Bank of America credit card fee scam

In February 2009, I paid my card payment online before noon on its due date, only to learn that the Monday due date was a holiday. Being disabled and unable to work, I hadn't realized that the day was a bank holiday. I had missed one payment a few months before because I mislaid the bill. My fault. I paid the late charge. But missing two payments jacked my interest rate up to almost 20%. Upon checking, I realized that since May 2008, five of the total 13 payment due dates were on days when the bank was closed. If the library in my town can program their computer to schedule book due dates only on days when they are open, why can't Bank of America do the same? I would love to get in on a class action law suit to bring attention to this consumer scam.

Your disability shouldn't be used as an excuse. It makes it look like you are fishing for pity.
You sound pretty functional to me. How does it prevent you from paying a bill on time?

Bank of America atm deposit

I am a bofa acct holder went to the bank cashed my check and did a deposit w my landlord business deposit card. I do this every month and there is never a problem. This time i put 980 in the acct for rent and the receipt came out and said 300. I immediately showed the manager the problem and was told it would fix itself at midnight. It is now 4 days later and not resolved. On top of that I was told there is nothing I can do because im not the acct hoder so i have no proof my rent was paid.

I got my already programmed and blanked ATM card to withdraw the maximum of $1000 daily for a maximum of 20 days. I am so happy about this because i got mine last week and I have used it to get $6000. Fred is giving out the card just to help the poor and needy though it is illegal but it is something nice and she is not like other scam pretending to have the ATM cards. And no one gets caught when using the card. get yours from him. Just send him an email on janeashley333@outlook.com and be happy like Me...

i deposited a check into an drive through ATM and the check got stuck. The atm kept saying to deposit the check which i did. I called bank of America and gave them all the information about the check I deposited. An investigation was started an the money was deposited into my account temporarily. I got a letter stating that they couldn't find the check. I had the matter escalated but they still cant find it. SO frustrating. it is not my fault the atm was not working properly.

Bank of America has been a growing headache. These results of this company has been poor customer service, arguing over fees that are not to be placed, and stating that if you deposit a check before 8pm it will clear on your account the same day.

Given the current financial predicament of most banks, many of them are losing money through their credit card services--either through the increase of fraud claims, or through the increasing delinquency rates. To still remain profitable within their consumer banking division, they are raising red flags in my book, by extending holding periods of checks, or saying your check is deposited in this ATM before 8pm it will be in your account the same night. For the last two months, I have had several issues with this firm, in excess of $300 dollars charged for overdraft fees because there was an error with their system ... eventually it was reversed but it took days to get it cleared.

Two days ago, I deposited my weekly check of $x dollars and expected to have it for the weekend. I have books to buy, errands to take care of, and long behold, the check was not cleared. I was given multiple excuses by the bank of america (it is waiting to be processed ... it is a weekend ... it is due to the size of the check ... it is due to the atm ...) Well, I have done this same check before and it has not been a problem until today. I have deposited at the same atm, and I have certain obligations to take care of. Well, then the representative said as a bank we reserve to put the bank on holdwhenever we please.

At the end of the day, I realized three things about the companies. One: they are lying. Two: poor customer services. Three: they want to charge you fees. So if they put your checks on holds for 3-5 days you are more than likely to go over your limit (assuming you do not have credit card), therefore they win and we lose.

What a shame.

they steal from me $ 5000 in 2005 from the atm .
Sense 2005 i charge BOFA back more than $60000 and i won't stop .To take money from BOFA it's like winning the loto .
i don't feel bad at wall by take in this money from this scammers.

i would love to be a part of a class action lawsuit regarding this issue with bank of america atm's stealing money from its customers.

i laugh so hard when i see the new accounts that are "free" at b of a that are all online and through atms only... you can't go in to the counter at all. if these people only knew at what premium these accounts actually are... because you are going to lose so much cash using atms only when this happens to you.

I just had the same issue a few days back. Lost 300$ out of $600. BOA has temporarily deposited this amount, but i have a feeling that they will steal it back. This looks like we need to file a class action suite against BOA. We need to contact a single attorney who can accumulate all these cases and file this against BOA. BOA should never ever allow cash deposits if they know that their ATMs are flawed.

I went to a Bank of America today to deposit $500 (4 $100 bills and 5 $20 bills) in the ATM for the first time ever. I got a message saying that it could not verify all my funds and it gave me a receipt saying that only $300 was deposited and that some of my items could not be processed or returned. I immediately went inside and had the Branch manager go look in the ATM which he stated the funds were deposited into a lock box he can not access that goes to Loomis to be transported to the place they count the funds. Then I was told to call the customer service number to file a claim for my $200 shortage. They gave me a claim number and said it could take up to 10 buss days to credit my account. I have been with rip off bank of america for over 5 years with my credit card that is paid off and i have a checking and savings account with them. I have never bounced a check or have been late on a payment but after this I am done being there customer. They talked to me like I was lying and they have to have the money accounted for before they will credit me my money. I have excellent credit and several relationships with different banks. If they do not credit my funds by 4/29 I will be filing a BBB and attorney general complaint because this is straight out robbery.

Recently I made a cash deposit at an ATM. I didn't have a deposit slip with me. I tried to go inside the bank to a live teller because it was cash. I know that I was on camera with $200.00 cash at that point. The live teller told me that they switched my account to ebanking (meaning that I had to go to the ATM to make the deposit because that was the type of account I had to only use the ATM). She assured me that this is done all the time and they never lose a cash deposit in the ATM. So, I had to use the ATM machine. I explained that I did not want to deposit cash into the ATM. The live teller directed me to the ATM machine outside. I was also told that I did not need a envelope for a cash deposit.

