After working for Heritage Web design as a outsource writer and having our payment schedules changed and having more and more hoops added each month to what we were suppose to do to earn our $.05 a word I was glad when they had a downturn in business and could no longer keep my contract.

I turned in my last invoice and was expecting my check in a timely manor. This did not happen. I had heard rumors that they shorted, "lost" or took their sweet time paying you for your last check but only had a problem with them once until this time. Checks are sent out and you have to give them 10 days to reach you. I usually received mine within 3 days so I called to ask if they had sent them out. (that was the one problem; once they "forgot" to send out everyones checks for outsource.

I was then told to wait the full 10 days. I went on vacation and came back 4 days after the 10 day time period. Another 2 days and I finally got my check. I was working so I tried to cash this final check 3 days after I got it. I went to the bank and was told that there wasn't enough money in the account to Clear the $240 check. I overheard the teller talking to the phone help guy and they were over $78, 000.00 in the hole!

I just wanted to warn all those who have heard the rumors and thought it was just a bunch of bitter people, well yes and no. Are these people bitter, yes because they haven't gotten what they were suppose to and no because I'm sure somewhere there are people who have never had a problem with them. I unfortunately am not one of them. Warning do not expect any money from them. You may not get it.

I'm the orig. poster and I did get my check and three days after I got it I got a call from "accounting" and they wanted to see if they could FedEx me a new check. Um yeah got it and bu bye lady. Good luck to all you trying to use HIT and I am so glad that I'm working my own thing and actually getting paid from my own clients!

WOW! I thought I was alone in this. As I am reading this, I feel like someone has been spying on me and writing my problems with them. Well the short version of my story is, like all of you, the sales person was very convincing and my account manager was nice at first. My account manager started with Austin Miller, he told me that I would have a draft in one week after I submit what I wanted for the website. I send him what I wanted before that conversation was over (I had everything prepared). Almost two weeks later after trying to reach Austin, I receive a phone call from Eric Taylor (all of a sudden my new account manager), promising me that he will send me a draft in two days (two weeks later and all they did was put my company name on the layout that I chose). Four days after that I could not get a hold of Eric. Lance A. now my new account manager (3rd), sends me the same draft Eric send me a week earlier. A week later, again I cannot reach Lance A. but I receive an email from Scott Devine (4th account manager) with a link to my draft ***yes you guessed*** the same draft that I had received two weeks and a week earlier now for the third time. This time he send me instructions, that I should send any changes to another email. With every new account manager, I send an email with an attachment explaining everything in detail what I wanted with all the words for my page and instruction of how I wanted it. So I resend it for the 5th time to the email he told me to.

Now it has been 4 weeks and my site still looks the same. I called and after 2 hours I finally spoke to Chris Page (5th account manager), I again now for the 6th time send him the email with my specifications and he said I will see a draft in two days. LETS see what happens.

I was looking over the contract and it says that my account manager will introduce me to my designer, who is suppose to conduct an interview to better understand what I want. So I asked Chris if I could just speak to my web designer so that I could just explain to him/her what I want, he said that the designers do not speak to the customers. I believe that is a breach of contract. I do not know if any of you where able to speak to a designer, but I was not and as I said, that is a breach of contract. Utah County, State of Utah is one of the leading places nationwide in white collar crimes that go un-prosecuted due to a lack of funding and allocated resources.

The Utah County Attorney cannot or will not investigate nor prosecute a crime without a police report. Once they receive a report, they must choose which cases to pursue. NSF checks payable to employees or consumers are low on the list. They refer the lack of payment of wages to the Utah Labor Commission. They refer the NSF check to customers to their local police department. The local police department refers the victim to the police department where the business does business, which in this case is Provo Police Department.

Consumers must file a police report before the County Attorney can even consider the case regarding the taking of funds from account without authorization, the promise to deliver services and the keep of funds paid even though the services are never delivered or delivered satisfactorily.

The Utah County, Provo Police Department discourages the filing of police reports, claiming that the victim has to prove intent. They have also informed individuals that they can take the report, but that the County Attorney will just send it back to them and do nothing.

