Binder & Binder Poor Representation

I am a disabled Veteran. The Veterans Administration (VA) has determined me unemployable due to my service connected illness. I wish getting VA benefits was as easy as typing that opening sentence, but it isn't. To get VA benefits you have to fight the Government tooth and nail and it took me around 13 years to get my benefits from the VA.

To qualify for Social Security Administration (SSA) disability benefits you must meet certain eligibility requirements. The VA and the SSA have the same eligibility requirements as both are United States Government Departments. I was told by the VA to also apply for my SSA benefits. I figured that would be easy since I was already found unemployable due to my illness through he VA. WRONG! My SSA claim was denied.

I seen Binder and Binder's commercial on TV and called them because I was exhausted fighting the Government so I was going to let them fight the Government. After all, they said they were specialized in it so I figured it should be a walk in the park for them and I mean literally because I was already found to be unemployable by the VA which is another Government department.

Five years later and three appeals later, I along with my Binder and Binder lawyer who I have never met before was in arbitration. The SSA sent their doctor as their witness who testified that after his review of my medical evidence he found that I was unemployable. I figured it was a locked deal. I mean their doctor just testified on MY behalf! About a month and a half later however, I received a letter from the courts with the arbitration judge's decision. He ruled against me and his reason was because he believed that if I was sick the way I claim I would be skinny, not obese. YES, that was the explanation to his ruling. He disregarded my VA medical records, he disregarded the doctor who was their on behalf of the SSA and he used his own personal opinion to make a decision.

Binder and Binder appealed and the court sided with the arbitration judge. That is when I received a letter from Binder and Binder stating that we had one appeal left which was to the Supreme Court. I forget the cost involved, but I had to pay it up front if I wanted to appeal the Supreme Court. I had to let it go. I was railroaded and although I know that is what the Government does I still hold Binder and Binder responsible, because I do not believe they properly handled my case.

They kept sending me these questionnaires that asked me about my knees, hips and back because they were going for my arthritis. I kept telling them the arthritis was not my problem that it was my Gulf War Syndrome that made me unemployable, but they never listened to me. Hindsight is always 20/20 and looking back I wish I would have gone with a local law firm where I could have actually seen my lawyers face to face when needed.

If you are going to look for a lawyer to represent you against the SSA, don't pick a law firm that is national. Get a local law firm that you can deal with directly with your lawyer when you need to. I wish I could sue Binder and Binder. Any lawyer looking to take a class action suit?

I would also like any information about any class action law suits being filed against Binder and Binder for miss representation of their clients that they were advocates for. They had my case 3 years and sent an attorney to my hearing who had only reviewed my case for about an hour. The attorney could not pronounce the name of my disease much less present the case. I presented the case to the Judge and rehab specialist. Binder and Binder never got any money from me, but wasted a lot of valuable time of mine. Binder & Binder why it takes so long and do i have a chance with just one doctor

if i dont have a chance because of not enough info let me know i dont want to go to a hearing for nothing and then get a bill for something i cant afford, my family is broke i could not pay you if i louse so let me know soon if its worth it to go on with it,

Hi. First of all, Social Security does take a very long time to process. The more medical records you have and the more cooperative your doctor is, makes a ton of difference. I had to go see a doctor, upon the Social Security department's request, one that they chose, to have a complete health physical before I could do anything else. Now, I went without a lawyer. I handled it all on my own, because I haven't the finances for lawyers. Most people will be rejected their first time applying and need to file an appeal. This is when having a lawyer is most useful, or an advocate. I'm sure if you were to talk to the SS office, they could find someone to represent you for little cost. I've heard things about Binder and Binder (no idea how truthful they are) that would give me pause to choose them to handle my claim. I was approved without having to appeal, but that rarely happens. What is the condition you are seeking payment for? There's a list available from the SS office that might help you determine if you have all you need. Good luck and best wishes.

