Be warned about Bank of America Mortgage Practices! Bank of America has committed mortgage fraud in our home loan contract by changing the status of our loan type and structure of the loan, by adding PMI, "AFTER" the closing, and without notification that they were changing our loan within thier system! And they most certainly have done this to hundreds, if not thousands of others throughout 2008 & 2009. If you do not pay PMI to Bank of America, then you need to conduct a thorough examination of your loan documents and run the figures through an amorization calculator. There are actually 3 different ways that they could have calculated your loan. I suggest running all 3. We found out the hard way that our loan type was changed when we tried to refinance our current loan with another bank! We had already payed for the appraisal ($350.00 dollars) and the new bank was pulling the payofff amount and found that within the BoA system, the type of loan we had was actually different than what was on our loan documents. When I contacted Bank of America about this they stated that they had payed for the PMI issucance "AFTER" our closing. The PMI department at Bank of America then stated to me that PMI costs were added into our APR and that is why the percentage rate is higher. I then ran the figures and sure enough the difference in the interest rate over the life of the loan came to within a few dollars of the amount that BoA had supposedly payed for, but had actually charged to us in the annual percentage rate! I have made complaints to the regulatory agencty that governs National Banks, the "Comptroller of the Currency Administrator of National Banks or OCC", they sent the complaint to the bank, the bank responded and apparently directed them not to discuss or release any ionformation to me about this issue. I have also filed a complaint about this with the Texas attorny Generals Office. If you suspect that you are a victim of this fraud as well, you can file complaints on-line as well. Please do so so this can be stopped before anyone else if ripped off by Bank of America!

harassing phone calls every hour
Bank of America/BAC Home Loans Servicing LP would call my home phone every hour from 8.30Am to 9 PM looking for a Marcus M, unfortunately that person have never lived at this phone number address as I have been living here for the past 15 years. I informed Bank of America/BAC Home Loans Servicing LP and they said they would remove my number. Days later I am still waiting for this to happen, the harassing phone calls continues on Saturdays & Sundays as well.

Hi, I have the same problems with BAC. And I have received calls all hours of the day and night. They are looking for someone who does not live here and over 10years ago had our phone number. BAC informed me they would put me on the do not call list which has not happened. I even went to alocal branch of BAC in Houston and the manager said she would get the harrassing phone calls stopped.
Today 6/11/11, we received a call from a group called UPLS who said they wer calling for BAC and they stated they could not take me off the calling list since they were calling for BAC. I plan to gert advice from an attorney.

Hi, I've got the same problem. I am on the FCC Do not call list and have also requested within BAC to put me on their do not call list. It doesn't help. I have filed 3 complaints with the FCC Do not call Regtistry. They have a glitch in their computer system and have the wrong phone numbers on the accounts. I feel that if there are enough of us, we should make them pay hefty penalties for these abusive telemarketing practices. That is what they are because the recording asks you if you are interested in receiving their products or services. I wish more people would file complaints with the FCC to give all of my complaints more status. Until then, I just keep my caller ID on to record the instances and when I get fed up, I file another complaint.

