations of their financial affairs. Yet, Extreme Acai Berry is violating these rights and stealing lots of monies from a lot of people.

This is THEFT!

I sure did not give any authorizations to anyone to siphon money out my personal financial account.

I stupidly signed up for the "free trial" of this product not only did i not recieve the "free trial' but they have since taken out of my account the full price of the product. I have rung the number numerous times and have had no luck. The worry that they will continue to take money from my account is very real. It is wrong that this company is allowed to do this i have researced numerous websites about how to cancel this onec and for all but have had no luck, please help.

Ordered a free sample 21 September. They sent out a full shipment on September 27 and another on October 5 without authorization. The person "Noreen" said that it was my fault because I did not cancel. They will only give one refund - so the other shipment is just stolen money. The second bottle is not even the same stuff as the first!

I will file a dispute with the credit card company and hopefully will get my $89.31 back. Of course time will tell if "Noreen" really canceled the future shipments.

I was able to get through very easily - but I called the number shown above about 30 minutes before they close - at 9PM Mountain time.

Acai Berry Unauthorized charge to my account

I ordered a free trial of Acai Berry which said I would have a 30 day trial and that i could return the item if i did not want it. First of all, it took 14 days before i received the package. On the day i received the Acai Berry i called GNS because the invoice said i would be charged $79.90 (for the free Trial) and that i would be charged another $79.90 in 45 days. I immediately called GNS who had me on hold for nearly an hour. I told the rep that i thought his company was trying to pull a scam.
The rep told me that i should keep a bottle of the Acai Berry to see if i liked it and to send back the unopened bottle. I told him to make sure that my account was not charged because i only wanted to try the product. The rep assured me that my account would not be charged. This was on 1/28/09 14 days after i had placed the order on their website.
On 2/6/09 my bank account statement shows "GNS*SLIMBODY VITAM800-5954670 CO" with drew $79.90 from my account. I called and email them on 2/7/09 to find out what was going on with my money. I was told by the girl who answered the phone that payments are returned two days after they received the item in their warehouse. UPS shows that the item was delivered 02/05/2009. It is obvious that this company is running a scam. Does anyone know how to shut them down?

It happened to me also. I was informed that I could not get a refund but could order something of equal value. Cannot find any other products to purchase. At time of cancellation there was only an anti-aging cream with the same balance.

I, also, was taken - with two orders, one for me & one for my wife. Took it for two weeks with no apparent results. Then raed the small print about additional charges and shipments. Immediately call their customer service at the 800 number provided above by escott. Lady was helpful. I sent back both shipments first class that same day. I called again today & they confirmed receipt & that no additional charges or shipments would be made. We'll see. I also wrote a 2-page letter with attachments to the Attorney general of Colorado registering my complaint with him.

I too was scammed over this. The day after my delivery came in I called to cancel all other orders, the man that I spoke with gave me an authorization # and explained what to do step by step. I mail the order back and waited a month. After that I called again, I was told a long song and dance. Eventualy I was given a $ 105.00 dollars credit. Not that I'm interested in ordering anything else from these scammers. But I do have the credit so let's see if I even get this.

I wish I checked this site before ordering. It is totally a scam. I called back to get the Return Authorization Number and representative basically yelled at me. After telling him that I did not appreciate his tone of voice he completely igonred it. He told me bluntly that they are NOT going to refund my money - I can use exchange. Requested to talk to the supervisor but the rep told me that there is nobody above him and nobody will authorize a refund! Basucally, tough luck... Completely unacceptable. SCAM! Please stay away from them...

I too fell for this scam and returned my product immediately when I noticed the $80 charge to my account. My money was refunded - luckily - but not for about a week after my product had been returned.
A helpful tip I found along the way - by calling GNS directly and not the number provided on the shipping invoice I was able to get in touch with a representative without any wait time at all (compared to the hour long wait to receive a return authorization)

The number is [protected]. The representative I talked to was very friendly and resolved my issue with speed and ease.

I was also scammed into this "free" trial. I tried to cancel within 15 minutes of ordering and got a song and dance after 3 days of phone calls and emails with their standard responses. I have and will continue to file charges with the State Attorney General and will do everything I can to stop these people from their scam. They suck you in with the $3.97 trial and then go into your account and withdraw the full price of the pills which you have sent back at your own expense.

I totally agree!
I didn't even get the product and I was charged $80+.