Binder & Binder No Help

I was turned down for ssd 3 times I called Binder&binder for counsel so I talk to someoni told them I need a lawyer to present my appeal so they ask a lot of question and telling me what I needed to do, I explain to them all of my documents where in the computer, told them I worked 33 yrs on the same job, I have OA of bothb kness ben though operations and hard for me to get around. She said before I come in I would have to get all of these things be for I can have a interview. I couldn't get all the things that they wanted and just turned me down. After that I found a great SSD lawyer that knew everything, he told me I would have to wait a yr for my appeal to be called, he just stayed intouch 2months before I had my hearing I got up to dat doctorse doctors notes for the hearing and won my case and got back 2 yrs of money owed to me I very greatful for the lawyer I got just had to tell my story I won my case thank you Binder&Binder for being so cold and not helpin me win my case, y'all need to learn how to talk to ppl needed your help so glad I found another lawyer and he got payed well.

Binder & Binder Pirates

These thugs are true crooks. Their name should be BENDdem and BENDdem. The will Bend you over and stick it to you with no grease. What is worse, they are doing it to the Disable and Elderly. Please do not use them. Please, Please, Please save yourself. They will lie to you and on you. They have NO INTEGRITY, MORALS or Respect for Human life at all. You will talk to the receptionist the whole time and not meet your "Attorney" until the day of your hearing, if you get one. You have to do ALL OF THE WORK YOURSELF. If there is any cost for medical records our anything that has to do with your case. You must pay upfront. Please go to your County Advocate with any Social Service Office. I am in the process of trying getting a refund of $6000.00. Fees they charged me for nothing. The Attorney even came to court to tell me he had NO PROOF to win my case. In the Judges Chamber he asked to postpone. The Judge said NO and ask if I wanted to proceed. I said yes. He sat there quite the whole time. The Judge made a Bench decision "GRANTED". This Attorney then asked for a MOTION. Need I say more. They are AWFUL. Just Awful!

Binder & Binder Lied to

I am a client of B&B and I went to my disability hearing last week. My representative from Binder& Binder told me if I would get a partial favorable decision from the judge we would appeal it. I told her I do not want to appeal a partial favorable decision. She then told me I would still get my disability checks even if I would appeal the partial favorable dicision. Which I found out is a lie. She said they may only pay my backpay to my 50th birthday which was in August 2011, so I would only get paid about 7 months of backpay instead of the full amount when I applied for disability in Aug 2010 and became disabled in Aug. 2008. I need the money now.I know I will be missing out on alot of backpay money, if I don't appeal the decison. Binder& Binder still will get paid some money and I will start getting my disability checks. Does anyone know if B&B can make me appeal on a partial favorable decision if I do not want to. How do I go about gettiong rid of them, if my decision from the judge is a partial favorable decision? And when I do get rid of them, can they charge me more if I don't appeal a favorable decision?

Binder & Binder Liars

Binder and Binder should be sued. I spent almost 6 years trying to get my son disability through them. After the appeal was denied Binder and Binder told me the only way passed was to file a appeal with the supreme court or find another lawyer. I was hoping to at least keep my sons access to pay forr his medical bills and figured there was no way for getting help forr him. When access inforrmed me that unless I did another appeal (which Binder and Binder did not state) he would lose his medical access. It was to late to appeal so I talked to another lawyer through access and was told that my sons previous denial did not show anything from the physiatrist he was seeing. Binder and Binder never submitted that inforrmation to the Social Security or they got paid off so he couldn't get it. Either way I have to start all over again and we lost the almost six years previous. What ever you do never ever trust Binder and Binder. They are a fraud and ripoff. It will be a waste of your time like it was our. Find someone who actually knows what the law is and really care forr people.

BEWARE! These are some of many crappy law firms/lawyers to avoid: Fleschner Stark Tanoos & Newlin, Binder and Binder, Ramon Walls Palanca, Jr., Nathaniel F. Hansford, James W. Ellison, Daniel W. Hamilton, Michael C. Garrett, Benjamin A. Jackson, Jackson R Massey, William Sussman, Jeffery S. Bowman, and Darwin F. Johnson, whom all have had & continue to have- numerous complaints and accusations of violating the law, sexual misconduct, racism, lying about clients to cover up their mistakes, rudeness, falsifying records, and sabotaging their own clients's cases (esp. that of African-Americans)!.

