Wells Fargo holding repair claim check hostage

My insurance company (Progressive) said I could go anywhere I wanted to have my car repaired and wrote the check to me and Wells Fargo. I arranged to have the car repaired. When the car was done, I sent it to Wells Fargo (endorsed, as requested) with a copy of the quote, the invoice and a letter of satisfaction. I waited until the car was done to send the letter because I didn't want to send a letter saying I was satisfied until I saw the repair. Wells Fargo deposited the check a week ago.

Then, Wells Fargo said they wanted a letter signed by my mother - the co-signer. Then, the repair guy had to send a different invoice because he gave them his address verbally over the phone and it didn't match my letter. Then, they decided it was fraud because my letter and his didn't match and they don't pay labor to individuals so he had to send a third invoice along with a copy of the business license.

I told her the car was repaired - did she want pictures? Or perhaps a letter signed by my dad or a grandparent? When I asked if this was all that was going to be needed - yes or no, so I can get my car back, the CSR told me that she "told me what I needed and if I kept this up, the repair guy was going to have to send the receipts too... " When I asked if she could give me a yes or no answer she hung up on me. When I called back, her supervisor said the same thing. I have called the repair shop again. I have sent another letter again. I have no confidence that they will ever release the check or that I could get my car back ever. I have never been so unhappy with a lendor in my life. They have no customer service skills - they change the requirements from day to day and then, when you struggle to comply, they accuse you of insurance fraud. I will never finance another thing through Wells Fargo and I will tell everyone I know that they are the worst excuse for a company I have ever seen. This is exactly why everyone should pay cash for everything. If they needed customers worse than we need them, we might get some service or respect. I am paying them good money for the "privilege" of a loan through them. I don't need this kind of "privilege".

I think they create these delaying tactics so they can earn the interest on the funds. If my money and yours are combined, I bet they make millions on this over the course of a year. And the sad thing is, it's legal. They are entitled to make their own ridiculous requirements because they are the "lienholder". I will never again let anyone have this kind of power over me again.

Wells Fargo unapplied payment / refi payoff

I am in the process of refinancing a mortgage I have with Wells Fargo with another bank. In order to do this, I need a payoff letter from Wells Fargo, showing the proper amount of principal and interest due them in order to close on the new loan.

I found out last week that Wells Fargo mis-applied a mortgage payment I made for the previous month showing that I owe them thousands of dollars more than I actually do.

As soon as I became aware of their error, I called customer "service". After 3 hours of speaking with a half dozen different people, I finally found my way to one of their senior supervisors who told me to fax over the cancelled check to a specific fax number.

When I called the next day to make sure it had been received, I was told that the dept. whose fax number I was given was not the right dept. and to fax it over to a different number. I did this immediately. since then I have been trying to resolve this to no avail. I was PROMISED i would have a new payoff letter this morning, then again by noon. Time has run out to get the new mortgage documents in time for closing. When it came down to the wire, the latest batch of supervisors I've spoken to claim they are powerless to do anything except "wait until the system updates" to get a payoff letter that shows the proper amount due to them.

I have a couple of choices. I can delay the closing. If I do this I will have to resubmit my financial documents and start with the approval process again. Or, I can go ahead and close with the higher payoff amount, have to pay Wells Fargo several thousand dollars more than I owe them (out of my pocket in addition to closing costs) and wait an unspecified amount of time to get back my money. Either way I lose.

How is it that banks can get away with this?

I have the same problem with Wells Fargo. They are such a bad liar cheater.
I will definitely not going to do any businesses with Wells Fargo, and i suggest people not to do business with them, they will trick you with any ways they can, just to get more money from you.
The customer service is sucks and rude too.

on january 4, 2010 my house is schelduled to be sold at public auction our nightmare began in 2007 when my husband and i were laid off from our jobs and fell behind on our payments. thru 2007, 2008, 2009 we have complied with every request made by wells fargo. my favorite make these huge balloon payments and the three monthly payments. during the three month period no correspondence received from wf then shortly after the 3rd (within a week) we would receive letters stating we were in default. only to call and be told the modification was in review. we also many many times sent hardship letters, monthly income and expenses. in july 1989 we purchased our home borrowing with fha loan amount of $34, 250.00 with south carolina national. loan was purchased by wf in september 1995 (5th servicer). as of today wf tells me our balance including principal, interest, other fees and attorney fees $36, 500.00 over $2000.00 more than we borrowed 21 years ago, and by the way we have paid wf $12, 000.00 since 2007. how can this be? on november 16, 2010 i faxed a written request to wf correspondent depart. requesting : loan balance when wf purchased in 1995. stmt. of all payments made by borrower since 1995. copy of orignal loan agreemnet. itemized stmt. of all monies owed as of this date and amount of payoff for a clear deed to my house. i have called wf serveral times to check on status and did receive a letter stating my request was being researched. i have kept all my records since 2007 with many wf lawyer letters and court documents that contridict one another, payments being held in suspense untill default and and many documents with my name spelled in incorrectly. what can i do ?

I have a 15 yr. re-fi loan with them and whenever I call customer service, I always pray that I don't get stuck with a rep that is incompetent as the last. No luck.

It seems like everyone there is a recent graduate from the University of Stupidity.

