Carey Lowe misrepresented to us in Oct. 2009 that we could rent out discounted Premier Pueblo Bonito Timeshares to others. The ability to rent Premier timeshares is forbidden by Premier's Terms & Conditions. The salesperson lied to us about this ability. A major part of our presentation was on the subject of an income opportunity of being able to rent out discounted Premier timeshares for a profit. All this information was buried in the back of a 33 page booklet that we received after the documents were signed. We were required to sign the Cardholder's Agreement which states " I realize and understand that the earnest money deposit that I have credited towards my purchase contract is non-cancelable and non- refundable." By requiring us to sign the Cardholder's Agreement and deliberately inducing confusion by not informing us of the five day cancellation period as required by Mexican law, our rights were violated per the Mexican Federal Consumer Protection Law. We were required to sign the Cardholder's Agreement, which is an illegal waiver. Article One and Article Thirty-Two of the Mexican Federal Consumer Protection Law protects consumers against such despicable tactics, therefore, our contract is null & void. Article 32 states the following: The information or publicity relative to goods or services that spread by any means or forms, will have to be truthful, verifiable and clear of texts, dialogues, sounds, images and other descriptions that induce or can induce error or confusion, by its inaccuracy. Therefore, the five days cancellation period was violated.

We received an e-mail from Carlos Barrera-members services stating the following: Please be advised that your purchase agreement has no provision for cancellation after 5 days as described on 12-C. To cancel your contract, please send a notarized letter stating your wish to cancel and acknowledge that under the terms & conditions of the contract the deposit is not refundable 5 days after purchase. I would also state to this individual that my contract has no provision for cancellation of the contract, yet they are willing to cancel because they know they are wrong.

We will pursue every avenue available to us and will not rest till our deposit is refunded. I will spend the rest of my day making complaints about this organization and expose them for what they truely represent - and perhaps help some one else avoid such a ruthless sales practices. I will also make a complaint to PROFECO and any other organization that is available to the consumer.

Me and my husband been scam as well we vistited on 10/30/2022 have submitted emails certified letters and everything and no one has responded we was scammed out of 2922 for deposit can someone please help

Thank you for creating this post! My husband fell victim to the lies and deceit at Pueblo Bonito Sunset and purchased a Timeshare in Dec. 2016 when we were there for what should have been a nice break for our family. The sales person literally kept my husband all day. Our young son and I became worried, but finally he returned in the early evening thinking he purchased something of worth to use as a vacation rental, and to pass down to our son, since the sales people told him he would be able to do all of those things as well as enjoy visits and bonus points. My husband was sold a pack of lies. We have never been able to get the dates we call for, and we are always told call back in a few months, maybe something will open. Now, in 2021 they say they are only operating at 50% occupancy so it is even harder to book. This was supposed to be a vacation rental for us, as well as a place we could come to at the end of the year from time to time. Pueblo Bonito Sunset in Cabo San Lucas is a complete scam! A complete lie! Clearly, no lie is too great in an effort to make a sale at the expense of their unsuspecting victims. I am on a mission to learn how to get out from underneath this ball and chain and inform everyone I can about the scam they are running. They currently made 30K from our family, and when I reached out to a place that buys and sells Timeshares I was told we could make about 1, 500-2, 000, and that we would never be able to get back the 30K my husband spend. Not kidding! I also called Pueblo Bonito Sunset to find out how to sell the Timeshare and they say they don't do that. I searched for hours today to see if anyone wants to do a class action lawsuit against the thievery happening to unsuspecting vacationers. Please let me know if there is already a class action lawsuit I can join, or if anyone wants to pursue starting one. I can't stand this unlawful company. I can't take one more of their lies. They basically lied about everything and stole our money without regard.

How can a Mexican business report to US credit bureaus? Has anyone questioned this?

Thousands of International travelers, particularly from the US and Canada, have fallen victims of timeshare fraud while vacationing. Resort developers hire skilled salesmen to represent their timeshares as many different attractive packages, such as financial investments, deeded properties, or vacation clubs, just to increase their sales.