Binder & Binder Mishandling of Husband's SSD Case

We felt after the first refusal that something seemed wrong with the way Binder and Binder was handling my Husband's SSD Case. After the second refusal and he talking to one of heads of B&B who said he would look into the problem personally, we and friends in the legal field although this was not their area of law, our feelings became fact. He was turned down for a third time. Mine you, my Husband is a amputee with 20 pounds of medical records supporting his claim for SSD and B &B didn't think that was enough so they sent him to their doctor, at our cost, for medical evaluation. B&B couldn't get any of this medical information accepted. Thank goodness for the good people we know, they lead us to a law firm that took his case to the Federal Level. B&B very politely tells you that they are sorry and will help if you choose to go to the Federal Level but they don't do that and discourage you from doing it because it is too much work and time envolved. If you are turned down DO NOT give up, their are law firms that can help, but it may take up to another 2 years. My husband finally got his SSD after over 5 years of additional pain and suffering. We shall be always grateful to the Law Firm that helped us. I wrote 2 letters to Charles Binder after all was said and done and my husband was finally getting much needed medical attention but he skirted the issues. My second letter which was very detailed must have really struck a never because Charles Binder's response was that he couldn' t take anything I wrote serously because I was not the client my husband was and that I just should get on with my life. I realize that everyone's issue with B&B is different but if anyone would like a copy of this 2nd letter, it might help you through your ordeal, I will send it. Thanks...you stopped me from using them. After two emails that went un-responded to and a call that I should get in a "few days" two weeks ago...it didn't take much to figure you they are just a people mill.

I just saw that the Senate is wanting Social Security to look at all of the cases that have been represented by Binder and Binder. Some people may even have to pay their won benefits back. If I were you, I would NOT trust these guys. Just look what they did to the guy on the website linked above.

Yes, I too have been working with Binder and Binder and I have to tell you all that they are not what they advertise. They are far from simpathetic too your needs. I am barely able to drive to the Doctor, when I recieved a letter from them telling me that my own doctors exam results were not good enough to win my case. After 2 yrs of treatment and exams and x-rays, and MRI's suddenly all that isn't good enough. It's almost like they are working for the Social Security Administration. I say this because I was told on the phone by 6 of the case workers handling my case, that my case was open and shut. But now I will have to pay $350 to see an outside doctor, which is 5 hours driving time away! or they will not be able to gaurantee me a favorable outcome. I am petrified that I won't win now where before this letter from them I was feeling very confident about my case. Good Luck with them if you consider hiring them.

Here is the scam that can happen because it did to me. I signed with Binder & Binder. I sent them all the info they requested. My case involved a workman’s compensation lump sum payment. I did not expect to win my case. After about five months I got a call from the local social security office telling me that I had been approved for social security disability. I went to the local office and the lady entered all my figures in the computer. After the first calculation I was told that the off-set for my workman’s comp. payment had left me with a 0 payment. The lady then said wait a minute and she re-entered the figures and this time she said I would get about $1496.00 per month. I was amazed and I thought something was wrong. I asked her to confirm it and she said it was correct. She said I would receive this payment for the rest of my life or until my medical condition improved. I called Binder & Binder and ask them to make sure this was correct and they assured me it was. Well 6 months later I get a letter from the social security headquarters stating that I had been overpaid and the payments would stop and a mistake had been made at the local office. I had built my life around this payment and now it is gone and I am ruined. I called Binder & Binder and the rep told me that the local social security offices frequently make mistakes. She also said that Binder & Binder require a $6000.00 retainer to work on over-payments. So you can see that now Binder & Binder have collected their fee for my disability case. I should not have received anything from social security and I will have to repay them around $15, 000. I don’t have that kind of money. I am now screwed as far as future payments from SSD or regular social security. Binder & Binder have their money and I cannot afford anymore legal fees. Does anyone have any advice?