I ordered my product on 1/31 and never received it. Next thing there was a charge on my credit card. I reported it to my credit card to dispute charge.

I'm still waiting to get in touch with the company...this is totally a SCAM!

So what do we need to do to report it? Can we report it to consumers beaureau?

I ordered a FREE sample of this Nature's Best Acai Berry. The only thing that it was going to cost was $4.99 for shipping. They charged my card an additional 79.96! I never authorized the charge. Additionally, they leave no telephone number on your credit card statement to dispute. My credit card company has refunded my money, but they did say that this is a very popular scam with this company. If you're smart, you'll stay away from them!

STAY AWAY.

PLEASE KNOW the free trial offer requires SEVERAL "stages" of cancelation that are not disclosed to you when you call and cancel the product. I always request a confirmation of my cancellation, and had one for my initial trial. The customer service people are trained well to avoid disclosure any of the addt'l and future charges that supposedly were part of the initial trial request. BEWARE. When you sign up for a "free trail" even if you cancel the product, you have only cancelled part of your trial. You have to ALSO cancel the Membership to the website, (29, 95 per month after trail offer ends). AND if you are not specific in asking if there are ANY other undisclosed charges that the customer service people should disclose as future charges, you will be charged 8.95 per month for access to a useless service called FIT FACTORY. This company is obvously TAKING ADVANTAGE OF CONSUMERS, relying on getting away with just enough charges on a bank statement; if they have manage to sneak in 2 or 3 payments before you cancel, the money is pouring in for them. To sum up. when cancelling ALWAYS ASK to have ALL memberships, website access, and anything else disclosed to you immediately by the customer service rep, and then cancel all of them with separate confirmation numbers and emails. This company is savvy enough to have cloaked all these "services" under different names so that its extra confusing, and to continue to perpetuating a smoke an mirrors game to consumers. THEY ARE PREDATORS OF YOUR BANK ACCOUNT, . DO NOT LET NATURE'S ACAI BERRY PRODUCT (and its undisclosed subcompanies) COSTSMASHERS AND FITFACTORY have access to your hard earned money.

I orderd a free sample for 4.99 shipping. 15 days later they charged my account 79.96 . I had to get to my bank and stop this charge as well as cancel my card and order a new one to prevent further charges from this company. They are selling a caffeine pill with very little acai berry in it. It made me so nervous and jittery that I only used one of them. The company I beleive has changed their name and price within a few cents to make us think these are different companies. I think they are tied together. Should you try to contact them GOOD LUCK. Don't they have an obligation to disclose future charges? I am not the kind that goes for a subscription to any monthly fee or service charges against any of my accounts. I have spent to much time trying to get this charge reversed. I HAVE BEEN HAD AND DON'T LIKE IT!

As per someone else complained... Unauthorized Charges regarding this company. They do not post additional charges in plain view of persons ordering their product. You fill out the form for your free trial, and submit it, but... what no ones see's is: in the middle of the page farther down... it says it will charge $85.91 to your credit card sometime after your 14 day trial period with the Acai Berry expires, within 15 days they will charge you the $85.91.. it does advise one to call before the 14 day period is up... but also, all of this is way down the page from where you order, what you believe and in good faith order a FREE trial bottle of the Acai Berry from Nature's Best. They need to honor what they say / but also, they need to put all this information where everyone can see it prior to ordering the free trial from them. This is how they scam you and charge you additional charges... NOT GOOD BUSINESS PRACTICE AT ALL. I will never order again from this company online.

I purchased the trial of Natures Best Acai Berry. It took 12 days of the 14 day trial to arrive. I had no time to actually try the product properly but gave it the benefit of the doubt and decided to accept the 1st charge of $79.99 for a 1 month supply, that was on 2/23/09. I have never received any more product. I can't find a phone number or e-mail to contact them. Less than 3 weeks later I received another charge of $84.95 but the name on the charge is slightly different. I have no idea what that is for and can't get in touch with anyone to find out what is going on. They do not supply a phone number or legitimate web address on their charges which I thought was a law. I will now have to dispute my charges and probably change my debit card number to prevent any other charges. I am also writing Opra to let her know that they use her name for endorsement and this is what happens.