Wells Fargo ssn wrong/account closed/not my fault

I tried to open a bank account with wells fargo... When I did I gave my "personal banker" my i. D. , ssn and other forms to identify myself. After completeing what I thought was " opening an account" I naturally went back home and waited for my checks and dc to arrive in mail. Wanting to check things out further I went to there there website and I had noticed that my bank account was on a hold. I realised that she had given me a folder that was licked close. I opened it and she had my "tin" or "ssn" incorectly by 1 digit. After calling and trying to clarify what the issue was. They had stated that I had falsely identified myself which means that they will not let me use them for buisness. So I asked for $$$ back and they said I had to wait 2 weeks for it to close and then they wil mail it to me which takes another week. Upon me complaining further the manager at the location (9th st. / greenway-phoenix az) which I believe her name was "sergi patell" had told me that my banker at the time "ponja" stated I had never given her my ssn. And that I had mis identifeid myself. Now I have to go to ssn administrator to get a letter from them to that states I am who I am. {like my birth certificate, professional licenses, diploma and several other documents isnt good enough. Not nly is this embarassing to me. I cant acces or take out my money. Or does anyone there believe me. Its one thing to make a mistake. But when a "personal banker" doesnt own up to there mistake it makes you wonder if I was depositng 1000$ and they had misenterpreted that into 100$ what would happen then? Who are these people and why are they in charge of hiring people with no dignity?

Wells Fargo wachovia loan modification

I began our loan modification process with Wachovia back in Oct. 2009 and to date we still haven't been able to finalize it. I find it absolutely stomach churning that every single god given financial documentation was provided to them (within 24 to 48 hours after Wachovia's request), and they still managed to delay the review process by claiming that the fax was never rec'd, the date was missing, the name was misspelt, Snoopy ate the mailbox, and Garfield, the cat, jumped on the stack of papers and his lice/fleas ate the documents!...seriously, my 5 year old son has better (and thankfully less) excuses then the Reps at Wachovia.

Well, I don't know about you guys, but quite frankly, I've had enough. Wachovia shouldn't have accepted the bailout money from the gov't (which is really our hard earned tax dollars) if they had no intentions on bailing out anyone other than themselves! I've sued Wachovia in the past (before they acquired World Savings Bank) for extending a prepayment penalty fee and I had the entire matter resolved within 1 week...and mind you, I am not an attorney, never went to law school, and I sued completely on my own. Now, that being said, I took some of my own steps yet again for the 2nd time in hopes of getting what I was promised when we initially went through the phone interview: (1) 2% fixed interest rate; (2) lower monthly payment that included my escrows; (3) keeping my home (especially since we put 20% down payment on the purchase price back in 2005). I am keeping my fingers crossed that I will succeed for the 2nd time but it's never a guarantee!

I think that if we all ban together (picture the Boston Tea Party) and everyone writes or files a complaint to the addresses listed below, then they will have no other choice but to listen and comply. My filed complaint alone is completely useless unless it's backed up by everyone else who is experiencing the same difficulties. Below you will find the steps in filing a lawsuit and complaint in your own County, but please keep in mind that all we can do is try our best and hope it'll work:

1. gather all docs and any fax/mail/email/fed ex confirmations sent to Wachovia;
2. organize in accordance to date, all phone calls made to Wachovia, whom you spoke with, and the topic covered during that conversation;
3. go to your County's website or google "how to file a complaint in _____ County". Once at the website, you can download the forms you need to complete in order to file a lawsuit. Be watchful of the Complaint you submit to Court, because there may be 2 different lawsuit forms: (1) small claims (typically used if you are suing for less than $6, 000); and (2) civil complaint.
4. If you do not have access to the web or your county does not provide this online, you can visit your county clerk and ask for the forms directly.
5. in addition to filing your own lawsuit, file a complaint online with the Department of Banking and Insurance and also with Thrift Supervisory.
6. Lastly, once you have a copy of your filed lawsuit at hand, along with all the other online complaints you filed, feel free to drop a few lines to the following people at Wachovia:

Hello All,

I was at a family function last week and was asked how the loan mod was coming along, to which I answered: "I started the loan modification at the age of 34 and I finally starting seeing progress at the age of 86. However, I can't seem to remember if I'm modifying my old house that I foreclosed on over 50 yrs ago or my 10x10 room at Mt. Sinai Hospital!"

Since my last post, I actually had an attorney from Wells contact me few days prior to the hearing date (scheduled for 2/28/11) trying to scare me into dropping the lawsuit by saying that it is their (Wells) intention to file a Motion for Adjournment based on needing more time to fly in an expert witness, specializing in mtg mods, from California to New Jersey. I told the attorney they can file and fly in whatever and whomever they wanted, it's not really my concern and they should be contacting the Judge's clerk to discuss that especially since the trial is less than a week away. The same day, I get another call from the same attorney asking me what I was trying to accomplish and if i would be willing to consider a settlement, in lieu of dismissing this case. I told him that i was not interested in settling for a quick payout, but wanted the 2% promised and would not trust going through Wells' customer service line again. Fast forward 30 minutes and a return call from the attorney...he was trying to convince me of having a weak case hoping that I would fold, and after firmly standing my ground, he and I agreed on a provisional dismissal based on: (1) having one key contact person at Wells assigned to my loan that would review my application; and, (2) a final decision would be made within 7 business days. The same day at 7:00pm, the attorney conferenced me in with Michael Dolan, VP of the loan mod dept, where he (Mr. Dolan) was brought up to speed of the deal that the attorney and I struck earlier.

So, after going through all this, I was unable to get the application over to Mr. Dolan until recently, due to my father being diagnosed with lung cancer, falling ill, and passing away all within 2 months after speaking with Mr. Dolan.
I will be following up with Mr. Dolan this coming Friday and will know then if this was the "real deal" or just another tactic by Wells...either way, I'll keep everyone posted.

Hi All,

I am happy to say that the alarm clock finally went off! I rec'd a class action settlement notice which stated that Wachovia/Wells violated consumers rights relative to the pick-a-payment and loan modification program. The notice gave 3 me settlement options: (1.) Receive a lump sum payout and waive right to pursue any legal action against Wachovia/Wells; (2.) call settlement admin and neg. loan modification who will in turn present it to Wachovia; or, (3.) do nothing and receive a much smaller lump sum payout. Since, I haven't gone into foreclosure yet, I'll be pushing for the loan mod...I think that it would cripple them more rather than just to pay a lump sum and call it a day. Everytime they go to run a profit/loss statement and see a (25, 000, 000.00) loss, , I want them to put a face to all the names they unjustly foreclosed on, bullied, and denied a loan mod to.