I contacted Binder & Binder in 2006 to represent me for Social Security. I was told to go to Social Security and file a claim for a work-related illness. I filled out all the claim forms online and then was denied and had to file two appeals online. During this time, Binder & Binder said that this is normal for Social Security unless you are confined in a hospital. They said that they had accepted me as a client and would be at my hearing today and then didn't show up.When I asked them why they didn't show up, they said that I didn't retain them but yet I've been on the phone with them 2-4 times a week for months, submit medical records and disk from Social Security, just to be told that I am still a client but need to be approved by their intake department but yet their intake department confirmed today that they had everything that they needed. Boy, was the judge and Soc.Sec. Adm. pissed and granted me a hearing extention and told me to find a better attorney other than Binder & Binder. Now they won't return my medical records or the Soc.Sec. disk that they asked for. These guys are a scam. You have to earn a clients trust before you can earn a clients money in my book. Hell, they never even called soc.sec. adm, to imform them that they were going to represent me and then they had the balls to say that I didn't retain them. Shame on you!

This is malpratice in anyone's book and Binder & Binder should be banned from practicing law in all states of the union. A good attorney will represent you for life and a bad one is used only once at best. If you want good legal advice, listen to your dog, he has more important things to say than these guys. The first thing my dog said when I said that I was going to call Binder & Binder after seeing another one of their ads on Tv, "Ur don no" and then he stretched. Little did I know that this was a sign of things to cum. No I didn't spell that wrong, I'm just as pissed as the judge was today!

Binder & Binder Crooks

Binder and Binder are the biggest joke for a law firm in the world. The judges do not like them and my judge made a joke abou them. I saw many attorneys who were local and the judge jokied and chated with them but when the Binder gal came his face changed. The person they sent to the hearing was not even a lawyer.

Binder wears a hat like he is some good old boy when he is really a native new yorker. These two guys have ripped off many many people. other people I kn ow and sometimes they just send a letter to the judge and do not even want a hearing. (dont want to come that far.)

Get a local lawyer. DO NOT GET BINDER AND BINDER.

Binder & Binder Scam

You were reading a complaint about Binder and Binder.

Filing a new complaint about
Binder and Binder's advertisement says there is no fee until we win your case to collect Social Security.

That coulldnt be farther from the truth.

I HAD to stop them from continuing because I could afford them anymore.

YES!

Couldnt afford it.

Why?

I would receive letters and phone calls saying they needed a check for $30 here and $50 there because this is what the hospitals require...etc.

Their "free" service does not include photo copy fees, medical record fees and any other fee that it takes to work on your case.

I actually fell for this for the first 2 years.

I would get letters asking for money BEFORE they would continue.

I called and was told that the percentage they get if they win your Social Security does NOT include fees needed for the paperwork to get to that point.

YOU as the consumer have to pay for that.

After several hundred dollars I had to stop them from going any further. I was giving up groceries to go even this far.

It's a total rip off.

The company Binder & Binder took my case and started to work. Within 3 months they have taken from me huge amount of money. I asked them to tell me everything regarding my case, but they kept silence. Finally, they called me and stated that I have fooled them and I didn’t have any case. It was the worst and very stupid thing, which I have ever heard. I have problems and this company made the situation even worse than it was before.

I won a settlement with social security with Binder & Binder. Almost two years afterward social security contacted me and said I was overpaid by over $6, 000. I contacted Binder & Binder since they were the ones who represented me and asked for help. They said if I contact them within a year for overpayment they could represent me but they were not responsible or liable to help afetr a year. The problem here is that Social Security did not contact me for almost two years after I won my case. Binder and Binder abandoned me and now I have to find a way to pay Social Security over $6, 000 or I won't be able to collect Social Security after I retire. This means I have not only been left out in the cold by Binder and Binder but will also be by Social Security after I retire. It goes without saying my money has been gone for some time and I cannot pay this back.

Binder and Binder allowed me to ask a few questions at a time and them abruptly terminated the calls. I collected the documents that won my case. The agreed to a fee for a lesser amount, but have refused to refund the difference.

Oh my goodness -- I wish I had read these reviews before I bothered with Binder and Binder. Going on one year now I have been assigned to four different caseworkers; each time I call in for status of my case I have to recite my SS number. My claim has been denied twice; received last notice directly from SSA yet have heard nothing from B&B. When I called to question this I was informed that my NEW caseworker was busy with other clients. Left two messages, have not received any follow up. Have 60 days to file an appeal, I better get busy and fire B&B before they try to charge me.