Bank of America is a very dishonest bank, there thing is to trick you or cheat you in anyway possible. And believe me when i tell you that they are liars. I don't want to spend all day writing a book on how they have cheated me but i am going to take the time to post this so when people come to look they will find yet another person saying that the things bank of America are doing are against the law. who is going to protect the people from these bullies? they are picking on and ripping off the elderly and so much more. its disgusting to use the word America in there name.
These people are trained to lie, if only someone would be honest enough to tell you that. My situation was that being unemployed for several months, I would like to get a loan modification to lower monthly payments, etc. At first, they said no problem, but later said I didn't have verifiable income. Well, that was the reason I needed help--lack of income. I filled out all of the paper work and did everything they told me to do, only to be denied in the end with sooooo many excuses. You can speak to 50 different people (they love to put foreigners on the phone to really fray your nerves) and all 50 people will tell you something different. These people are liars all the way. I absolutely hate doing business with them. They also love to manupulate bank accounts. One day you will see a transaction processing, then the next day it is temporarily gone, only to show back up the following day and then change the day you made a deposit so now you can be charged with an overdraft fee. They love this trick! This bank is the worst!
I have never been lied to by a supposedly reputable company as I have BOFA. They are the most disorganised company I have ever seen. If you speak with 5 different service reps about your concern you will get 5 different answers. We have been trying to get a loan modification for over a year now. They have lost very sensitive financial information FOUR (4) times now. They just asked for the same information that I have already sent them 4 times! It's no wonder the state of Arizona is suing them for fraud and bad business practices. We have just sent our complaint to the California Attourney General but of course I see no help coming from there. The only thing I can do is to hopefully warn any one against doing business with these banksters. Why in the name of God did our government keep these shysters from going out of business, which they so deservedly need to do.

In my last twenty year I have not experience any worst customer services which I experience on 1/22/2010. I am 20 years customer and paying my bill on time on two cards. Bank of America Visa and FIA Master Card. I called because they reduce my credit line and that effects my credit. Upon calling the ### of BOFA closed my accounts with insulting remarks for my credit report. Which was result of Furlough since I am a state employee (CA). I dont know how to deal with this.
manulating deposits and posting
I understand ifI am over on my account then I have to pay the fee.
BUT why do they have to hold my deposit which more than covers my purchases so that i get overdraft fees, My deposits went in first.
They also move your largest purchase even if it was you most recent to the back of the line so that all the other posting bounce as well.
I am a mother with 2 jobs and 2 girls to support and I have just got assessed a bunch of charges so basically my pay from my second job is gone.
Please tell me where to get help. Again I understand one if the recent purchase is over but to move everything around is really unfair.

No this is bad banking business, as all banks now use the same practice to manipulate and move debits and credits to their advantage. They hold all transactions until the end of the day using the smallest to largest debits posting first then the credits with the end result that NSF will result. The banks are making their money this way stealing from the average person that lives paycheck to paycheck and doesn't have the money to cover. Then they delay sending notices and also charge a fee per so many days for being overdrafted.
Were they direct deposits? If they're checks, then they hold the deposits a few days.
Perhaps don't write checks until you know the money is there...

For the third time, Bank of America has "forgotten" to pay the real estate taxes and insurance on a mortgage that they service and for which they have a hefty escrow balance. What happens is that
(1) we receive the notice that our insurance is expiring and/or our real estate taxes are in default, (2) we have to call Bank of America and suffer through endless "push button " (for which escrow issues is not an option) and bad music, to inform them that they forgot to pay. In two of the cases, we had to FAX the bills to them, and in the most recent case (after an hour on the phone) they said that they will straighten it out without our faxing things in (we'll wait and see). Each time, they blame the problem on the County tax office and the insurance company, but this never happened with the same parties on our previous loan with BofA. The County states that BofA has not done what they need to do as a loan servicor with an escrow obligation.
We are resigned to the fact that they have a glitch in their system and cannot handle the escrow payments. I am looking forward to paying off the loan so that we can make these payments directly.
In our last call, the customer service agent mentioned that they had merged servicing systems with Countrywide and that this may have caused the confusion. The timing of our difficulties matches the Countrywide merger. While I can understand the confusion, if you have a business system with a terrible glitch and you fail to correct it, it is bad business. Once, I can understand. Twice, I wonder why they don't fix things. Three times? Bad business.
While I have had BofA mortgages for over 30 years, if I need another mortgage I will look elsewhere.

forclosure after short sale approval
I was short selling my home, I received an approval letter from Bank of America on March 5, 2010 that approved the short sale as long as closing took place before April 19, 2010. The buyers completed their inspections, obtained financing and signed all the appropriate closinf paperwork on arround April 12, 2010 the final settlement statement was sent to Bank of America for final review as requested in thier letter and the closing agent received notice from Bank of America that they had foreclosed on the property on April 7, 2010 and that they could not move forward with the short sale even though they had supplied a letter stating that the sale was approved as long as they received their funds by April 19, 2010. I have copies of all the letters and documents and I am learning this is a common practice oc Bank of America.