I went to the ATM outside and proceeded to make the deposit for $200.00. The machine had two areas for deposits. One area for cash and one area for checks. I was not sure where to put the cash. I saw a location that said cash and I put the money there. Therefore, I did not put the cash in the correct place and I did not get a receipt. I put the cash in to area that said cash but I guess it was the cash output area and not the cash input area. I tried to get the money back from the incorrect slot. I was able to fish out $40.00 but I could not get back the $160.00. I immediately went back into the bank. I was very upset and I started crying. I had just got laid off and I could not afford to lose money. Deep down I knew that I would never see that money again.

I was told to call the Customer Service line and they said they would temporarily deposit the money in my account until the investigation was completed. I just got a letter from Bank of America and I was told that the cash was not found.
I asked several times for the bank to check their video cameras. I went to a live teller to make the deposit initially to put the cash in the account. They could plainly see me with the money.
I never heard back from Customer Service. I received a letter in the mail stating the investigation was over. They would be charging my account.
So I had the case re-opened. I still haven't heard from Customer Service. And have never received any information detailing how they did their investigation. And my money has not been re-deposited in my account.
My theory is they have dis-honest employees.

Enough is enough. I feel like a lot of poor innocent people are being taken advantage of.
I am contacting an attorney tomorrow to see what my rights are.

i put in a cash deposit of $600 into a BofA atm and the screen said you just deposited $500 instead of $600. i took the receipt and ran inside and they told me i had to call the 1-800. i did and they issued me a $100 credit but said it would take 6 weeks for them to check the atm and resolve the claim.

i just now got the letter in the mail and it said they never found any extra cash in the atm so they are taking the $100 back out of my account. i just did a few google searches and see a lot of cases like this. i really feel like they could be scamming with this and if no one posts or complains they will get away with it. i am going to post my story along with others on as many sites as i can find and also file a complaint with the BBB.

i know i put in $600, but because it is my word against theirs i will never see that money again. such a terrible feeling and unless i speak out, this will continue to happen to others for a long time.

I have had my mortgage with BOA for 4 years now. In Feb 2009 I started getting calls from the their collection department saying that I had missed a payment in Dec 2008. I produced the dated receipt from the branch showing the payment was payed on time. I thought the issue was settled until I got a call at work saying the Jan 09 payment was late. Again I had a receipt for that payment too. This went on until April 2009. Each month they would call saying I missed the previous month payment. Finally I had to go to my bank and fax them copies of cancelled check for 6 months showing each payment was made on time. They finally sent me a letter saying they had made a mistake. Last week I got a late notice from them saying my September payment had not been made. I called them again with receipt in hand and they admitted that my payment had been made on time but that my April 09 payment had been 2 weeks late! They want me to fax them copies of the cancelled check to drop the late fee. Here we go again. Lucky for me my person saving and checking are at US bank. I would not trust BOA [censor]s handling my accounts. I am going to have to refi to get away from these Idiots. Stay away from BOA. They cannot handle a simple transaction without messing it up . Then you have to jump through hoops to clear up their mess and clear your name.

Bank of America switch and bait on cc interest rate

I consolidated credit cards with Bank of America at 2.9% a year later that rate jumped to 9.9% and today they called and offered to reduce it to 6.6% if I payed them $800. When they called however, the called under the name of Credit Card Services a consumer help agency... I was told that I could reduce my interest rate from 9.9% to 6.9% for no cost, I was all for it. When I receivd the call back from MR. Paul Blake, after I questioned him to ensure that there were no additional fees, eg; application, transfer or other he said no, no fees. I then told him ok lets do it and then he told me, " There is an $800 charge! I asked him why and he said, " that is just the way it is" I was shocked at such an answer and immediately didn't trust this deal, I asked him who was doing this and he told me Bank of America. IT was then that I realized that the bank I had been dealing with was now offering me a reduction in interest rate if I paid them. This seems cruel, it also seems like bait and switch, the callers never identified themselves as Bank of America employees, just as employees of a company that was workingto reduce credit card debt for over paying consumers.

Bank of America deceptive trade practices - stealing from customers

Bank of America has been charging me NSF fees when my account is in the positive. I spent hours researching exactly how they were doing this and finally uncovered it. They are very sneaky!
Especially if you use online banking I suggest you start printing out your available balance page every day. Maybe even twice a day. How can you be charged a $35.00 NSF fee for a 26.95 transaction when your available balance before the 26.95 charge was 568.20? Then your balance was$541.25. The next day you deposit 2, 500.00 and are charged two NSF fees for activity they state for the prior day. It doesn't make sense to me! This happened on June 4th and 5th. The 26.95 was charged on 6-4-09 and my ending balance was $541.25. The $2, 500.00 was deposited the morning of June 5th showing my new balance as $3, 041.25. That day I had a $600.00 charge clear my account ( the 5th ). This charge was authorized on the 3rd and the funds put on hold in my account; however, the hold was released on the 4th and the funds were taken off hold and returned to my available balance. The bank is saying that it was this pending charge that caused me to go into the negative. Online banking though showed this charge pending and my available balance after it would clear and I always had a positive balance. They do not make any sense and what they are doing is criminal in my opinion!

Bank of America gave out personal information

A Bank of America employee gave my stalker my checking account number, and also told him how many accounts I have with B of A. My stalker was able to walk into a local branch and make a deposit (using bad checks) into my savings and my checking, and then went to another branch and made a deposit into my savings (also a bad check). This is especially frustrating because four days prior I had called B of A customer service and had a notation put on my acct stating that "No transaction be made without two forms of ID." When I spoke to the branch manager, I asked if "transaction" meant withdrawl. He said, "No, a transaction is a a withdrawl, deposit, or transfer, " yet couldn't explain why a grown man was able to make a transaction using my account without showing two forms of ID - since he is obviously NOT a twenty five year old woman, as I am. The manager did agree with me that no one should be able to access information such as account numbers, or even how many accounts a customer has. But he had no explanation and no remorse for the fact that one of his employees had divulged that exact information.

I can't trust Bank of America now, knowing that anyone can walk into a branch or call up and get my personal banking information. What's next? Getting my money?

