Acai Berry RIP OFF SCAM

ALL VIV3 LABS WANTS TO DO IS STEAL YOUR MONEY! THEY ADVERTISE FREE TRAIL, JUST PAY FOR SHIPPING. THEY STAND BEHIND "WEBSITE" INFORMATION THAT YOU HAVE TO CANCEL ACCOUNT. THE ORDER FORM DOES NOT APPEAR IN THE "WEBSITE" A MONTH LATER THEY CHARGE YOUR CREDIT CARD FOR FULL MONTH SUPPLY OF BOTH ITEMS OR $270.00 CDN. THEY DO NOT SEND ANY PRODUCTS JUST CHARGE YOUR CREDIT CARD. THE EMAIL ADDRESS HAS BEEN DISCONNECTED & THEY DON'T ANSWER THEIR PHONE.
THEY ARE THE MOST DISHONEST COMPANY I'VE EVER HAD TO DEAL WITH.

Hi!
Here is my story. Saw the offer. Understood it. Got the trial. Called the number on my bank statement (+ 44 [protected]) a couple of weeks later and...canceled. I know that probably won't make any headlines but that's it.

It took 30 seconds before an available agent answered the phone. I didn't wait that long to reach them on the phone and it didn`t cost me a cent.

All I can do is recommend that you do the same.

Same thing happened to me too. They say they give u 14 days free trial from date of order but samples don't come until after two weeks so by the time u cancel they will just charge u for it anyways. In the end it isn't even free. Do NOT buy anything from UK. Especially from VIV3 Labs.

Acai Berry Unauthorized Credit Card Charges

I saw an ad for a free trial of Acai Berry Cleanse. I followed the link from Weatherbug and filled out some information. I then cancelled it because I wanted to check on it some more before I committed to it. They had my phone number from what I filled out, so they just continually kept calling me. When I finally answered the girl (unfortunately did not write down her name) told me that it was just a free trial and all I had to do was pay for shipping and handling of $3.95, I asked her again so all I have to do is pay for shipping and handling? She said yes. I asked her do I have to call and cancel anything and she said no. If I liked the product I would have to call back and order. I said ok. She then asked if I would like to try the colon cleanse and I would just pay for shipping and handling. Again I asked her if I had to pay anything else and she said no, just the shipping and handling, that was it as this was a free trial. I just saw I had (2) charges for $87.13 on my cc and just received another order for which I was also charged $87.13 each plus $3.95 each shipping and handling. All of the charges have been by different companies. I called Customer Service and he said all of the information was explained on the contract I agreed to on the online ordering. I told him I did not order online and was never given such information. There was no instructions in the box explaining I needed to call someone. They were very misleading and false in their explanations. I am putting in a complain with my credit card company in regards to these charges. They did give me a return authorization for each of the bottles and said they would credit those last 2 bottles. Now I am wondering if I will really see that. Rip off...do not get involved with them. If they were a good company, they would not be using different company accounts when charging your credit card.

Yep, the story is all to familiar. I decided to take advantage of the so called, FREE TRIAL through an ad on MSNBC that was accompanied by a video featuring Katie Couric, no less. They also claimed to have the reccomendation of both Oprah and Dr. Oz. Same thing as far as the two charges for$79.62 (on the same day from naturedetox) and two charges for .99 cents two weeks earlier from revampdetox, and this was on both my business credit card and personal card. I orderd several for relatives on my personal card and several for independent contractors that work for my company as a healthy gift to start the new year! Fortunately one of them opened the box before christmas and told me that they'd been sent something called Colon Cleanse. However, i'd ordered Colon Zen, not Colon Cleanse! I called the naturedetox customer support line at [protected] and was told that they were the same product. I cancelled all of the "memberships" on the spot and demanded a refund and return shipping address. The first rep named "Kim" refused to give me a return address. The next three reps simply refused to offer a refund or to accept any return of the merchandise. I did some digging and found out that many of these distributorships are pushing variations of the same product coming out of Nicosia Cyprus. The links stemed from; http://www.google.com/search?sourceid=navclient&ie=UTF-8&rlz=1T4ADBF_enUS329US330&q=katie+couric+colon+zen and from here: http://www.top3coloncleansingreviews.com/.

I will pursue this to the end with the BBB, FTC and any other governing or regulatory entity that I can find.

Why isn't the FTC doing something about this. This is an illegal scam. Did you notice on the "Free Trial" any terms and conditions, I didn't and still don't. MSNBC, and all the other "SUPPORTERS" of how great the product is, should really think about who they support. I just got charged AGAIN. I'm not stopping here I have already filed a complaint with the FTC, and will file another one. How come all the other people here are saying the same thing, "We didn't see, read, or were told verbally of any terms and conditions". Risk Free Trial, means Risk Free or is my definition of it wrong? The stuff is crap, bet if I had it tested - which I might, there's nothing in it but fillers and crap. Colon Cleanse my butt, how about BANK ACCOUNT CLEANSE, Illegally.

DANGER, DANGER - Will Robinson. Stay away from this product and company.