I just was informed by the servicer of Fanniemae that the property we had on short sale with an approval til February 15, 2011 was forclosed on Jan 28, 2011. How can they forclose when they give you an approval stating an expiration date. I would understand if we had gone passed our approval date but it was not even close. How can we fight this? The Buyer was receiving loan docs this week. This is horrible! I never thought they could foreclose while in an Approved Short Sale.
I had the same situation were the approvl letter was good until July 5, 2010 and BofA foreclosued on June 14. any one here in Texas? I'm in oregon...I wonder is there is a relation ship where the property is or not? Please contact me to see if you were succesfull or not.
I have been waiting for a response from the closing "delaying" officer. Their letters of approval or demand letter should be written so they are "good till close" since it can take them 4-7 days to review anything and a response to rewrite a letter of demand that has expired by one day can take 7-10 days..very poor and untimely service...it makes me wonder what their goal is and objective..and how it serves the parties with a vested interest..
I have the same problems similar to you too. I got short sale approval on May 19, 2010. my buyer want to set close date by June 5 2010. but Fennie Mae foreclosed the house May 28. I am still looking for some help to avoid foreclose.

bad customer relations/service
I requested a replacement debit card on April 2nd, I was told it would take about 1 week to receive. On April 8th (4 business days after the reqeust) someone deposited 2 bad checks using that card at 2 different ATM in city's that are not close to me. They were both Bank of America checks payable to me, and the signature on the back was just my first name. These people then tried to use that card to purchase goods and withdraw a large sum from the ATM. I do not keep alot of money in there so those were denied. Bank of America closed my account due to fraud. The card must have been stolen from my apartment mail box or it's an inside job. I have made a police report for the stolen card. I have never received a call or paperwork from the bank after I made a fraud claim. The biggest problem is that the day they closed the account my paycheck was direct deposited. I have had the same employer for 7 years and been a customer of the banks for 17 years. Since they closed the account they mailed me a cashiers check on Friday April 16th to this day May 3rd I have not received it. When I call the department that closed the account I was told they couldn't do anything until the check has been out for 15 business days! Get real in this day it does not take that long for anything to get to you. They must be using the Pony Express! I have gone to several different bank offices and they say their hands are tied and give me the 800 number to call customer service. If you have any accounts with this bank GET OUT NOW!
tendering a payees check after payors account was closed
Where do these banking policies come from? Bank of America is taking advantage practicing 'back door habit's on a gross level. Recently my husband and I closed our bank account (checking) after waiting for all check's to clear. Two check's had not cleared and were written by us approximately six month's prior to closing our account. We could not locate the payee as he was a helper that came along with a contractor to do some work on our home. We thought maybe the check was lost or misplaced by the helper. The other check had been written to purchase something over the internet and also had not been cashed. So now we would have expected that the payees would probably come directly to us for payment. Low and behold, these check's were both cashed by Bank of America after we closed the account. Those check's were not legally supposed to be honored after all our account number no longer existed as active. Account Closed should have been stamped on each check and returned to the two payees. They not only sent us a statement that appeared to be business on an existing account with a negative account balance of almost a thousand dollar's and overdraft fees as well. After going to the bank and not getting any answer's we decided to not deposit the funds to bring the account to a zero balance. But to go to corporate, still nobody could give us answer's. They have reported my husband and I to Check Systems a company who report's you as an undesirable customer and for 5 year's keep's you on a list that all bank's check as you apply for a checking or saving's account. Thus, we can longer obtain a bank account for five year's. Thanks to you Bank of America you have deprived us the ability to operate our live's financiallyin the normal way. We hope to see your incompetent organization charged with mis-conduct, fined, repay all cheated customers identified by a grand audit and finally, closed. That's what you deserve.

