Acai Berry illegal appropriation of funds

Terms & conditions not available or totally unclear. Two unauthorised amounts taken directly from my bank account totalling £146. No further goods received as of 20th August. Don't want them anyway as product doesn't work. Also goes under the names of Nature Berry, Viv 3, Focus Cleanse. BEWARE

I am another ex Local Billing employee, the owners of www.acaiberryexclusive.com, www.acaiberry-lifecleanse.com, www.absoluteacaiberry.com and another sites with these fake diet products (colon cleanser, acai berry, resveratrol). They are operating using various companies: Viv3Labs for Europe, FMW Laboratories for US And, lately, to avoid the problems caused by the scam using Viv3Labs, they are using Trading Planet Ltd for Europe and Information Tech Systems LTd for US. Also, they are using PurpleSky LTD at Cyprus for Europe.
The business model is to offer a FREE SAMPLE, only charging you the postage (this is an excuse to get your credit card number) and, then, due to HIDDEN Terms and Conditions, charge people incredible amounts of money for pills, which in any retail place cost less than 6 US$ per bottle.
The owners of those sites are Deepak Argwal (http://www.ccap.ph/index.php?option=com_content&view=article&id=106:deepak-agarwal&catid=76:hot-topic, apart from this business –contactcenter, legal-, he is running more than 2.000 Porn Sites –see DeeCash.com-), Clay Douglass (http://www.linkedin.com/in/claydouglass) and Mitch Platt (http://www.linkedin.com/pub/mitch-platt/4/271/878) and their plan is to scam as much possible and, then, go for another product and do the same (SCAM).
It is easy to contact them through the information who appears on the site registration of www.acaiberryexclusive.com. Now, they discovered this hole on their ability to remain hidden and are registering the new sites using a Marketing company located in the US:

Also, they are using a company called Phytoscience, located in the same address than viv3, to make the handling and the postal distribution of the products. The manager of Phytoscience is called Chris Swanson and his email is chris@phytoscience.co.uk.

I got caught too.. the $8.95 "risk free trial" from acaiburnexclusive.com suckered me into 'agreeing to' an additional £69 ($130) 15 days later (because I didn't cancel it), then £49($95) every 30 days thereafter. Both these charges came from NATUREBERRY. For some reason, it was being converted to USD before AUD so add on conversion costs and foreign transaction fees, and all up this one little bottle of pills cost me nearly AUD$250.

I finally worked out what was happening, and managed to get through to the customer service number to cancel my 'account', but the line was REALLY bad, and they weren't authorised to email me confirmation of the cancellation, so I don't know if it worked. I cancelled my credit card to be sure, so now I can't even try to return the one bottle I did get.

Also, I've been charged an additional USD$14.90 from MAXACAIBURNCOM and USD$79.95 from NUTRITIONALSUPP (which I'm working with my bank to get back)

AUD$360 later, feeling stupid, lesson learned.

Unfortunately i have fallen victim to the same mob, they have managed to fleece me for over $320 au so far. Even today, a week after cancelling my card, they are attempting to take more money, as it was dated the day before cancellation.

I you have become a victim, it is very important to contact your bank within 60days.

I initially dealt with Viv3 and MAXACAIBURNCOM since then these following company names have been taking money from my account NATUREBERRY, FOCUSCLEANSE and NUTRITIONALSUPP

Acai Berry How to Get Your Money Back and Legitimate Contact Info

Hi everyone! I found this site very useful when I found out about Viv3Labs, and so I am hoping to help anyone who has had the same issue. I was offered a refund by the company -- but you have to act fast in order to get it! Here is what I did:

First, if you are reading this, your heart is probably pounding so hard, and you're probably thinking, "How could I be so stupid!" ... At least, that was what I was thinking. So I had to quickly take action. Without even looking on my credit card bill, I knew I was charged. I had an off feeling when I purchased the Acai Berry Detox pills, and when I received the product in the mail, I had an even worse feeling. I searched Viv3Labs online, and sure enough, this website came up first. I read the complaints, and I knew that I had to do something and contact the company immediately.

First, the numbers and website given to you on the Viv3Labs website are completely false. The email "[protected]@viv3.com" does not allow you to send email, but if you receive an email from this company, you will be able to reply. You cannot send a new mail message to this email address. Secondly, if you do send a message to [protected]@viv3.com, you will receive an automated response, telling you that you cannot contact this company via email, and that you must call them directly. It lists some numbers for you to call. I bought a calling card, and I called the numbers listed. I called out of their business hours, so an automated voice message instructed me to call from 8 - 5 (United Kingdom time, which is 5 hours ahead of the Eastern time zone in North America) from Monday to Friday. Well, I did call that number during their business hours, and it 'could not be reached' ... ! At this point, I was scared. I couldn't contact the company, and I knew that I had been charged.

Not to panic.

On this forum, I found other email addresses that could be contacted! I emailed ALL of these addresses at once and asked to cancel my subscription and for a full refund. Here are the email addresses:

Clay Douglass and Mitch Platt apparently run this scheme. I found their emails on this forum. I also emailed the "[protected]@viv3.com" along with these emails, just so that they knew that I was trying to get ahold of their company.

