I purchsed my timehsare in 1990 at Flamingo in Saint Maarten. I paid for the timeshare as agreed and now that Diamond interantional has taken over the complex.They have foreclosed on my unit becasue I did not pay the maintenance fees for 2010. They claimed they sent me a certified letter but I did not receive nor sign for a certified letter. In August of 2010 they foreclosed on my unit. Calls to them have been ignored and i have been spoken to rudely by their staff. I have had my attorney contact them to no avail. We have both been given the runaround. I believe this was a LAND GRAB. is there anyone else that is in this same situation? I would like file a lawsuit or class action against Diamond REsorts International.

I bought the timeshare a few years back. There were a number of things that i should have noticed as suspicious but did not take the time as i was rushed and pressured by the salesman. I bought the timeshare in Florida while at Disney vacationing with my family. There were a number of misrepresentaions made. the time share was presented as a real estate investment. They also presented it as a opportunity to make money. The salesman also presented some shady facts in the application process. They presented false info on the financial part of the application to make sure it went through. They also took the down payment adn gave it back in cash as a gift. The salesman suggested and performed all the steps. Some might say they are not responsible for the salesman but his boss knew about it too as he sit down and discussed it with us. I have names if needed. The yearly service fees were misrepresented and have increased numerous times since our purchase. This is all a scam as to how they trick people into buying under pressure as to it has to be right now to get the deal. It doesn't give you time to research the company and the facts. Once you are in it there seems to be no way of getting rid of the time share. I have no use for something that is taking money from me. In a usaual situation if you have something that you don't use that is draining money from you. You get rid of it. Not in this case. Seems that in a time when money is short and real estate has taken such a hit. How is the time share scam continuing to drain people. I want out of this time share mess. I have done nothing but pay for something that i have not used once. There are also better ways to vacation than timeshares, Is there any help out there?

Same boat as original poster. Purchased my Flamingo week pre-constuction in the '80's and paid off the note entirely. Enjoyed many years of trouble free vacations there and thought my 99 year deed meant something. DRI took over the property and jacked the maintenance fees through the roof. In May of 2011, they "foreclosed" on my ownership and said they were pretty sure it's "gone", due to a late payment of my maintenance fees. Even the rep on the line admitted that the certified mail they sent was returned unsigned and unopened. At this point, I wonder if I'm not better off to be rid of them. That being said - I would certainly love to join in any lawsuit - should one happen.

I would love to see a class action suit against them. My first time share was a 25-year Right to Use contract, and we loved the exchanges with RCI. Now with a deeded unit in Lake Tahoe, we pay monstrous fees and can't find an exchange in Florida in winter other than Orlando. $20K for the timeshare and another $4k for Club Diamond, all down the drain.

My story is very similar to the original poster's, Nicholas Piscatelli. Does anyone know of a class-action against Diamond Resorts? My timeshare in St. Maarten, at Flamingo Beach was paid. My week was week 6, a red week which fell during Valentine's Day. I was late with my fees by 6 months and they "repossessed" it. I called them when I was able to pay the fees and was told it was too late. This has been a few years ago now, but I'm still pissed every time I think about my 99-year deed to my unit. If they want my unit, fine; however, I am due a substantial refund.

Resorts Nationwide is being investigated by the Dept. of Agriculture and Consumer Services. This company was served on 4/20/2011. The Dept. of Agriculture has jurisdiction where this company is located so this is why they are handling this case. If you were ripped off by this company, like we were last year, please do the following below. I was told by this government agency on 4/20/2011, that they will try to get refunds for people who have been scammed by this organization. Go to www.freshfromflorida.com, For Consumers, File a Complaint, Consumer Complaint Form, Online Form. Fill out your complaint online. We have a very good chance of getting our money back!

Dufturds is just too overwhelmed on this board he likes to hang out at the quiet forums where he can respond to one or two complaints a week.

On this board we had no problem calling the dufster to the matt and in order to respond he would need to be honest and DRI does not teach or instill honesty...

Fortunately (or not) I am not 'YET' in the same position as I elected to pay cash for the whole package... So I am not just out the initial deposit but the whole package price (more than $14000CDN). I have yet to be able to use a resort as just like noted elsewhere on this board, there is never a resort available and if you find one, it is hugely expensive.
My biggest complaint however is that they sold/shared my info with another scammer... Resorts Nationwide Inc., who guaranteed to rent my unit within a 2 month perioed at $1800 per month, neither of which happened.

I would be pleased to add my name to a class action suit if one were to be filed. As I live out of the country I don't believe I would be able to start one myself.
A question I have about this site is do these complaints get viewed (and responded to)? Or is it just a site to vent on?

Not in the same situation as I still own my Deed. I never bought in to the DRI magic points or threw my deed in to a black hole. But I am still funding that beast that takes over resorts. How is that fair I said no to the program they offered and they took away all of my resort privileges like traveling to sister resorts in Kaui and Tahoe and more. It is my opinion they control the boards at the resorts, so they can increase MFees through the roof to try and foreclose on as many properties. Then they can resell them to new naive travelers and eventually they will probably cash out and leave us all holding the bag o Cr@p like Madoff did, I can only hope we hold the head rats accountable.
