Chrysler - recall failure or false warranty claim

I contacted Cummins Dodge in Weatherford OK Oct 18, 2019 and talked to Chad Cummins first letting him know my car was not fixed by the dealership as they stated to me and that it was in worse shape now after them bringing it to me Thursday then it was when I took it May 13th. He stated that he did not know what I was talking about which I had contacted him a while back about it. He stated that he knew my car had been nothing but problems but that he just sales cars he don't build them. He stated he does his best to keep them running and that sometimes they build a product that not high enough quality built. He stated I needed to contact Chrysler and push the lemon law. He stated when they build a product like that he cant just give me a car just because Chrysler built a bad product. He stated im his customer not his liability. He stated that he was all for helping me get the car bought back but he couldn't do anymore then what he had tools to work with.I told him I knew it wasn't there fault and that I had not had problem with the dealership till they brought me back my car and it was not fixed after being there 5 months.

I told him the shifter knob did not indicate what gear the car was in like it did before and that I called Steve the Tech Advisor at Cummins and he said he would have to talk to his mechanic and get back to me on the issue. As of Thursday at 630pm I still had not received a call from Steve. I advised Chad that Steve had called and left me a voicemail the morning of Friday Oct 18, 2019 but I had not called him back yet but I would after our phone call but I needed to let him know that my car was not fixed. I told him I had a mechanic come look at my car and the mechanic said my car was not fixed and that it was a very serious safety issue because the car can be put into gear without the keys even being in it or running and the break does not have to be pushed for the car to even go into gear. I told him that my car was in worse shape now then it was. I also stated that my problem now was with Cummins as well as Chrysler because they sent my car back saying that it was fixed when it is not and that now it is a safety hazard and can not be drove because the shifter knob can engage just by pushing it back and forth without car running.He stated that if they don't build parts to fix the car he cant do anything about it. I stated that if they could not fix it then why did the mechanic say it was fixed and why did they send it back to me saying it was fixed. He stated he just couldn't do anymore and for me to contact a lawyer. He said its expensive for us for you to be driving around our car(loaner). I asked why did the mechanic say my car was fixed if it is not fixed and that it is in worse shape then before. He stated that we have done all we can do and you know we have done all we can do. I told him why cant he call Chrysler and tell them this car is not fixable and he stated he was not allowed to do that. He stated that he does not know why we are even having this conversation and that he has got to hang up. I then contact the service dept at Cummins to ask what mechanic worked on my car and Justin stated id have to talk to Steve. I told him I called about the shifter knob he replied yeah youll just need to bring it over here. I told him that's the problem that the car was not fixed and it was not driveable. Explained to him what the car was doing and he stated the car was working properly when we brought it to you. I made sure and told him I had not even drove the car and that the mechanic that looked at my car only test drove it for 5 miles. He then hung up on me. I then tried to contact Donnie at Cummins which is who I had been talking to about my car but for 2 weeks I had left voicemails left messages with receptionist for him to contact me as well as text messages and not once did he return my calls or even respond to my text messages. I told the receptionist it was very important that Donnie calls me back she said she would give Donnie the message but after an hour or so I called back asking for Donnie and Dave Morris answered. I asked to speak with Donnie he stated Donnie was not available. He stated im Dave Morris I manage this store I said oh Donnie doesn't manage this store anymore he said yeah. I told him I called Steve this morning to let him know the car was not fixed and that I had a mechanic take a look at the car and he stated it was not fixed. I explained to Dave what the car was doing he stated they test drove the car 4 times and that they did not find anything wrong with it. I asked if they did not find anything wrong with the car engaging into gear without the car even having to be running or break pressed. Dave stated we didn't find anything wrong and it didn't act up for us or other wise we wouldn't have returned it. I asked Dave, "so your telling me the mechanic pushed the shifter knob back and forth while the car was turned off and it didn't move back and forth. Dave stated yes our mechanic did before we released it or we wouldn't have released it. I asked so how did the car get messed up if your stating it was fixed. He said I don't know you've had another mechanic touch it so I wouldn't have any idea. I laughed and said oh I figured you would try to say something like that. I said the mechanic literaly test drove the car for 5 miles and that he could not have done anything to that car if it has been fixed. He stated I was told you had legal representation I said yes and he told me to contact them. Monday morning they refused to speak to the attorney. I am now seeking another attorney because I declined the offer FCA sent. I also will be looking at filing against Cummins Dodge as well for sending my car back stating it was fixed when it is not and it also is a serious safety hazard because If anyone was to just get in the car for any reason and they accidentally hit the shifter knob it will go into all gears and roll away. I also have recorded audio of these 3 conversations as well as the mileage on the car when it left the shop as well as when the driver dropped it off at my house with his initials on the invoice and pictures of the mileage after the mechanic test drove it. This has become a very serious matter and im very concerned about the fact that no one seems to care about the safety issues with this car. I refuse to even get in the car that's how uncomfortable I am because of all the problems it has given just with the transmission not including the new engine, turbo, starter and many other things. Since the day I purchased it May 31, 2014 the total days it was in shop for repairs was 442 days as of Oct 17, 2019. Tell me as a first time new car owner that being without a car for over an entire year is ok and that I should just deal with it even if its past 5 years old by just few months. I had warranty when it went to shop in May but May 31st it ended. I have documents for 95% of the complaints, cases with FCA, BBB, FTC, Attorney General for the past 5 years showing ive tried getting something done bout this car. I towed my car to Doug Grey where they will be inspecting it. If my car was fixed by Cummins then why when they received the part Sept 20 did it take them till Oct 17 to fix and why does the service report indicate other things were replaced that did not need to be. If Cummins fixed it like they stated then it needs to be reported that the RECALL part has already failed after 5 miles. I truly do not feel that it was fixed i beleive they just did what they needed to in order to get my car out of there. I was lied to numerous times and now my emails are blocked from Cummins they talked to me like my safety concern did not matter and hung up on me as well when asking about my safety concern. The fact that the dealership sent my car back to me with a safety concern and they are refusing to even speak to me or the attorney tells me they must have done something wrong so either it is a failed recall or a false warranty claim that FCA will be paying for when they did not even fix it and stating they did. I have documents and recordings of said phone conversations with the 3 men from Cummins that hung up on me stated my car was fixed and that his mechanic did move the shifter knob without car running and that it did not move from gear to gear and of the owner stating that if Chrysler does not make the parts available to fix the cars they can not fix them and for me to contact an attorney. i tried adding recordings and documents but it only allows certain files that i dont have saved in that category so if you want them I will have to email them.