Saw the add on Real Age .com about the Acai Berry, Dr OZ backs use of this.
Placed order for free trial, had to pay shipping at the time of purchase of $4.95.
Cannot take the product, made my blood pressure go very high.
Now the company hit my credit card for $79.95 without my approval, I have tried to no avail to
contact this distributor and cx what they are charging. I am in process of filing against the charge with
my Chase Credit Card company.
I cannot take the product, I tried the trial for two days but blood pressure went up to 171 over 101. I cannot
take and will not take and will not pay. My credit card is cut up and I have a whole new account to prevent
stealing scams such as this.

I also tried the product and it don't even work. I have not lost any weight in taking this product and do not get any extra energy like the product advertised. I saw the add saying it was a RISK FREE trial for $4.95 for a 2 week supply, on line, as seen on OPRAH, along with ProBiotic. I printed off all of the information. I read the information, found that on the ProBiotic, you only had 15 days to cancel or they would charge my account for future shipments. I called and cancelled as well as sent an e-mail advising them NOT to send me anymore products and they were not to charge my account.

I found nothing about joining a membership on the site for Natures Best Acai Berry, therefore was not aware there would be future charges from Natures Best until the charge appeared on my bank statement. I called the number provided, found no e-mail address. I had to threaten several times to turn them into the Attorney Generals office before he agreed to give me a refund. He just kept saying it was clearly stated that I had a limited amount of time to cancel the "membership" and that I had not resonded in time. The product had no effect on me what so ever that I could tell.

If anyone else is having this problem or any trouble related this this company

please email me at: tabitha018@yahoo.com

I am pretty positive that I am not the only person who is going through this with this company.

I would really like to talk and I need to find out how to go about this situation, because I'm about ready to file a lawsuit on this company. Also, I can never find anyone in that company that speaks good English, it's very frustrating, no offense to people with poor English language, but as far as this company goes, it seems like they do it on purpose so they can turn my words around on me. They are keeping my money illegally, and I want my money back now, they don't deserve to keep my money and I'm am NOT going to pay for anything I didn't receive.

Acai Berry scam hidden charges free shipping bogus

I ordered a free trial of ACAI Berry for the price of shipping, and without being warned they billed my bank card 87.65 I refuse to pay this and when or if I receive any more shipments they will be returned. My card had better not be charged again in future months and My card better be refunded! In this economy the people should be ashamed of themselves.

I fell for it too. they charged me for the sample and then the 87.65 . The bank said I could send in a letter to the card comp. and tell them what happened. The email they send you to order is not the same page you pull up with their web site.the auto ship that's where they get you because they almost always get the first big payment. I am going to have to cancel my card too. Get a new one. I guess we really sould just go to the vitiman shope in town when we hear about these things. Have you read the ingredients? They are listed as the first is the most amount of ingredients the last is the least. acai is the last. There probably isn't even any in it.

Like everyone else I am appalled at the attitude of this company! They had the nerve to be so bold as to tell me they would get my money no matter what my complaint. I would like to know, who owns this company and how they could turn a blind eye to this! According to the woman I talked with, they are scamming the public by using the Internet and seem to be proud of it! I too had to cancel my credit card account so they can not charge me any further amounts for product that I did not receive. I ordered the free trial and was charged $87.65 for a product that I did not order.

I agree this also happened to me and the thing is the phone number that was posted to my bank account wasn't the correct phone number. So I started researching to find the number the first time I called and ripped into them they said they have no record of me ordering when I knew I had the right number. So the next day I called and told them I was looking into ordering the acaiberry sup and I had already ordered from them and asked them to pull up my info and sure enough they did, it was just funny the day before they said that they had no record but now that I said I wanted to order they all of a sudden had all my info. They said I couldn't return due to a AFDA confliction and they couldn't refund me. There should be a way to stop this ###.

Call the credit card company that you used and tell them that you want to have a new card and number issued to stop all future charges. This will give you a new account. This is what Im doing to stop any new charges. So far this is my only resolution I can find that I can do. Im also filing a complant to my credit card to dispute the charge. I did think about paying off card then closing it but my card company said they can issue me a new account number and a new card inistead.

