This complaint seems eerily similar to others on this board. I signed up with Nextiva in 2022. Signed a 24 month contract and was told by James Towle, the sales rep that once the contract ended it would be month to month. I signed the contract but was NEVER told that there was hidden auto-renew clause in the terms of service which was a small little link at the end of the agreement I signed. This hidden information has now trapped me into a contract that renewed without my knowledge just a couple of weeks ago. I had decided in June to terminate with Nextiva after having made several requests for help to get our phone number from coming up "spam," then spending money on other companies to help when Nextiva couldn't seem to get it together and then not ever being able to reach anyone in customer service, paying for lines that are unusable, and rates being raised by more than $4 a line. I requested a port of my line on June 30th and was told by the new servicer not to cancel my service with Nextiva until the port was complete...which is what Nextiva told me about my servicer previous to them when I ported my phone number to nextiva. So I waited. not thinking I had a contract. Now, I am being told that the contract auto-renewed for 24 more months as of June 23rd and I will have to pay a termination fee of more than $7000.00. Here are the issues: Terms and Conditions are not clear, nor are they easily found. They were not relayed to me regarding auto renew and when I signed up and was explicitly told I would be month to month after 24 months, I expect this to be followed through on. I was NEVER given notice of the auto-renew when it came time to do so and there is nothing on my account that shows term length, the fact that auto-renew occurred, etc. In fact, I have an email from April of 2024 stating that my membership would renew in May and that fees would be going up. This made sense at the time because the email came in April, I was under the impression I was month to month, so the renewal would have been May. The wording is misleading, the sales practices are misleading, the contracts are misleading. It is not easy to cancel and when I finally got ahold of someone, he was rude, flippant and denied me speaking to a manager immediately. In addition, he told me that even though my phone was already ported over to a new service, I could just continue paying for Nextiva...for 24 months...for a service I can't use. I have to wait up to 24 hours to speak to a manager.. He put in the request and practically hung up on me. Then sends me a next steps email that states I have to wait 24 to 48 hours? Which is it?24 hours or 24 to 48 hours. This part seems as organized as the contracts. I have already reached out to my attorney as I believe Colorado Law has been violated by this practice and possibly Federal law as well.

Claimed loss: More then $7000 if I have to pay the termination fee.

Desired outcome: Cancel my service without the termination fee.