VERY IMPORTANT THINGS TO NOTE IN THE EMAIL:

On the Viv3Labs website, it does state that you must cancel your subscription within 15 days of your PURCHASE. BUT, it ALSO states that a customer may receive a full refund within THIRTY days of purchase. Here is the link to where it states that on their website:

So, if you want your money back, and you're contacting them within 30 days of your purchase, they should give it back to you. They refused me the first time I asked (see emails below), but I told them it was unacceptable to refuse me because of their policy.

ALSO IMPORTANT IN THE EMAIL:
Consumer Protection Act / Fraud

I also threatened a UK law against them: As the website offers a refund as an option for the consumer, you are able to to take action using the Consumer Protection Act based in the UK, which will entitle you to a full refund of your product. I made that clear to them in an email, which they immediately responded to me that they would refund the money. Since this is a UK company, it must comply with this Act.

Additionally, I told them that I spoke with my credit card company. Because their website states that they will refund money withint 30 days, if they refuse, told them that I had already contacted the appropriate personel regarding the matter, and should a refund not be given, I would take further action to ensure that they did not receive payment, as it is FRAUDULANT to note that you refund customers if you refuse to do so. I threated that my credit card company had noted that these conditions are enough to prove credit card fraud by the company. ...In fact, my credit card company did not tell me that these conditions were enough to prove credit card fraud. BUT, it probably would stand up to being that, since if a refund is not offered when the company says that it will give one within 30 days, that is fraudulant. I actually hadn't contacted the "appropriate personel", but it was a scare tactic that I had used for them to refund my money (see emails below -- the scare tatics worked!)

On my credit card bill online, there was a phone number listed next to the charge. This number is [protected]. Again, I used a calling card. I got through immediately to a person, who asked for my "order number." I told him that I did not have one (they never sent me a confirmation email), and so he asked for my email address. I spoke with him before I received an email response. I asked to cancel my subscription, where he gave me a confirmation number, and I told him I wanted a refund, because the policy noted that I would be able to receive one within 30 days. He said that he was not authorized to do so, but within 72 hours, someone would email me regarding a refund. This happened, and here are the emails which we exchanged that got me a refund.

When contacting your customer service by telephone, I requested that I be contacted regarding a full refund for the $118.63 USD. I have read your terms and conditions, and it clearly states that a customer may request a full refund within 30 days of their purchase. I would like to request a full refund of the $118.63 USD, as I am not satisfied with this product. As I had purchased this product on July 27th, the 30 day period has not yet ended. Consequently, I would like to be credited for the full $118.63 USD. Additionally, the 15 days trial period ended on August 13th, which was only 1 day shy of my first attempt in contacting your company. In first contacting Viv3Labs, all phone numbers and email are illegitimate, making the contacting extremely difficult. Please keep this in mind given my request for a full refund. While I purchased this product, the terms and conditions were not available at the time of checkout. As I referred to them afterward, the terms and conditions clearly state that within thirty days, you may request a refund. This is found on the FAQs page on the viv3labs website. Here is the link to that to verify this: http://viv3labs.helpserve.com/index.php?_m=knowledgebase&_a=viewarticle&kbarticleid=26&nav=0 . Here is exactly what the policy states:

"Our refund policy is as follows:

* 1. You may receive a refund of any Product that you ordered up to thirty (30) days after Your order is placed.

* 2. Customers are restricted to receiving a single refund per product ordered. Repetitive refunds are not permitted unless the product, as delivered to you, is defective. VIV3 reserves the right to refuse a refund to any customer who repeatedly requests refunds or who, in VIV3’s judgment, requests refunds in bad faith.

* 3. In order to process your refund, you must supply VIV3 with Your name and delivery address. If you provide us with insufficient or incorrect information your refund will be delayed.

THEREFORE, I am ENTITLED TO A REFUND for this product. It is completely unacceptable to "be unable to credit my account for this product", as your policy CLEARLY states that a refund is an option. There is absolutely no reason why a refund cannot be placed. Your website clearly states this. Additionally, your services make it extremely difficult to locate and read your terms of service at the time of checkout, as many other customers have noted. Further, as your website offers a refund as an option for the consumer, I am not afraid to take action using the Consumer Protection Act based in the UK, which will entitle me to a full refund of your product. I have already contacted the appropriate personel regarding this, and should a refund not be given, I will take further action to ensure that Viv3Labs does not receive payment, as it is fraudulant to note that you refund customers if you refuse to do so. I wrote them back accepting these terms, and I also asked them for a confirmation number or an estimate as to when the amount would be credited from my account.

DO NOT LET THESE PEOPLE TAKE YOUR MONEY! IT'S NOT WORTH IT!
I will respond back if they do not credit my account, but if they do not, I now at least have written emailed proof that they agreed to pay me back. Also, I am planning on cancelling my credit card account, as many people have said that even after they contacted this company, they keep charging them. I would suggest doing the same.