I can bet my entire life savings (and thanks to Wachovia/Wells, it's barely enough to buy a small bazooka gum) that if NJ is in on this, so will other states. I will post the administrators number on this board tomorrow and I am sure that they would be able to tell you if there are any additional states involved in this lawsuit.

I hope that Wells/Wachovia will end up like Countrywide: broke and forced out of business! I completely agree with you, Debtors Atty, the clock is ticking for Wachovia...and when the alarm goes off, I'll make sure that there's no snooze button to hit!

I'm still waiting to hear from either Wachovia or the County Courthouse...i'm certainly not going to hold my breath for either.

I am part of the class action lawsuit with Wachovia. I am in class B, which is doing nothing to help people like me who is and always have been current on my loan... It appears that they are going to do nothing to help us. I have been turned down twice for a loan modification, and now am told to try and re-submit it... I know I will be turned down again.
Is there any recourse I can do to help us out of this terrible situation?

Does anyone here know the difference between the Due Date on a mortgage payment and the Late Date (the date late fees may be applied)? In my case they are about 15 days apart. I keep getting calls from Wachovia starting the day after the Due Date claiming I am late even though it is still prior to the Late Date. Don't you think that if a bank provides a Late Date (grace period) that they should honor it and not harass their customers with claims about being late?

The local Wells Fargo Mortgage Loan representative promised I would save money by combining my 1st and 2nd mortgages together. Little did I know (until I received my first payment notice) that he had attached FHA loan insurance at my cost of $140 a month to my new mortgage. In hindsight I now realize it was so Wells Fargo would not have to negotiate with me to modify the loan when I went in default because of being over extended on the mortgage payments. They can sell my home in a foreclosure sale (which they are currently arranging) and submit any loss to the Feds for payment through the FHA insurance. LEAVING THEM NO REASON TO MODIFY OR NEGOTIATE A REDUCTION IN MY MORTGAGE AMOUNT OR PAYMENTS. LOST MY HOME AFTER 25 YEARS OF INTEREST PAYMENTS TO THE MONEY GRUBBING THUGS.

I just recently finished my modification with Wachovia, i did start in November, it took a while because they r really backed up, not everything that i was told every time i called was givin to me example 2% for life turned to 2%b for the first 5 years only, 6th year is 3%, 7the year is 4% and 8the year till 34the year is 5%...it was still much better than my intrest only loan and they also took of 18% off my principal but they did keep in touch with me...i wish u the best.

Wells Fargo charges for

I used Wells Fargo Auto Finance to Lease a car. Before I returned the vehicle I took pictures of the car. Wells Fargo proceeded to charge me for Excess Wear and Tear of the back bumper. I took pictures of the bumper and showed that there was no damage. Wells Fargo representatives threatened to ruin my credit several times if I did not pay the excess wear and tear damage that I disputed with evidence pictures. They said their pictures show damage and refused to let me speak to a manager. I asked to see the pictures that showed the damage they refused to show me pictures of the damage and said the pictures are proprietary. I spoke with Anthony Mason, and another representative that continously threatened to ruin my credit and felt forced to pay for damages that I disagreed with.

Wells Fargo mortgage fraud

2006 I warn the dept of bank the attorney generals office of NY State.
The way this crooked mortgage broker and banks were doing business.
no one took me for my word at the time after years of my own investigation humiliation and stress justice is slow but i still have faith
in it. I Dare wells Fargo to foreclose on my home and I am happy to say.
they can't. to any one who is a victim of mortgage fraud. check the
court records you will be suprice how many thieft work for banks
and re wrote and change the terms of many mortgage today on
foreclosure action today.I will be more than happy to help you
and for free.

Wells Fargo no help from loan services

Wells Fargo Auto Services, formally Wachovia Dealer Services, does not know how to help their account holders and treat them with respect. I have a car loan originally through Wachovia Dealer Services and has now been taken over by Wells Fargo. They are the same employees. I have had my auto loan with them for nearly three years and had a few rough years. I have since paid on or before my due date each and every month for over a year. I however had to file an extension last January due to a death in the family. They did grant that and then I fell behind in February as a carry over from the funeral.

Since March of 2009 I have paid on or before my due date each and every month with a money transfer. The Customer service representative stated that I would not be considered late as long as I did this. I am concerned about my credit and that is what they said would not be affected. I need to check that! In the meantime I have paid the late fee each month as my car payment is one month behind. They also stated that since I just had an extension in January that I would not be eligible for one year! So I paid every month as I stated I would, never missing a payment. A full year has transpired and they will not give me an extension. I stated that I followed everything they wanted, but they said it was their right to refuse! I will give them that! I told them that as of April, I was unemployed. They stated that I would have to be employed to get an extension! WTF! I am self employed then! That won't work! Just pay the the past due month! At least now, even with out a job, I will get the past due month paid! I am sure they will be happy.

During all of this time they have called numerous times every month to collect on the car. They called at home, at work, and now even on my cell phone. i told them I never gave them my cell phone number and that they had no right to call me on it! They said as long as I was past due, they have every right to call on that number! You might think that it would just be easy to pay for the past due month, and that is how they rudely treat me. I had bad credit, so they jacked up my interest rate, but I was okay as I got the car I wanted. I still feel that way. Treat me with respect and work with me, not against me as they do! My car payment is over $750 a month, no small change, so be respectful when talking with me!