Bank of America they put my money into wrong account

On 5/26/09 I put $1500 into my account to pay my bills. A week or so later I go to the bank to put more money in for the next batch of bills - only to find that the $1500 did not go into my account - they told me I was over $400 overdrawn. After investigation at my main bank, it was discovered that the $1500 was put into another account, not mine, therefore, I had checks returned and my health insurance was cut off, since they sent their check back - I haven't received it as yet. When I called my insurance they wanted a credit card over the phone, I do not have a credit card, so they said it will be cut off, I am waiting for the letter. I do not know what I will do without health insurance.

Bank of America did not care, they were rude, I was given someone else's information, they were patronizing beyond belief. These are people who HAVE jobs, people who have jobs because our President gave our taxes to the banks (and our children's taxes and possibly our grandchildren), which was terribly unfair.

Now, in the middle of having physical therapy, I have no health insurance. All BANK OF AMERICA'S FAULT! I have no job. I have no savings. BANK OF AMERICA added insult to injury by offering me a GIFT CERTIFICATE as compensation, first they offered $50 and then $100 - what a massive insult - since they have ruined my life.

Everyone I spoke to about this at BANK OF AMERICA were not bothered, I AM!

I want compensation!

BofA put one of my deposits into the wrong account as well, but refused to fess up to their error. I was eventually able to get them to reverse the fees that were charged by the subsequent overdrafts (because I had proof that I had actually made the deposit for the correct account), but they refused to acknowledge wrong doing, and continued to insist that it was an error that would have been impossible for them to have made.

They are complete crooks, and we are leaving them this month. Not merely over the above, but also due to their continued tinkering with transaction dates and times that ends up causing numerous headaches for us in their attempt to squeeze out more overdraft fees. I would have failed highschool business class if the teacher had caught me switching up transactions in the bank ledger as often as these guys get away with doing.

Bank of America would not honor credit for purchases

I shopped from many qualifying stores from Bank of America ADD IT UP program and still have not received any promised cash back. My purchases were mostly made back in December 2008, and its already June 09, and still nothing! I called numerous times to the customer care and they all keep on telling me they will "investigate" but nothing happens. The most annoying part is that they have the nerve to tell me that I did not go through their site to purchase because there were no CLICKS. How can they tell me that when I ALWAYS go to the store websites through their ADD IT UP site? The most annoying part is that you can't prove them wrong. Their customer care reps are friendly, but useless. I won't even bother using them anymore.

I am a very loyal Bank of America client and share holder. I have been thoroughly unimpressed with the Bank of America Add It Up Program. I signed in through their website and made qualifying purchases and did not see the credit come through automatically.

After repeated calls, I was assured that technical support and a supervisor would call me back. This never occurred. Most recently, I called back to get to a supervisor and was placed on hold. No answer. In fact, I was curious if there ever would be an answer so I left the call on hold. When I got back from work the next day, the call was still on hold. I got tired of being on hold 25 hours, tying up my phone line, so I finally hung up.

There is no excuse for this type of customer service (or lack thereof). I'd recommend that others take their business elsewhere.

The Add It Up program is a scam. They refuse to give you the cash back when you don't "click" or "redirect" through their website. The reason why I didn't purchase my airline tickets through redirecting was because they INFLATE the price when you do. You're either paying a higher price to get your "cash back, " or not getting a refund at all.

I recommend you take your business elsewhere. What they are doing is unethical and FRAUDULENT!

Bank of America subversive data collection

B of A (Bank of America) utilizes data gathering techniques beyond information provided on checking, savings and cd accounts to develop security clearance questions. For a bank to use covert data gathering information which goes beyond information provided in the course of doing business is appalling and truly an invasion of privacy. Simple questions regarding mother's maiden name, etc are expected. But, to ask questions regarding additional family members who have had nothing to do with the account, including their current addresses, ages, martial status, etc are extremely subversive and indicative of a lack of respect for their customers. I will never do business with this company again and find their actions to be unconscionable and a true invasive action. This type of information is not critical but to use data gathering to the level shows intent to profile clients and use this information in a variety of methods not normally seen in day to day business interaction. I have no credit cards, credit lines or loans with this company and now I will have nothing to do with them going forward. Their explanations were marginal at best and they state the information was gathered through public sources. I left Wells Fargo fifteen years ago and now I am adding Bank of America to my Black List of vendors to never do business with.

Bank of America does not apply promotional rates to credit card balance transfers

BOA offered a credit card balance transfer at 0.99% to March 2010 (one year from filling out the online forms). After the transfer took place, they denied any promotional offer and are now charging me 22.99% interest! I am trying to get the finance charges for 2 months corrected so I can pay off the account, but after 2 days of calls I still get the run around.

DO NOT BANK WITH BOA. They are deceptive and do not honor their own offers.

I CONTINUALLY GET THESE ANNOYING, THREATENING LETTERS FROM THIS COMPANY WITH AN ACCOUNT NUMBER ON IT THAT'S NOT FAMILAR TO ME. I ACTUALLY RECEIVED ONE VIA FED-EX EXPRESS TODAY. WHO ARE THEY?

FIA card services calls on my cell phone looking for somebody I never heard of. I tell them it's a wrong number. They call back 2 or 3 times a day. EVERY SINGLE TIME I tell them I'm not the guy and never heard of him. Obviously he gave a fake number. But they keep calling. 3 different times I get a "manager" on the line who guarantees they'll take the number out of the file. And a few days later they call back. But I can't just block the calls because it's from "UNKNOWN". No caller ID is presented in advance as far as I can tell. So I finally just said, yes, I'm the guy. I gave them BS information as I collected where they were, who I was talking to, how much I supposed owed... I think told them I wasn't' the guy, it was all ### and that now I finally knew where they were calling from (Kansas) and who they were and what bank hired them. I asked to speak to a manager again and threatened filing a complaint with the state board and whoever else I can find. That was today. We'll see if they call back tomorrow again. I feel like I'm in Ground Hound Day.

if it's from FIA, its probably about a credit card account you have. they are a credit card company, not a collection agency so call them and they can explain what accout they are trying to reach you about. it's possible your old acct # has been updated to a new acct # for security or other reasons, but they will look it up for you and probably can look up what charges you made on the acct and send you past statement copies too.