Binder and Binder ignored my requests that I would obtain my medical reports from my doctors myself and save the outragous fees compared to requests from Binder and Binder directlyto my doctors. Example...one report my doctor would charge Binder $300. for but I got it directly for free. After a number of incidents of Binder ignoring my request about this I fired them as my SSD reps and decided to represent myself. They told me there would be no fees to me after they were dismissed. They then sent me a notice they would be requiring the same fees if I won my case myself as if they were still representing me. The ssa judge me they would be able to still collect. They are bandits. In the end they collected nothing and I will start fresh representing myself.

Contact S.S and make payment arrangements with them. They will take so much from your check each month til paid. I know this because it happened to my mother and they took a hundred dollars a month til it was all paid. Binder and Binder also represented my sister and they just forgot about her for a year. It took her 3 years to get her disability with them.

I wouldn't trust Mr. "We'll deal with the government... you have enough to worry about" to feed my dog! And what's with that idiotic hat he wears in a national TV advertisement? Hey there Bindy Baby!... if you read this just know that if I were you, I'd be embarrassed to ever show my geeky face in public again after airing that lulu! What a puttz! (Not to mention a complete scam ripoff - your day will come and then you can listen to your lawyers tell you "We'll deal with the warden - you have enough to worry about and if you drop the soap, I'd recommend you just leave it on the shower floor!)

Binder & Binder Cold hearted and rude

I just got off the phone with Binder and Binder. I was on hold for an extremely long period of time and when I finally did get someone to initiate my consultation it started out fine. The woman didn't sound thrilled to speak with me but I ignored that. By the time I got off the phone with her I was in tears. She was cold and rude (not what they advertise that's for sure) and accused me of giving her incorrect dates. I almost hung up on her just a few minutes into the consultation but decided to wait it out and see. By the time the consultation was finished and I hung up the phone I had decided that I do not want Binder and Binder to represent me. Horrible, heartless lawyers.

I just saw that the Senate is wanting Social Security to look at all of the cases that have been represented by Binder and Binder. Some people may even have to pay their won benefits back. If I were you, I would NOT trust these guys. Just look what they did to the guy on the website linked above.

Binder & Binder Horrible Lawyers, Can't do the job!

I initially signed on with Binder and Binder in 2005 after I signed up for Social Security Disability, and was denied. I moved to North Carolina with my Husband who had just gotten stationed there. That's when I thought I would need help from Lawyers to file for an appeal. I had a great case worker to start with, and after 5 months of sending file after file, and record after record. Constantly updating them on my Medical Status which was cut and dry. Mind you I am already 100% Unemployable through the Veterans Administration, so how hard can it be to get me approved right? WRONG! These Brain Children passed my file from one dope to another! No one could give me an answer as to what was going on, and no one could keep my file in their hands for longer than 2 months before it was on someone else's desk! I got more and more frustrated as time dragged on. I actually got a letter that the Social Security Department needed me to sign and send back in for me to get a trial, and I was informed that since it didn't come from Binder and Binder NOT to sign it, and wait. So now October of 07 passes, and THEN they want me to sign it! It's passed the due date so now I have to start from scratch all over again! I am stuck with hundreds of dollars in medical records, and over a 1000 bucks spent to send off the said paperwork and to pay for the constant copies, and I so far have gotten NO WHERE! Mind you also that at one point, they assigned my case to their local Raliegh NC Office, and when I called to find out what was going on, the idiot on the other end of the line acted like I was disrupting her entire day, and I shouldn't have wasted my time! You got that right... Mysteriously overnight, my file was shipped BACK to NY, where Mr Binder HIMSELF was now working my case... HAHAHAHAHAHA! Right! I still got absolutely no where! I lost my so called appeal, my other case had gone stagnant. I was so angry that I fired them. They had the Balls to tell me I OWED THEM 75.00 to get back my Medical Records back, after all the money I put into it to do MY part to do their job! Binder and Binder sucks. They cannot do their job. They give you a false sense of hope, and make you think they can help you. I have heard many more stories such as this, one even going back 7 years! Really 7 years to get something approved? DO NOT TRUST THEM! I got the letter for my appeal in the mail, and what do you know, I went by myself to fight for my appeal, and I got it! The Judge that handled my case was fair, and stern. Regardless, I got my own benefits! There is one thing that is scaring me though, and that is, Binder and Binder, even after Firing them, still had their name on my case. I am waiting for the back pay to see if any of it will go to them, and if it does, I am going to sue for that and all the time they lost for me! Trust yourself and go to court on your own for an appeal. It's easy. Just be honest and answer the questions that they Judge asks of you. If I can do it, anyone can...