The easiest fix will be to completely get caught up, which will happen this month, and shut those bozos up! This is kind of a rant, but you can see how they will not help even after I kept up my end of the bargain each month. Wachovia fell on hard times because they were stupid and Wells Fargo will do the exact same! Especially if they continue to treat their Customers this way!

I feel better letting this out and especially since I will be caught up this month!

Hey I know how you feel, how you thought about calling them and asking them to modify your loan ? So if you say have 17 months left to repay, they could re modify the loan to have 24 months, which will get you caught up and lower your payment just a little every month! It not easy to get a bank to do this though!

I do agree, wachovia got a bail out when they hit hard times, but the banks don;t want to return the favor to the consumer, of cause one could say this and that but in all truth, if the bank would work with people behind they might had not had to been bail out by us then taken over by wells Fargo ! wells Fargo should learn from the same and not make the same mistake!

The little guy is always the one screw the hardest when they fall on hard times, this world is gear toward the rich and people with money will never truly understand how easy it is to get behind be it because of a death, a car repair, house repair, esp when your budget is strained by being unemployed and you have drain all your savings while unemployed

never ever tell a bank your not working when asking to defer a car note, always say some thing along the lines of a emergency arose has drain you of all your savings and regular monthly income!

I agree with everyone else that has had a complaint with Wells Fargo's overdraft fees, I am so fed up with every transaction I make, does not matter when I make it, and if it is pending, before they clear my account, Wells Fargo puts them from greatest amount to least amount .so that if the greatest amount comes in last it will be first in order.and then all the small transactions will reap a fee of $35.00 for being overdrawn on that given day.I have complained to them over and over again, and all they can say is it is for my own good that they do that, and that it is a benefit for me.hmmmmmmmm, they are screwing me over by doing that.they dont have my account handled in the best interest of me.they do it their way regardless how it hurts the customer.we are on unemployment and after they hit my account with 8 overdraft fees because they put the large transaction in first after it came in days and last minute of all the small pending transaction s and left me paying out my entire weekly check from unemployment to cover the overdraft fees.after complaining they stated they had the right to do that and that the fees were applied correctly.I have decided after 18 years of banking with them that I will be taking my accounts to Chase and that seems to be a Bank that will be exactly what I am looking for and all my friends and family that banked with Wells Fargo have also gone to chase, now I know why...Wells Fargo is a bad bank and should be closed.maybe Chase will buy it and turn it into a great bank with their name...do not bank with wells fargo, they will steal your income and will not care if your on the streets because of it...

I agree completely Wells Fargo bank are just plain greedy people who don't care about their customers. They are manipulating the order of charges so that the largest gets paid first so they can charge a over draft fee on all the rest. I guess they didn't learn their lesson when California residents hit them with a class action lawsuit and they had to pay out 303 millions dollars. Arizona residents need to get together and file a class action lawsuit as well. I'm going to look into it with my lawyer to see if we have a chance to get some of our money back. I'm sick and tired of them taking food of my table just so they can line their greedy pockets. I just got hit with 6 over draft fees and I will be changing who I bank with tomorrow. Everybody who banks with them should change banks and put their greedy butts out of business.

I agree, Wells Fargo does not care about there customers. They use there system to charge these ridiculous overdraft fees. My account was overdrawn by $2.50 and that was from a non Wells Fargo ATM fee, it cost me $35.
The only reason i stay with them is because of the abundance of ATM around town. I hate Wells Fargo and the greedy rotten people who run it.

Wells Fargo unethical practices

Anyone out there interested in joining with me on a class action suit against Wells Fargo? Have you had a similar experience? Please email me at [protected]@gmail.com.

My husband and I had a mortgage with Wachovia. In fact we had more than one mortgage with Wachovia and we also bank with Wachovia and have had a very pleasant experience since they first took over my husband's First Union account more than 8 years ago.

Then Wells Fargo bought Wachovia and two of our mortgages got transferred to Wells Fargo. Last year we ran into some financial problems which I won't go into here but we called Wachovia and they offered us a 2-month forbearance on the one mortgage they still held, which we accepted, and have since resumed payment on and everything is ok. They suggested we call Wells Fargo about one of the mortgages that was, at the time, one to two months behind, depending on the time of the month. :)

We called in November, were told they did not have a forbearance program (though it was mandated for this to be offered by all banks) but that we did not qualify for a modification which was the only program they had. I hung up pretty upset because they had been rude and condescending and not at all pleasant.

In December I tried to make a payment on the Wells Fargo mortgage and we had been blocked from making a payment online. So I called their customer service number. After speaking with a very pleasant helpful rep who suggested we apply for a modification and telling her about my previous experience with Wells Fargo she suggested we try it again with her. We were on the phone for over 45 minutes, she took me through our financial info and then told me we in fact qualified for a modification and proceded to tell me the terms of the modification. One payment had to be made by a date in January, a contract would be mailed to us which had to be signed and notarized immediately and sent back, and we would not pay instalments until June 2010, at which time our monthly payment would increase by approximately $24. I agreed, she outlined and recorded my agreement and I rejoiced!

Hah! No contract ever came and when I started calling Wells Fargo I got a different answer each time I called. They were waiting on documents from us, the contract had been sent, they would send a new one, our file was under review, etc. They danced me around for several more weeks. I finally spoke to a young lady who took my "one more payment" over the phone and gave me a list of documents to fax in.

Then, it was, one thing and another and more time passed.

One day when I called I was told that my husband and I had applied for a short sale on the property and the file had been transferred to the short sale department. THAT WAS NOT TRUE.

I had to go through a series of phone calls to their short sale department, requesting the file be sent back to loss mitigation, then wait a couple days, then call in again and formerly request the modification all over again, have that reinstated, then fax in the documents all over again.