The same exact thing happened to me, I am still fighting to get my 79.95 back! I don't know what to do! I don't know how to get my money back. I have called this place several times and argued on the phone with these people who barely speak english and keep telling me that they have refunded my money yet my bank account is still empty! How do I get my money back?

SAME THING HAPPENED TO ME!

I ordered Sept. 28. Estimated date of arrival Oct. 5th. It is now Oct. 17th and I saw that 79.95 is pending. I called and they told me that since my account was active for over a period of something like 19 days, they would go ahead and bill me for each month. I asked to cancel it and they thought they could be sly and just cancel FUTURE orders only and asked for a reason. I then asked to confirm cancellation of the 79.95 and he asked why?... WHY?! I had ALREADY explained to him twice I hadn't even received the trial and he thought he could be smart and just cancel future orders ONLY. He then told me that I could return it once I received the package and provided me with a shipping address which he didn't bother to spell out for me until I asked for him to clarify. He said "green" and I asked like the color? He said yes, but with an e after the n...Who would assume that green would be spelled any other way. He then was very vague on how to return and gave me my return code (which he said faster than I can type and I type 102 wmp) to write on the package that I now have to pay for and pay to ship. Turns out that my shipping had already been "received" at zip code that is nowhere near the one I provided. How can I return a bottle back and get my 79.95 when it doesn't even get delivered to me?!

I read this too late! I am having the exact same problems as these other customers. I too am out of a lot of money for getting a "free" sample and then being charged a monthly fee of $80.75. When I called to question why I was being charged for something I didn't order, I was informed that by ordering the free sample I had signed up for a monthly delivery of a product I still have yet to try. When I asked to cancel, they then proceeded to charge my $80.75 for my "free" sample because I cancelled outside the 14-day window. Is there no "better business bureau" or site to get these types of dishonest vendors off the internet? What a waste of money and time! Customer beware!

Acai Berry address

please do not use the address on the terms and condition page as means of contact or returns.THIS IS MY FAMILY HOME.we have absolutly nothing to do with trading planet ltd, viv3 labs or what ever they want to call themselves. we have only been alerted to this when a flood of letters and tablets came through the letterbox.believe me this has been reported to the police, trading standards, companies house and who ever else
that will listen. we are in the process of trying to find out who is responsible.
we are as shocked and sickened as the rest of you, who have clearly been ripped off.there is another address in the impressum section at the bottom of the page next to terms and conditions. it is 118 fines park, annfield plain, stanley, co durham dh9 8qz. the company is called lb cassiopeia media ltd this comany is legit and is regestered with company house but what part they play in this we do not know yet.the phone number underneath is also bogus as the country prefix is clearly not english.it is infact the former yugoslavia that no longer exists( it gets better doent it).if any one has any information please pass it on to the likes of TRADING STANDARDS etc as i think this is a very serious matter that concerns my family. if i find anything out i will post it. thankyou.

I initially fell for the intro offer for acai berry and colon cleanse, it was only when I sought to cancel them both because I simply didn't want the products I realised the contact details were either non existent or belonged to a person who had nothing to do with the obvious scam. I was immediately concerned that money would be taken as I had no way of cancelling the offer so I resorted to cancelling my card which is a nuisance but is a practical way of stopping them withdrawing money and getting a new card with new details. I would highly recommend doing this if you don't want to lose money in the future. Lesson learned on my part!

I was cought out by this scam by acai berry exclusive and they have had over three hundred pounds out of me, i am furious with myself for falling for such a clever scam but also furious with my bank because when i made them aware of this, they said they could not do anything about it because i had given them the card details (even thou the bank has addmitted to it being a scam) I have had to close my bank account down and by the way the only tablets you get are the trial ones, they then carry on taking your money but dont send you anymore tablets.

About 1 hour ago I got sucked into this whole entire acai bery/life cleanse scam and am trying to undo it if I possibly can.

Here are the problems I have encountered in the last hours:

1. When typing in my personal info. I typed in one digit on my home address that was incorrect...however I did not see this until after the order was placed.

2. I immediately tried to go to the customer service site to find out who to call or who to contact to rectify the problem...

3. I am from Canada and apparently this product is purchased from the UK.

4. All I could find was internation numbers...all of which do not go through once you complete the dialing...

5. Then I went back to the website that I ordered the product from and tried to re-enter my correct info...They requested that I fill out 3 of the 4 fields in order to re input the data...they ask for a confirmation number...I did not get one...

6..so with no confirmation number, no phone number, no website to file my complaint I have no found myself here in this venue...talking to all of you...can anyone help me figure this out long before the money gets taken from my credit card...Its obvious I want to pull out now before i get sucked in...thanks everybody...

I just order a product from the internet claiming to help people lose weight and cleanse their bodies quickly...it was called life cleanse
However, the problem starts when I realize that I have inserted one wrong digit in my address and wanted to change it...
I could not fine any help whatsoever in doing this transaction.
I called a number that was located in the United Kingdom and the operator tells me my call cannot go through as dialed..

I happen to live in Canada...I call the operator and she is unable to get through...in the meantime this company has my credit card information and I am not happy about not being able to trace them down...
they say one can cancel an order at any time, but I say HOW does one do this with no followup telephone numbers or email addresses...I will report this to my credit card company and my local police...this is a scam...