Binder and Binder have been the biggest mistake I have ever made. Now after they've wasted three and half years of my life, I have had to hire a local firm who actually do care. I cant even begin to explain how angry I am with them. I'm just thankful that I am in Texas and they are way up in New York else I would have already gotten myself into some deep trouble. Don't use them. I would give anything to have not made that first phone call to these clowns. Dam.

To the anonymous lawyer, I say where do I find a counsel that is not in for the money and just to make a difference.
I hired Binder and Binder and I have nothing but a bunch of people not doing their job unable to answer their phone, or return a phone call.
I have 6 major illnesses, I am almost unable to walk anymore and I just got my denial letter today. My doctor was outraged, and could not understand, well neither can I. How do people get it when they are not even sick, and we get denied when we are really hurting.
I am firing them tomorrow but need someone who is going to fight for me, really fight, however, my history with attorneys has been very bad and honestly, when I have represented myself I have done a much better job however, it took me many hours studying the law and how to do it right.
I don't want to pay them a dime to them claiming to be working my case. Also I'm sick and my energy level is not as good as it used to be. I need an awesome attorney, probably newby, broke in debt to work on my case...once they become big and rich their thinking changes a lot.

Binder and Binder is now a hedge fund. The definition of a hedge fund is "a flexible company for a small number of investors (usually the minimum investment is $1 million dollars). This means that Binder and Binder is getting RICH on your disability. Binder and Binder do not hire lawyers to represent you. They hire people to go in to the Hearings and embarass themselves before the Administrative Law Judges. If you want to gamble on your Social Security benefits hire them. They will take your money and re-invest it into their hedge fund.

I am an attorney who represents clients who have cases like this, trying to get disability benefits from Social Security. PLEASE HIRE AN ATTORNEY IF YOU NEED ONE. Most of us who do this work are not in it just for the money; I happen to really like making a difference in others' lives. I, myself, am a sole practitioner. I am the one who has ALL the contacts with the client: I interview them, review the case with them, and prepare them for the hearing, which I attend as well.
I have gotten so many clients who went to their hearings by themselves, but were unable to win the hearings. Ask for references when you hire a lawyer, if you need to.

Binder & Binder Thrown out like trash

In 2004 I hired Binder & Binder to handle my disability case. They claimed to be the #1 best Social security disability advocates. Well...to make a very long story short 3 years later my hearing was finally here. The reason for the 3 year delay was due to the fact Binder & Binder was not sending my doctors reports. I was told they wouldn't send anything that would hinder my case. Instead they just held it up. When I found that out I sent my records directly to social security dept. With in 3 weeks I had a hearing date. One week before my hearing date I received a phone call from BINDER & BINDER ... THEY WERE DROPPING MY CASE ! I was told I would not win my case. They hung me out to dry ! I have a written letter from them saying they would not continue my case.
Although the out come for me was great... I won the case. I am receiving SS disability and I DONT OWE BINDER AND BINDER A DIME.

For any one who needs to file for ss disability... trust me you can do it yourself.

Wow... I applied for Social Security Disability with Binder & Binder in 2011 and had no problems... They did all the paperwork for me.. I submitted all of my required documents... They answered all of my calls as well as returned my calls if they were out of the office... My attorney was GREAT... Very professional and nice.. Didn't take long for me to get my disability... I'm really shocked at these complaints... Maybe I was just lucky... Well good luck to those still trying to get their disability...