Finally in April 2010, I got a phone call from Wells Fargo saying they needed additional documents. They wanted those documents by 1:45 pm the next day. I asked for more time since that deadline was unrealistic. They gave us until the following Tuesday at COB. I got them everything they asked for by the Friday BEFORE the Tuesday deadline. I was told everything was ok and the file is under review.

The next day, Saturday, my husband and I were served with foreclosure documents by a process server, who delivered the paperwork to my house and gave them to my son.

Each day I called in for the next two weeks, they asked for a new document. At one point they wanted me to include my son on the documents and I refused because I found out that they had reported us as being late and in foreclosure to the credit bureaus, totally messing us up with everyone else, in spite of the fact that we were supposed to have had the modification in place and we were supplying them with every document they asked us for.

They danced me around and stringed me along for almost three weeks, they stopped taking my phone calls, just around the time when my 20 days to file a response to the foreclosure paperwork were about due.

I have had one returned phone call from them since telling me I am only allowed to call once a week to check the status and that our file is still under review.

I have read literally hundreds of other and very similar stories on this and other websites.

My pastor recently told me that he had read an article which said that they had insured all their mortgage loans when they were being packaged as an investment and in fact the more loans that go "bad" or into foreclosure, the more insurance money Wells Fargo will collect. Plus they will still own the foreclosed property and can sell for additional profit.

So I don't think Wells Fargo is trying to save our properties. Seems like they are pushing some of us into foreclosure.

When this all started we were one to two months behind and trying to catch up with all of our other debts. Now we have caught up with most of our other debts or made arrangements with them but we are now several months behind in this particular mortgage. Which never would have happened if they had not told us we had been approved and NOT TO PAY until June.

Please let's get together and stop the lying and stealing of properties all for profit.

I have been working with banks for over 40 years with no problems and found them honest with high ethics and morals however I have never experienced problems that I have with Wells Fargo! I wish you good luck.

I paid off my car and they don't want me give my title from car!...10 employees have 10 different lies!(they sent me title, they lost title, they don't have title and now they sent me car title today - should i believe them ?!)

Wells Fargo, BAC and First Tenn. have caused our property values to diminish to such an extend, that we do not qualify for HAMP.
I and several other homeowners have purchased our properties in 2006 for $ 130, 000.00 with substantial down payments ( none of us had Wells Fargo as a lender, our loans where sold). Even at that, we are upside down in our mortgages, all due to these 3 banks selling foreclosed properties in the range of $ 39, 900. Out of 35 units we have 13 foreclosures, all owned by these 3 banks.
Wells Fargo will not even respond to our inquiries. I am contacting the States Attorney Office, Treasury ( not sure huch good that will do)
Is anyone interested in filing a class action lawsuit against Wells Fargo in the State of Georgia or elsewhere?

I lost my home due to the unethical practices of Wells Fargo. They are impossible to work with and I tell everyone I know to stay away from them. The problem is that they are so big, it is difficult to do anything against them. I dealt with them for several years and the end result of their "help" was a $1300 monthly payment on a $90, 000 loan on a house that had 3 small bedrooms, 1 bath and 830 square feet. With that kind of mortgage payment, you would think I lived in a $250, 000 home with 4-5 bedrooms and at least 2 or 3 baths and 2500 square feet of living space. No, I don't live in NY or CA...that's right here in cowtown USA, Kansas!

I suggest after going thru a simular experience, before trying to go thru any of Wells Fargo programs that you make sure that you get a counselor at The Hope Hotline to answer questions, guide you, and even submit paperwork for you. I was put into the HAMP, and should have probably done the HARP program first as the HAMP forces you (at least at Wells Fargo) to make trial payments-which impacts you credit. If I had done the HARP first there was no waiting and I would have know if I qualified 8 months ago. And if not then I could have took a short at the HAMP. Everything I have done with Wells Fargo has put me in a worst position. And the customer services omits facts when you call in to check status. I did not know for 5 months that I had been turned down for the HAMP. The did not apply a called in payment making me appear lat e for months, and did not inform me of this upon calling in. If they don't want to give you a loan and you don't know that it helps to at least have help from one of the real non profits sanctioned by the govt. HOPE was also listed on my union web site AFSCME. [protected]. I wish all well it has not been and easy four years for me.

Wells Fargo took away lease assumption

Who wants to go into a class action against wells fargo auto finance?

They cannot change the original contract without both parties initials - signatures (stated in the contract and has to be signed upon execution of the contract and before driving vehicle of the lot)

My goal is to exit my lease and recover damages after I send in last year for lease assumption and they denied! One day after they changed the contract rules & terms without notifying me

I also have employees at the bank that know about this... And got fired when they just closed the department

Plus a lot of victims stuck in 5 year leases that cannot be posted an swap a lease.com or anywhere to exit.

Is there anyone else that wants to stop them doing whatever they want to the consumers ?

They know they did something wrong and will settle. I would have chosen another bank if I would have known they are going to pull the fully assumable option.

Any lawyer ready to take case ? I have a lot of recovery info ready.
I would like my money back and have them take the car because they broke the contact!

Wells Fargo customer service

I tried to call Wells Fargo Auto Finance today in hopes to come to some kind of agreement to get my payments current. When I was routed to another representative, the not so gentlemen like man, rudely claimed I had no business taking care of this matter (even though my name is on the account to take care of this matter). When I insisted on speaking to his supervisor he then continued on about how he was going to remove my name from the account (which I'm sure he can't do with out authorization of the account owner, which is my husband who put my name on the account in the first place). He finally just got so obnoxious that I hung up and called the number back to speak to someone else. Finally, after getting hung up on twice, I finally got to speak to a young lady named Jessica. She was very friendly and very helpful. She actually listened to me and then made suggestions that could help us get caught back up. Instead of acting as if these people have never owed money before in their life, Jessica spoke to me as a human being should and was very respectful.