I'm not even a customer of BOA Home Loans and never have been. Some woman who shares only my 1st name is and for some reason my phone # is in her file. They call me at least once every day and some days 3 or 4 times a day. Every time I answer the phone I go through the whole thing over and over again. They say I've been taken off of the list and then an hour later or the next day they call me again. I even got a prerecorded solicitation call the other day telling me there was some conference in Las Vegas. AHHHHH!
BOA please if you read this, the phone # ending in 4600 on Elizabeth Martinez's records is not hers. It is mine, STOP CALLING!

Home Modification:
I too have had to run circles for BOA with no success yet. I first started my application for a loan modification in 03/2010. I received the packet in the mail and filled it out completely and provided all documents requested. After about 6 weeks I received another packet in the mail stating required documents were missing and I needed to send them again if I wanted to continue the process. These included 2 months most recent paystubs and bank statement along with signed form for them to have rights to request last two years of Taxes. This time to rush the process I faxed the papers to the number I was given. Two weeks later I received a packet stating these same documents were still missing. I called and gave them the fax # [protected]) I sent the papers to and was told it was the wrong # and that I should fax the new updated papers to [protected]. On July 16, 2010 I faxed the 14 papers plus coversheet to this new number and made sure my loan # and the file #31340 were on the top of each paper as requested so they would not get lost or mixed up. I then received another packet and letter of intent for foreclosure if I was not caught up by sometime in December. I had until January 22 to return the papers yet again and this time I used the enclosed envelope with tracking, making sure once again that my loan # was on every paper. The tracking showed it was signed for on January 17th, yet I received another packet stating I was missing the same papers again on January 22nd 2011. This time I called and told them the tracking showed it was signed for on the 17th. They said oh yes, we do have that paper work and that they will let my Rep (Jeremy Dikeman) know and to disregard the new packet. I asked to please have Jeremy contact me since I have not once had an opportunity to talk to him. He has still not tried to call me as of 02/13/2011.
Re-instatement fee:
I have also had no luck with 3 attempts to get my re-instatement fee from BOA. I have ordered this 4 times now. The first 3 times I was told to call back in 48hours to give them my fax # and they would fax it plus it would automatically be mailed to me. I have not received a fax or letter in the mail yet. The 4th time I called 02/11/2011 I was told it was ordered again on January 31st and would not be ready until February 16th and to call back then. Maybe they will get it to me this time. I pulled $10, 000 out of my retirement fund to catch up and try to save my house but I cannot get BOA to give me an amount to pay them.

Fake Homeowner's Insurance
Warning to all Countrywide Home Loan homeowners. Double check to see who your Homeowner's Insurance is with. Countrywide Home Loan may have allowed your Insurance to lapse, and you may now have in-house forced-placed BALBOA. This is NOT a real insurance company, but a loan guarantee! If you burn down your kitchen, Countrywide will not rebuild your kitchen, and will not make a check out for damages. They will take your home away instead! You will be left with no home, and no check from an insurance company, because BABLOA is only a LOAN GUARATEE!
Countrywide has been allowing homeowners' policies to lapse. If they get a call from your insurance, asking why the bill is not being paid, Countrywide will claim that YOU called them and said you decided to go with another company, thus illiminating a call to YOU to let you know Countrywide was not paying the bill (out of your escrow account). This has happened to me twice now, when my loan was purchased my Countrywide. I had no idea this was happening until I had to get a lawyer for something else.

