I have been a loyal TK Maxx customer for many years and have purchased numerous pieces of jewellery from a variety of brands without any issues.
Given that I have only owned this particular item for a short time, I am extremely disappointed that it has developed a fault so quickly. I believe this indicates a manufacturing defect rather than normal wear and tear.
Based on customer feedback and comments made by staff at the Wood Green branch, it appears this brand has received similar complaints from other customers, suggesting an ongoing quality issue.
Under the Consumer Rights Act 2015, goods must be:
Of satisfactory quality (Section 9),
Fit for purpose (Section 10), and
As described (Section 11).
Furthermore, goods must last a reasonable length of time, taking into account their price, description, and intended use. As this necklace has become faulty after only a few months, it clearly fails to meet these statutory standards.
Additionally, under the Consumer Protection from Unfair Trading Regulations 2008, retailers are legally required to act with professional diligence and must not mislead customers regarding the quality or expected durability of goods. During my visit to the Wood Green store, I was informed by a staff member on the jewellery counter that I should have purchased the necklace with the expectation that it would not last long, and that I was lucky I even got a month's use out of it! This is an unreasonable and unacceptable expectation to place on a customer. If goods are known to be of poor or short-lived quality, that information should be made explicitly clear at the time of purchase through a disclaimer or similar notice otherwise, this could be considered misleading by omission under the regulations.
Given these points, I believe TK Maxx has not met its obligations under the Consumer Rights Act 2015 and related consumer protection legislation. I would therefore like to request an appropriate remedy, ideally a full refund or replacement in line with my statutory rights.