The Attorney Generals office gives out this response:

“Thank you for writing to the Utah Attorney General's Office. The Attorney General’s Office is counsel to the state agencies. A case would have to be referred by a state agency in order for this office to get involved as we can only advise our client agencies. The Labor Commission is a state agency and they would have to refer a case to our office in order for us to get involved and we would represent them in court.

I trust you will find this helpful.”

The BBB take reports, it does not resolve them nor does it possess any authority to do anything about the complaints. It has been under investigation for buy outs for improved ratings, though this company has the lowest rating it can get. Filing a complaint with the BBB make the complaints available to anyone using the BBB as a reference, however the marking of the complaint as resolved does not necessary mean to the satisfaction of the Consumer.

You can continue to work for the company and file a wage claim. If you have not been paid, we encourage you to really think about why you work for free. Many employees who have left the company have found new jobs and are much happier due to the elimination of the stress of not know if or when they will be paid.

Keep in mind that this company will use the contract against refunding any payments.

11. Completion Timeframes
Client understands, agrees and acknowledges that HIT does not guarantee a time frame for completion of ANY website.

34. Cancellation Fee and Refund Policy

MINIMUM CANCELLATION FEE – Client agrees that a minimum cancellation fee of 50% will be retained by HIT on all cancelled accounts even if no work has been started.

100% cancellation fee will be retained and NO REFUND will be issued by HIT if Client cancels after 90 days from the initial sale

No Refund will be issued on any website cancelled after services have been rendered, including but not limited to, the design work having been completed and/or the website taken live.

Beware of any contract that states:
• cancellation fee of 50%.
• does not guarantee a time frame for completion.
• no refund after 90 day of initial sale.

Such a company is not under any pressure to perform, they postpone the work as long as they like and then claim that it is past the 90 days and you are not entitled to a refund. There are plenty of developers out there that will not have you sign a contract such a contract. An ethical company would provide a full refund, if services are not rendered, they would also deliver a product to the full satisfaction of the purchaser.

Be advised that this company does not own the web servers that the sites are hosted on. At present they lease the server space through Fibernet, they use freeware OS and server software. Their contract locks you into payment of one year of web hosting through them or you do not own your site.

This contract is too one sided and not for mutual benefit of all the parties. Stay away from it.

OTHER INFORMATION:

This company owes more than 8.5 million in taxes running back to 2006. They owe approximately $340, 000.00 in back wages with a bimonthly payroll of $120, 000.00 or $240, 000.00 per month. Plus they have a judgment against them for $44, 000.00 from Aetna Health. They have no assets and lease a run down bowling alley.

They receive an estimated $600, 000.00 in monthly merchant transactions.

The inside set up resembles a boiler room. It does not presently look like the pictures on its site. It is fairly dark inside because most of the lights are off. Carpet is torn and unclean. The treatment of its employees has been described like a sweat shop. Several employees have lost everything and have become homeless due to the non-payment of wages.

I suggest that you follow my steps to get your money back, and hopefully you used your VISA or MasterCard when you went with Hit Web Design, because if you went with American Express or Discover Card it will be harder to get your money back.

Step 1: Call your Bank or Credit Card company, and do a charge back. Do not let hit get any more of your money and try to get as much of it back as you can.
Step 2: Contact the Utah Attorney General's Office and file a formal complaint with them about your relationship with Hit Web Design.
Step 3: Contact the BBB and file a formal complaint with them.
Step 4: Contact your local newspaper, radio and TV station and inform them of your experience.
Step 5: post ALL over the internet your experience, and post your results!

Utah Code Annotated reads in part…

§34-28-3. Regular paydays -- Currency or negotiable checks required -- Deposit in financial institution -- Statement of total deductions -- Unlawful withholding or diversion of wages.
(1) (a) An employer shall pay the wages earned by an employee at regular intervals, but in periods no longer than semimonthly on days to be designated in advance by the employer as the regular payday.
(b) An employer shall pay for services rendered during a pay period within 10 days after the close of that pay period.
(c) If a payday falls on a Saturday, Sunday, or legal holiday, an employer shall pay wages earned during the pay period on the day preceding the Saturday, Sunday, or legal holiday.