run around / stonewalling
On 3/9 I contacted Bank of America Home Loans. The person who took my loan was Chad Harter in AZ. On taking my app, I explained that 4/23/2010 was my closing date and the reason I was going with BofA was because aprevious bank made a bad error that left a bad taste in my mouth so I didn't want their mortgage.
HE took my app, and I sent all the documents needed. I was assigned to Toni Ann Magadino in Long Island, NY. After forwarding her the documents, again, she was removed from my loan.
I was then assigned April Connolly out of Melville, VT. I got a conditional approval with a letter of conditional items. I supplied all these documents on April 1st, 2010.
My loan documents were not looked at until APRIL 16, 2010. That is a week before closing. It's incredible!
The week before closing, I received a letter asking for more documents. The day BEFORE closing, I received another letter asking for:
a) a marriage license (because I did not take my husband's name)
b) a letter from my post office that my physical address is the same as my POBox - ie, both were to me.
c) 20 other documents that would take days to get.
Why this stuff wasn't needed a month ago, I dont understand. I feel that they didnt have time to do my mortgage, knew that and stonewalled me.
My lawyer, in the business locally for 30+ years, said he's never heard of a marriage license requirement or a post office requirement.
I was able to, a day before closing, find another provider I have a business relationship with to write me a mortgage. I have excellent credit and financial reserves.
Bank of America wanted my business, and was willing to lie to keep my business. They've now lost all my business.
beware of hidden escrow accounts!
Yet another BOA scam unfolds! We just found out that BOA opened an escrow account "on our behalf" to pay our real estate taxes and property insurance bills this year. Problem is: WE ALREADY PAID THE BILLS DIRECTLY OURSELVES! Yes, incredible but true! We wondered why our mortgage payments so far this year are being considered only "partial"? Well, guess what! Good ol' BOA had been applying a portion of each and every monthly payment we made to this mysterious escrow account, which of course had a NEGATIVE BALANCE since we had NEVER SET IT UP or added to it in the first place. Amazingly, they even think they are entitled to the "late fees" they are charging us since we "only made partial payments" on our mortgage! The gall of these people is truly remarkable. Watch out, America, BOA is taking Uncle Sam's bail-out money and doubling it by using unethical business practices against us poor unsuspecting consumers. IT'S TIME FOR US TO TAKE THEM DOWN! REMOVE ALL OF YOUR MONEY FROM ANY ACCOUNT AFFILIATED WITH BANK OF AMERICA TODAY!
How did you resolve this matter? I just discovered the same thing on my statement. Now there is a random "escrow" payment due.
Also I have had repeated issues with them taking out insurance policies that i do not need. wtf?
can not resolve a simple issue
I just refinanced with Bank of America in Diamond Bar Calif. To make the story short they did not lock in my loan as promised. I did get a letter fromt he VPresident of the Bank that they would honor a certain rate and would make good on a .475 loan origination. They took 3 steps in retifiying this problem. First no credit then a partial credit then another credit and still to this day have not given the amound promised on a company letter head statement from the bank. I have received one call from the CEO of Bank of America and have not to this date received a call back. I have written to the BBB in hopes to retify this problem. MY loan went thru but at this point I cannot trust the word or work and will not do my banking there at this point. What happened to the the Consumer Relation and Customer Service for which I have knowledge and expierence in for the 20 years of my life. Hoping to get the credit I deserve. Still awaiting a call to correct this complant. My refinance took 6 whole months to complete. This is not what people want to do in trusting in their operations.

