Dear General Manager / Customer Relations Representative,
I am writing to formally register a complaint regarding a service visit to your facility at 2899 Cypress Creek Parkway, Houston, Texas 77068. My vehicle was brought to your location after presenting with several alarming symptoms: a battery warning light flashing on and off, a "Check System" dashboard message, loss of radio control, and ultimately a complete loss of vehicle power, which required the vehicle to be towed to your facility. This letter documents two distinct issues arising from that service visit, each of which resulted in direct and avoidable financial harm to me.
Issue No. 1 — Unnecessary Battery Replacement ($259.54). Upon inspection, your facility diagnosed my vehicle's battery as defective and unable to hold a charge. At the time of that diagnosis, my original battery was covered by an active warranty with O'Reilly Auto Parts. I requested the opportunity to remove the battery from the vehicle in order to exercise that warranty at O'Reilly, which would have resulted in a no-cost replacement. Christian Brothers Automotive refused to permit the removal of the battery for this purpose, effectively preventing me from utilizing warranty coverage I had already paid for. As a result, I was compelled to purchase a replacement battery from O'Reilly at a cost of $259.54. Upon retrieving my vehicle, I brought my original battery to O'Reilly for independent diagnostic testing. O'Reilly's testing confirmed that the original battery was in good condition — it was not defective, but merely needed to be charged. I have a printed O'Reilly diagnostic report in my possession documenting this result. Because the battery tested as functional, O'Reilly was unable to process a warranty refund. The $259.54 expense I incurred was a direct and proximate result of your facility's refusal to allow me to exercise a valid, active warranty on a battery that your technicians misdiagnosed as defective.
Issue No. 2 — Unauthorized and Coercive Additional Repairs ($3,155.08). In addition to the alternator repair — the only issue for which I brought my vehicle to your facility — your staff presented me with a list of additional recommended services, including replacement of the Front Crankshaft Seal, Water Pump, Timing Belt/Water Pump components, and Serpentine Belt, totaling $3,155.08. I explicitly instructed Christian Brothers Automotive to perform only the alternator repair, which was the presenting symptom and the sole basis for the visit. Despite my clear instructions, I was subsequently informed that your technicians had already removed the components associated with the additional recommended repairs, and that it would "not be to my advantage" to have the original parts reinstalled. This statement left me with no meaningful choice. The components had been removed without my prior written or explicit verbal authorization, and the manner in which the situation was presented made it effectively impossible for me to decline without risking further damage to my vehicle. This practice — commencing work prior to obtaining customer consent and then using the incomplete state of the vehicle as leverage to compel payment — is precisely the type of conduct addressed by the Texas Deceptive Trade Practices Act (DTPA), Tex. Bus. & Com. Code §§ 17.41 et seq., which prohibits false, misleading, and deceptive business practices in consumer transactions.
The cumulative financial impact of these two issues is substantial. I was charged $259.54 for a battery I did not need and was prevented from replacing at no cost under an existing warranty, and I was placed in a coercive situation that resulted in my authorization — under duress — of $3,155.08 in additional repairs that I had not requested and did not consent to in advance. I am requesting that this matter be addressed promptly and in writing.
In light of the foregoing, I am formally requesting the following from Christian Brothers Automotive:
1. Full Reimbursement of $259.54 for the unnecessary battery purchase caused directly by your facility's refusal to allow me to exercise a valid O'Reilly Auto Parts warranty on a battery that O'Reilly's own independent diagnostic testing subsequently confirmed was functional and not defective. The supporting O'Reilly diagnostic report is available upon request.
2. A Written Itemized Explanation identifying and justifying, by policy and procedure, why components associated with the additional recommended repairs were removed from my vehicle prior to receiving my explicit authorization to proceed, and the specific policy under which your facility permits work to begin before customer consent is obtained.
3. A Formal Review and Adjustment of the $3,155.08 in Additional Repair Charges in light of the coercive and non-consensual circumstances under which those repairs were performed, including consideration of partial or full credit, refund, or other appropriate remedy.
4. A Written Response Within 14 Calendar Days of receipt of this letter, addressing each of the above items specifically and in full.
Should I not receive a satisfactory written response within 14 calendar days, I will have no alternative but to escalate this matter to the Better Business Bureau, the Texas State Attorney General's Consumer Protection Division, and, if necessary, to seek legal counsel regarding potential violations of the Texas Deceptive Trade Practices Act and any other applicable consumer protection statutes. I raise these possibilities not as threats, but as the logical and necessary next steps should this matter remain unresolved. I sincerely hope resolution can be reached cooperatively and promptly.