(e) Wages shall be paid in full to an employee:
(i) in lawful money of the United States;
(ii) by a check or draft on a depository institution, as defined in Section 7-1-103, that is convertible into cash on demand at full face value; …

§34-28-4. Notice of paydays .
(1) It shall be the duty of every employer to notify his employees at the time of hiring of the day and place of payment, of the rate of pay, and of any change with respect to any of these items prior to the time of the change. To stop the bounced payroll checks or bounced check you must report the abuse to the State of Utah, Utah County, Provo Police Department. This is where HIT AKA Heritage Web Design, AKA Heritage Management Services, Inc. is located. The issuing of Non Sufficient Funds Check is a crime under Utah Code Annotated 76-6-505. You can search Utah Code Annotated online and read this for yourself. The police can not stop this fraud if it is not properly reported to them. The more people willing to take appropriate action, will stop this practice. Making comments on this site has not put a stop to anything. The second thing you can do is to provide Heritage Management Services, Inc. with a Notice of bad check pursuant to Utah Code Annotated 7-15-1. The wording that goes in the notice is contained in the Code it can be found by searching google. There are Notices that contains the wording on the web for free. Search the Web for Utah bad check Notice. The third thing that you need to do is file a wage claim with the Utah Department of Labor. The form is available on the Utah Department of Labor's website. There is a 5% penalty per day for up to 20 days for failure to pay the check when due. The answer to the question, can I still work there and file the claims? The answer is yes. Many ask why someone would continue to work under such horrible conditions, some don't have confidence they can find another job, while others don't want to lose their medical benefits. Each decision is very personal. However, you are not helpless to stop this unethical practice, which is in violation of Utah law. To do so you must take the correct action to stop this practice. As of 1 week ago the bad checks, non payment of payroll checks continues. To frustrate the collection efforts, the Central Bank Manager Gary Jensen is now refusing to issue letter or any verification to the payee of NSF checks drawn on Heritage Management Services, Inc. Payroll account. Mr. Jensen may be contributing to the cover up of the crime of Heritage knowingly issuing bad checks. Mr. Jensen State he promised Heritage that he would not issue any more letter. Complaint about this should be directed to Matt Packer at Central Bank. You can also send a letter to the Office of Thrift Supervision. Depositing the check into your own account may result in you being charged a fee for a returned NSF check. If you issue your own checks off the deposit and the check bounces you will then have additional charges as well as the headache of coming up with the funds to make all of the checks you issued good. Lastly, you can file a civil suit for damages of all costs you incur as a result of Heritage issuing bad checks. Keep a file of all your additional expenses including late fees. Under normal situations that are a simple and rare oversight, I would not suggest any of this. But this company's practices are a joke and not a funny one.

I have worked for lots of companies. Of those companies, I have worked for some bad and some good companies. HIT brings home the award for being the worst employer EVER. After my second day of "training" I was told by my trainer how much people hate the company. Something I should have done before I started. I went home and read through website after website of complaints about the company. It was confusing to me at first how HIT seemed to want to make employees happy. After all, chair races, wrestling, bowling, golf and loud music in all departments accounted for 1/2 of the work day. I went through the next two weeks trying to see how I truely felt about this work environment. I realized that everything I was ever taught about customer service (15 years worth) this company did not stand for. This was evident in just about every aspect of the company. Dave Aiken himself tried to say how the company just needed good people. But how can a company know how to hire good people when management itself is not good? I remember trying to help people and hearing peoples complaints. For a month I heard the same response from my manager with every complaint I ever voiced for the clients.The responses I got 100% of the time was..."I dont care", "Let them cancel", "you cant make everyone happy". Imagine trying to help someone and this is the response from management? I also got to hear of contracted employees calling trying to collect what was owed. Or customers threatning action not only against the company but you just because you work there. I have seen Dave Aiken pull the company together for a meeting to talk about how far the company has come even though they had to fight such a huge "attack on the company". I dont know what this attack was but really I hope at some point this company gets put down. A business of HIT calabor does not deserve peoples hard earned money nor do they deserve the good employees they supposedly look for. I can go on and on about this company. As I have many, many negative stories, and experiences with this company. MY advice to anyone looking to do business with HIT Web in any manor...run. It will save you many gray hairs, and gray hairs are hard to get rid of.

