I’m Hope Avery and on May 8, 2023 I went to Mercedes Benz of Houston Greenway and purchased a 2019 Mercedes Benz GLC 300 Coupe Certified Used. It had 83,295 miles. Don Morales was my salesperson. I put the vehicle in my LLC, business name and personal guarantee it using my personal. I put $0 down for the down payment to the finance manager who was Kevin Cayard. He told me I had a great warranty and it covered for any mechanical breakdowns, labor, wheel and tire repair, etc. The warranty was implemented into my bill for $5,333.00. The first day of driving it off the lot around 7:30pm, the vehicle was having brake & steering problems. I messaged Don Morales and he told me to bring it back and allow the service department to fix it, they fixed it. Later that month of May, the vehicle began to idle and misfire and it was hard starting it as well. I messaged Don again about it and no response. I brought it back to the dealership to receive my license plates & my registration. I told the service managers. It took them 2 hours to assist me then I had to leave & pick my daughter up. Then after another month, the engine light came on. I texted Don again, no response. I went to the location & was told by Jason and Remus Bulmer that I could not trade it in and they did a diagnostic and it was the fuel pump and everything was fine. They told me to go home and scheduled for me to come in the following Thursday to fix it. Monday came and in the middle of driving, the car shut off and rolled off the street. I towed it to the location and they called me and said it was an engine problem. My service advisor Drake said I can go through my warranty & he was 99% sure they would fix it. 2 weeks later the claim was denied because the car was in my business name & deemed as commercial use. I did not use it for that. Now I have to pay $20K for a new engine. I would like to trade in the car or get rid of loan. I was sold a lemon. I would like a refund for my warranty that I did not use. Also it is illegal to sell someone an extended warranty if I cannot use it. If I couldn’t use the warranty because it was in my business name, what was the reason for Kevin Cayard selling it to me. Also I was told by Don Morales that the car had no accidents and a clean title. I ran the car fax of the vehicle and the car had 2 previous accidents from a previous owner. I was lied to and scammed. I would like the money back for my warranty that I can’t use, a trade in, and also the debt to be removed from my credit.

Claimed loss: I would like a refund of my extended warranty of $5,333.00.