Bank of America screwed me over. I was away and overdrew my account several times through automatic payments of a few dollars here and there. each time it happened i was penalized a $35 fee. For about $50 in purchases i was charged $600 in fees.
Never got an email alert or anything. This despite many years of being a good customer and lots of money in other accounts.
Now i know some would say it is my fault for letting my account default but the issue is that they know i am a good customer and might have said something.
Bank of America has never failed me in 10 years of banking with them. You gotta know the rules and what you sign up for... if you wanted to get e-mail alerts, then sign up online for the "overdraft alerts" option they offer... that simple. They even have a "low balance" alert to prevent you from getting any fees. If you dig into it and really care about your finances... you can even tell the bank to freeze your card when your account is overdrawn, and they will do it. They use a system called "coin" in which a simple code will make that happen. BOFA has saved me many times from fraud. They disable my card when they see suspicious activity going on and let me tell you, 90% of the time, they were right. I can live with the other 10%, knowing that they did it putting my safety as their first priority.
BOA is not there to hold your hand. It is your responsibility to know what is in your account at all times. They have many, many, many customers and you are not special. Try using a check register and keeping track of what goes in and what goes out correctly. I have been with them for 20 years and when the occasional issue does come up I don't get a call. The fees and everything pertaining to your account is spelled out in the booklet that you get when you sign for your account, or you can request one at customer service.
i got robbed by the cab driver who was taking me home when i was drunk as hell and couldn't even walk to the ATM when i realized i didn't have any cash to pay him for the ride and just me being nice and willing to pay cash... son of a ### looked up my PIN and took my card because i forgot to take it out of ATM, after that all cash was gone and account was overdrawn, BofA seemed like a good deal when they refunded money day after and straightened everything up but the branch worker who live across the street from me was insistent that his ZIP code is the same as mine when it was different ( los angeles, baby) and put in my address wrong ZIP so i've never received any paperwork to fill out about the fraud with ATM, after one month i got charged for that refund, money were taken back and put me overdran with 10 transactions pending so do the math - 350 in just fees and then for each automatic payment from my cell phone company they charged another 35$ for each attempt from the side of the cell phone which took them like 5 times to realize, my account is not givin any money... so i had to pay BofA around 600$ in fees plus that 500$ that was stolen... then they were pushing me around that they're still investigating my case and they will return everything that got affected... yeah, one day i had to call and talk to supervisor because it took them about 3 months to investigate it and then i get a letter that since PIN was used - they're not gonna do a thing about it... slap to my face... i pay everything off, close account and forget about those ###... now i bank with chase and got no problems...

I received a check for services rendered. I took it to Bank of America and they told me i had to deposit it in my bank account to see if it was any good. I told them that was fine. (14) fourteen days later they told me check was no good and they were closing my account for depositing a forged check. I do not understand no money was drawn on that check or my account since that transaction why do i have to loose all my accounts with Bank of America. I am seeking a lawyer to find out how to get the funds that their holding in my accounts. Bank of America did not loose any funds and neither did myself. Why dose the little guy always suffer.
loan modification scam
I was reading the other persons complaint and the people at bank of america are the dumbest people I have ever dealt with. They should have never gotten a cent in the bailout money. I have not heard of them helping anyone. I dealt with countrywide and they were great they gave me a modification within a month. Then bank of america took over and they cancelled it 2 weeks before it was finalized. I have been doing this modification process since dec. 2008. Over a year me and my two little boys have been in fear of losing our house. I have applied and reapplied 4 times it goes so long that months later they cancel you without any knowledge. I lost 700 dollars a month in child support but I still have the children full time and I just need some help to lower my 1000 dollar a month payment but they will not budge they just put me on hold and cancel me so I have to pay to resubmit all the paperwork. Last time I called they had no programs for me so I said fine I will have to foreclose well that is what is happening my house will be at auction june 11 2010. My house is 800 sq feet and 1 1/2 bedroom. I was an idiot and paid 108, 000 still owe 106, 000. They will be lucky to get 50, 000 it needs lots of work. But you know what it is their stupid behavior that put them in this loss. They could of had the full amount if they would of worked with me. So lets give bank of america a hand for their loses they are taking and the families they are stressing because they cannot help people they need to keep it for themselves I guess. All of my friends and family are taking their accounts out all over too for their stupid business mistakes they have made on me and my two little children... Guess they don't need money like you and I they have the government to scam. Please do not do business with them. They might do it to you as well. All their reps do not know a thing or you cannot understand them. Bad customer service.
the same thing is happening to me. i have had my home for nearly 8 yrs..Country wide was my mortage company till they sold out to Bank of America, , i had a 30yr fixed rate then and now it is a adjusted rate, that means they can change it any time they want to. i also was in a Loan Modification, and did not know that it was only for 1 yr, , they took me off the program without my knowledge and now though i have talked to several of their people about my wage loss they have raised my mortage to 889.00 per month, , i cannot afford this at this time. and though i have paid for a full year and was not be hind dealing with the modification, they say i am in default fo well over 1000.00usd. i know this is wrong because i sent the money they say was needed inorder to not be in default at all..then they take your money and don't tell you where it goes, , it is like you didn't send any payments at all...my balance is higher now than when i frist got the house in 2002...thiis is the worest bank or home loan company i have ever seen, , they offer you no help at all, , called them and was told i can get no help because my wages were cut, , , , ARN'T WE ALL IN THIS RECESSION...SO WHY ARE THEY DOING PEOPLE LIKE THIS, WHEN THEY SHOULD BE HELPING THEM, AFTER ALL IT WAS OUR MONEY THEY USED AND ARE STILL USING TO BAIL THEM OUT OF THEIR TROUBLES, loan modification rippoff scam, , don't know what is going to happen to me now, , trying hard to keep my home as my husband died her in 2008..these people have no heart but they call them selves Bank of America, , , WHERE IS THE HELP FOR THEY AMERICANS THAT HELPED THEM, should have let it with Country Wide Home Loans, , they did atleast understand hard time and the people who have them...KEEP AWAY FOM BANK OF AMERICA THEIR KIND OF HELP YOU DONT WANT OR NEED