I really hope that I helped some panicked people, and I thank all the posts that helped me when I needed it.

I ordered the resveratrol extract and acaiberry detox from one of the free trial websites and to my surprise, shock and horror, they had charged a total of $390.00 to my credit card. They had also charged me for one more bottle of something I never ordered. I called them up and told them I never received my order (which I did actually receive), and they immediately gave me a full refund. I was lucky and will be so careful from now on when I order online.

I have just rung through to a customer service area which was very helpful. It turns out the number on my credit card statement is actually a phone number (the lady at the bank told me that when I disputed the item). I have two different entries on my statement this month from two different companies, howver I rang 0011 44 [protected] and the lady I spoke to (Kelly) was quite helpful and assures me my account is now cancelled. She gave me a cancellation number so that at least is helpful. Goodluck!

I just got my credit card account today and viv3lab have taken £150. A pop up menu invited my to sample these tablets foc - I only had to pay postage.

Unfortunately the date of the delivery invoice was 4 Aug 2009. I am therefore outside the 30 days return limit. If viv3lab had sent an invoice for the additional £150, it certainly would have drawn my attention to the scam.

Someone else mentioned that it is illegal to impose terms and conditions to foc samples.
This is truely a scam. I look at those two little bottles and cannot believe I was conned out of £150 for vitamin tablets that I could buy for probably £10 in a shop.

Can anyone help? Guess it's too late.

Hi,
Writing re: the Acai Berry and Life Cleanse products I ordered. Not really sure what I should do. I am in the same situation, but still a little different. I made an order, received it and had no results using it. I called to cancel my next order, and asked if there would be any further charges to my credit card. He said "NO". This was not within the first fifteen days. Well today I got my credit card bill and you guessed it $135.04 per bottle was there staring me in the face. I was under the impression that I had called to cancel. Why would I ask for a refund if I am canceling? And when he says "no" that means no right? Well I called the number that they give, and I was hung up on twice. I just don't know what I am supposed to do. I am so frustrated. Can someone help? I have read what you have said, but not sure it will work for me either.

They told me that if I did not receive an email from them then I was denied for the refund because in the statement it says "may receive a refund" yet no one would tell me why it was denied. They also told me by calling now it was too late. I only got my statement now, how was I to know they would charge it after I called to cancel. Cancel means no thanks, no working. They should have automatically refunded the money.

I too had wound up swindled by this scam and I fought back. It took a lot of perseverance. It took 3 phone calls and a series of emails but today I was rewarded for my efforts when I received an email saying they would credit me back my 119.02 U.S. I thank the OP for her ideas on how to fight back.

Well my 30 days is up today the 31st Aug. I have had no answer from them whatsoever except that I am in the wrong. 2 bottles of tablets with 60 tabs in each and they take nearly $400 out of my credit card, how disgusting.
I'm so happy for you Sarah. I'm not having the same luck, oh bugger, so angry.

Okay, thank you Sara, I hope this'll work out. I've tried all the emails now and already cancelled my credit card. I've tried calling & emailing them, but the Phone number did not work and the email response was that they didn't offer email support... this is SO frustrating...

Acai Berry rip off scam

I signed up for a free trial of a colon cleanse that is immediately switched for something called Acai berry Detox. I am charged $1.95 for shipping and handling. I get numerous phone calls saying my order was not processed even though I can see a pending charge in my bank account.
Then I am offered an extra bottle for $39.95 and a trip to Cancun, I agree. The person on the phone says there is no other obligation or charges. Then a week goes by and I get hit with a charge for $87.13. I still have never seen any product. Numerous calls to the phone number provided to me by my bank for customer service are ended abruptly as soon as I question the $87.13 charge.
I plan to dispute this with my bank. The company says I agree to the $87.13 but it was never mentioned nor was there any wording or terms and condition upon ordering the "free trial" This free trial has now cost me $129.03. And the products say they are endorsed by Oprah...

I ordered a trial bottle of Acai Berry and I did receive it. I decided I didn't want to continue getting the Acai Berry and I called the 800 number to cancel. A month went by and I got $82.31 plus an $.82 international charge. I called and complained at [protected] and they told me I didn't call in the 14 day period. They are scammers! I cancelled my credit card to make sure they do not charge me again. What a RIP OFF!

I am with all of you. I am going through the same thing. I called to see why I hadn't recieved my trial offer and a gentleman told me if I didn't recieve an e-mail conformation then my order never went through. I said okay and thought oh well I won't try it. A week later I have an unauthorized charge of 86.42 coming out of my account. I had to do the same thing, cancel my card and put in a formal complaint. I am so mad because you put your trust in these companies and the advertisements. I have called three times and you get cut out or she tells you to call back because she can't hear you. I will keep trying but I feel it will be along time before I see the money. It's not alot but I am a single Mom on a tight budget just looking to be healthy. I was just going with the trial offer unless it gave me the energy of a 5 year old then I might have gone with the expense. Will never know! Jess Roy