Oh by the way...I later find a number in the U.S...they tell me that Canada cannot get this product delivered to them...I find that interesting...they've got my credit card information...Can anyone help me...

Acai Berry Want a full refund because of deceptive practices

I ordered a trial bottle and 3 days after receiving it, my account was charged $83.95 on 9/12/09. There is no time to test this product and I find this to be a deceptive practice.
With this product, I also ordered the colon cleanse, which I never received but paid $4.95 for shipping, and was charged another $83.93 for this on 9/14/09. The company is refusing to give me a full refund after speaking to a rep by phone. I also tried to reach the company by email and the system is so backed up that I cannot get my mail delivered.
These two companies are one in the same. The second phone call I made had all the information from my call for the previous procuct.

everyone is being ripped of here. I think watchdog should investigate the so called T & C which they only state once you have put your payment details in. This is a rip off and its supposed to be a FREE TRIAL. Surly that is not legal promoting something which is not true at all. The trial is NOT FREE, they charge you after 15 day.
As soon as you place your so called FREE order, call them on +[protected] and have your order number ready and cancel otherwise you will be charged.
These are Con men so be ware and DONT order from any online. We can easily pick up these things from Holland and Barretts or any other health shops. These products are easily available. I will be wring to Watch Dog. Please join me and e-mail them too.

I just realised that its nearly two weeks since I ordered the acai berry and that the guarantee states that I have only 15 days from the date of order, not the date of receipt, in order to evaluate the product. As it hasnt actually arrived yet this presumably means I can be charged even though I havent received anything.

Acai Berry scam

I singed up for a free trial of acai berry and life cleanse, I was then charged $au146.54 for each (a total of $293.08). 9 days later I was charged a further $au145.88. I called to cancel and so far no further money has been removed from my account.
The acai berry product is not what it claims to be. It contains high levels of caffine.

One further complaint I have is that there is a direct link to this scam at the bottom of the complaints page. I think this is defeating the purpose of the complaints process. This company has been proven to be fraudulant and yet they are still permited to addvertise any where they wish.

Acai Berry Contact info. to reach Viv3 scammers

I have been scammed like all of you for the 'free sample' of Acai Berry and/or Life Cleanse.

I have scanned through all these posts and compiled the below list of email addresses, phone numbers and websites to write and complain.

*I have called 3 times today (the 416 number below) to no avail
*I called my bank (in Canada) to cancel my card and was advised they can keep charging me even with a new card # (it's considered a 'subscription' and the vendor and banks have 'agreements')
*I wrote (and will send by registered mail tomorrow) to the below addresses, the same letter demanding a refund, cancellation of the 'subscription' and confirmation that I won't receive another charge ever again.
*I am going to email these ### every.single.day (even to the addresses where it bounces back) until I get a refund. The squeaky wheel gets oiled!

The company goes under many names. Write/call them ALL!

I will come back and post the outcome of my barrage of letters/emails and phone calls.

Here is my story: I was charged on August 13, 2009 $13+CDN for shipping/handling for Acai Berry and Life Cleanse and expected no other charges. August 31, 2009 I was charged $133.11 TWICE (once for Acai Berry and once for LifeCleanse). I have demanded in every email and letter a cancellation, a full refund and confirmation that I will receive no further charges.

Read the below and get writing/calling!

Best wishes, everyone!

P.S. I would like to add that I think it's deplorable that this site, Complaints Board dot com would allow ads (very similar to the one I responded) on their website. These are the very scammers we're trying to avoid!

I received an (almost) refund today!

They initially charged me the shipping; the tablets arrived, then they charged me the whopping $266+ CDN. After my bombardment of emails and their response that I would receive a refund, indeed it was credited to my credit card overnight. They did, however, only refund me the $266 less shipping. In essence, they charged me for shipping twice. In total, I am out ~$30, but I'll take it!

I got my refund by bombarding them with "I want a refund" emails; 15 or more per day every day for probably 2 or 3 days. I told them in the email I would bombard them every day until they gave me the refund. Eventually the "you will receive a refund" email arrived. Total time from scam huge charge to refund was about 3 weeks so be persistent!

Good luck everyone!

Small victory.

I received the below email today. As a result, I called my bank to see if indeed the refund was there. It was not, but I was advised it can take up to 5-business days for it to appear in my account. I acknowledged the email telling them the above, and that I will confirm with them once I have confirmation of the refund. I will let you all know if indeed I get the $$ back! Best advice, hammer them with email after email demanding a refund. I wrote to every email address at least 5 times a day, in addition to registered letters to the above mailing addresses. Good luck everyone!

I received another email from another one of the email addresses I bombarded yesterday. It was from Local Billing who said they have nothing to do with Viv3 (BS!).

The email address it came to me from is: support@localbillinglimited.com

The link to 'customer support' information included in the email is: http://viv3.com/ This site also references the "30-day return policy", so keep writing and fighting everyone!