The past two years we have experienced financially hardship, the loss of our jobs, IRS problems, the loss of our home, and yesterday the repossession of our car by Wells Fargo. I do understand that we are responsible the maintaining current on our payments, so I do not find fault in the repossession of the car by Wells Fargo.

What I am upset with is the customer service at Wells Fargo that we received by Cheryl #514 & than later Sommer (who would not give us her ID #) in trying to get information to resolve this situation. They were so nasty with us, the tone was un-necessary, Cheryl would not let us talk with someone else, not a supervisor/manager, nor their Legal Dept. All I can say is wow.

Wells Fargo misleading banking practices

In May of 2009, I applied for a Mortgage Loan Modification with Wells Fargo, while I was off work on disability. I was told that I was eligible and was granted a temporary loan modification, which lowered my payment by $1000. per month. I made every payment and called Wells Fargo, every month to get a status update on the modification. In January 2010, I received a letter of "special forbearance" with a payment greater than my original loan payment and when I inquired about it, I was told that they based the payment on my income, and they showed that I had an additional $5000. of income monthly! I have one job and my net pay does not equal $5000. monthly. I was then told I had to resubmit a full packet of information including a budget worksheet, bank statements, pay stubs, my disability letter from my job and the doctor's note returning me to work. After submitting all requested information, in March I was asked to submit the exact same information, and I did, on March 19. The next week I received a letter dated March 22, stating that because I had missed a payment in August 2009, my request for modification was denied. I called them on it and provided all of my payment receipts showing there was no missed payment. Then I was told I was in violation of the "special forbearance". I never agreed to it, so how could I be in violation? I was told to resubmit my packet, but foreclosure is inevitable because I am now over $30, 000. delinquent, the remainder of my monthly unpaid payment is still accruing finance, interest and late charges. I was not given this information when the temporary payment arrangements were made, and it is not my fault that a year has passed and I still have no loan modification.

No one that I know, has received a loan modification from Wells Fargo, not even when they worked with attorneys. I really regret getting a loan with this bank.

Wells Fargo home loan

I have been dealing with Wells Fargo - ASC for a few years. And once my husband and I lost our jobs we got behind on our payments because we had a 2 year balloon. I contact them because I heard we could do a loan modification. We had to do it for 4 months and be on time. Finally after the 4th payment I received a packet in the mail the needed to be completed stating what our payment would be, what our % would be and that they needed a lump payment up front. I contact them because I had just paid my property taxes (which I called to see if I needed to do so and was told yes) and the amount they were requesting is what I just paid in taxes. So they told me they would wave that fee but everything else was good to go. So I asked if they would send me a corrected packet for us to sign and they said they we unable to do so. Well I contuned to make my monthly payments. I get a letter stating my home is in forcloser and I need to pay a double payment. I contact the loan modification department and demanded that I speak to supervisor. Which he did call me took down some information and said he would call me back. A few weeks later (after I called him everyday because he gave me his direct phone number) a rep named Myra called me stating she is working with this manager to help me. This was in October. Well to make a long story short they still have not completed my request. I was told by Myra that she has talked with someone at the Head Office (which I could not get a name) to see if they could help. Since then I have received 5 statments in 2 months all with different montly payments due. I don't know what else to do. Can someone who has gone through this please comment with some advise. I need all the help I can get right now.

I recently disclosed a chapter 7 bankruptcy. I am also working with wells fargo on a loan modification. It has been 5 months and I have sent 30-35 pages of all kinds of documentation. I haven't heard from them for 3-4 weeks. When I called I get different answers. Now they want me to update everything and send in again even though nothing has changed. I keep getting statements showing I am behind 4 months and I can't get any answers about the loan modification. I am really fed up but don't know what to do next.

Wells Fargo nsf fees

This is in reference to a Bank Manager on another Wells Fargo forum who writes he, "listens to his customers" and who states, "It is [the customers] fault...for the NSF fees."

I am a small business owner of two businesses, one a construction company and the other a boutique. I as many retailers have a Merchant Account with a credit card processing company (not Wells Fargo) of which my customers may run their credit card - for merchandise in my boutique. Again, I am a small business owner. I am not making millions of dollars, in this economy, but just getting by day to day like everyone else - to pay my bills.

I recently had a customer - and this has happened to me a few times - tell their credit card company that they did not use their card in my establishment. So, without warning the credit card company removes the disputed $616.00 from my Wells Fargo bank account. I then received - and this always happens on the day they remove the funds - a notice from the credit card company, informing of their removal of funds from my bank account. See, the credit card company will remove funds, then have me prove my case. In their letters they request the actual invoice, the shipping address, the billing address, and their signature. All, of which I submit.

Due to this recent removal of $616.00 - it created over $280.00 in NSF fees..now I am out $896.00. Due to my proving my case it will now take 7 to 10 business days for the credit card company to deposit back into my account the $616.00. Now, the $280.00 in NSF fees from Wells fargo, well, that may not happen. The incident like this before...cost me $760.00 in NSF fees from Wells Fargo.

One of my business offers online shopping. I deal with those incredible people who will purchase and will attempt to say they never received their product, or those who state they never made the purchase. I get slammed for the amount they are disputing. However, I win my cases showing proof of every delivery, or sale.

This is my first problem with Wells Fargo. They only reimbursed me on the previous situations for half of the NSF fees. They state, that "they can only refund all the NSF fees, if it is a bank error". Of the $760.00 in NSF fees they took from me a few months ago, Wells Fargo only credited me half. Due to this recent situation I am trying to get my NSF fees back from Wells Fargo and have yet, to get anywhere with them.

This is my second problem with Wells Fargo. When my account is in the negative during these situations, Wells Fargo continues to allow transactions of which transpired previous to my knowledge of the removal of credit card funds - to come through thus, Wells Fargo making a profit of $35.00 a transaction.