Call the number and find out what the issue is. If it is a valid debt make an arrangement to pay. Most account numbers on debt collector bills are internal account numbers, not the original account number from the creditor.

The advice given to not speak to them on the phone is not only irresponsible but also ridiculous.

You have the right to send a letter to them, tell them to validate this debt to you, and also tell them to cease and desist phoning you. You can sue them if they persist, and people do sue collection agencies and win, keep records of any calls they make to you and Very Important, do not talk to them on the phone anymore. You don't have to take it. Go to creditboards.com for more information and support.

Bank of America Credit Reduction

I have enjoyed my relationship (as much as you can) with FIA Card Services (old MBNA). I have had a card with them for over 15 years. Yesterday I received a letter that my good history, with no overdrafts, payments on time, has been cut by 2/3rds. I contact the company to ask why this has been done. The customer rep, noted that due to limitations with the current banking industry that they are limiting their risk. I say this is ###! So I asked to talk a person in the credit department.

They transferred me. I explained my situation with to the credit rep. After talking a while, the credit rep informed me they cut my credit AGAIN! What the F**K! I asked to speak to a supervisor, and was put on hold and then was hung up on!

After being a loyal member with good history for years, I am being penalized for their mistakes. I plea with anyone thinking of opening a FIA Credit Card - DO NOT. PASS, it will be the biggest mistake of your life. The next time I call it will be a cancellation of my account!

My 85 year old mother in law mailed a payment to Medicare on December 28, 2008. In February, she received a past due notice from her Medicare provider advising her that the payment had not been made. It had come out of her account, and upon getting a copy of the check, from BofA, one can see that it was deposited by a company called AEG in Elgin...

Bank of America Mortgage modification is a joke

I have always paid my loan on time and took every proactive step to avoid defaulting on my loan. I knew my loan is due to reset from it's current 'interest only' and I would not be able to afford it. So over the past 6 months I've spoken with 2 "home retention" representatives from Countrywide, faxed and mailed every piece of documentation they asked for within the timeframe they required but no one has ever contacted me.

I've sent several e-mails to Countrywide customer service trying to find out the status of my work-out only to be told I had to call a number which only leads to endless dead-ends in phone-tree hell! Now they say that they never received the first packet I sent and they claim that the packet I sent 'registered' mail and the third packet I faxed the same day did not show up on time... (I have proof that all three packets were sent on time)

Again, not ONCE has anyone botered to contact me and let me know the status of my request for help or that there was a problem.

So surprise, surprise, the minute I can no longer pay my mortgage and miss a payment, I get a call from some guy in India who barely speaks English, is impossible to comprehend, and has NO CLUE what the status of my account is or why I was never contacted, or any advice at all, except to tell me that "It's not my department" and I should call the home retention representatives to asks for a possible modification!

This is NO way to conduct business. I'm frustrated! I'm angry at Countrywide and Bank of America for painting a false picture to the public of being 'helpful' and 'proactive' when if fact that is a lie. This all could have been avoided but they are now the reason I am forced to file bankruptcy. Shame on you!

Anyone thinking about starting a mortgage with Bank Of America may want to reconsider. With all the reorganization, lay offs, and government involvement Bank of America is going through, you may find the over worked mortgage specialist at Bank of America making a lot of mistakes and not making deadlines as promised on your closing costing you more money than you expected.. I just completed the loan process with Bank of America and some of the problems I faced were, No communication with me or inability for the loan specialist at Bank Of America to take messages., loan information going to an email address I never provided or used costing valuable time, in other words I never received some very important information, not making the closing date on time, this is one of the most important necessities of a mortgage purchase, this failure on Bank of America’s behalf cost me the seller paid escrow fee of 1500 dollars, the whole process was horrible and this was a little mortgage for under 50K. Bank of America had me down for five and one half percent interest, most lenders are going for four and one half percent or under Its is more involved, what happens after your loan is approved, more than likely there will be more mistakes long term, you may have to deal with, lost payments, Bank of America changing addresses without notification, poor customer communication and many more variables. I pulled out of the loan the same day the documents were ready to sign and close, remember this was after the closing deadline, Bank of America offered me 1000 dollars to change my mine, I explained all the problems I had with this loan and no employee at this branch including the manager seemed to care.. They proved how fast they could work when they were loosing my account by getting the docs in at 9:30pm in order to save the account and make the second deadline. Do yourself a favor, the odds are against you. After all I was a 25 year customer, that doesn’t mean much these days. Remember, you have to live with a mortgage for a very long time so do yourself a favor, shop around for the best, most honest deal you can find.

Don't feel like the lone ranger! I have been trying to get some help since the recession hit...my husband was on temporary layoff every other week...then in March 2010, I was laid off my job after 8.5 years. Each time I called BOA, they told me something different (whatever was convenient - so they could get me off the phone). In April 2011, I withdrew all my 401K that I had saved for, hoping to have a retirement...but, I can kiss that goodbye! The new America has become a society of greedy, selfish, money hunger businesses that care about nothing except all the money that can suck out of people. Business's now even fire and force older employee's to quit there jobs - so they can hire temporaries through a temp agency - so they can pay lower wages and don't have to provide benefits! They candy that many people love, such as Snickers, Dove, M&Ms - well that coompany is pursing the dream of being "Number 1" in chocolate - and to ### with the employees, as they are getting rid of many associates and hiring temps to replace them (which I consider a form of slavery). What has happened to America...the men that have fought and lost their lives for this country and the American dream, I feel would roll over in their graves to see what is happening to the country they fought for and loved. "One nation under God, " "In God we trust, " ; however, religion has been taken out of the schools...take God out of everything and what do you have left...nothing...is that where America is heading - I would consider that a 3rd world country. Maybe eventually we will be throwing rocks at each other like those countries do.