Spoke with their customer service agents today(oo33173045299). It was fine. They canceled my order. I still don't look like a hollywood celebrity but hey...I also don't have a full time yoga instructor, make up artist, driver and team of personal assistants. Still buying lottery tickets :-)

Acai Berry scam on terms and conditions

I've just been reading the various posts here regarding the scam by viv3 to charge "free trial" subscribers credit cards every 30 days if the 'subscription' is not cancelled by telephone. This has prompted me to consider the technicalities under which this 'agreement' must surely be broken? When subscribing to or purchasing any product online, the 'terms and conditions' are prompted in an information box whereby the subscriber/purchaser must agree to accept those conditions before proceeding with the purchase. This has not been the case for viv3 which means those who availed of the free trial did so in good faith and were never given the option to accept their terms and conditions - one being that they will not refund customers who seek a refund in "bad faith". Therefore, surely since in bad faith they declined to give those free trial subscribers the opportunity to accept terms and conditions, they must provide a refund in good faith? I will be cancelling my subscription by telephone first thing tomorrow and if they have charged my credit card, I will be pursuing a refund under the technicality that I never ticked any boxes to agree to their terms and conditions of purchase in the first place.

is it just me or is it disgusting that this complaints website is running ads for Acai Berry in between posts?

if the company doesn't stop billing, have your card number changed. make sure you call the company & get cancellation numbers so if they do manage to keep billing, you can do a chargeback on the transaction with your credit card company. get the name of the agent you speak with, a cancellation number, their employee number, the actual name of the company they work for & also ask for an email (but don't hold your breath for it). oh and don't yell at your bank about this - it's not their fault.

Jennifer,

I was in touch three times today with viv3 talking to their customer service about the $266.22 I was charged on August 31, 2009 for their supplements. Customer Service is useless! I only found their number by copying the charge from my online credit card statement, entering it into google, and coming across THIS site with all kinds of complaints against them. I didn't even know the company's NAME before today. Order a free sample online, pay for shipping, sounds legit to me! What a sucker I am!

On the phone with them today, 3 times I said I was charged for something I didn't authorize and 3 times I was told that I needed to have cancelled within 15-days of the online order being placed. What? Where was that written? Where did I agree to that? On here, I learned their customer service # and a link to their customer service statement which says you have 30 days to get your money back. I'm within the 30 days so I want my money back.

I keep getting the runaround.

VISA is useless.

I can't afford $266 a month to a scam company!

Surely someone should be able to help?!

Acai Berry False advertising

I found an article, Health News 6: Acai Berry Exposed" that looks like legitimate Health News. It starts out as being skeptical of Acai berry and Colon Cleanse products, then ends up selling them. DON'T BELIEVE IT. I can't find any info on the name of the advertorial or the staff reporter who wrote it. I've been scammed by XM Brands, Inc. and am an advocate for exposing these crooks.

I totally agree! I HAVE NEVER ORDERED ANYTHING ONLINE MUCH LESS A DIET AID. However, as the complaint above says, using a major network as a reference stating they gave it their stamp of approval was the ONLY reason i agreed to try it. i had no intentions of continuing with any future orders so i cancelled it as soon as i got the package. i got my order in about a week and made sure to cancel it within 14 days (was 9 days). actually got a human on the phone. shocking. did the same cancellation as above. i agreed to send back the empty bottles...whatever...a few bucks to learn my lesson to NEVER order online! I immediately called my credit card company to put a hold on my credit card so that NO charges will go thru. again, another inconvenience to learn my lesson. i could have gone thru the dispute after the fact with my credit card company but i was trying to avoid it and deal with it before any charges came down. let's see if i'm successful. how sad that they were allowed to quote and use the misrepresentation of the networks to lure people in. absolute losers!

I too read the Health News 6 Acai Berry story fell for it. There was a discount code number for shipping, etc. I did read what I thought was all the fine print under offer details which stated you had to cancel within 14 days of ORDER date so I don't know how you would even have time to try the product and then cancel. It also stated the Pedometer is mine to keep for free as well as the Lean Spa Cleanse. In any event, it is very deceiving as you don't realize the product you get to keep is in addition to the product you ordered. Apparently there was more fine print somewhere else, but not on the order form where I was told it was. I did manage to get a customer service rep and she gave me two choices: Return the product and pay the return shipping or do their "Easy Cancel" where you have to pay another $19.41 on your credit card. Since I didn't even have the product yet, I was afraid I wouldn't have enough time to return it in the 14 day window and then they would start charging me the $80 or $90 everyone else is indicating. I think that this is very deceptive advertising and this company should not be allowed to use a news station to SCAM customers into buying there product. Since the company has to trick people to buy their product I can only assume that is not any good. I regret that I did not do more research and would never have fell for it had it not been for the bogus News 6 anchor that lost all the weight.

Scam artist alert. OMG, what is with these people? I misunderstood the terms? I think not. I was smart enough to PDF the order form prior to my submitting and had to read to 3 different representatives what was written in the "Offer Details" section. They've taken out $99 from my checking account, I haven't received any product, and I'm told I'm not reading the offer correctly. So, now I have confirmation numbers on both cancellations and we will see what happens. DO NOT PURCHASE THE PRODUCT AND GIVE THEM YOUR CC INFO. I suggested to "Charleen #471 - the floor supervisor" to locate a new job as her employer is not on the up and up.