Sure, one may suggest that I go else where. However, it cost money to change two business accounts, one trust fund account I have for my sons, and multiple personal accounts. I am working from morning till midnight just to make it now. Wells Fargo has told me that as of August 2010 - they will be removing the NSF charges altogether and if there is no money in ones account - then it is declined. Well, who was the brain child of this one? That is how it should be. Why not do that now? I asked, Wells Fargo to do that for me...however, there reply was - they can not do such a thing at this time.

That is the best news I have gotten from Wells Fargo - whom all the well knowing ones account is in the negative - will push through another transaction in order to fill their pockets. Wells Fargo is not for the business owners, nor the nine-to-five working individuals. They are for profit and if your family does not eat one night, well their, "Fat Cats in Corporate" sure will.

I wait for the day, when CNN shows the, "WellsGate" scam and they, the "Corporate Gougers" are made to pay back all the monies that they have greedily taken...Wells Fargo needs to quit ripping their hard working customers off!

I had to get a small cash loan of $200.00 to pay my rent, since both my parents, who recently became divorced, are financially unable to help me out.

When the first payment came in I was short $5.00 of the balance that I had to pay for my loan. I figured that they would just take what I had and be done with it. Then a few days later when I had sufficient funds in cash to pay it back, I deposited the money into my account. Then I got charged $70.00 for not having sufficient funds. Apparently, Wells Fargo charged me $70.00 in NSF fees for not being able to pay the first time. Then when I put the money in the bank, they took out the first $70.00, and when I couldn't pay the second time because of the money taken by the bank, I was charged another $70.00. Now I am out $140.00 to the bank in NSF fees, and now United Cash Loans, where I got my loan, raised my balance to $350.00.

I always thought that Wells Fargo was a bank that helped the working class, but apparently they just want to get money any which way they can. I am a college student, from a middle class family that is going through very tough times. I have a part-time job that barely pays the rent, and any financial aid I receive goes to books and school fees.

If at all possible, I wish that someone in higher ranks of the Wells Fargo Bank Co. will see this and realize that these fees are hurting those who rely on this banking services the most. If they don't see this, then I hope that people will see this and realize that this bank is one giant rip off, and avoid getting an account here.

Wells Fargo needs to have a class action lawsuit against them. They hide all pending debit ACH and check transactions to try and trigger fees to the consumer. Chase shows pending status and allows cutomers to make a deposit before 6 pm to cover a check etc so a fee is NOT incurred. Wells Fargo is crooked and only wants everyones money.

Wells Fargo holds payment without notice

Wells Fargo has started (new to me) holding payments made to your personal line of credit accounts without notice. This first time this occurred was when I made a sizable check payment to payoff my line of credit like I've done in the past. They put a 15 day hold on the payment even thought the check cleared my bank 2 business days later. Their excuse for not notifying me was that by the time I received a mailed notice, the hold would have cleared. Would the letter be coming from the far reaches of Antartica? The most recent occurrence was when I used their website to do a bank to bank payment (like I've done before) and even though the money was taken from my account on the next business day and they confirmed that they received it, I was told that there could be up to a 25 day hold on that payment. 25 days? How ridiculous is that? And the only reason I found out about this hold is that I called them to see why my payment hadn't increased my available line of credit (learned from the last situation).I've been a customer since 1990, had a line of credit since 1997 and have never had a problem until now. I'm disgusted with Wells Fargo. They made me feel like I'm going to try and rip them off.

Wells Fargo unethical business practices

I am recently unemployed and have been faithful with my car payments with the exception of this past month. When I contacted Wachovia which is now Wells Fargo and Chase before that, I explained that due to the economy, I was laid-off and taking care of my disabled Mother and needed to make a payment arrangement.

It was rudelly explained to me that they would need to post a payment to my account knowing full well that I was overdrawn at the time. I might as well have been asked to write a bad check which is ILLEGAL! The rep. quietly explained that "it's okay to allow us to post this payment from your account, because it won't go through right away. You should probably have money in there by then." Furthermore, the rep. asked if my Mother has any money to give me. I explained that she is 100% disabled and that I am the primary caretaker.

Wachovia/ Wells Fargo...or whatever they're called now, bully their customers, and are willing to partake in unethical business practices.

ok so i work at a technology with some of the smartest people around. It amazes me what technology allows us to do... I mean my car can almost drive itself. so why when you call to check your accont they cant tell you whats really available. I mean cant they charge me Friday for what I spend on Fri why must I wait til next Tuesday... and why do they bother saying available last time I checked it meant present or ready for immediate use

Im starting a fan page on fb on Wachovias unethical charges do you know they charge you overdraft when its on hold then again once it goes through. They know its wrong so they are changing the rules in the next month per my personal banker who I like but unfortunately wont be dealing with anymore because im closing my account