I called to see if these "complaints" were true. Yes they were 100%! Within 24 hours, I received over 25 emails from 10 people, and over 40 missed calls and voicemails. These people DONT STOP. I gave them a phony credit card number to see what would happen. After I did that, they stop calling for i'd say several hours. They tried to run my card, and they called and emailed back every 10 minutes. I cannot believe how immature this company is. A quote from the sales rep, "I really would appreciate it if you bought this website, my manager said if I don't i'm fired." Thats complete BS, and I hung up. DO NOT give them your banking or credit card numbers. As soon as you give this to them, they will stop calling and emailing you. They will not provide the services for at least 2 months, and there quality sucks. Google Heritage Web Design to see why they changed their name.

I'm pissed someone didn't file a law suit on these people.

I have been predicting this company's downfall for a while now. I'm sure it will be coming sooner or later. The place is so terribly run from the inside out. The people in management know next to nothing about website creation and put way too much work on their employees.

At first they had us juggling 20 customers at a time, then it went to 60, then 80+. That's way too many people to deal with for one person. There's no way anyone can keep a promise of getting their website done in 2 weeks when they don't hire enough help.

On top of that, employees (minus mangement and owners) don't get any health insurance until a year of working there. But they either get fired or quit before then. The only way this company stays afloat is by shafting their employees of benefits and by making monthly profits off webhosting.

On top of all the work they dump on their employees, they also have them answer phones all day long. And they wonder why projects can't get done on time? You can't have your designers, programmers, etc. answering phones all day when they're supposed to be working on the sites. They have this thing called a phone queue. Since they obviously don't have enough customer service/secretary type positions to answer phones, random phone calls come in all day long. Yours may randomly ring. Usually its a complaint about a customer you never heard of or a website you never worked on. While trying to figure out what is going on with someone else's client (either current employee or ex-employee) valuable time is wasted that could be used working on people's websites.

On top of that, their tech support department likes to dump their responsibilities on other departments. This greatly adds to the chaos and frustration there. It is not any departments responsibility other than tech support to set up emails, trouble shoot problems. Other departments have no time to deal with these issues when they've got 80+ clients to talk to on the phone weekly and work on their sites.

It is horrendously understaffed and overworked employees. The owners are idiots and know how to run a business just as much as they know about websites. Good riddance, I say.

How can we start a class-action lawsuit because something NEEDS to be done about this! They can't say they will provide a service and not complete it. I read the TOS agreement and it stated in the contract that websites had NO TIMEFRAME OF COMPLETION! This means that they can BS you as long as they want! At $39.99 a month for web hosting on a site that will never be completed, they'll BS FOREVER! Also in the TOS (at the bottom of the contract) they stated that if you write a complaint about them on any website they can charge you $2, 500.00 and an additional $100 every time the complaint gets a 'HIT'! I guess that's what HIT means. They'll HIT you in the pocket!

This company took my money too. The salesman told me all type of lies to get me to give a down payment. They started off on the wrong foot getting my domain name wrong. i had sent out major email blast for a site that didn't exist it took me about 3 days to realize i had been really scamed. so i requested a refund they didnt even start on my site but claim i can only get half my money back. called a humdred times with diffferent scenarios of how we could move forward. When i told them i was not intersted they just hung up on me. complete scam company there full of promise and are not professional. i am ready to get with others who have been jipped and sue this company.

I'm a journalist and I think it might be easy to simply call as an actual customer and record an entire case...That we then allow the paper to reveal.

I can't imagine that it would be difficult to catch them red handed.
After all, they are Heritage Web.

I advise you to go to your bank and do a chargeback. I used to be a client of HIT web design, I paid $2, 000 for a website, they gave me the run around and asked me to contact their management. Once I contacted my bank and sent my bank all the information, within three months I got a FULL REFUND from the bank. These people are crooks.

If anyone reads most complaints against HIT, it is striking how many cut and paste, generic responses they make, almost always blaming the client. This is a company full of psychopaths, believing they are entitled to rip off "suckers, " aka many consumers.

See how most of their responses lack a full name (if a name at all), title and phone and fax numbers?

This company has no intention of helping.

They are a largely fraudulent company that the city of Provo, the state of Utah should shut down, make numerous arrests and take to court before prison sentences are handed down. Complaints against them are not isolated incidents, they don't resolve them either. If you look closely at the BBB, their grade is a C, which is terrible, and resolutions don't indicate consumer satisfaction, they indicate the credit card company you use has washed their hands of you. That's "resolved" to them.