I opened a checking account with bank of america at the lasalle & adams branch in chicago. They gave me an account number, temp checks, and an atm card. The woman told me to make sure to fund it with at least $100 on that same day to complete the process. Two days later, I find out that my balance is - $40. It seems that they decided to "close my account" due to information from check systems. They put a freeze on the $100 that I deposited, and then charged me $40 to close my account!
I told them that this was a non-disclosed fee, and they said that it was a "research fee", and that research fees were disclosed. But it's not a research fee. It's an application fee that seems to only be charged to those who are not accepted as customers. Had I known that any part of my deposit could be taken as a fee for applying for a checking account, I never would have opened it.
The racket is to make it appear that you have an account, when in fact you don't (If they are still screening you). That way, they can say that they are closing it instead of denying your account application.
Has anyone else been charged these "research fees" or "closure fees"?

I recently decided to open an account with Bank of America due to the fact that my current bank is beginning to charge service fees to all account holders unless you have a specific dollar amount in the accounts. I only work part time and have two children so I cannot afford to just give money to anyone. When I opened my account with BOA they debited $25 out my Chase account for the checking and $25 out my account for the savings. Then I was told that I would receive my welcome package in the mail. About a week later I received five different letters from BOA, one was a welcoming letter, one was the pin for the debit card, one had the debit card attached, one had a online passcode, and the final letter was notifying me that they closed the accounts. Well I didn't understand this so I called the Risk Account Closure Unit mentioned at the bottom of the letter, and they simply responded: that under their Depository Agreement the have the right to close any accounts for any or no reason. After further probing the rep on the phone, there was no reason given to me for closing the accounts. So my next question was when will I get my money refunded to me, I was told that a cashiers check had been mailed to me. I was gonna leave it at that, but something told me not to, so I asked what the dollar amount of the cashiers check was, the rep said $10. I told the rep that I deposited $50 into the combined accounts, where is the rest of my money, and I was told that a non refundable research fee was assessed to me in the amount of $40. I questioned the rep further; asking how is it you can just take someone's money and not give them a reason for doing so, and how do you even have that right? The response was that I had agreeded to the terms and conditions of their organization and that those terms and conditions allowed them to basically do what they want. They stole money from my children, I will never do business with them again. On another note, I still have to pay Chase a monthly service fee for them just holding MY money, unbelievable.
This exact same thing happened to me. Despite every current friend saying, you are so smart why would you even considering putting money in Bank of America. This is a racket and i will file a complaint with the local police in Somerville, MA.
We have to get politically active on a local level to stop the Corporate Fascism that is taking over the US through PACs and the new January 2010 limitation lift to allow banks and other corporations limitless contribution rights to buy all future senators, congressmen, and presidents to insure this is only the beginning of the corporate fascism we can look forward to.
Yes, they, Bank of America, screwed me too! I opened the account, was given a temp bank card, temp checks, a BIG WELCOME package and told to make sure I activated my new card at their ATM before leaving. Well, now I am magically overdrawn by $65 on a $50 deposit that I had only withdrew $20 at their ATM to activate the card and drove across the street and put $20 in my gas tank.
HOW IN THE HELL IS THIS POSSIBLE?
Is this how they are trying to repay the BILLIONS they STOLE from the TAXPAYERS?