I have been swindled for the last time. I'm one of the unfortunate people that read an article on News 6 Chicago advertising whether or not these products work. They recommended a free trail for both the cleanser and Acai berry for a shipping price of about $3.00 for both. I did not receive the product in the 3-5 days it stated and thought nothing of it until I received an email alert from one of the products stating I was to be charged $169.99 for a year subscription and NO REFUNDS. Reminder that I still did not have the product. I right away responded I wanted my money back and to cancel whatever it was they call a SUBSCRIPTION. After review of the email it also stated you have to pay an additional $12.00 for each time you need a new bottle. What kind of scam are these people running here? I'm seriously in need to loose weight. I'm well over the weight I should be according to my height and age but trusted that this would work. I have tried repeatedly to request a refund and I am told I can keep calling to speak with a supervisor. Apparently everyone at the refund center is a supervisor. That says a whole lot. Oh and by the way, the Acai Berry product is from the same company as the cleanser but of course you have to cancel that at a different number too.

J& M Fullfilment in Roselle Park, NJ and Fullfillment Center in Atlsnta sent me ACAI powder and Cleabnse ProX . Before they sent thiese products they called and asked for someone who doesn't live here. The products were sent to that person. I never ordered or heard of the person to whom these products were sent to at my address. They charged my Visa debit card. I had to cancel it and gom through a rigamarole with the Bank of America fraud dept. which is still going on. I don't know yet if I will get my money back. Another company called PureMeds in Decateur, IL also sent ACAI pills. These three companies must be the same FRAUDSTERS under different names. I don't know how they got my debit card number and my home address and telephone number.

As many others I have since discovered with this company, the 30 day back guarantee is falsely advertised and is really only a 14 day guarantee from the day you order. If like me, you don't receive the product for 10 days, you only have 4 days to evaluate the "wonder" product. The customer service is ridiculous.

I ordered the "free" trial of AcaiBerry. All of a sudden I received 2 more bottles of the product and charges worth $209.85 on my credit card! When I called to see what was going on the woman told me that I will keep receiving the product until I cancel the account. I told her consider it closed. Now how do I return this and get my money back. She stated that I could put all 3 bottles in the same package and send them back to one address. She gave me 2 RMA numbers and that was it! I sent the product back with a USPS tracking number that way they would have to sign for it.

I received 2 of the 3 refunds.. So I called their 1-800 number again and they told me that yes they received all three bottles, but because there was not 3rd RMA number they would not give me my money back!

I asked how this was possible since I returned all 3 bottles unopened/unused and the woman basically told me that it was my fault I didn't get all 3 RMA numbers and it was just to bad and I was out of luck.

This is so UNACCEPTABLE. The product was unopend/unused and returned and I still did not receive my money back.

Is there anyone out there that can help?

Thank you!.

Ordered the product and forgot to cancel within the 19 days. Received 4 more products within the first 30 days of ordering, which I returned although not with an RME #. I had received a phone call initially to verify my order and was told that I would receive a packet of information about the product. I never received anything. When I called to cancel and request a refund I was told that thy would not refund my money without an RME # and denied calling. in addition, the 4 charges on my credit card all come from different companies with different phone numbers. I asked for an address to send a letter and was told to send it to the Shipping Manager and that no other information could be given out due to security reasons. I ordered my FREE sample thru "mydietmaxcleanse.com". They charged my credit card $87.49 plus S&H. Cost me a total of $97.29. Big price for a FREE sample. I even filed complaint with BBB of Chicago/Northern Illinois. May send letter to Nutrimax Labs, Inc in Hollywood Florida. This a rip-off, scam, and false advertising. Acai Berry Fraud

When purchasing this product, I was told I would receive a 30 day free trial. I never received the product but was charged $88.64 seventeen days after they supposedly delivered. Two weeks later was charged another $88.64. When I called the company they told me that as far as they were concerned, I had received the product. When I insisted that I did not receive the product, I was told that they would not refund or resend product because I had the option to cancel within 30 days. I asked him how I could have known whether I liked the product well enough not to cancel if I never got it. I then pointed out that I was not even given the 30 days before they charged me.

After getting nowhere with this person I asked to speak to the billing department. According to this operator, the billing department had just moved and did not have a phone number.

When I asked to speak to a supervisor, I was told that the supervisor was out. When I pushed the issue, he change his story, and I was told the supervisor was helping other people. I told him I would wait. The operator put me on hold where I stayed for 20 minutes.

At this point I was not sure what to do. I went to my bank and filed a fraud report. I had to shut down my ATM card, but at least they will not be getting anymore of my money. My bank told me that they would reverse the charges unless this company could prove that I agreed to pay for it. I said "Of course I agreed to pay for it. But I never received anything." At this point I am in limbo without my ATM card.

I then went to the post office and filed a mail fraud report.

FRAUDELENT COMPANY! Do not even try to justify this complaint Jonathan (Acai BT customer service mgr.)

This happened to me too...

