I have been approached by this company and am unsure as well. They said they will find the discrepancies in my loan (for 1% of original loan amount) and give to their law people who will then assign a lawyer at $1000 per month (for about 9 months). I have researched the lawyers, the Founders and everything I can. All seems OK...but they are a newbie company. Basically not enough data to determine. The Rep I talked to was knowledgeable and explained well and answered my questions. I would go for it for sure except for...I am afraid of the process where I am not supposed to talk to the lender once the TRO (temporary restraining order) is filed, which means I'm not supposed to be sending the lender money, correspondence, nothing. That is the only part of this whole thing I am holding back on because at this time, I have never been late in my payments. Problem is, everything is going to change and soon--so I have to do something. Also, 9 months (10 if you include the audit the first month) is a long time to wait to see if you are a winner...almost like having a baby! I was told things would get worse before they got better--but they cannot guarantee that we will win. So what to do...what to do.

Thank you everyone! I have been holding off becoming a customer of these guys and am glad I listened to my gut. They were too positive I would win my case, they kept lowering the cost of the audit and raising the cost of the legal services. George Pulvino keeps trying, but the next time he calls, I am just going to tell him we went with someone else (and I did... me!). I've figured out how to make it all work without losing my home or even being late on one payment. By the time trouble comes-a-knocking, when all is said and done, I will be paying less for my house than if I went with US Loan Auditors/My Legal Service.

My thoughts and prayers go out to all of you who did get scammed, I hope Karma bites them ALL on the behind!

Jennene: You are clients or you were clients? Are you happy you are giving your money to them instead of your lender or saving it? Your writing this telling us about potential? So your saying your very happy this might work but in reality nothing has happenned, so typical but more then likely your not a client, your an employee or associate. We have seen posts like yours before that have praised USLA even though actually nothing has been solved. Let's play along, now why don't you be more specific, has your case been filed? What did they say that made your young family so joyful? Did they say you won't have to pay your bills? Good luck.

We are clients of US Loan Auditors. We were pretty sceptical of the upfront fees that were being charged in order to conduct the investigation into our loan. However we were drowning under our bills and needed a solution. After several months US Loan Auditors came to us with some positive news and we proceeded with the action immediately. Needless to say their work has saved us potentially tens of thousands of dollars in the long run and our young family will be forever thankful.

My apologies...

Was correct about no case being filed for Karen Johnson. It seems the case was filed on behalf of Karen Gardner, apparently her maiden name. Case was filed March 17, 2009. Case number: 2:2009cv00744. It will soon be one year since being filed. Interested to find any progress in this case.

SACRAMENTO – February 25, 2010 – US Loan Auditors announced today that they are endorsing California Attorney General Jerry Brown’s crack down on “phony loan audits” and “loan modification” scam artists by warning California families that scammers are out to steal their hard earned homes and money.

“It is a shame that people would setup a storefront and call themselves a foreclosure relief agency just to steal from local families, ” said Shane Barker, one of the founders of US Loan Auditors. “It is absolutely critical that consumers do their research into the company they are working with and extensively check references before assuming a firm has experts. We have never done, and will never do loan modifications. Our audits are specially designed for attorneys to take right into court.”

yes Mr Barker was most likely calling Jerry Brown trying to get him to crack down on these "scammers", Shane is so upset that some would actually have the nerve to rip off someone just for money. I wonder if Mr Barker is going to set up a special task force to work along with Mr Brown to get these scammers out of business. HOW FREAKING FUNNY? IF BARKER WANTS TO FIND THE DISHONEST SCAMMERS, ALL HE HAS TO DO IS LOOK IN A MIRROR.

Stop being the consumer who walks around with wool, already pulled halfway down your head! The burden of proof is on the company seeking your money. You want proof of dishonesty? Here it is...

The ONE testimonial given at www.myuslegal.com(sister company of USLA) is a fraud! Karen Johnson writes a testimonial(Aug. 2009) addressed to Shane Barker, in which she states, "To date, my case is in the federal courts waiting to be heard by a judge"... Wrong! No federal case has EVER been filed on behalf of Karen R. Johnson! Check it out yourself at www.justia.com, where you can find ALL cases filed in federal court.

Lets go further...Karen R Johnson also wrote:

"Not knowing where to turn, another trusted friend convinced me into short selling my house to keep from getting a foreclosure on my credit report."