Incident = In February 2010 I contacted my mortgage lender Bank of America about their Making Homes Affordable Program in which I was solicited via the internet. I did call and inquire but was told I did not qualify. About 6 weeks later I receive a FED-EX package about the program. I called Bank of America and was told the documents were sent by mistake and to "toss them in the trash." That is exactly what I did.
On June 4, 2010 I noticed that $199.16 was missing out of my checking account. After looking through my bank statement my fixed rate mortgage had jumped from $424.17 to $523.75 in May of 2010.
I contacted Bank of America and was told "this is your new payment as we opened an escrow account to pay your property taxes and insurance for the Making Homes Affordable Program. I explained to 7 people over a 2 hour time period that I was not eligible for the program, never signed any documents nor submitted an application and have paid my own taxes and insurance outside of the loan since I first purchased the property.
The bank did admit that I did not qualify for the program but the escrow account had been set up and it could "never be terminated." "You will have to just live with it Mr Russell the rep explained." I told her my taxes are $199 a year and my yearly insurance is $250 but your withholding almost 1, 200 a year? Response: "well at the end of the 27 years we will refund you the difference". I then informed her that Bank of America fraudulently changed the terms and conditions of my loan without permission, my knowledge, or any signed documents. Response we do this all the time its perfectly legal for us to withhold for your taxes and Insurance. I stated my taxes are paid to date and so is my insurance, you cant legally raise my mortgage!
I explained to the representative that I may not even be able to pay my mortgage next month as Bank of America has funneled out $199.16 out of my checking account due to the "increase in my mortgage." Well Mr. Russell if you don't pay your mortgage, we will simply have to foreclose on you and have the Sheriff remove you." I explained to her I have a limited amount of money and pay my property taxes each year with a small bonus check I receive from work, my insurance is paid in small increments monthly and I cant afford a $100 monthly increase in my mortgage. The representative then hung up.
I called Bank of America back and basically was told pretty much the same thing after speaking with 4 more people and a supervisor. The supervisor informed me that he could "try to opt me out of the program"(could take months) you know the program I did not qualify for, and never returned any documents or applications I stated. He said yes sir that one. I demanded my $199 back (1/2 of next months mortgage payment) that Bank of America had fraudulently removed from my bank account via auto-pay. The authorization was only for $424.17 a month not $523.75 Response: its not possible Mr. Russell. Because of Bank of America fraudulently increasing my mortgage and illegally withdrawing more than agreed upon I'm sure I will have overdraft fees as I only have $9.00 left in my account.
It is quite apparent that Bank of America is committing blatant fraud in order to account for the TARP money they have received. If you are wondering why their numbers have increased by 70% in one month, allegedly enrolling more people in the Making Homes Affordable Program? This is how their doing it. I no doubt will loose my home as I will never be able to catch up or pay the higher unlawful increase in my mortgage. Mortgage loan # 8709XXX Did I mention my taxes, insurance, and loan payments have never been late!