HIT will not finish most people's projects, they will not provide a degree of customer service beyond "F" quality and you will lose a bundle.

Spend money on the lottery. Even as itsy-bitsy as those odds are that you'll accomplish anything more than wasting your money, there is the smallest of chances you might actually get something for your money. With HIT, that is highly unlikely.

They post many fake testimonials, they put up some feel-good thing about Haiti relief to deceive you.

LEARN FROM OTHER PEOPLES MISTAKES.

Don't let your dream be stolen.

I'm not sharing my name for one reason. This company is vindictive and mafia like in their business dealings.

I payed 200 dollars to have flash buttons put on my site. After a month of going back and forth with customer service they told me it was already completed when the work never started. They said when you hover over the buttons they flash green and I told them thats been doing that for 4 months. They wont refund me they said they just did that even though the technician says he didn't do anything. Heritage Web Solutions now known as hit wont help me. I have sent tons of emails to all their complaint departments they will most likely post after I post this saying contact there 800 number and or email them at customerservice@hitwebdesign.com or qca@hitwebdesign.com or ceo@hitwebdesign.com Trust me you have to send tons of emails to those three emails to get a response. I have called them so many times for help and they wouldn't help me. They are now riping me off saying the work is done. HIT web design stay away. There customer service wont help. All the like to do is sell there service and make you wait months to do anything even though they have the resources. They will tell you after you sign up they have know SLA that's service level agreement. My site was supposed to cost 2999 it's now cost 2000 and still not done. This company will rip you off. HIT Web design should put and S in front of HIT. This company is also Mormon Owned. Their articles of faith state be honest in your dealings with your fellow man. I thought when i signed up with them they were honest. They just sell empty and very late results. I have emailed all of them 800 plus times since the start of my site and its still not done. HIT web design when you read this, this is no new news for you grow up and be honest will your customers tell them we will finish your site when its conversant for us. Also the designers will only email when the site is done so your site will never look the way you want it unless you call and email hundreds of times. Come on give me an AMEN on this report. Just google search HIT for reviews I am telling the truth as God is my witness and I am LDS also. These are just bad mormons.

I started up a new company, and my web designer was out sick at the time. So I saw this company, Heritage Web Design now known as hit web design. The guy who answered the phone, was really polite and helpfull. I got what I felt, was a fair price for what I needed. I ordered and gave them all the information, that was needed about my company. They took the payment, I didn't hear anything for a week or two and no emails from anyone. So I called, them back and they wanted more money, becuase what I was quoted. Was inaccurate, it should have costed more than I paid. I refused and told them to cancel, they was all like I am sorry. I will goahead and upgrade and you don't have to pay anything else. 2 months went by, no response or anything. So I called them, and got the run around. Finally
I told them to cancel it, they said they couldn't since they filled their part. Which I was like "WHAT" and they said it was completed, all I have to do is give them more information. I explained, that i had already gave them all the information, that was needed. So I said just cancel it, so they transferred me to the cancellation department. The guy there was nice at first, then became completly rude. I told him I wanted it canceled, and my money refunded. He said no problem, so I got an email that said it was canceled. A month went by, and never received my money back. I called them back, and they wasn't helpful. So long story short, I had to get my company lawyer, to call them. So I ended up screwed. I got my money back, but kinda lost since I had to pay the lawyers. So don't go to this company, if you need a good reliable web designer. Go to http://sitetology.com, the owner of the company is Ryan Meo. He is great, and has done great work.

I wish I had read the negative reviews before I used them to create my web site. Dealing with this company has been one of the most maddening experiences of my entire life. I was unhappy with the service, the design, you name it.

Sounds to me like someone should have googles reviews on HIT web design prior to working there... even googling HIT WEB DESIGN now ranks this complaint board next to their site, which is a good thing in my opinion since it's so difficult sometimes to tell up front who is good in the web bi, who's great, an who's just plain rotten. Sounds to me like all your complaints did the job just from ranking... Though I'm sure dice they're popular that they'll still mAke money. I wouldn't wish anything bad in HIT, but what comes around goes around. Meanwhile, it makes me feel good in knowing the position this has left a competitor in due to employees issues, not to mention what customers may have dealt with...