If this has happened to you, you need to DISPUTE THE CHARGE, THEN CANCEL THE CARD YOU PAID WITH!

I ordered this product because a popup appeared for a free bottle, had no idea we would get more and be charged, the first charge was $89.45(00.71 International Banking Fee), the second was $88.74. When I tried to cancel, they said we did not read the fine print that says, you have 14 days to cancel, so we have the 2 brand new unopened bottles, they will not take them back or issue a refund, I feel so helpless and frustrated.
When I asked for a Corporate number they said it was company policy that they could not give it out, I don't feel like that is true. I told them I would call back everyday.
I went back to their website and it is down the message says, they are currently not taking new orders, yeah I bet!
Please do not be taken by this company, they are taking advantage of anyone they can.

I first found Acai Berry Trpoic in October. I was online and saw that they were offering a free trial. I signed up for the free trial and agreed to pay the shipping for it. After I entered my Debit card information, I noticed that the small print said that they would bill my account $88.64 unless I cancelled within 2 weeks. I immediately cancelled the account. When a customer service representative called me to welcome my new account I told him that I did not want my account to be billed for the monthly amount of $88.64. He told me that he would cancel the account but just to be safe I should also send an email. He gave me the email address and I emailed them the Cancellation request. I never heard anything back so again I sent a "Cancellation Confirmation". They responded and said that the account had been cancelled. After that I noticed that my account had been billed the $88.64. I have been fighting with Acai Berry since October and still have not received a refund. I did receive the "free trial" but still have not received a refund for the money they were not supposed to take. They sent me numerous emails saying that the money had been refunded and that the funds were initially declined by my bank. When I took pages upon pages to my bank, they said that was not the case. They would never deny funds being refunded. I am from Idaho Falls and currently have an add in the local news paper to find other people that are in the same situation.
Every time I called Acai Berry I was also assured that my refund was being processed and that I should receive it within 5-7 business days. I have pages upon pages of email between myself and Customer Service and myself and Billing. They say the same thing everytime! They defintiely are a scam. Be aware, all of these statements are true! It has happend to me too!

Hello everyone,

here is a letter I sent to the BBB, it basically sums up my entire situation with this company. They are completely a scam and I'm getting hit hard from them. They claim if you call they will resolve the situation but they wont, since the only way a bank will go after the company is if they give IN WRITING a statement saying they will offer a full refund. However, this company refuses to do anything of the sort. They tell you to e-mail their billing department, and 5-7 business days you will hear back. I've called several dozens times and spoke with the following reps: Mark Davis (Supervisor of call center), Adrea, Carlos, Alexa, and Laurie. Each time I go through the same circle:
1)call back with Chase (my bank) on three way call. Once you do, Chase doesn't talk much but writes all the notes down in their system regarding whoever the rep is claiming they will offer a full refund. They refuse to send an e-mail to chase or you, and ask you to contact their billing dept over the refund.
2) You e-mail the billing dept, and hear nothing back. I proceed to ball continously and complain and request proof they have my e-mail and a refund will be issued. What I get is an e-mail from Customer Care stating they received my e-mail. Nothing else.
3) I call back furious but calm, and once more am told I need to be on a three way call with chase. I've also been told they never received my e-mails and I never previously called three way with chase (Despite the fact CHASE is on the line telling them otherwise and I have the e-mails in front of me from their company).
4) Repeat all the above steps.

I've lost all hope this matter will be resolved. The best I can do is go to sites like this and hope others are reading this and learn before it's too late not to deal with this company. If anyone knows of any legal action being taken against the company please contact me (Drakelb@gmail.com). Listed below is my letter to the BBB. I strongly urge everyone to contact the BBB regarding this company.

"Hello,

My name is Jeremy Scully, and currently I am in a dispute with an internet company called Acai Tropic Berry. The issue is revolving around a need for refund of $88.64. The history behind the problem is as follows:

I originally made a purchase online through their website for a free 14 day trial. I never recieved their product and attempted to contact them for a refund of my money. I proceeded to call various numbers, one from their website, and the numbers on my bank statements associated with the debits. None of the numbers were working or even for their company. I then was debited twice for the amount of $88.64 along with other chargers I never agreed to. I immediately called my bank (Chase) and issued a claim. The company Tropic Berry had their billing dept contact me and threaten to hurt my credit since they could no longer debit my account. The e-mail was a noreply e-mail, but I tried to reply anyway. It also stated to contact their customer support e-mail. I contacted their customer support and was bounced back with a "MailerDeamon" (The e-mail they gave was bad). Eventually the claim was almost completely won, there was an amount of $88.64 that my bank Chase claimed the company proved was a true debit. The proof Acai Berry Tropic used was the fact they had my credit card number on file and information. I claimed that was obvious since I originally made the purchase using my credit card, but that I never approved of the $88.64 debit. Since that time I have had several three way phone calls with Acai Berry tropic and Chase bank. Each time Acai Berry promises over the phone I will receive a full refund, each time Chase bank adds this to their notes, each time I am told to e-mail the billing department at ACAI Berry Tropic requesting this refund, each time I receive a customer care e-mail telling me they have received my e-mail and are processing my request, each time nothing happens. Chase is unable to go after Acai Berry for any refund until they get something physically in writing stating from Acai that a refund will be issued. Acai refuses to give anything in writing stating a refund will be issued. It seems i'm stuck and there is nowhere for me to go. Acai is smart enough not to give in writing anything of a promise for a refund, and Chase refuses to do anything on my behalf until this company submits something in writing.