Disgusted and Frustrated
I wasted 5 yrs with Binder and Binder. Using Binder and Binder disability advocates was an ok experience. But once my case was being worked by The Law office of Charles and Harry Binder it was Horrible. I could never get a hold of anyone and when I finally did they were either rude and sounded very uneducated. I updated my new address with them many times, at least 6. Left messages which were not returned. Then I found out today they sent me a letter back in March to drop me to my old address. Come On Now! This process is hard enough. I have reached out to another Law Firm for assistance. 🙏

#1 - Binder & Binder are NOT attorneys. They are “advocates”.

#2 - Social Security is nothing but a waiting game. They are understaffed and underfunded. It is not that the lawyer/representative is not doing anything, it is that your file is at the SSA in a pile and will not get looked at or scheduled for months or years. There is nothing for your representative to do during this wait.

#3 - 90% of cases are denied the very first time due to the fact that over half of the denied cases will not appeal. This is from an attorneywho previously worked FOR SSA

#4 - it is not determined by whether your condition is on the list of disabilities, but by how severe your symptoms are

#5 - it is also determinedby if you can do ANY job(janitorial, laundry services, etc.) not just be the job youpreviously had

#6 - contact your Congressman about your case. It's not a guarantee, but it can help.

I have been through this process several times - first for my (now ex) husband who had a rare autoimmune disease (took 2 years from initial filing), and my son who has severe PTSD (1 1/2 years from initial filing), and now myself. I was denied at first Judicial Hearing for SSD and now just got my date for SSI Judicial Hearing. I filed initially in 2013

My experience with Binder and Binder is unsatisfactory and honestly a bit confusing. In 2015, I filed for SSDI on my own. I'm a disabled veteran and had a VA disability rating of 80%. I was denied. So, I contacted Binder and Binder and they accepted my case. Years to get a hearing, during that time I made repeated calls for updates and was finally told that my case wouldn't even go on the list for a Judge until another year had passed. Why not tell me that upfront instead of me calling every few months. That should have been my first clue that I was going to have to do follow-up calls since the workers weren't calling me. The second thing was that each time I did call, I had a new caseworker, which mean my re-telling my story countless times as if my information wasn't in their system.

Fast forward to the hearing. The firm rep contacted me about a week before the hearing and we had a 10 minute phone call. At the hearing, the rep spoke to me for about 5 minutes. Case denied. After the hearing, the rep told me that particular Judge was known to not grant SSDI. Great.

I received letters from Social Security regarding the hearing, along with the Judge's decision. I call B&B and they said they hadn't received any letters. I call again in a few weeks. I was told my case was transferred to The Advocacy Group. Really? Who are they? I contact The Advocacy Group, why didn't they call me? So frustrating. Anyway, they said they're filing an appeal.

Tick tock tick tock. Appeal hearing scheduled. New caseworker each time I call. Rep speaks to me for less than 5 minutes before the hearing. Denied again. Another fast forward, I contact B&B and they tell me my case has been with The Advocacy Group, which is an outside agency. I assumed (shame on me) that they were a part of B&B. Clearly, I'd been officially handed off.

The Advocacy Group filed for a second appeal. By this time, being three years since the initial hearing, my VA rating went to 100% TPD (Total and Permanently Disabled), which is above the VA Unemployability rating though both are 100%. That determination was based on additional evaluations by PhD specialists, four in total.

Second appeal hearing was with the same Judge and yes, he denied my claim again. He wrote in his report that he was giving little weight to the newer evaluation evidence due to previous evidence (3 years old) of my Primary Care Physician (a nurse practitioner) not supporting my disability. So, basically, he's holding on to old evidence and disregarding new evidence by four specialists. Not to mention my initial injury was while on active duty in June 2000.

After calling and leaving messages, I was told The Advocacy Group is no longer handling my case and I can get an attorney. So, what was B&B? I'm beyond frustrated. I was told there wasn't legal grounds to file another appeal. What? I'll never use a large firm again for any reason.

I'm currently researching local firms to find one who will represent me and actually fight for my case versus one like B&B who shuffled me off to a side agency who wasn't even aware of what was in my medical files.