Wells Fargo credit ruined in loan modification trial period

I refinanced my house in 2006 to buy a business. The lender was Fremont Invrestment Loans(bad company!). They sold it to ASC/Wells Fargo Bank. It was fix for 2 years and then became adjustable. Six months before change to adjustable I called ASC asking to help me refinance. They told me I had to call Wells Fargo that ASC can not do that. Called Wells Fargo, they told me to call ASC, that they could not do it. They told me ASC and Wells Fargo were not the same. That was the first lie. Meanwhile the prices of the houses kept going dow. Finaly they sent me a letter telling me I did not qualify to change the interest, but did not said for what reason. Tired a contacted statewide Bancorp Inc. They got a trial period for a loan modification and told me that that was my only option and I had to sign it . The terms were not good I did not signed, took them to court and they had to return my money because they did not have a permit to collect advanced fees for a loan modification. I called Parsa Law Group. They were on TV boasting they helped over 3000 customers to modify their loan. They took my money and shortly after Mr Parsa licence to practice law in California was removed for moral turpentry. Still waiting for them to return my money. I continue sendingthe documents the Parsa Law started and finally ASC put me an a loan modification trial period for 3 months with reduced payments. We asked before signing the agreement if that will afect our credit and they said "no, that is an agreement between you and the bank". Another lie. After we completed the 3 month trial period payments the loan modification was denied and our credit ruined! ASC reported the payment as late payments. We called them and they denie dthat they reported late to the credit agenices. They asked to send them the copy of the credit report. They also told me "of course the trial period will lower your credit score, everybody knows that". Really? We asked before and they said no, they lie. And they refuse to remove the bad record from the credit report. We are stuck with a bad credit and a Bank not welling to help and reported late payments when we neverm were late in the mortgage. Only neede a loan modification to lower the outrageous interest of 9.7% with a cap of 15.7% !

I did 2 loan modifications on 2 properties in 2010, the first bank was very helpful, but Wells Fargo refused to modify my loan and my husband had died and my income was cut in half. I went through everything and I have high payments with Wells Fargo and now there are a bunch of new laws and I wonder where to get the best info and how to apply again for a new loan mod. They also wrecked my credit so I can't open up an account anywhere else.

Due to an income decline in late 2009, I called America's Servicing Company (ASC) / Wells Fargo to discuss the possibility of a loan modification program. I was told I have to be at least 3 months behind in my payments, that I was to stop making my mortgage payments for 3 months then call back and begin the process. In April of 2010 I called ASC and began the process, that involved TONS of paperwork. When I'd call to verify received, they didn't have it, so I'd have to resend tax documents, income statements, pay stubs, hardship letters etc.. In July 2 days after having major surgery I received a call stating I would need to fax over paystubs for both myself & my husband. This could not be done, I was still in the hospital, plus my husband had just begun a new job with the government and had not received his 2nd pay stub. I was told by ASC to begin making our mortgage payments for a couple of months then call back and we'd see if there was another program we may qualify for. We made 2 payments and on October 7, 2010 we found out our house would be up for sale on October 27, 2010 for foreclosure. On October 25, I called ASC and talked to Andrea (Employee ID QFY) who put me on hold while she called the foreclosure attorney (Morris & Associates) to stop the foreclosure. Five days later we received notice our home had been foreclosed and the sale went through. We had 48 hours to negotiate a vacate date otherwise be left with a constable placing our belongings on the street. We have NEVER been late with one payment until this nightmare began! Now we have to be out of our house by December 6, 2010 or place eviction! ASC / Wells Fargo are awful people!

Same here but with Bank of America. We've never had a late payment, before, during or after trial period. We immediately paid due amount when we were denied. And yet our credit score is now ruined because they said all those months (they kept us waiting 9mos.) of trial payments were late payments. We went from a very good, upper 800's credit score, to a bad, lower 600's. Now we have no ability to refinance or anything!

Isn't there anything we can do?

Wells Fargo travelers advantage

3 months and still waiting on my free DVD player. I was told that they would send it to me 4-6 weeks after signing up for Traveler's Advantage. I called after about 7 weeks wondering where it is and they were veruy apologetic and said that i had to fill out a form and according to thier records was never sent to me. So they sent this "form" which didn't even have the right number a spaces for my membership number a week later. The form said it would take another 4-6 weeks. I called to complain and have it expedited. They told me that they had already sent me the DVD player. We never received it. Iw as then told that I have to wait another 4-8 weeks for it to be sent to me.

This company is a BIG FRAUD! Anyone with Wells Fargo should look into their account to make sure that they are not being scammed. I've banked with Wells Fargo for over 9 years. This Travelers Advantage/Triligient has been deducting money from my account for almost 4 years. I signed up with Wells Fargo's Identity Theft Protection program and Travelers Advantage back in 2008. In 2009, called to cancel the membership with the Travelers Advantage. They stopped taking money from my account for a few months and then they started taking money from my account again and I never even noticed. I thought the money being deducted was for the identity protection so I didn't even question it. In November 2012, I got a call from the Wells Fargo Fraud Dept to check my account so I looked into my account and saw 2 transactions and questioned Wells Fargo with it. They then told me that Travelers Advantage has been deducting money from my account monthly. when I looked into my account, they've been deducting money from my account monthly for the last few years. When I filed a claim with Wells Fargo about this company, I was told that I have to cancel the membership with travel company first so I did that and called them to file a claim again. Then Wells Fargo and the traveling company told me that there's nothing they can do for me. They said that they can't return my money for me because I just cancelled the membership and that I had authorized it years ago. WTF! I spend 60 minutes arguing with them on the phone and apparently I just can't get my money back regardless of what I say to them. I called and spoke to Wells Fargo's Resolution Specialist and was told they'll only give me one months payment back and that they are very sorry. yea right they are sorry for selling their customers money. I'm so angry with Wells Fargo for allowing this to happen to their customers and they won't even do anything to protect their customers money either. I have 3 accounts with them and will be taking it elsewhere. I may be out hundreds of dollars($15.99 a month for 4 years) but they've lost a very good customer and her accounts! I will also make sure all my family and friends don't bank with them either! BEWARE!

Yes, we did a similar thing for a digital camera and never got the camera or any mail from them. My husband cancelled the subscription 2 months later, but they never cancelled it and have been charging us $11.99 per month for the last 4 years. I have wondered what this charge was but dismissed it as something from a store purchase. We finally called a representative for our Banking Account which happens to be Wells Fargo and asked them to block any future deductions from the Wells Fargo Travel Advantage program. Anyone have any luck getting money back from these people. We were reimbursed for 2 months onto our checking account which is small compared to the estimated $431 dollars they have taken from us.