Why do i only hear of these scams till I am in it! I too ordered the trial bottle of acai berry, gave them my account number for the .99 cents s&h, and now they are billing me every month for something i did not authorize! When I call them, i am on hold, then they have a thick foreign accent so I can barely understand them, by this time my anger is growing more, then their lines keeps cutting out. So by the time I do get someone I can half understand, they appoligize and tell me I will receive a refund in 2-3 weeks. Can I beleive them? If not, then what? Can they just get away with that?

i had the same thing happen to me signed up for the free trial and was hit twice on my bank! never order from them again, I had to cancel my debit card so they wouldn't do it again

I SIGNED UP FOR FREE TRIAL FOR COLON CLEANSER AT A COST OF $4.95 I NEVER RECEIVED THE PRODUCT AND 14 DAYS LATER MY BANK WAS DEBTED FOR $82.97 IT PUT MY ACCOUNT IN NEGATIVE. I DISPUTED WITH THE COMPANY AND THEY TOLD ME THEY WILL RETURN THE FUNDS THIS HAS NOT HAPPEN YET.THIS IS FRAUD. I DID NOT AUTHORIZE THIS TRANSACTION.

The other problem is I had to also cancle my bank card today in order to prevent the transactions from re-occurring.. They filed a formal complaint as well.. do not order from thsi company or you will be ripped off.. I never even received the initial trial bottle that I was also charged.. what a joke!

this is exactly what happened to me.. i was told by the operator even that the pending transaction would be cancelled.. it never was! this is fraud! I cant get my bank to remove somthing I didnt ever authorize because I cant get anyone to assist me here with health cleanse.. In addition, I never received even the trial bottle! this is crazy!

Acai Berry ACAI BERRY - DETOXIDANT

We ordered over the phone an Acai Berry that was advertised for .99 cents. We never recieve this order that cost .99 cents. It sounded good but the result was a scam. Two weeks later, this company charged us $82.31 for another product (Detoxidant) we never ordered. Please watch Acai Berry advertising because they are scam and basically steal money from people.

They charge you account and do not send the product, then charge your account again still without product. when you call the phone ring. They hang-up.. They tell you that it is only $.99 and you later see a charge for $82.31... When you order the first order they call a few days later you tell they them no on the phone, theny you get another charge.
How can we take they to court.?

My friend and I both fell for the acai berry scam.I was double cranky when I saw my credit card statement as my friend had asked to use my card as she didn't have one, which I had agreed to, after all it was only .99c, WRONG.I tried to phone them on numerous occasions at a costly expense from Australia to Cypress.They say they are in England but the number is transferred to Cypress.After they agreed to cancel our memberships I tackled them about a refund, I was abbruptly told NO and hung up on.This just made me more livid so I emailed the company about 4 times and did not take no for an answer.I told them I was taking legal action and to my surprise recieved an email back saying my account would be credited within 5 days, and guess what, IT WAS.I recieved back what had quickly amounted to nearly $2000.00.I urge you all to stand up to theses thieves and do not give up untill you have recieved your money back.I hope this helps

Its in the Terms $ conditions which are hidden at the bottom of the page. Basically if you don't cancel within a certain time they charge you for the trail product as well as subcribe you for more. With the other charges after the trial charge, you can request a refund as long as it is within the 30 days of the order being placed.

It sounds like I should go straight to my bank with a complaint of fraud instead of even trying to deal with this company. I ordered two trial month bottles for .99 ea. In less than a month I now have been charged 2 charges of $87.13 and 2 foreign transaction fees of $2.61. In addition when I just now called to cancel I was informed of another $83. charge. I never received any information on their policy or that I was going to be charged more $$.

In March 2009 I ordered the "free" trial of the Acai Berry detox. I called and canceled 6 days after I received the product. I received a package late March and returned it refused. I called the company again, On April 6, I recieved a charge of $83.18 on my credit card from "TopBerryColonHealth Cambridgeshir GBR". I called again and was assured it would be removed. Same thing happened May 6 but this time it was "Berry X-Clusiv [protected]". I had already refused that pkg as well and they never removed the charge. Again on June 6, $83.18 - "Rainforestberry [protected]", by this time I had already returned 3 packages. On July 5 - $83.18 from DETOXCLEANSE [protected] and Aug 6 $83.18 + $2.00 + $1.95 from DETOXICANT [protected]. I'm letting my credit card company deal with it.

On thursday I had a chat with operator Sheila (CA-046), asking to cancel a purchase and she told me it was canceled, but now I was looking my bank account and the purchase wasn't canceled. I want you give my money back because I didn't authorize this purchase.
Now, I'm trying to talk at chat online but all operators aern't available and on the fone too.