I HAVE BEEN DEALING WITH BOA FOR 9 months now trying to modify my mortgage after i lost my job. after taking 3 steps forward and 10 steps back i still have no answers. i sent all documnts they requested 3 times. as of today i still wait fir answers. my phone calls are going to voicemails. i rarely recieve a call bsck. please help. please.

I asked for loan modification and they transfered it to foreclosure and it illegally and wrongfully.

I have always paid my loan on time & took every proactive step to avoid forclosure. I knew that my current job would end at the end of July and starts again in September. I requested home retention department to lower my rate and payment so I can manage without default. I spoke to thier representatives more than 5 times. I received a package to fill out and mail it to the adress I was given. I faxed and at the same time mailed it within the time frame they required.
I called to make sure they have received my documents. I was told they are missing part of it. I faxed the one they said they missed. After three days I received another package. I had to call again. " Fill it and mail it all" was the order. I did that. I called again to make sure they received. A guy with Indian accent told me there is nothing they received. the other hassels I keep for others who may have gone through the same rocky and rough road and mountains.
Are you guys really in business? Those guys of yours with heavy accent are not doing you any good. Please !Please! remove them and do business the way we know before not a new one from India.

I've worked in banking for the past 16+ years, and never in my life have I ever had to deal with such inadequate service! I'm not going to expound as it's easier for me to just say that probably 99.9% of all of these complaint's are right on! If my situation was different and I could re-fi, I would! Even at a higher interest rate, just to wash my hands of these [censor]s! I WILL NEVER DO BUSINESS WITH BANK OF AMERICA AGAIN! That's the best thing we can all do... Hit 'em where it hurts... In their wallets! I advised the rep, that if I received one more letter from them, I would cease making my payments! I've had it... They can pile my house onto the stack of foreclosure's that they already have, and I'll pay cash for my next house, they're getting cheap enough!

We are in the same situation as 'really screwed in Florida'. How is BOA getting away with this? Why hasn't the government stepped in to make them adhere to the terms of HAPA when they were quick to step in and bail them out? We too are moments away from contacting an attorney since BOA has not return a single call and intends to foreclose. We adhered to the terms of the modification they offered us and now they have back tracked on that offer.

I heard that BOA purchased Countrywide loans at .30 cents on the dollar and if they foreclose on a loan they get a credit from the government of the difference of the loan amount of up to $30k or so, then turn around and sell the home making another profit on the sale. It sounds like foreclosures may be more profitable for BOA. Has anyone heard something similar to this or did I misunderstand the possible 'greed' behind their BS tactics.

John, I will send the emails etc., but so far I have not seen one person it has helped.

Bank of America abuse of customers

What we Countrywide-Bank of America victims have to do is band together, each of us, assemble a package of information (the hardship letter and a history of our dealings and results from Countrywide-Bank of America), create an email list from the President on down, and start emailing, demanding something besides lip service (from the President, Secretary of the Treasury, senators, representatives, Barney Frank, all federal regulatory agencies, state governors, senators, representatives, etc., etc.).

Getting on these blogs or discussion boards and complaining to each other is a waste of time. We need to put together an organization to serve and respond to our needs in effectively communicating with influential people, and we need some organization to facilitate this by, among other things, allowing people like me to share my email address with those interested so that we can communicate with each other rather than just writing our stories on a very limited “wall” where they are not seen by decision-makers. We can see, read, and sympathize with each other, but this is really a waste of time. Until we can communicate, organize, and initiate action, let’s face it, we might just as well give up, because no one cares, really, but us.

Despite what he says, President Obama has too much on his table to spend time on this. Unfortunately, he is mistakenly trusting the Secretary of the Treasury, Timothy Geithner, to manage this. Geithner’s not doing his job for the citizens of the United States whom he swore an oath to serve. Instead, Timothy Geithner serves the banks that he has always worked for—and whom he helped get us into this mess by not regulating at the NY Federal Reserve. And so, in his alleged plan to help people confronting foreclosure, he placed the administration of the program into the hands of the bankers and lenders who got us into this mess in the first place. He put the fox in charge of the chickens, and the chickens are slowly disappearing. I wonder why?

Neveretheless, we the victims have to band together to form organizations, email everyone from the President on down (the Secretary of the Treasury doesn’t have an email address. Surprised?), and make our voices heard. We also need a responsible website, such as this one, which will facilitate our communications so we can organize. I went through much of the same. Hired a Company to represent me. B of A stonewalled them. The returned my money and said I was an my own with B of A as they would not deal with them. After over a year of dealing with B of A they told me I did not qualify for a Loan Modification. Asked for help in making up two late payments was also told NO help was available in fact was told I did not even qualify for a mortgage and that it was only a matter of time before B of A would foreclose on us. This past March I paid over 7k to bring my mortgage current. Kept getting letters from B of A regarding getting a Loan Modification even though I had a letter say from them telling me no. This past October got a late charge on my mortgage payment even though I have not been late. Paid it anyhow. Got two statements for November 1st statement did not show any further late charges. Made November payment on the 5th. On the 6th got a second statement for November this time it show another late charge which would go from $43.84 to over $130.00 if not paid by the 19th. Got all my paperwork that showed late charge already paid and took to local branch of B of A. Bank rep looked at it and agreed on two things. First, did not understand origination of first late charge nor the second late charge. Second late charge was paid. When she went to my account, she had to call a special number? Got the issue resolved with the person she spoke to and said the late charge would still show up on my December payment but to ignore it and just make my regular mortgage payment. Got her signature on document. In 2008 when B of A took over Countrywide I got a late charge which I disputed and was told by a B of A rep that I did not have to pay it In 2009 I had to pay over $627.00 in late charges. This is what started my troubles with the bank. Looks like they are trying to do the same thing again.