-Probably just a coincidence, but the C0-founder of USLA, attorney Jim Sandison is also the owner of We Buy The Houses Guys, Inc., whom specialize in the same exact situation Karen Johnson is describing...short selling.

A little further...Karen R Johnson writes:

"God answered my prayers. It was the eleventh hour; the house was due to be sold within a couple of months when I received a notice in the mail from US LOAN AUDITORS telling me I might have been a victim of predatory lending. I knew this was God answering my prayers because when I responded, not only did they come to my house, but I knew Shane Barker, we were in the same networking group."

-And we come full circle. Karen R. Johnson knew Shane Barker, whose companies, NEVER filed a case on her behalf in federal court. Is that dishonest enough for you?

People, please... This company is a joke. If you are ignorant or desperate enough to hand over all of your money to them, I feel very sorry for you.
Work with your mortgage company, even if it's painfully frustrating. It's far more effective than placing your hope in this scam.

After reading 12 pages of the back and forth accusations I have to wonder what is really happening here, is anyone actual consumers with issues and/or evidence of dishonesty or fraud? Finally it appears we almost have some helpful information coming out to make a reasonable determination and this blog nearly freezes up? If someone has something that supports dropping the US Loan Auditor or US Legal Advisor, such as going to the AG or filing complaints with ? do share what is happening, maybe there is reason for this consumer to panic.

Mr. Barker,

Its time to cut the act. This is NOT a customer complaint forum. It may be www.complaintsboard.com, but your outfit Us Loan Auditors, is under the category of "Subjects of Wide Speculation". No answer... puts you in default.

16 days ago amid questions of his companies legitimacy, Mr. Barker wrote:

-"I will answer your questions and concerns very soon. You want proof, well that is on the way my friends."

-"Proof is on the way...so please quit asking me the same questions over and over. If you give me time to get my documentation all together that would be appreciated. It is not an overnight process.

Granted, he must be a busy man, so the "it is not a overnight process" is a legitimate claim. But over two weeks now? And still nothing...

Wake Up People! I'm tired of these kids ruining our economy. Doesn't their silence lead you to wonder? They are nothing but money changers in the temple. They take thousands upon thousands of hard working people's money, under the guise of helping them. The only way to fight back is to play their game...marketing.

I encourage everyone in this forum to do as I have done. Contact Good Day Sacramento CW31. Go to www.gooddaysacramento.com/contact, and address Chris Burrows. Send Mr. Burrows a copy of this article in the Sacramento Bee(/www.sacbee.com/2010/02/23/2556865/struggling-homeowners-warned-against.html) and ask him if he feels comfortable, having given Us Loan Auditors publicity, for the purchase of a blue weather wall at the cost of $237.

Mr. Barker: When you ask yourself, "who is this guy and whats his problem?". Please realize that normal people sat back in the good times, and let injustices happen. Not anymore. We are tired of you ilk.

Your best bet in getting your money back is filing a complaint with the Better Business Bureau, which will draw out Mr. Barker into dealing with you. One thing Mr. Barker and Co. understand, is that appearances mean everything. Marketing is half the battle. They want to keep their BBB score as clean as possible, because it makes all the future dupes(of whom are plentiful) feel warm and fuzzy inside. Secondly, file complaints with the CA Attorney General at www.ag.ca.gov/consumers.php. and the Department of Real Estate at www.dre.ca.gov.

When you contact anyone at Us Loan Auditors, ask some key questions(even though you're probably too late):

1) How many cases of the have gone to trial? -They have been in business less than two years, so probably none. Ask anyway.

2) How many loan modifications has your company been successful in producing, and whats the average result time? -You will get an answer. When you do, be ready.

3) Why do you only have ONE testimonial in almost two years of business? -They will say its a confidentiality issue. Ask yourself this: If a company helped you take on a big bad lender to save your home, wouldn't you be grateful to lend a testimonial? And when they say they cant tell when a trial will occur or how long negotiations with last, that is code for "keep paying us $1, 000 a month until you run out of money and violate the contract you signed"

Before you ask the 4th question, a little recap:

Mr. Shane Barker graduated from California State University Sacramento in 2003. He has been very successful. He is Co-founder of "Prop8 Associates", " Cashout Options", "Equity Flips", "Bailout Help" and maybe more, and now Co-founder of "Us Loan Auditors":

4) What will be Mr.Barkers next venture? And can I please have a job, so I can buy a new house?

ps: if you speak to mr. barker, ask him to instruct his ever-so gentle salesmen to hang up when an elderly lady answers the phone. In the old days, "honor among thieves" meant they wouldn't mess with each other. But it also meant "stay away from the weak, so as to not draw negative attention to rest of us".