Got me too! Only I've been charged over $200 so far. They signed me up for a bunch of other things I've never heard of, let alone ordered! I cancelled my credit card and they are blocking any additional charges. I just told them that my last charge was placed on Feb 9th and I haven't used my credit card since, so any charges coming in after that were fraudulent! If I knew what to do next, I'd nail these companies to the wall. But they count on us not knowing what to do next. If anyone has any suggestions, I'm all ears! nmulkey2001@yahoo.com

I found it difficult to cancel as well. Called my bank but didn't want to cancel my account. They only cancelled my card and re-issued under a different number keeping the account open and current pin intact. A new card will be mailed out within 5 days and if I need access to funds before I get the replacement card, I can get a temporary one from any branch. If you used a debit card to make your purchase this is the best way to keep these crooks from accessing any further funds. My bank also put the money back into my account and filed a complaint with the company - yea Wells Fargo!

this also happened to me. My daughter sent for a free trial and was enrolled in all different programs and I have several charges that incurred on my debit card. I called the bank and now have a hold on my card but have spent hours on the phone with these people. I am trying to find a phone number for a charge from Master Cleanse Watford. Thats all it says on my debit statement. Anyone who has info on them please let me know. Thank you I was able to speak to someone at Natures-Acai, from Creno, NV whom was helpful but they will not refund me 79.96 for a bottle she already opened that was supposed to be a free trial for $5.95 they said the $5.95 was for shipping But I also have incurred another charge for a bottle that she hasnt received yet for 85.91 they said they would refund that when I sent it back Very frustrating

Do something! When you file charges, that's when things get done. There are investigations and cases going on in certain States as We speak.

Try [redacted].com, maybe you have a better chance of getting your money back with them. If anything, through the Federal Trade Commission online.

This is some information I did find on this website, it's only part of it:

Two dietary supplement marketers that lured consumers on the Internet with allegedly deceptive weight-loss claims and bogus "free" sample offers, and then debited their bank accounts or charged their credit cards for continuing shipments without their consent, have agreed to settle Federal Trade Commission charges that they violated federal law. With the increase in Internet marketing, the FTC staff has issued a report providing guidance for marketers to help them avoid deception in making online "negative option" offers. (With negative option marketing, a company takes a consumer's silence or failure to cancel as acceptance of the offer and permission to bill them.)

If it's your bank card, you need to change your account. You will see more unauthorized charges. You have to go by whatever address that is sent with the product.

You should file charges with the Federal Trade Commission in that State and with the Attorney Generals Office. You can google this information and submit a complaint form on their website.

You are dealing with a group of Scam Artist. As much as you don't want to do it, you have to cut up that credit card. They will continue to take money from it without your authorization.

You should have kept some of the bogus product for evidence. Alot are getting sick from it. It might have the same ingredients posted on this website that said "NOT DIGESTIBLE BY HUMANS."

File charges. ic3.gov and with the Federal Trade Commission online. They have forms online you can submit. Makes a stronger case.

Acai Berry Internet Fraud

You may see a website that show's Kelsey's Weight Loss program that has a nice story about a local resident that loses weight from some AMAZING products such as Acai Berry and Cologenix. There is a 14-day trial offer imbedded in the story for both Acai Berry Detox and Cologenix. If you didn't dig into the website to read the crazy and unethical terms and conditions, you might have thought that you were getting an opportunity to trial the product for 14 days RISK FREE with an easy way to cancel your order from the AUTO-BILLING to your credit card for $87.13 a pop.

The deception exists in the fact that your bank card woes begin from the time you submit your order and then escalates 14 CALENDAR days after your order confirmation. If you are lucky enough to have printed your order when you placed your order then you have a record of your date and time and the order number. If not, you will not receive an e-mail confirmation of ANYTHING. My card was charged for shipping and handling but I never received ANY product. 14 days later I found two charges for $87.13 pending on my debit card. I immediately tried calling the number on my bank statement for the two charges and the numbers were disconnected. I then found [protected] but that number rang and rang and then I was in a never ending telephony loop where no one ever picked up (I am convinced no one was even logged into the phone system). I began researching complaints and found this site, the Complaint Board. After reading a few posts, I called my bank and CANCELLED my bank card. I then found a number on this site that allowed me to get to a live person supposedly in their billing department [protected] who could actually find my order and who I was able to coerce into giving me a cancellation number for my order. I did this even though I cancelled my bank card just in case they tried to continue sending me product in the mail and billing me via mail. By the way, I still have NEVER received any product.