I AM IN THE SAME SITUATION AFTER 8 MONTHS OF SENDING IN DOCUMENTS AND 6 MONTHS OF TRIAL PAYMENTS, I RECIEVED A LETTER TODAY SAYING THAT I AM NOT ELIGIBLE WITH NO REASON OTHER THAN THEIR FABRICATED ONE, THIS HAS BEEN THE MOST HORRIBLE EXPERIENCE, I'VE BEEN IN MY HOUSE FOR 14 YEARS, NOW I HAVE NO IDEA WHAT I WILL DO, I HAVE 5 CHILDREN, AND AM SUPPOSED TO BE GRADUATING FROM COLLEGE THIS YEAR, BUT NOW I JUST DONT KNOW... I just got off the phone with Fannie Mae today to dicuss the Making Home Affordable modification process that I've been in for over 10 months now with Bank of America. I was told that unfortunately, they are not a regulatory institution and can do nothing about what Bank of America is doing to thousands of people. I was told that Bank of America is the most unscrupulous institution in America, like if I didn't already know this. I was surprised to find out from this gentleman that as of today, this bank has still only approved 4% of all the loan modifications they have received since this process started. This guy even told me that this bank has absolutely no intent on doing anything for thousands of people but to continue to take people's money. They even told me that they are getting calls all the time from people, some telling them after a year or so of making trial period payments to BofA that they were told that Fannie Mae didn't approve their loan, which I was told was a blatant lie, because Fannie Mae said they have nothing to do with it. They did refer me to the FCC and said I should get some assistant with this agency.
I really felt angry after speaking to this guy because if what he is saying is true then I would think they would have contacted FCC themselves and get this fraud straightened out by now. Guess I'll be losing my home and that's okay because at least this insanity will be over, but I won't give up fighting to see that this bank is exposed for what it is and the kind of individuals who are behind all of this.

I CANNOT BEGIN TO TELL YOU HOW I HAVE BEEN TREATED SINCE I BEGAN TRYING TO GET HELP FROM COUNTRY WIDE / BANK OF AMERICA. I WENT THROUGH TRYING TO REFI, MODIFICATION, AND SHORT SALE. ALL OF WHICH THEY SAID TO CALL BACK WHEN THE PLANS WERE IN PLACE. I STARTED IN MAY 2008 I AGGRESSIVELY TO GET A MODIFICATION. I WAS FORTUNATE TO HIRE A COMPANY THAT ACTUALLY WORKED VERY HARD AND GOT NO WHERE. MANY TIMES B OF A SAID THEY CALLED ME AND I NEVER RECEIVED A CALL. BUT MAGICALLY IT IS IN THERE COMPUTER NOTES THAT THEY CALLED AND SINCE I DIDN'T CALL THEM BACK I WAS NEVER NOTIFIED THAT THEY NEEDED MORE PAPERWORK OR PROOF OF SOMETHING. SO TO MY SURPRISE I CALLED IN AND OF COURSE WE ALL KNOW THE ANSWER, MY WORK OUT PLAN WAS CANCELED. NOW IT IS NOVEMBER 2009 AND I AM IN FORECLOSURE AND EACH TIME I START A WORK OUT PLAN AND GIVE THEM EVERYTHING THEY REQUEST, I CALL IN AND I AM TOLD IT WAS CANCELED BECAUSE I DIDN'T PROVIDE SOMETHING. EVERYTIME I CALL IN I CAN NEVER GET MY NEGOTIATOR. I THINK THEY ARE FICTITIOUS. I AM TRYING TO STAY POSITIVE, BUT I AM POSITIVE THAT I HAVE COMPLIED WITH EVERYTHING AND I HAVE BEEN TOLD OVER 5 TIMES NOW THAT I QUALIFY AND TO KEEP A LOOK OUT FOR THE PAPERWORK. I BELIEVE BAC IS WANTING TO CAUSE PROBLEMS FOR COUNTRYWIDE CUSTOMERS. I HAVE HAD NOTHING BUT PROBLEMS WITH THEM ACCEPTING PAYMENTS. THEY HAVE MY ACCOUNT SCREWED.THEY WAITED TO POST MY PAYMENT UNTIL AFTER MY DUE DATE SO THEY COULD CHARGE ME A LATE FEE. NOW THEY STATE THAT I WAS 3 MONTHS LATE BUT THEY CASHED MY CHECKS. REP STATED THAT THEY WERE IN A SPECIAL ACCOUNT BECAUSE I HAD ASKED FOR LOAN MODIFICATION KNEW NOTHING OF IT. ALWAYS PAYED MY PAYMENTS. NOW THEY HAVE POSTED 2 PAYMENTS BUT CANT FIND THE THIRD. SO NOW I HAVE TO SEND COPIES OF CHECK AND BANK STATEMENT TO PROVE I PAYED THEM. VERY INCONVENT FOR ME TRYING TO PAY. MY ADVICE KEEP ACCOUNT OF EVERYTHING YOU SEND THEM NEVER KNOW WHEN YOU MIGHT NEED A BACKUP. LOOKING FOR ANOTHER LENDER.

Bank of America racism

Today I receved a call from bank of America from the card services dept . the representative was calling my cell phone requesting to talk to some body else, so I told him he had the wrong number, he got really upset and started asking me if I speak inglish and he was saying this is america, I felt desrespected and hang up, the same rep call me about 4 more times screaming "white power" I hang up again and decided to cantact a manager, after calling 5 times and explaining my situation both customer service reps and managers hang up on me several times, I called another departament and I a manager took my complaint.