Acai Berry Unauthorized Charges

Placed an order for a FREE sample of AcaiBerry and agreed to pay the shipping charge of .99 cents. Never received the FREE sample. Terms and Conditions of UthiHealth state that if you cancel your order with in 15 days of ordering sample, you have no obligation and will not be charged for product. On the 14th day I have a charge on my credit card for $86.42. I was quoted a price of $39.95. I tried to call the number listed on the internet and never got through and was disconnected. I then opted to use the Live Chat option for assistance. I was told that I could return the order that was delivered to me on 8/17/09 with an RMA # and then I could get a refund. When I explained I never received the product, so I could not return it I did not get an appropriate response. I bascially started to get the run around and was told they only had limited information or authority. She did cancel my account, however I'm not sure they really did due to their inability to give me a straight answer. When asked for a working number I was given [protected], which is also a number that skips around and plays pre-recorded messages and then disconnects. In addition, per their terms and conditions I had 15 days to cancel and not be obligated and they charged me anyway and will not reverse it.

i just cancelled my free trial offer. the number i called was [protected]...Egrass. the gentleman gave me his ID #, and also told me that my account was cancelled and that as a courtesy of their company, i did not have to send the product back. my free trial cost me 3.95 ...believe you me, i will be keeping an eye on my account, just in case.

They have done the samething to me! I was on hold for over 20 minutes just to speak with someone. Now they say it's been cancelled and I will not be charged anymore. I am suppose to get a 'refund" from the product I never received and if I send back the bottle I did get, then they will reverse the charges. So Far, I am out $200. Maybe I will see it again, but more than likely, NOT! Please do not fall for their Bullsh__!

I agree I also ask for a free sample of the acari and the clense and was charged $87.13 and then another 78.53.
This is a total sham and is a ripoff. I have tried to call and talk to someone to get the charges reversed but no one is answering. So I opt to have my bank card canceled becsues after it was said and done I am out almost $400 dollar on stuff that was supose to be a free sample to try and I was only going to have to pay shipping and handeling and now my account is over drawn and now I have over draft fee's on to of their crap. I am also contacting the fraud dept and reporting this as well hope the rest of you will do the same because this a ripoff and people are expecting a sample not to get ripp offffffffffff...

Went with the $.99 + $.01(?) on both products and received the cleanse in 9 days and the acai product in 14 days (15 day cancellation!). On the first on the month was charged $.99 + $.01 (x2), then on the 18th was charged $87.13 + $.87 (x2). Tried to cancel but due to the rules, not allowed to for that charge. It is now 8/24 and haven't gotted the product I was charged for on the 18th! Ordered this on line and didn't really see the 15 day policy listed anywhere. What a sham and a rip-off!

I saw an ad 0n a blog of a neighbor in my own town and surrounding towns swearing up and down these products work.
and like the rest of you looking to find a good honest products out there that work and help you stay healthy and lose weight
I bought a free trial offer and I was told thats all she paid and lost all that weight . well you buy and then you really pay.
I found out that I didn't just buy a product for free I also bought in to a website that was a bonus become a member for 1.95. they don't tell you in some cases you will or will not recieve the product but they will charge you before your 15 days is up like in 3 to 5 days and when I called I found out that I was also paying for a website for 4.95/9.95 on each of the products that I ordered as a free sample. Now let me back up a bit why all these free samples you ask? every time I went to put my credit card info. in I was DENIED. BUT I wasn"t and didn't know and used a different card 3 cards . and two of them charges are duplicated.

Acai Berry Acai Scam - Ripoff

My wife and I were ripped off by the ACAI ripoff artists, selling their worthless acai berry pills. One company has created MANY sites claiming the bogus benefits of acai berry, including weight loss, muscle gain, getting ripped muscles, etc. They are ALL liars. Read the fine print! You will be charged shipping for the "free" bottle, then you will be charged the monthly fee (usually $60), then another monthly fee, then you will start finding other bogus charges on your credit card. You will NOT be able to cancel. This is what we went through. These guys are CRIMINALS! Do not even bother ordering the products if you see the word "acai" as it is a ripoff. My wife tried the pills and they did not work, but we got charged over $150 on our credit card. What a NIGHTMARE!

Acai Slim and fit-fac are both allied..and they give each other credit numbers for charging services they never give.
this is really bad as their prices range over $100
they do not even want the return of the ACAI pills --they send out for 60 tabs and a charge of$4.95 s/h.

It is hard to reach them by phone..why doesn't the govt.step in and clean out these robbers?

biggg scam. this company wants something for nothing(your money).thats what they did for me. I orderd the sample at $4.99.The next thing I knew they had another charge on my debit card of $79.96 fir nothing I did not sign up for anything. thier telephone number is [protected]

Acai Berry False Charge

I ordered a sample of arci berry and was told I'd pay 3.95 for shipping, and nothing else. They billed my credit card for 89.31, and today I looked at my online statement and they billed me for $89.31. I called to explained to them that I didn't order anything else and I got billed for something I haven't received, nor did I authorize. I hope that you can help me out.