Please tell me there is something the BBB can do to help me? I feel I'm not the only one being hurt by this obvious scam. I never recieved the items in question, I was billed for items I never agreed to be billed for, and now no one will help me. I understand the concept of buyer beware, but this really seems outrageous. How can a company promise a bank a refund and then just never give it and get away with it? Wouldn't every company in the world be doing this? please, any assistance would be greatly appreciated.

I have copies of the bank statements, the e-mails between myself and Acai Tropic Berry. Chase has all the conversations logged into their notes (I'm not sure if I can get a copy of that but it should be accessible).

Thank you for your time.
Jeremy Scully"

Also note that you are automatically signed up for FuelMax Magazine and other offers. When you call to try and cancel these offers you will not be refunded.
When I placed my order online for the berry a girl called me a few minutes later from Berry Tropic Customer Service Dept. to confirm my order. On the phone I know I specifically told her I didn't want to be signed up for any other "trial", magazine or offer. She said "I'll put you down for a NO!" Well now I just paid FuelMax Magazine $33 that they said can't be refunded.
This is the same for the Vital Cleanse "free trial."
Sorry we all got dooped. "We try to make our terms and conditions very clear..." sure you do Joe C., I'm sure you hate it when you trick people out of their hard earned money.

This company is a SCAM. My credit card has been charged $79.95 three times, plus $3.95, plus .99, plus international fees and I have no product to show for it. I call every month for a refund, the last two months they said I would receive and this month they said I will not see a penny...I didn't read their fine print. Their customer service representatives (hannah and Trey) both said I would receive the refund; however, now none. I hope this company pays for all of their wrong doings.

Wow..the same thing happened to me! I sent back the unused portion before the 14 days and got charged, I called to cancel and a few days later got charged again. I called and complained(also waiting on hold for many minutes)and within a few days they removed the charge from my account...only to debit it again causing an overdraft. I filed a complaint with them and was denied a refund for both transactions. I also tried calling several of their toll free #'s but all of the voice mail boxes were full!

Acai Berry free trial offfer that can not be cancelled

To whom it may concern,

I ordered a free 14 risk free trial of effective cleanse antioxidant consisting of 1 bottle of Life cleanse and 1 bottle of Acai Berry detox from "Trading Planet Ltd" and I understood the terms and conditions to be that I would be automatically entered into monthly plan billed to my submitted credit card UNLESS I cancelled within the 14 days specified for the free trial offer. It seemed straight forward so I ordered online.

Then I read the fine print on the confirmation e-mail I received and discovered that it was from the time of the order, and not time of receipt of the shipment. It was a red flag that the product shipped from UK and while I was concerned that something may be amiss, I decided to wait for the order to arrive, provided it was well within the 14 days before pushing panic button, as I felt there would still be time to call number provided and cancel.

I placed the order on 23/08/2009 at 09:49:13 EDT and received it today - Tuesday Sept 1 2009. That meant I had only 3 full days left to try the product, as I also discovered the business hours only go monday to friday - so weekends you can order the products but not cancel.2nd Red flag. I got more worried after opening the package, and discovering there were no instructions other than an invoice thanking me for the purchase. I then went to research the product more thoroughly and discovered that many people have been scammed by this specific company (not all acai products are created equal it seems) and the people who ordered from Trading planet Ltd (life cleanse /Acai berry detox free trial offer) could not opt out of the plan, esp after the 14 days expired and so I felt I should not wait, but call the CDN number provided to see if I could cancel BEFORE the expiry period, just to make sure things were on the up and up. To my horror, the many numbers provided on the receipt were ineffective, or inactive and when I finally did get through to a human being after several phone numbers recorded messages or being given new numbers to try, I was informed that all the information I gave the responding agent (that is my order ID, customer # date of order, my name, my address, my postal code, ) was insufficient to cancel, and that apparently I was not in his system, as I was a Canadian client and he handled only UK. I tried to explain those numbers did not work and his was the only one to which I had been led to. All the agent (who had a pronounced Indian accent) wanted to know from me was my credit card info, and this set off a new red flag so I refused to give it to him, having given all the relevant details of my order and told him my only desire was to CANCEL my order immediately. he said he could not help me so I then said it sounded more and more like a SCAM and that perhaps I should report the company to the RCMP fraud squad where in he said he could not help me and he hung up the phone.

I then did more research and found this link and decided not to wait, but report my experience right away. I want someone to know that I tried to cancel well BEFORE the 14 day deadline ended, so if I have to take legal action I at least have some record of trying to cancel the order and reporting the scam officially.