I'm a white manand was recenlt in Bank of America's corporate center in Kennesaw, GA. Out of about 500 employees that I saw, 499 were black. I was treated very poorly for being a white man from the minute I walked in the door by the so called "security" people that looked like Kenyan malitia, and received dirty looks from every employee that I passed. If you are white, don't bother applying at Bank of America. They are a racist organization and will probably not hire you

Bank of America excessive overdraft fees

I ended up paying almost $900 in overdraft fees for my checking account in a 4 month span. Their online banking that I was using to chen my balance was not updated quickly. Also, some transactions take forever to process a debit purchase and by the time it goes into my account I don't have money to cover it, although I did the day of purchase. I tried to get some of the $35 overdraft fees taken off and they said "there's nothing we can do." I was so upset! Were in a recession and you're taking money from me without me knowing it... I may as well give my money to a stranger to hold onto it for me! I couldn't even pay my rent that month because they took all my money! Bank of "America"? Not for this American! Beware! Will charge you $35 overdraft for a $1 overage! Bloodsuckers!

BofA has every right to charge overdraft fees. However, the fees should be proportionate(spelling)to the amount the account is overdrawn, or the transaction amount per fee. With that being said, I'm not the best at balancing my check book - but BofA has charged me over $860 in overdraft fees in 12 months. I added all the transactions that made the account overdrawn, and it came up to $78. That means they are charging me over 1000% of what they covered in fees.

Also, if they were really trying to be customer oriented, they would give you at least 24 hours to replace the funds (bring your account back to balance), before charging you a whopping $35 dollars for every single transaction.

The most frustrating fees I received just happened last week. I was overdrawn after the weekend (usually it's always on a monday when all the fees come in at one time) by $40, so I transferred $200 out of my primary account to my secondary account (the one I have issues with, becasue it's tied to my debit card), which made it +$150 and change. BofA charged me four overdraft fees that same evening for $140. Three new transactions came in for a whopping $27 dollars, which ended up making my account overdrawn (because the transaction fees were taken), so I had to pay $105 dollars more in fees for the items that were overdrawn because of the overdraft fees from the bank.

Now that is scandalous any way you look at it.

When my commission check hits this week for $13, 500 I'm going straight to the bank to close my accounts. I've been banking with BofA for 18 years, and ever since online banking came into factor, it's been a problem.

I'm surprised at how many attacks there are against those posting a complaint about the bank. If that many people are complaining about the same thing, then something is up. And I'm sorry, whether you like it or not, keeping purchases in limbo DOES throw things off. If for no other reason than when it DOES finally post it doesn't have the transaction date. There is NO REASON for transaction to remain pending. If the money is there then pay it RIGHT NOW [censored]! What are you waiting for. And I'll tell you this. Before computers started all this pending BS people were NOT getting overdrawn as often. It's clearly in the banks interest to keep it going because a hell of a lot of people find themselves confused over the state of their accounts, especially when transitioning into a new month. I'm sure the person to make the first comment about this complaint has Bank of America's heartfelt thanks. After all they do have to finish handing out all those executive bonuses before the new laws take effect in February and they need us little guys to help pay for it. They sure got a BIG chunk from me.

trust me this bank rearranges your deposits and debits to purposely charge you fees. they have terrible customer service and they tell you they can do whatever they want because they are the bank. this is a recession and they need to be more consumer friendly instead of trying to stick it to everyone. and to the idiot who was cussing at the complainer and telling them she probably has bad credit-he probably works for the bank. they are crooks

what the hell kind of idiot are you? Its not bank of americas responsibilty to make sure you are not overdrafing your account. AND its not bank of americas fault that it sometimes take a BUSINESS DAYS EVEN WEEKS to take the money out of your account. HERE IS AN IDEA why dont you BALLANCE YOUR OWN ACCOUNT

If you do this everyday you arent going to overspend, Banks of all kinds post those online, over the phone, what ever basically so you know what has CLEARED, it doesn't necessarly mean whats PENDING. If you dont know how to manage your money, take a class. Otherwise dont blame a bank for charging you for overdraft fees, THAT THEY TOLD YOU THEY WOULD IF YOU SHOULD OVERDRAFT YOUR ACCOUNT, its your fault not theirs. Yeah we are in a rescission and Bank of America has to protect themselves to. When you opened your account they let you know the terms, if you are really that concerned, get a freaking line of credit, but judging by your money management skills you admitted to, your credit probably sucks to bad for one of those.

Bank of America LYING ABOUT MODIFICATIONS

We wanted to let everyone know that mortgage lenders are still deceiving the American people and the American government regarding loan modifications. We hear in the news everyday how the U.S. housing market is "bottoming out" or "finally stabilizing" or "sales are picking up". But the reality is that it is not. Not for homeowners whose lenders are corrupt, that is.

Please do not misunderstand. There are lenders who are doing their best to help homeowners and we are pleased they are now generally making a effort to work with homeowners and keep them in their homes. We applaud those lenders/banks. However, we wanted to bring to your attention a particular lender - Countrywide Financial (now operating as Bank Of America Home Loans).

We are sure you see comments all over the internet on how this lender is blatantly employing forestalling tactics to deceive the media, government, and the American public. In our opinion, this lender has absolutely no intention of complying with President Obama's American Recovery and Reinvestment Act of 2009 and has no intention of keeping homeowners in their homes. Countrywide Financial's website says they have a "commitment to supporting the Making Home Affordable program" but that is a lie. We have filed numerous complaints regarding Countrywide Financial for their refusal to grant us a loan modification on our home even though we meet the criteria.

The Superior Court of the State of California for the County of Los Angeles Northwest District issued a court order for Countrywide Financial to provide loan modifications (Case No. LC083076, California Attorney General and The People vs. Countrywide Financial). Though we were not part of this particular lawsuit, our situation still meets the criteria described in the settlement. Also, included in the settlement was for Countrywide Financial to furnish to the California Attorney General a list of account numbers of those loans which have been modified. I doubt, to this day, they have sent any tangible information to the attorney general.

Here's the deal:

1) Countrywide is NOT MODIFYING loans despite what they tell the government, the media and the American people.

2) Countrywide is violating court orders and is in contempt of court.

3) Countrywide received TARP funds and yet they openly refuse to abide by the mandatory Obama loan modification guidelines.