I theink we need to file a class action law-suit against Concord Servicing and Pueblo Bonito. They have been in business togetheer for over a decade scamming Americans. Once Concord Servicing Group popped up on my credit report, theey tried to use anotheer collection agency to collect, however, I wrote theem and theey have not pursued thee collection as I have provided all thee details, cancellation information, etc. My deposit WAS refunded via my credit card company, however, my credit is still affected. Pueblo Bonito tried to manipulate me as well stating thee deposit was not refundable and thee waiver theey produced IS illegal and does violate Mexican law. CONCORD SERVICING GROUP and PUBELO BONITO have been working togetheer for years scamming Americans. Since Concord is a 3rd party loan service AND collection agency theey can really mess up your credit. I filed a despite withe thee credit bureau and Concord did not respond. The credit bureau removed thee info from my credit from my credit report but Concord later reported me AGAIN. I had to file a 2nd dispute. The credit bureau stated theey do not have to respond which means thee details will get removed... BUT theey can report me again if theey want. Makes NO sense! Is theere an attorney out theere willing to assist in a CLASS ACTION lawsuit? Laws have CLEARLY been broken and I have a response from Pueblo Bonito in which theey admit to violating Mexican law, thee law in which thee contract is governed, as well as proof I canceled withein thee 5 day rescind period. I also filed a dispute withe my credit card company thee 4the day after I purchased thee timeshare since Pueblo Bonito was not responding to thee cancellation. LYING SCAMMERS!

They should acknowledge that they didn't provide you with the enough information at the moment of purchase, such as telling you that ALL timeshare contract purchase in Mexico, you are entitle to 5 days after the purchase to cancel your timeshare contract with a TOTAL refund of your monies, no questions ask.

so does this mean I can't get my 5, 000 back the deposit I Paid on may 15 2011? Could I just not pay the rest of the deposit which is another 5, 000 then and just forget about what I signed or will they get into my account and call my bank?

Everyone needs to read their contract line-by-line. If it isn't in the contract, you are not getting it. It doesn't matter what the guy told you or implied. Salesman lie.

As for a class action lawsuit, on what will this be based? Your contract or he-said/she-said? And then it's in Mexico. If you guys come up with a viable class-action suit, I'm in. But the contracts are pretty air tight. I'd be happy to just be out of the contract.

BTW, so you know, yes I too own at Sunset, for 8yrs now. I went through the 5 stages (denial, anger, bargining, depression, acceptance). Now the family and I are sure to take a vacation each year that we enjoy.

We are in. We just purchased this as well and when got home, no such 4 weeks exist. Why lie? Lets do something about this.. We need to stop this scam and get our money back. Please get back.

I too was taken advantage of and lied to this past summer at Pueblo Bonito Sunset Beach. I cannot believe all of the lies they told me! Income property, would be rented out, one-time only maintenance fees. The lies go on and on! Is anyone taking legal action? Is there anyway out?

I was encouraged to purchase at Pueblo Bonito Sunset Beach as an investment opportunity and it seems that similar sales tactics were used with all of you. PB's sellers are taking advantage from many of our conational's making thousands from this timeshare issue every year, I find it very disturbing and I feel that PB's contract is protecting the lies of sales department, why to invest if we are not going to make a profit from it?

Unfortunately, I too fell victim to Pueblo Bonito Sunset in 2006. Like many others, I was lied to about my ability to rent my property. Moreover, each time I called to use my week I was told they were booked. I purchased even years, every other year. It becomes a big deal when you have spent a decent amount of money only to be told the resort is booked out several years.

Will someone please tell me how any of this is legal? Who in their right mind wants to continually pay for something they simply cannot use?

has anyone ever had any luck in getting out of their contract and getting their deposit back? has anyone considered a law firm rivera y gomez; found them on the internet when researching timeshare complaint, but afraid to use them to only get further into this mess. we purchased a week at the montecristo in 12/09 and want to rescind the contract. any thoughts? The contract does not provide any language to rescind in 5 days...plus it sounds like they wouldn't do it anyway.

My wife and I have been fighting with PBSB since last September when we signed a contract and rescinded the following day. They refuse to refund our $4745 deposit and although the sales manager responded to my recission emai, they continue to stonewall and now the servicing company that they send their contract for payment processing has been harassing me telling me that the contract is still valid. I sent them a package via USPS certified mail Return receipt requested (which they signed for) and they still call me and tell me I am late on my payments. I have filed a complaint with PROFECO and will file a complaint with FTC related to Concord Servicing, the service company. Although I contacted Bank of America the day I rescinded I have been unable to get them to refund the deposit. Beware of PBSB and for goodness sake don't give them any money!
