I recently recieved a collection notice from Finex Group, saying I owe from a towing/ storage fee's from a car I sold over a year ago. I sold my nice car to this kid whom did not submit the release of liabilty to the DMV, but I did. I sold the car "as is" becuase it needed some work to pass smog and so I also have the bill of sale. I faxed the collection agency the copy of release of liability with the bill of sale and they are telling me it isn't enough for them to stop from this affecting my credit. This is a total scam because I never recieved any information about the car I sold being found abandoned nor did I ever recieve notice that there had been a lien placed on it and by the way this car I sold has already found a new owner whom purchased this vehicle from an auction and is in the process of registering it under her name. Can you please tell me how to go about getting this cleared up?

I have no idea what is going on with this supposed account opened in Mar of 2017 for $2, 900 and something. I have No outstanding unpaid balances and I have never applied for a loan. I have lived in Merced county for more than 6 years and I have never been to San Jose CA.

Hello All-

I am a consumer advocacy attorney in Oakland, California. I am very sorry to hear about the problems you have had with Finex. Even more regrettably, I can assure you none of you are alone. My office has been retained by a consumer who is also a victim of their misconduct in trying to collect money from former owners of vehicles towed/stored after a car's ownership has transferred to another party. My colleagues and I work to protect individuals and the general public from illegal and unconscionable business practices like those apparently relied upon by Finex. My opinion, at this juncture, is that Finex's attempts to exact payments for bad debts is illegal and, therefore, the law should be brought to bear on them so Finex is held legally accountable for its bad acts.

If you agree that entities such as Finex should not be allowed to harrass and exploit individuals, wrongfully and with impunity, I kindly ask you contact me to discuss your situation. At this stage I am only interested in learning more about each person's experiences to discover how widespread the problem is. Certainly, there is not any charge to speak with me. I have had the same exact thing happen to me 2 times with their company! The people in their office are completely rude and just because you have a copy of the release of liability they will not accept it since the DMV is messed up and did not properly file the information. I completely feel for you and I wish I had a solution to this problem, but everyone keeps telling me to get a lawyer or call seven on your side. Please let me know if you have found a way out of their scam!

DISAGREE THE LAW SAYS IN ORDER TO BE HELD NOT FINANCIALLY LIABLE UNDER SECTION 5900 IN CA YOU HAVE TO PUT IN A RELEASE OF LIABILITY, THIS EXONERATES YOU FROM FINANCIAL, CRIMINAL AND CIVIL LIABILITY. WHILE YOU ARE REQUIRED TO SMOG THE VEHICLE THIS WAS WRITTEN INTO LAW FOR THE DMV TO ENFORCE FOR THE BENEFIT OF THE CONSUMER NOT FOR A COLLECTION AGENT WHO IS TRYING TO BE CRAFTY AND CIRCUMVENT THE POWER THE STATE OF CA TO DICTATE WHEN FINANCIAL LIABILITY WILL APPLY. I HAVE A STRONG SUSPISION THAT THE ABOVE AUTHOR IS THE HEAD COLLECTION AGENT AT THIS FINEX GROUP, REPORT FINEX TO FTC, BBB AND THE DMV..

Unfortunately, this sounds like a case where smog test or something else to release liability by DMV was not completed. That is a requirement to have DMV release liability under the law. I am a little lost here this morning because I just checked my Credit Report and saw my Credit Score go down by over 100! I have a Tow charge for $2700. on there and have no idea what the heck it is for. Office is closed but ready to fight Monday! Evil tow Yard. Who are they?
