Business Response Please see attachments Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) I DO NOT accept the response from Statewide. The company should have taken care of this issue with Palm Beach County back in early April, actually January 13, 2020. The paperwork from county website, showed the failed inspection on January 13,2020. (History attached) I was unaware until I was cc: on a letter from the county to Statewide owner *** in April,2020. I was cc: on an email from Statewide to County Building Director on April 22nd,2020. Not a word from Statewide other than I was told one of the staff was working on it. No one has helped or responded other than blaming that so-in-so was working on it. As a matter of fact, I texted ***, on May 22, 2020, after I found a part of the permitting processed paperwork that I had been given, it stated that Statewide was going to install two alarms/fire/smoke detectors, with 10 year batteries, as part of the window installation. On June 6, 2020, Statewide came and installed them..(not really sure that these are the required alarms and I know they were purchased at Home Depot, per the installer.. I would not have spent $27,000.00 for these windows. This should not be my problem? This failed due to code violation, whether they knew it or not. They need to make it right. As I stated, I need to sell this property as soon as possible. This is not for profit but for my well being.. I have called, texted and been waiting for Statewide to take care of this issue. The response letter sounds like its my problem and they have been working with me? Sorry it doesn't feel that way to me! Avoidance, frustration and stressed out is what I'm feeling.. Business Response Better Business Bureau Complaint ID: XXXXXXXX Customer: ***, *** ("Customer") Contractor: Statewide Windows & Doors ("Company") The content of this correspondence serves as formal notification for the referenced complaint filed on June 18, 2020 by ***, *** ("Customer") against Statewide Windows and Doors, Inc. ("Company"). The City Inspection which was held on January 13, 2020 failed due to the absence of the permit card for the inspector to authorize for approval. A subsequent inspection was called in for January 15, 2020 which as approved by the assigned inspector and the authorized permit card was left in the property owner's possession. The building department later rescinded the approval and results reflected for the property in April after retroactively enforcing the new requirement for the Fire-Barrier protection on the patios. The Company has been attempting to contact Director Doug Wise of the Palm Beach County Building Department as well as the deputy Director *** Blake to have the action reversed. The Company has been working to assist the client in this matter to resolve reversal of the approval. Additionally, as a part of standard patio enclosure requirements within Palm Beach County, a smoke detector/alarm must be installed upon the enclosed areas. This was completed in early June by the Company but is a separate component of requirements apart from the new enforcement to install Fire-Barrier protection on both patios. The Company has recently been in contact with the client to advise on attempts to obtain a response from the Building Officials addressed and shall continue to assist the property owner with this matter. The Company shall arrange a physical visit to meet with a Building Official regarding the status of the permit if no response is received within in the next 10 business days from either Director. *** President Statewide Windows & Doors, Incorporated Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) On January 13, 2020, Statewide Windows and Doors had scheduled the inspection and had two of their staff members waiting for the inspector. One female and one male, they waited several hours for the inspector. They only had copies of the permit and copies of specification for the windows... I don't know what went on between the the 3 of them during the inspection. I had never seen a copy of a permit posted on my property. On January 14th, when I returned home I found the original yellow card taped to my door and approved by the county inspector. I had no appointment set up for an inspection that day, and no one from the county came into my home, since that time. The county information that I previously submitted stated improper Fire Resistant requirements. They sent a letter to statewide regarding the permit being recinded and cc: me. The Company hosted the aforementioned inspection on January 13, 2020 at which time the inspector reviewed the scope of work with our personnel on site and approved the installation performed. As the Client stated, the original permit card was not present for the inspector to sign off with approval during the January 13th appointment and a subsequent inspection was called to endorse the reprinted copy of the work permit card left on site. The contractor typically leaves the original permit card at the home with the homeowner and is their responsibility to have it available per our contract with the homeowner. The inspector advised that a secondary review was not required and to simply post the permit card to the door of the premises so it may be endorsed physically (The client has the original copy of such still in possession). The Company is continuing its efforts to contact the Building Department on the homeowners behalf to reverse the rescinded approval but has not received a response. The next suggested action would be to visit the municipality jointly with the homeowner with the goal of speaking with a decision-maker that can fully comprehend the events that transpired and reverse the rescinded approval. *** President Statewide Windows & Doors, Incorporated Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) I don't agree, because Statewide has have had over six months to correct this issue. All I hear is that hey are working on it... This is not my responsibility and they are stalling and for reason. I'm guessing statue of limitations... Statewide is in code violation and I have given them contacts at the building department to speak to. I don't know what they are waiting for.. Business Response We continue to go in circles responding to the same complaint which is detracting us from fixing the actual issue which we have discussed at length. The city approved the permit, surprisingly retracted the permit and we have been working diligently to determine what needs to be done to ensure the permit is approved and closed out once and for all. We ask for the customer to exercise patience as we appear to have made recent progress with getting a definitive solution from the city and we are working with a vendor to execute the solution. We don't even know how statute of limitation applies in this instance nor do we care because we are not looking for a legal loophole. We would like to resolve the matter and make everyone happy. They sent someone to look to add sprinklers first part of August and he described what it would take. My home would be a mess, PVC pipes running through not to mention the construction that would need to be made after completion? I need to sell as soon as possible. this has been since January. How much patience am I supposed to have? This is not acceptable... I am physically sick over this mess and it just continues...They should have know the county permit requirements before the job started. Wish I would have cancelled the the contract in the beginning when they ordered the wrong windows for the job.
