After years of visiting Vidanta properties as guests of a member in Mexico we went to the Puerto Vallarta property. We were staying in a Luxxe property when we went to a presentation for purchase. We were willing to consider a purchase and told the sales person Dean that we were only interested in a Luxxe property. He offered us a property called the Grand Mayan Luxxe. He proceeded to sell us on the renovated beach front property with ocean views, private pool and Luxxe status. We purchased this property. It was supposed to be ready at years end but on our next vacay January 2023, it was not so we had to pay extra to stay in a Luxxe room. We were told that the Government was requesting additional work. Etc and that Covid was delaying work. We accepted that reason. In Mid 2023 we booked our 2024 vacation and were told it would be ready by October 2023. In November we asked of photos and info but were told that weren’t releasing that yet. We were now very concerned, checking the website for updates which there were none. We called again a month before arrival to confirm building was done and that a pool was complete, we were told it was. When we arrived January 7th 2024 we were greeted by anxious staff telling us that we were not getting ocean front, and there was no pool. We were told that there had been alot of complaints and that our input into changes was appreciated. We were then shown to our new Luxxe property. Wow, what a joke. Building is 20% complete. No balconies. Definitely not Luxxe! After refrusing to stay in this room/ property we were put in a Luxxe room. After a meeting the next day to resolve this problem we were offered a 840k new build! We were told that we shouldn’t have expected them to renovate a 20 year old building into a Luxxe Property! Staff were calling it Delux not Luxxe. They told us they could not address the problem but could offer us a 200k upgrade!

We were sold a false property. This was fraud! We asked to have the contract changed to a Luxxe room but they refused.

We only wanted the same level of service and accommodation that we had before.

Claimed loss: 40k

Desired outcome: A Luxxe Loft contract to replace fraudulent sale
