I am extremely disappointed and concerned about my experience with Vivint and one of its sales representatives, Mr. Rosenberg.
A Vivint sales representative came to my home offering alarm and security services. I normally do not entertain door-to-door salespeople, but I agreed to listen to the offer.
Before agreeing to anything, I made one issue absolutely clear: I was in the process of preparing for a major purchase and was expecting to receive a favorable interest rate. I specifically asked Mr. Rosenberg whether signing up for Vivint would result in a loan, financing account, or anything else appearing on my credit report. I explained that if it would affect or appear on my credit, I was not interested and would not move forward.
Mr. Rosenberg assured me that it would not appear on my credit report. I relied on that representation when I agreed to proceed.
Approximately two weeks later, I received an alert from Credit Karma informing me that a new loan/account had been opened in my name. I was extremely alarmed because I initially believed that I had become a victim of fraud or identity theft.
After investigating, I discovered that the account was apparently related to financing for the Vivint equipment. This was completely contrary to what I was told before agreeing to the service.
Had I been properly informed that Vivint’s equipment would be financed through a loan or financing account that could appear on my credit report, I would never have agreed to the transaction.
I have contacted Vivint several times attempting to resolve this matter. Each time, I have been told that someone would contact me or call me back, yet I have not received the promised assistance.
I am requesting that Vivint immediately investigate this transaction, including reviewing all documents, electronic signatures, recorded calls, sales notes, financing disclosures, and communications associated with my account and Mr. Rosenberg’s sale.
I am also requesting a written explanation of:
What financing account or loan was opened in my name;
Which financial institution issued the financing;
What authorization Vivint or its financing partner relied upon to open the account;
What disclosures were provided regarding the financing and its potential appearance on my credit report;
What steps Vivint will take to correct this situation and address any impact on my credit.
I relied on the salesperson’s explicit representation that this transaction would not appear on my credit report. I expect Vivint to take this complaint seriously and provide a prompt written resolution.
If this matter cannot be resolved directly with Vivint, I am prepared to dispute the account with the appropriate credit bureaus and financing company and submit complaints to the appropriate consumer-protection agencies.