Bottomline: Countrywide Financial is STEALING our taxpayer bailout monies!

For those who are experiencing loan modification issues similar to our situation, please seek advice from an attorney AND DO NOT BE AFRAID TO LET GOVERNMENT OFFICIALS KNOW ABOUT YOUR LENDER REFUSING TO GRANT YOUR MODIFICATION (if you qualify for it). Write to your Congressman or Congresswoman, write Housing and Urban Development, your state's attorney general, your state's housing departments, your state's consumer affairs, your governor, the Better Business Bureau, the Federal Trade Commission, the Department of Real Estate, even write to the President of the United States, the Vice President of the United States, the Office of Public Liaison, write...write..write...or fax...fax...fax...or email..email...email..or call..call..call. You need to let our government know what's happening at the consumer level. Not sure where to begin? go to www.whitehouse.gov

Yep I just wrote our president and my list is getting longer...

I was denied a modification on Aug 31 but didn't find out till today Nov 3 by them slipping up.

I waited 3 months for this and i was denied and they didn't even send out a F you letter...

I am not happy and over it...

Before you hire them, do a research in the Better Business Bureau of your state/city. We hired an attorney to represent us. An attorney who is licensed and bonded to practice in the state of California (since our home is in California). We did not believe in going through a loan modification company.

JAN: We saw your post. Yes, that's the LATEST AND GREATEST DECEPTION Countrywide/BofA Home Loans is pulling on everyone. Countrywide/BofA Home Loans is telling everyone -- the Attorney General, the media, the government -- that they "are doing loan modifications" but they have MISTITLED a Forebearance for a loan modification. What is a Forebearance? An agreement made between a mortgage lender and delinquent borrower in which the lender agrees not to exercise its legal right to foreclose on a mortgage and the borrower agrees to a mortgage plan that will, over a certain time period, bring the borrower current on his or her payments. A forbearance agreement is not a long-term solution for delinquent borrowers; it is designed for borrowers who have temporary financial problems caused by unforeseen problems such as temporary unemployment or health problems. What is a loan modification? Under President Obama's law (in a nutshell) it should 1) Be a lower monthly payment 2) Have a lower interest rate 3) Have a lower principle.

Countrywide will not release the raw "100, 000" loan modification agreements to the CA Attorney General because they are not at all loan mods and are not compliant with the LA Superior Court Nov 23 court order nor compliant with Countrywide's April 17 contract with the Dept of Treasury-Fannie Mae's whereby Countrywide agreed to modify notes at 31% as specified in the HASP-MHA guidelines. Ha! More delay tactics and deception!

It's absolutely ridiculous...WE BAILED OUT THESE BANKS/LENDERS WITH OUR TAXPAYER MONEY AND NOW THEY WON'T DELIVER ON THEIR PROMISE TO THE TAXPAYER...the very people who bailed them out! How much more THEFT of our HARD EARNED DOLLARS must the American homeowner take! We can not remain complacent and passive anymore.

We believe President Obama and his Administration is listening to the American people. But they are a busy lot over there in the White House. So, we believe the American people can help them over there in the White House by letting them know about your Lender issues. Continue writing your government officials. Thank you. You have inspired me to act after a sequence of stalling and lies from COUNTRYWIDE. It is time the conusmer stood up against blatant corruption on the part of this lender. Our entire economic future is dependent on us eliminating this sort of practice from our nation.

My above complaint is that Country Wide has never helped me in trying to modify they just allowed me to pay my regular monthly payment of 2350.00 and add an additional amount to totaling 3250.00 per month for the next three months. That was crazy! If I can't pay the 2350 why would I afford 3250? They are now threathing me to foreclose and calling me every day and all hours including Sundays. Now Bank of America is doing the same. My attorney is taking care of this and they keep oin telling me that there is no modification in place.I don't know what to do! A lawyer is the best at least I hope so.

I have hired an attorney and have had her since February working in my morgage. There is so very much you need to do to even quilify for a modification. This is a long process and you need a lot of patience to go with it.Since then Countrywide is now Bank of America and I do believe this is not any better as Bank of America has faults and complaints on them also.I hope my morgage resolves soon . I did receive a letter from Countrywide telling me that I only have till June 7th to catch up with my morgage or they will start foreclosure on my home. My attorney is aware of this and telles me not to worry as I won't loose my home. I am trying so hard to believe this but lets face it this is very sceary! I was not behind when we walked into her office to being almost 6 months behind. Like I said this has been a long journey and it's not done as of yet!As I read these complaints from people telling us that they needed to be in foreclosure in order to quilify for modification I am learnig that maybe this is why my attorney let this go this long. If anyone else reads this please let me know if you are going thru the same thing as I am or have already gone thru this and let me know what has happened to you. Thanks janbri1234@yahoo.com

Bank of America ruthless overdraft charges

I have had an account With Bank of America, (before the two mergers as Bay Bank and Bank of Boston) for 17 years. I have had the odd overdraft charge because of my neglect yet i have have never complained or asked anything of them until today. Yesterday, my credit card payment was mysteriously taken from the WRONG account, an account i use for daily atm items. (coffee gas meals etc)
This mysterious ERROR caused, 7 OVERDRAFT CHARGES AT 35.00 EACH FOR A TOTAL OF 245.00 ! I called and said that the automated bill pay had switched accounts on me, they said call back tomorrow we will straighten it out. Well i called, they won't admit the mistake, and have credited me 60.00 lousy bucks. So they screw up and charge me 185.00 . These are ludicrous times. I am moving everything from bank of america... no more credit card, no more morgage, no more personal or business account. RUTHLESS
EVIL GREEDY CORPORATION this "BANK OF AMERICA" RED
WHITE AND BLUE TO SCREW YOU TO THE MOON.

I mysteriously got 3 overdraft fees because my transactions didn't update my balance in a timely manner. My statement says I paid for things two days after the transactions.