I hired Binder and Binder in August 2007 I hired them based on my Dr's recommendation He had used them when he was ill and couldnt practice for 3 yrs Dr was a neurogist and told me that I was disabled All paperwork was submitted via mail and info exchanged via phone I had a female rep whose name I no longer remember Most times I was able to reach her on phone if I needed to ask question I read my contract and it was stated in that contract that some Doctors charge for copies of records and that's the client's responsibility Mine never did I never had any real problems with them I had 2 very helpful doctors who filled out functional ability forms and did narratives Both stated I was totally and permanently disabled from performing any type of work I got a fully favorable award letter 6 mos after applying I am grateful I did not have any problems with Binder And Binder Never had a hearing or had to go before an admin law judge Perhaps it was the luck of the draw so to speak and I am etetnalky grateful that it turned out well for me I really feel badly for all of the people who have had terrible experiences but felt I had to tell my story

I hired binder/binder 3 years ago, it's just like hell when you hire them. Nobody knows what's going on, don't even try to leave a message, the 95% of the time they won't get back to you, leaving a voicemail is even worse, I've never had any of my voicemails returned in the last 3 years. They don't do any work, they want you to get all the records, figure out yourself if you have one of the listed impairments. They say to me they've contacted my Doctors office for records multiple times when they haven't; both times I went to court, NONE of the records were ready, only the ones I brought to court myself. The attorney never returns your calls or emails regarding the hearing, you're lucky if you get a call the night before to speak with the lawyer for 30 min. If you miss their call like I did for the second hearing, you'll never get them on the phone; I tried calling them back several times all day, they never answered or returned my call. At the hearing, they might as well not even have been there. You do all the talking, they offer no advice at all during the hearing or step in to help. When I got fed up with waiting for binderbinder to get my records and the due date to submit was approaching, I called my Doctors' office myself to request copies of my recrods. Every office asked me why I was doing all this work, I have a lawyer, it's their job, I said, yeah, I know, tell me about it. When I brought this to binderbinder's attention, they wouldn't let me talk, yelled at me and hung up the phone.

I could go on with so much other unprofessional, downright dirty, no good stuff they did regarding m case, but no one in the world has that much time. I'll conclude with this; 5 days before the deadline for the appeal, they send me a letter stating they were no longer going to pursue with my case and if I wanted the records that I sent to them, then I have to pay them to return the records I that obtained for them, back to me. I called, and was told by a secretary, I guess, because of course, my attorney was not available, that my case was "still being reviewed, it was sent to another office for another attorney to look over the case' Needless to say it took almost 2 weeks to sort this out, the deadline passed, and I had to type up and file a petition with the court to ask for an extension for my appeal. I started looking through m records and right there, in the beginning, states as clear as day, in black and white, where the medical documentations with supporting evidence Disabilit needed. Now, I have to send another request for Disability to reopen my case. If binder binder was just competent at their job and knowledgeble, all they had to do was just read my medical records, I wouldn't have needed to wait for 3 years, I wouldn't have had to go to court multiple times, I wouldnt be in this position I'm in right now.

I been trying to get disability thru binder n binder since 2012 an I still am with no insurance an no income an be pending in family to take care me an my finances due to them unable to do their job...I wish i had never went with them. Ppl say u learn from ur mistakes...but mistakes like this is to hard to live by...I need to visit my doctor more an do blood work an i can't I dont have the money for the fees. I wish i could sue these ppl for my back pay I can't get from social security...I dont know how to do that.

Yes i have repeatedly been in contact with this same attorney group now since my SSDI claim in 2008 and been in compliance with thier every inquest and requirement to bring my claim to the adjudication stage now i am requesting them to expedite the decision writer's and to get my decision in writing and mailed in which they have neglected to follow up on, i am under on going unusual hardship and medical issues and mobility issues that this should merit consideration for expedited processing from a legal standpoint and they are not treating it that way .

Do not use Binder&Binder. After a 4 year battle for my disability we finally won and I also was going to receive 4 years of back pay plus my kids can draw off of me and they were supposed to get a years worth of back pay. I was supposed to get back nearly 50k but they are trying to take all of that. This isn't the last people will hear of me because I'm gonna make sure everyone knows how they rip people off.