Acai Berry Charged for product never shipped

Saw on "Oprah" and ordered "no risk" product to try "FREE" for 30 days for cost of shipping. Stated to try for 14 days from day of shipment to cancel at any time. Ten days later product never arrived, called after later than stated and they said to wait a few more days. Waited until the last day (day 14) and still had not arrived. Called to complain and waited for 45 minutes on telephone AND at the same time tried the on-line customer service chat. Nobody ever answered my on-line chat even after 30 minutes. Finally got through to cancel and request refund - they refused saying it was too late for refund. Even after I told them product had not arrived it did not help. Then they offered to charge me half as much if I was willing to wait additional few days - said no. Finally went on-line and saw HUGE number of fraud complaints. Called credit card company (charges for product was still in "Temporary Authorization" area - i.e. NOT paid yet). Put stop on payment and cancelled my card. Hope this helps. Of note is that this "company" is called "Preciousmind Trading LTD" and located in country of Cyprus - impossible to prosecute them for fraud. AVOID www.acaiberrydetox.com

I believe this is put on the page just to make us think they are from cyprus. I may be wrong about that, and for all we know they could really be from Cyprus. To support my claim that this might be a fraudulent company, I did a WhoIS WhoIS IP on these guys.

Please remove this from my account. I have two charges i didnot approve. $1.95 and $2.00. This was cancelled and when the box came it was not opened but handed back to the postman with return to sender. You need to credit my account today. They are cancelling out my yahoo account and my bank card. I have had to many fraud cases.

I am beyond frustrated with these so-called companies. I requested the free trial after seeing the ads "as seen on Oprah and Today Show". I was shipped a free trial and noticed no benefit and threw it out. The 99 cents, that I agreed to pay for shipping was deducted from my account. Then I received a call from my bank two weeks later regarding possible fraudulent charges on my account. $86.42 was being deducted out of my account from CCC Enterprises out of Cyprus. This was NOT the same company that took out the 99 cents. The bank asked me if I had ordered anything online recently and that was the only thing I had ordered, since I said yes, it was not considered fraud and they closed my case. When I spoke to my bank in person I was told I could not dispute the charges because of the terms in fine print that I unknowingly agreed to. They were aware of a lot of these cases out there and urged me to call the 800 number to request a refund directly. After several attempts and over 30 minutes each time, on hold a poor speaking representative told me the same story everyone else has gotten. When I receive the mystery shipment of product (which they show was shipped two weeks ago and received) I could return it for a refund. I have not gotten it and know that I never will. These people are trash and should be shut down for pulling this kind of crap. I have cancelled my debit card and had to re-issue to avoid any further charges.

I am having the same problem that all the previous people have complained about. So far I have had 5v deductions from my credit card and no product. Totals are over $90.00 for a produst that was supposed to be free for the first 30 days.

Product never shipped and I have 4 charges on my card from this company. 2 charges for shipping which are under two different company names (oxi-berry and uthihealthproduct), as well as two misc. fees. They never sent an email with any sort of order number and they do not pick up calls. I'm worried they are going to charge me the price indicated after the trial-period expires. This was a big BIG mistake... Would it be best to contact my bank and cancel my card?

I also ordered "free trail" paid the shipping and handling and never recieved the product. The company actually gave me a "ups tracking number" that when I tried to track it it wasn't a real number.
Live and learn. I will never order online again.

I am having a similar problem with the same supplement. I did get it in about a week and used it for roughly a month and had no results. I tried calling for the past week and no one answers your calls to cancel your account with them. I'll have to go to my bank and talk with them about canceling my card just to stop the extra charges. I would suggest buying the acai berry supplement from an actual store, the internet sites will suck you in.

I do not wish to recieve any other supply of the Acai Berry Detox or the colan cleanser. They have made me very sick. i have contacted my bank, and my cc company to ensure that there would be no money withdrawn or processed for these items. i have aslo sent a copy of this e-mail to the authorities to make sure that they have a copy of my e-mail sent to you advising to stop all further shipments, this is my proof that i have advised you today August 14/09. i would appreciate an e-mail back from your company confirming my request of cancellation. i can not get through the telephone # on your packing slip. My cc company will proceed with fraudulent if you process another payment on my card. They have a copy of this e-mail too. I too have become seriously ill from these products, so much so that it resulted in me being hospitalised for a week. I do not wish to receive these products any more and I take offence to the fact that you sent extra products to me and debited my credit card without my knowledge or permission. I have tried your 0800 numbers and they all appear to be disconnected. I am sending the partially used product and the sealed product back to you today. I also have contacted my bank and the charges are under investigation and I would appreciate it if you reversed everything and I will be going to the police as well. I require a confirmation email from you before the day is out as well. Email address is security@eastland.co.nz and my name is Mandy Edwards. YOU PEOPLE ARE DANGEROUS!, both financially and helath wise and I will be advising as many health/government/police authorities as I can, to get some kind of warning out to people.

Acai Berry Unable to Cancel

I've attempted to cancel my 'membership' for the Acai Berry Detox numerous times via email as stated in the 'Terms & Conditions' on the webpage. I have never received a reply notification. I am going to send a letter via US Mail to see what happens. I've been returning the latest shipments 'return to sender' and have just received 2 email notifications that state: "8/13/2009
This is an automatic notification – do not reply to this e-mail This confirms that a transaction for the amount of $83.18 has been refunded and should appear on your bank statement in 5 to 7 business days.
Should you have any further concerns
Pelase contact [protected]@fwmlabs.com
Or call us at [protected]".