The next installment will ask about Co-founder James Sandison. He is the owner of The We Buy The Houses Guys, Inc. Apparently his career as a personal injury lawyer with Hitman & Sandison, ended about the same time US Loan Auditors and Us Legal Advisors was founded.

Pat: I would get your money back yesterday. These types of companies that act as middle men have Lawyers to protect them, most people are so excited from the sales pitch they don't even realize what they are signing. They are set up to pack overnight.

Pat: Have you signed on already? or thinking bout it? It takes a long time to shop for an attorney to take a case like this, they are hard to find. I'd say around 3 months. Once you sign the agreement to continue your case, there is no refund. Read what you sign. If you have a case, contact an attorney yourself. Read what scbell posted, very good information.

This is great information! My advice to all of you who have money "invested" in USLA is to ask for your money back ASAP. If they refuse OR STALL, get an attorney or take them to small claims court so the court can file a judgement lien, ANYTHING before these guys file for bankruptcy. After reading the above post, it's only a matter of time before these guys fold. Shane Barker faulted me for criticizing their cheap offices...they are that way for a reason...so they can make a made dash when they're forced out of business. The writing is on the wall. Get your money and get out NOW!

There is a reason the board has been silence with no word from "Need Help" and Shane Barker...they're packing their bags...

State officials warned struggling homeowners Monday about a new variation on loan-modification scams: "forensic loan audits."

Under the dubious service, homeowners are enticed to pay upfront fees for an audit of their mortgage loan, purportedly to determine their lender's compliance with state and federal laws. It's pitched as a way homeowners gain leverage in the loan-modification process.

In reality, the audits do nothing to help those facing foreclosure, according to state Attorney General Jerry Brown's office.

"It's the latest phony foreclosure-relief 'service' by an industry that continues to be long on promises and short on results, " said attorney general spokesman Evan Westrup. "It's another way to get homeowners in distress to pay for services that ultimately aren't helping or providing the relief they need."

Brown's office partnered with the state Department of Real Estate and the State Bar in the warning.

Real Estate Department spokesman Tom Pool said ads offering "forensic loan audits" to distressed homeowners have appeared on TV, radio and in print. Last year, the Real Estate Department investigated more than 2, 000 instances of loan-modification scams. Of those, nearly 350 individuals and businesses were ordered to halt illegal activity, according to the attorney general's office.

If you've been scammed, contact the attorney general's office at [protected]. You can also file a complaint online at: www.ag.ca.gov/consumers.php. or www.dre.ca.gov. For more information on loan-modification fraud, visit www.ag.ca.gov/loanmod.

Here's additional advice from the attorney general's office:

• Don't pay up-front fees. By law, foreclosure consultants are prohibited from collecting money in advance of providing services.

• Don't ignore letters from your lender or loan servicer.

• Don't transfer title or sell your house to a "foreclosure rescuer." This scam convinces homeowners they can stay in their home as renters and repurchase the home later. It also could be part of a fraudulent bankruptcy filing. A scammer can evict you and take your home.

• Don't make mortgage payments to anyone except your lender or loan servicer. Fraudulent consultants often keep the money for themselves.

• Never sign a document without reading it. Homeowners have unknowingly signed documents that transferred their home ownership to someone intent on evicting them.

One thing they DO say in their mailings way down in the very fine print, is that they don't make any guarantees and can't promise you they'll do a darn thing to help you. Wow. I'm sold!

Need Help has been noticeably absent. His parents must have put him on restriction. LOL.

What they should say in their mailings to make them not bogus " we will collect your information and shop for a Lawyer to take the case while you keep paying us, we will give you advice to stop paying your mortgage but we didn't say that."

This is my first comment, I have enjoyed reading the fake comments/need help, did they finally give him the boot? or was that last question just too much to keep his charade going?

I've been receiving mailings from USLA about their "investigative" company coming to the rescue for homeowners. It was one of those bogus mailings that you immediately identify as junk mail and toss in the trash, however, the name USLA caught my eye, and so I read further and noticed they are trying to sell themselves as an "investigative" company. Interesting. Did anyone else receive a mailing such as this?