The key that worked for me to at least get a cancellation number is to inform the agent that you are filing a complaint with the Florida Attorney General's Office, the Better Business Bureau and the FBI Investigative Unit. This quickly changed the tone of the conversation. Also, the phone reps are in an offshore facility somewhere in the next timezone east of EST in the USA. I've learned a few things from this experience: 1) Only do business over the internet with companies YOU KNOW (i.e. Sears, Amazon, Best Buy, etc..); 2) Make sure that there are positive ratings from consumers who have used the company previously; 3) Look for endorsement by the BBB. I feel for everyone who has had a bad experience with this company. I was very upset, lost a good night's sleep, and have to deal with the hassle of cancelling my bank card and setting up a new one. Good luck and happy shopping!

I also have been scammed by these crooks. They have 4 different addresses listed on Florida's Better Business Bureau web site. They go by many names, also. You may have seen on your bank statements: COLOGENIX, FWM*LABORATORIES, and don't forget the MC CROSS BORDER FEE. They've stolen about $350 from me. Today I went to the bank and closed my account. I'd already closed my debit card and somehow they still got it out of my checking!

Acai Berry Did'nt future orders - - took $79. 22 out of my account

This e - mail concerns my utmost desire to collect the money that was taken out of my account after ordering ultra berry slim for shipping @ handling fee of $4. 95 and after four days canceling any future orders. The fee of $79. 22 was taken out of my account without my knowledge or agreement. This has caused me much distress because other drafts that i'd written were overdrawn along with a over - draft fee. The cancellations of any furter orders were sent on time. This money should not have been taken out of my account. Please credit my account so i'll have the money to pay my creditors who were affected by these fees. Look forward to hearing from you! Vanessa cole help! P. S. The package the first bottle of pills sent to me, i have thrown away, so i have no knowledge where that shipment came from and have not received any productd for the $79. 22 that was taken out.

I didn't have too much of an issue attempting to cancel my subscription. I read the terms and agreement page and it was very clear about having to call and cancel before 14 days was over. After 14 days it clearly stated that you would continue to recieve the product and be charged approximately $75 and will continue to recieve the product until you cancel. Although the phone number they gave me to call,
[protected], was not a working number. It had a phony operator recording stating that I was out of the calling area. after reading a few posts on here I quickly found another number. I called and had to wait approximately 15 minutes. I was able to talk to a real person on the phone. I told him I wanted to cancel my subscription. He first asked for my credit card number and I refused to give it to him. He then asked if I would give him my email and mailing address. I felt more secure giving him this information. (I would rather get bombarded with junk mail than bills.) I gave him the information and he pulled my account right up. He canceled my account and told me that I would recieve a conformation email of the account being canceled within 24 hours. I wasn't too sure of letting him off the phone without a conformation number. I figured I have a phone number for them now so if I didn't get an email within the alotted time I would call back. Right as soon as I ended the call with him I recieved the conformation email on my phone. I will continue to check my bank account to make sure I do not get billed anymore. If they do I have an email stating the account was canceled. I feel like they should have given the correct phone number on their website, but after about 10 minutes of Googling I found the phone number. So I'm not upset. The correct phone number that I was able to cancel my account was [protected]. I hope this post helps everyone out.

If you read the terms and conditions as I just did posted on their website it clearly states that you have 14 days from the day you order to cancel your trial offer or you will be charged the fee and entered into monthly shipments. There is a number provided under the terms and conditions to call and cancel the trial.

Acai Berry Total ripoff - trial not free

I order the free trial for $5.95 shipping & handling. If you do not cancel within 15 days of their shipping, you get charged and addition $88.62 which is non-refundable. Then they start charging you $94.57 a month for this product. The same bottle in a health food store is $9.99. Same ingredients, same everything. even the same bottle. I tried the website www.mytrialsupport.com to get a refund and at the same time, dialed the phone number associated with the charge to my account of [protected] and they refuse to give me a refund. I had to pay for the initial free trial bottle because I did not cancel within the 15 days. I have lost my job and money is really tight. This put my checking account into overdraft and they still would not work with me. Said it was on page 2 of the terms and conditions.

The AcayBerry was suppose to be a free trial formula under nu obligation to purchase if you canncelled within 15 days.
Otherwise the company charges you on a monthly bases $94.57 for each month supply .
The problem is that you can not cancell whatever you do .
The phone number doesn't answer, the net site doesn't have any cancellation window and they will continue to charge as long as they want .