I see on various complaints that this number they provide is very unhelpful/non-existent. I'll try this number also. In the meantime I'm going to wait and see if a refund really DOES appear on my statement.

My goodness, that was a process. I ordered a free trial of Acai Berry Supplement and paid $4.95 shipping. I'm super glad I read up on it and was told they would start charging my credit card around $80 every month. I called two numbers. The first was listed on this site. They weren't able to find my information. They gave me this number - [protected] and it was the same story where they couldn't find my info. Finally I went back to the credit card statement and found this website www.newslimu.com. They had a phone number listed as [protected]. They cancelled my membership but now I have to send back the other half of the bottle since it was only a 14 day trial. CIRCUS! Hopefully this benefits someone else. Good luck!

Acai Berry - impossible to contact to customer services

I called many time and keep waiting on que . One time, one lady pick up and I couldn't talk to her about I want to cancel the order and I need an RMA# ??? for returning because if I don't have that #, the company will not accept the return but she hung up right away. Acai Berry Free Trial is not Free After All!!!

A month ago, I ordered Acaiberry and Life Cleanse capsules from Viv3Labs, who happened to run a special Trial Offer through one of the advertising boards on hotmail.
The Trial Offer consisted of a supply of 60 capsules at a total cost of GBP 1.00 for each product.
The products arrived failry quickly with a very basic invoice confirming that I had been charged £1.00 per product.
Today, another supply of 60 Acaiberry capsules arrived in the post, with an invoice for £79.00 + £3.95 handling fees.
I rang their Customer Services immediately who informed me that by accepting the Trial Offer, I had also agreed to an automatic supply of these products. Apparently, this was in the small print of the offer! I can confirm that I do not recall seeing ANY information about this automatic subscription. If this was indeed printed somewhere on the Viv3 Labs Trial Offer, it was made virtually invisible to the customer.
The Customer Services representative I spoke to advised me to return the unwanted product. When I questioned the refund process, she said that she would have to submit a form to their Refunds Department and that I would be contacted about this refund by email.

Having seen so many similar complaints on various websites, I am guessing that Viv3Labs have made a huge amount of money by fooling thousands of customers this way and I am now querying the legality of such practises. At this point, I do not know whether I will ever receive a refund. I cannot believe that any company can charge a credit card automatically, without making it very clear to customers before hand that they have agreed to these automatic charges.
And more importantly, how can I ensure that my credit card is not charged again for further unwanted automatic orders?

I have recieved some Resveratrol Extract which I never ordered. Also you have taken, 2 lots of over £75 = £150 plus, without my permision. What on earth is going on?

Hi!
Here is my story. Saw the offer. Understood it. Got the trial. Called the number on my bank statement (+ 44 [protected]) a couple of weeks later and...canceled. I know that probably won't make any headlines but that's it.

It took 30 seconds before an available agent answered the phone. I didn't wait that long to reach them on the phone and it didn`t cost me a cent.

All I can do is recommend that you do the same.

H i said i was going to find the next one and i think i just have... everyone click on TOM H M's profile and see how he repeats the same statement over and over and over these vile people get everywhere, so SharilynR and Shane2 have stopped saying how they are so sorry for the inconvenience ... blah, blah, blah and we now have Tom MH how long are you going to stay here...see you around

I too was conned with the no obligation free trail offer!

fortunately (I hope!) I saw the many SCAM remarks on the internet when researching it after ordering. So I found the small print and called them within the 14 days cancellation notice period (also followed this by a letter by recorded delivery to their invoice address!) hope it works?

I too have fallen for this - as soon as I noticed the payment taken on my credit card statement I rang Viv3 customer services on [protected] I explained I did not want to continue with the contract, gave them my name and they found my order details and cancelled the contract and future orders. I have not yet received the product I have just been charged for but am supposed to get it in a few days. I am happy to get out of the agreement and accept my stupidity for falling for this. But if you complain enough and return the products received, you may well get a refund. Their customer support email is 'support at viv3.com' the people at the customer number just work at a call centre that works for Viv3 they were very nice and helpful.

How do you get theme to stop sending you the product?
Honestly these people are nasty.
I've had the same probleme, I don't want theme to send to me a second time for 79pounds..!

Acai Berry Unauthorized Charges to Account

I ordered from an ad while playing games on the Publishers Clearing House games. It had Oprah, Rachel Ray and Dr Oz saying how great and fast you could lose weight. I signed up for a free sample that I needed to pay $1.95 for shipping. I did on July 10, 2009. On July 20 they shipped the free sample. I received it on July 23rd and on July 27th (14 days after I ordered, there was a weekend in there)they made an unauthorized charge to my account for $87.13. When I called I told them I had just received the free sample on the 23rd - they hadn't given me my 14 days to cancel if I wanted to or even a chance to see if I wanted to try this product. Why had they sent the automatic shipment before I knew what I wanted to do?They said I should have called to let them know 3 days after I ordered to tell them I hadn't received anything. The first person I talked to canceled my account and gave me a cancelation number and a number to return the bottle. So I waited to get the automatic shipment that they had referred to that would be shipped if I hadn't canceled in the 14 day period.