I've also noticed they've pulled Karen Johnson out of their hat again to do radio commercials for their company. Wow. A full court press. This screams desperation to me. I just hope folks are smart enough to check this board first before paying for their services.

Need Help,

My apologizes for being from a bygone era. There is no way I should expect you to know what the phrase, "being taken to the woodshed" means. That being said, I am hip enough to know that a bouncer doesn't jump out of the computer screen and demand my identification when I sign up for an email account.

So when you state, "thank you for verifying that. I was not aware of that.", in response to being told people can lie about there email account info...I came to two conclusions.

1) You really didn't know, and;

2) You were responding in any way possible, just to read your own post and congratulate yourself.

-I will let you decide which option is worse. Think about it.

So lets move along and play your game,

How is your case progressing? You speak to Mr. barker regularly, and recently spoke to your fraud investigator, any info?

What did your loan audit find? What law did the lender violate?(please DONT give specifics, ie: bank name, your name, case #)

ps: unless you want to give specifics. I found some pending cases on myuslegal.com, which was previously uslegaladvisors.com. They have many filed cases, and one testimonial by karen johnson.(that is quickly getting outdated) But im sure, as a diligent client, you already knew all that.

An email I received from a former associate of USLA. I removed the Associate's name to protect his identity, and unfortunately, the U.S. Loan Auditors logo does not show up in this post, but I do have the original email if anyone (legitimate) is interested. Please note the second paragraph where he discusses not having to make a loan payment. According to Shane Barker, owner of the company, his representatives were not giving people this information. I hope you all find this informative and helpful...

..."I can fully appreciate your concern about the cost of our program and I completely understand that this is a big decision. All I can say is these cases take a lot of work up front to prepare the cases and there are a number of fixed costs that need to be covered during the process which is why we have the monthly fee. At the end of the process we return a clients attorney fees over half of the time and we also target a return of some closing costs. Our goal is for this program to ultimately cost the client as little money as possible by the time it is concluded. I do understand that each case is unique so I cannot make any guarantees, but our program puts you in the best position to save your home while reducing the principle balance on your home. To put some context to the impact of our program I have attached a spreadsheet that shows the saving our program could generate if we only got you a 25% reduction in principle. I hope the spreadsheet makes sense to you, but to summarize in your case the total saving over the life of the loan would be over $300, 000. This is mostly derived from the reduction in principle and the interest savings on that reduction. I also used your current loan modification figures, so it is reflective to your current situation. Add to this the potential to get your attorney fees returned.

Additionally, once we file the lawsuit you no longer have to pay your mortgage payment since your loan is frozen, and our monthly fee would generate a monthly saving to you while we went though the negotiation process. If the negotiation took 7 months to complete, which is our current average, you would save approximately $7000 over that period which would more than offset the cost of the audit.

I hope this helps to put our program into perspective for you without adding more confusion. If you still think the program and the approach would help you then let me walk you through how I generated these numbers so you can completely understand it. I honestly see that in your case our program will save you money over the life of the negotiation process with the potential for a good result at the back end of the program.

And for everyone else, U.S. Loan Auditors is beginning to feel the heat and is putting on the full court press. Not only have I received deceptive mailings from this company, but they are now heavily advertising over the radio, etc. I sure hope others are smart enough to search this post for some real answers. And, Need Help, do us all a favor and GET A NEW JOB. I'm sure there is a used car dealership somewhere in town that would appreciate your skills.

My friend was asked for money up front by a salesman, without even speaking to a lawyer. This was the red flag that started this journey. I have not personally dealt with USLA, and have never pretended to. Don't expect too many answers on this site, you will soon be accused of being Soleng, or Mary Poppins depending on the mood in the office at USLA.

He claims to want to hear from folks with complaints, but is just the guy who monitors this site for Shane Barker. I'm guessing mr. barker will reappear on this site to respond to you, someone who has done business with USLA. I hope you can get a refund, to pay your first and last months rent. Sorry you lost your home.

I took you to the woodshed son! And the only response you have is that my complaint was not valid because it was third person being 3rd person. Well, i never pretended to be anything other but a 3rd person. You sir, are still pretending. I have to step in and complain, because mild mannered elderly woman cant. They have a hard time fighting the finely tuned sales skills you people acquired in the mortgage industry.