Acai Berry Fraudulent Charges and Undigestible ingredients

This company fraudulently charges your credit card. I signed up on the 27th of January. I received the Pure Acai Berry (have not received total cleanse yet) and I called to cancel my account. The first person I spoke to said I could not cancel until the 10th of Feb.? By then the trial period would be over. While I was on the phone with them they pinged my Credit card account with TWO $1.00 charges. I used a credit card that did not have much money on it..or I'd probably be complaining about the 80 dollar charges as other are.
I called back again to ask why they pinged my account and that I wanted to CANCEL. They gave me some BS confirmation number. It is my order number with an RM in front of it...and said I have to mail the product back. I just opened it and what about the 14 day trial? So I pay money and can't use it and have to pay to ship it back? I don't think so. Then they send you a 30 day supply instead of the 14 day supply because they try to HOOK you in. You can only take 14 days worth and if you don't want it you have to PAY to send the remainder back! When I was on the phone he was trying to get me to commit to only having to pay 20 dollars a bottle! This is what my charge card statement looks like as of yesterday.

Ok, I just pulled my online Credit card account again. The pending I had earlier was for ONE acai charge and ONE total cleanse charge and the TWO one dollar pings. They doubled it. I will copy and paste. 01/27/2009 pending EASYBODYDETOXONLINE $5.95
01/27/2009 pending MY ACAI OFFER $4.99
01/27/2009 pending EASYBODYDETOXONLINE $5.95
01/27/2009 pending MY ACAI OFFER $4.99
01/30/2009 pending UMG*SERVICES $1.00
01/30/2009 pending UMG*SERVICES $1.00

Down below I did more research on the ingredients. Not only are they stealing our money we are not even getting a PURE product as the label states!

WHAT about AOL, MYSPACE etc..that has their advertisements all over the place. They need to PULL these advertisements out. THESE testimonials are FAKE! Look at HELEN MILLER in bradenton..a blonde mom..take off the end url and it is another HELEN MILLER dark hair boasting about the white tea.. This company is going under several names and uses the same order number to pull money out of your account! WE NEED TO PULL TOGETHER and STOP THIS!

************ PLEASE READ THIS ********************** I just looked up the ingredients in my bottle of PURE Acai Berry.. An Advanced Wellness Research Product. Here are the ingredients.

*acai berry juice powder 1200mg *... this has the asterisk. Now I go to the ASTERISK on the side and it says this. THESE STATEMENTS HAVE NOT BEEN EVALUATED BY THE FDA. Here are the OTHER ingredients: Gelatin, cellulose, magnesium stearate and silicon dioxide.

CELLULOSE is NOT digestible by humans!

Here are some definitions and links to the sites where it comes from. Do your own google search too!

CELLULOSE: http://en.wikipedia.org/wiki/Cellulose
Cellulose
From Wikipedia, the free encyclopedia
Jump to: navigation, search
Cellulose, a linear polymer of D-glucose units (two are shown) linked by β(1→4)-glycosidic bonds.
Three-dimensional structure of cellulose, with four glucose units visible. (Black=carbon; red=oxygen; white=hydrogen.)
Space-filling model of cellulose, with four glucose units visible.

Cellulose is an organic compound with the formula (C6H12O6)n, a polysaccharide consisting of a linear chain of several hundred to over ten thousand β(1→4) linked D-glucose units.[1][2]

Cellulose is the structural component of the primary cell wall of green plants, many forms of algae and the oomycetes. Some species of bacteria secrete it to form biofilms. Cellulose is the most common organic compound on Earth. About 33 percent of all plant matter is cellulose (the cellulose content of cotton is 90 percent and that of wood is 50 percent).[3]

For industrial use, cellulose is mainly obtained from wood pulp and cotton. It is mainly used to produce cardboard and paper; to a smaller extent it is converted into a wide variety of derivative products such as cellophane and rayon. Converting cellulose from energy crops into biofuels such as cellulosic ethanol is under investigation as an alternative fuel source.

Some animals, particularly ruminants and termites, can digest cellulose with the help of symbiotic micro-organisms that live in their guts. Cellulose is not digestible by humans and is often referred to as 'dietary fiber' or 'roughage', acting as a hydrophilic bulking agent for feces.