Well, what that turns out to be is the "free sample" that was shipped on the 20th is the bottle that you have to return. There is no automatic bottle that shipped if not canceled in 14 days. It is the bottle you thought was the free sample! What it all comes down to is you don't get a free sample. What they send you is the bottle that costs $87.13 (probably different amounts depending where you live). There is no chance at trying the product for 14 days to determine if it works because you get it 1 day before your 14 days is up and they put through an unauthorized charge to your card the next day. I have returned by "free sample" and am waiting to see if I get my refund.

Beware - it may be a reputable site you are on but I guess that doesn't mean what is advertised there is reputable.

Acai Berry Debit Card Charged $86.47

7/15/2009 Ordered ACAI Berry Detox from Oprah's website. received no email confirmation nor anything thing on computer to copy when ordered. all companies i've dealt within via internet send email confirmations. 7/17/09 debit card charged .99 cent shipping and handling fee. 8/3/09 debit card charged $86.42 - didn't know why. Called [protected] (twice before got through 8/4 and 8/6) was told terms were that i had to cancel within 15 day trial period or card would be charged. on 8/6/09 told hadn't received product; was told shipped 8/4/09. Requested anything they had for me be cancelled and was provided with cancellation confirmation number 1607496. When received (1) bottle of product on 8/6 no invoice accompanied package. Only address have to return product is ACAI Berry Detox, Hollywood, FL 33020. just notice on bottle ACAI Berry, distributed by FWM Laoratories, Hollywood, FL 33020. will try and return there and get credit. Acai Berry debiting my checking account without my permission

On July 10th I ordered a FREE trial sample of acai berry as advertised on the Weather Channel website. The website displayed clippings from Racheal Ray, The Today Show, Do Oz and others so I figured it was not a scam. I never received my sample but the $4.95 shipping was taken out of my account. Then today another $87.13 was taken out of my account, I did not authorize this deduction as the web site states you have 14 days to try the sample before deciding to order - I never received a sample. I called them and after waiting 1/2 hour someone came on the line and told me the charge does not appear on their records and I would have to call back in a few days. I want my account credited and this deduction stopped.

When you give a site your credit card information, you have authorized them to take money out of your account. Never give a site your account info, even for free stuff. Because, that just made it "not free." You're never going to see your money again. Only suggestion is either close the account or dispute the charge. But, I'm willing to bet, they're going to keep charging your account. You just got scammed. You could put a stop pay on the charge, but that only works if the charge is the same amount. If it's different, even by one cent, it will go through.

Acai Berry Scam

I too have been scammed by Viv 3 with the purchase of the free trial of Acai Berry & Life Cleanse. I did not see the small print in the terms and conditions which state that if you do not cancel within 15 days of ordering (not receipt) of the "free trial" then you will be charged the full price for the product and also entered into a monthly subscription. I only found this out when I checked my credit card statement. I have never received any products from them, not even the free trial.

I spoke with my credit card company who advise that it is best to contact the scammers in writing, I emailed them and got a standard reply to say they don't respond to emails. I called them yesterday and was advised they would put my request for a refund forward. I have today been advised (by email) by them that I will not receive a refund.

I have spoken with the disputes department of my credit card company and they will now take the matter forward as I have been charged for goods and services I have not received. It may be that it is the credit card company that refunds me my money (nearly £300) and not the scammers, but at least I have a chance of getting my money back.

My advice to you is, if you have just ordered, phone them and cancel and ask for a confirmation in writing and a confirmation number. Advise your credit card company/bank of the issue. If all else fails seek the help of your credit card company or bank as I doubt that Viv3 that will refund monies.

The credit card company advised me that as I can prove that I tried to contact them and that I have requested they cancel any subscription if they now try to take any further monies they can be charged with fraud.

The credit card company also advised that it is better if you have not received any goods as you can be refunded by them in due course for not having received goods or services - therefore when the postman comes, do not answer the door and do not take in the products.

Failing that, lets all get together and pay them a visit...

I ordered a trial size of each of the products above at $3.95 each on 12/22 which I have not received. Today my account was charged $87.13 twice which I did not authorize. I called the company and they said they are refunding the charges. I was alerted to the charges by my bank.

Acai Berry Fraud, fraud, fraud

I foolishly fell for their come-on advertising stating weight loss, etc. I placed an order for a "trial" shipment of ACAI Berry Breeze and Probiotic Cleanse. I only had to pay a nominal fee and was totally not aware of any membership charges or automatic deductions from my bank account. I have spent this entire day trying to get this straightened out. This has impacted my status with my bank and caused me much frustration. This is a scam...pure and simple. These people need to be stopped.

I did the same thing and now am being taken to collections due to the "trial 14 day period" scam! My advice...always look into the company before giving out credit card information. I had to cancel my credit card and get a new one due to this mess!