I luckily have no skin in this game. After visiting this site and dealing with Need Help aka USLA Employee of the Month, I have definitely found the answer I was looking for...

Well here goes. I just lost my house because us loan auditors told me to stop making my payments, and never filed a TRO "restraining order" like I was told by the audit "specialists". At the point when I started to get worried I went to the office, and while I was waiting, the receptionist at the USLA office told me how she had already lost her house too, and the company she worked for (usla) had failed to do anything with her case too. I knew at that point I was really in trouble. If they couldn't save the house of one of their employess, who is right there in their office and able to monitor the progress, what would they be able to do for me.

By the time I was refered to an attorney I only had 20 days left in my house. US legal advisors had done nothing but sent my information to an attorney after 3 months of doing nothing. My bank had sent me a deal right after my audit, and the personel at USLA laughed at it and tossed it aside as they told me to put in my ACH form to start paying $1000 a month to get legal fee's going so they could pursue the lender in court. I should have taken the deal but I believed USLA would go after the lender immediately.

Now on to discussing the attorney. With only days to spare I hunted this usla referred attorney down to plead my case to him and find out what was being done. I had sent several unanswered emails to the attorney. It took going to the first 2 questionable neighborhoods listed as addresses to finally get a third address where I found him. He didn't know I was his client and to be honest he was not the sort of man I would want representing me in court. When I told him my situation he explained he was very busy and didn't think he could help with so little time. Now I am wondering exactly what I paid $1000 a month for. I had a deal on the table and my USLA rep's tossed it aside as though they would be personally filing my case within days. This post is here to report a case from start to finish.

Is this the same company that is advertising during the Clark Howard Show on AM 65? And the number one rule of Clark's is to never pay money up front.

Here are my complaints:

1) A lady I know received an unsolicited phone call from a salesman, and within 30 minutes is being told to send in her loan documents. To be followed by a sizable check. The salesman was described as pushy, overbearing and condescending. LOL

2) I arrive at www.complaintboard.com trying to find more information.. Only to find that a employee of this company is masquerading as a client, and then telling me I am someone named Dennis and have no business here.LOL

-Are you like... El Cliente Numero Uno? So you're saying a "client", with no complaints has the ear of the head of this company? If so, you have a conflict of interest. You sir have been compromised...bought. Or you can finally come out and just say the truth. You and Mr. Barker are colleagues. You've probably been itching to just say it and give up the charade. You trip you self up constantly, for example: "... asked if WE can get a list of all the employee's...That way WE can call them..." Why would the head of a company in any situation, allow a current client to phone and question ex-employees? LOL

I apologize for my excessive, anal-retentive use of the acronym LOL. I use it to mask my poor grammar, lack of reasoning and logic. LOL

Attention Complaint Board, be on the lookout for a sleazy piece of mail that U.S. Loan Auditiors is now sending to homeowners regarding their "services". Just when I thought they were at their lowest, they continue to sink even deeper...

Need Help - first of all, I have never had a private conversation with you about Dennis, etc. Secondly, I am a female, in case my profile wasn't enough of a clue for you.

My email has the US Loan Auditors logo (beautifully scripted in the colors red, white and blue!) listed right below the name of the customer service representative, along with all of his contact info, including personal cell phone number. It never occurred to me to give him a call and find out what interesting things he may have to say about his former company. I'll save that for another time. I've privately forwarded the email to some others who found it quite interesting. I wouldn't want people to think I don't actually have a reason for being on this board. My concerns are legitimate, unlike yours.

scbell - The reason we post to this site is to help people like you make an informed decision based on our own personal experience with this company. In a previous post, Shane Barker (owner of the company) wrote, ..."US Loan Auditors has never and will never ask a homeowner to stop making their house payments. Our program is designed in such a way that, if needed, the homeowner can afford both their mortgage and our program. If not, it is the homeowner’s decision on what they want to do. The choice to stop making their payments is 100% up to the homeowner, not us!"

Mr. Barker's statement is a lie, as I have a very detailed email from a former rep of his company stating the very things Mr. Barker says they don't do. At the time the rep was trying to secure my business, and I had quite a few questions for him, including questions similar to what you are asking about the 1% loan value payments. He was very courteous and answered all my questions via email. Those emails have now proven to be invaluable to me, and I hope to everyone else.