Magnesium stearate: http://en.wikipedia.org/wiki/Magnesium_stearate

Magnesium stearate, also called octadecanoic acid, magnesium salt, is a white substance which is solid at room temperature. It has the chemical formula Mg(C18H35O2)2. It is a salt containing two equivalents of stearate (the anion of stearic acid) and one magnesium cation (Mg2+). Magnesium stearate melts at about 88 °C, is not soluble in water, and is generally considered safe for human consumption. Because it is widely regarded as harmless, it is often used as a filling agent in the manufacture of medical tablets and capsules. In this regard, the substance is also useful because it has lubricating properties, preventing ingredients from sticking to manufacturing equipment during the compression of chemical powders into solid tablets. It is used to bind sugar in hard candies. It is also a common ingredient in baby formulas. In pure powder form, the substance can be a dust explosion hazard, although this issue is effectively insignificant beyond the manufacturing plants using it.

When used as a filling agent in the manufacture of capsules and tablets, such as vitamins, the source of this ingredient is typically bovine. However, there is an increasing number of vegetarian options in which the product specifically indicates it contains magnesium stearate from vegetable sources.

Magnesium stearate is a major component of "bathtub rings". When produced by soap and hard water, magnesium stearate and calcium stearate both form a white solid insoluble in water, and are collectively known as "soap ###".

Silicon dioxide: http://en.wikipedia.org/wiki/Silica

The chemical compound silicon dioxide, also known as silica (from the Latin silex), is an oxide of silicon with a chemical formula of SiO2 and has been known for its hardness since antiquity.[1] Silica is most commonly found in nature as sand or quartz, as well as in the cell walls of diatoms. It is a principal component of most types of glass and substances such as concrete. Silica is the most abundant mineral in the earth's crust.

IS THIS STUFF SAFE..? NOT DIGESTIBLE BY HUMANS? THIS NEEDS TO BE INVESTIGATED AND I WOULD BE CAUTIOUS OF TAKING SOMETHING LIKE THIS.
I took it twice and each time i felt sick to my stomach!

What's interesting the location of Helen Miller is determined by the URL of your computer. Reading from Bradenton, Florida – voila! – the testimonial is from Helen of Bradenton. Check out the testimonial from your computer in Grand Rapids, Michigan, and Helen is from Grand Rapids! Wow! There are sure a lot of Helen Millers!

Acai Berry Scam

I have never ordered any product from them, but they keep sending me the products although I called them and cancelled the order. The operator tald me that the order was made 1/8/2009 using yahoo email address. I have never had yahoo email account. So, I knew this whole thing was fake. Also, my home phone number was totally wrong. (not even close)

Acai Berry illegal charging

I order this product through the website to try acai berry cleansing pills. It states they will charge $3 for S&H try for 14 days. I get charged the $3 and did not receive trial bottle. a week later there is a charge for $89.31 so I call to let them know they didn't send me the trial and I hadn't received the full bottle they were charging me for. So they cancel the account and tell that the trial was coming with the full bottle of pills. WHAT! I told them no I didn't want anything anymore because that is not the way they should be doing business. The man tells just return the package back and we will do a refund. So a few days later I receive the package I keep the trial (as I was charged for it) tryied it did not work. I return the pills, didn't open the package just put return on the USPS bag and drop in mail box. Now its been almost 60 days and no refund. I called and talked to two idiots at the customer service who tell me without the tracking number they can't issue the refund because the free trial was expired. Now explained everything the way I just wrote it. I didn't get a trial to try in the first place and my card was charged without me haviang a chance to try the product and agree or not to the terms and conditions! Now tell me if this isn't stealing, they should extended my trial period at least but no they didn't and now they wont refund my card. Oh and when I asked in both occasions to talk to a supervisor suprisingly he was in a meeting and then they hung up on me! The NERVE of these company but foolish me for not returning it via UPS!

Yes you've been scammed. I have gotten 20+ calls about this because my company in Portland Maine has a similar name and Directory assistance is giving out my company' phone number when asked for Direct MRKT!

The address is a PO box in a shopping mall in Portland - no store - no office.
I called local police and the Attorney General's office in Maine to make them aware. Local police said they've gotten reports about this PO
Box before and unfortunately they cannot do anything about it because the orders are coming in from out of state so your local police would have to open an investigation based on your complaint to them. I keep telling the people who call to check the website to learn about this scam and to not order if no phone number or website is listed. I am sorry . ~ Leslie @ Q4 Direct Marketing Portland Maine www.q4dm.com