Thanks for your help,

I have experienced the same problem! I ordered the "free trial" and tried to call the numbers available - on web, and my credit card statement - and to no surprise, they were not in service, I called 00 to speak to an operator and find out the company phone number, and she said there was no such company at no such address. I spoke to my credit card company and made a claims dispute as my 14 day trial period was over and after discussing it with credit card customer service there was two more charges on my card each for $129...ouch...right before christmas! I have notified my credit card company and hopefully I do not receive any more unwanted charges! ISo, Rizza blue 06 - that is why we all SEEM to have so much trouble to cancel - ts nice for you Rizza blue 06 to have had a great experience, however, I beleive you are the only one of a few mislead, and honest people! thank you Ex-Local Billing for sharing this important information with us, it is greatly appretiated!

I too am a victim of this scam; I ordered a free trial sample of 2 products at the beginning of September last but received nothing (was busy so did not check) then this week I received, totally unsolicited, 2 packets of pills with invoices amounting to £166; since I had not had the samples I was unable to read their blurb, small print or otherwise and agree that this must be regarded as a non contract; I did manage to speak to someone and told them I was appalled and would take this further so they have promised a refund but I'm not holding my breath yet. Has anyone posted this on Facebook, Twitter or similar?

Acai Berry unauthorized use of credit card

I signed up for the free trial offer for s&h charges. I received the trial size bottle, and tried to contact them to cancel and they just kept pretending they could not hear me and hanging up. They say you have 14 days to cancel but by the time you receive your trial bottle you credit card is already charged. I caught two of the charges and had my bank dispute them. The third charge i did not catch until after the 60 days that the bank will help you. I lost 88.55 and it makes me sick. If anyone has any idea on how i can get this money back please let me know. Also the product does not work. The company has several websites and several phone numbers.

What a ripoff...you get the free bottles, pay $3.95 for shipping and they charge you almost $180 before the free trial.
And good luck trying to call and talk to them..they'll hang up, claim they can't find you in the system, you call back and it starts all over again.

I had to cancel my Visa card because they just billed me again! i am sick over this!

Acai Berry Money taken out of our account

I have just checked my emails and I placed my order for the FREE TRIAL of Acai Berry Detox and Life Cleanse on 27th July 2009 (that is the date of the confirmation email I received). Like everyone else I paid the 2 lots of £3.95 P+P (by debit card) thinking that was that.

I always look out for those '15 day cooling off period' clauses and if I see it I don't order because being so busy things like that can get forgotten about - but I couldn't see anything like that and I thought I could trust it as it was a huge animated advert on MSN Hotmail, there wasn't any mention of the astronomical original price either so I went ahead and placed the order.

The orders arrived whilst I was on holiday and I thought no more of it. To be honest, I didn't open them immediately and have only actually taken 1 dose of each type because just taking that gave me tummy ache so I left the rest but you think 'well it's worth trying' don't you and you haven't lost too much ... that was until today.

I came home to find 2 packages that I didn't order and when I opened them my heart sank. Each one was accompanied by an invoice / receipt for £82.95. I immediately phoned the UK Toll free number and spoke to a lady I could hardly understand. I told her I was incredibly angry that this huge amount had been taken without my consent - her reply was that I should have read the terms and conditions.

I said I didn't actually remember the terms and conditions being pointed out to me or made clear and she said she would cancel my account. I said to her twice "so I will be fully refunded almost £166 won't I" and was told I would be and I would also be sent an cancellation confirmation email in the next 72 hours. I'm waiting to see what it says.

I phoned Consumer Direct who weren't particularly helpful ... who's side are they on ! I also phoned my bank to see if the money had been taken from the account. I was told that monies were earmarked but they couldn't tell me to who they were going until they have gone out/been claimed which I think is an absolutely ridiculous way of dealing with things. So, it seems that I will just have to wait and go through what everyone else has gone through but I will certainly never buy anything like this again.

I feel sick, stupid and very upset.

Emma

I am having the same problem with these people. They have taken $163.95 of unauthorized payments from my checking account. I received the product on September 28, 2009 and they started taking $ out of my account on Oct. 07, 2009. I called them regarding these charges and to cancel. They refused to give me a refund. This is definitely a SCAM that needs to be addressed. Do you think that we could file a class action law-suit against this company to get our $ back and to prevent them from scamming more people? Thanks, Bre

Acai Berry Scam vitamins

Legitmate looking advertisment on Hotmail advertising side-panel, looked at their 'comments' from CNN news and other high profile newsmakers promoting product. Figured it wouldn't hurt getting a trial size of the recommended products, but the ad also connected another product to it stating that with both it "really works". Went on site 26th August(Wednesday), ordered product with Visa. Site said it would send me an email acknowleding and confirming order. They promised delivery within 2 - 3 days - had an Alberta outlet via Scotland. Site - which, to date (Aug 31/09) never arrived to my emailbox. Also notice that the ad is no longer on the hotmail side panel advertising as well. I never accepted their terms, especially on something on a trial basis. My VISA was charged for products on the 27th. I had no way of contacting them to stop order because of no acknowledgement via email. They have no email contact address, only a toll free # that can be used in the UK. Called VISA to rectify charges Aug 31. NEVER, EVER, order anything on line unless you check them out on-line thoroughly first - that's what my daughter tells me. IF their product does arrive -it will be returned - address unknown.
