I absolutely feel your pain after dealing with NationStar on a professional level (my staff was professional at least) for the past thirteen (13) months. Everything you are stating is absolutely valid coupled with the fact that NationStar does not do their job unless you call them to tell them to do it (they actually told me that) and escalate every call to an escalation supervisor; but even that doesn't do the trick sometimes. I have had to put a lot of muscle into complaints and escalations for all of my many clients at NationStar just to get documents processed and loan modifications/forbearances/recapitalizations/settlements granted. I have had much success in battling NationStar but it is a fight that requires much time and knowledge...it IS a game after all so the one with the best strategy wins and WE have the best strategy!

You have rights and you need to assert your rights by way of constant pressure on the lender or servicer coupled with a strategic approach to enforcing Dodd-Frank, RESPA and FDCPA violations. Believe it or not, I have helped many distressed or "wrecked" homeowners in your situation to get through the BS and on to financial freedom. Begin by asserting your rights:
1. You have the right to appeal any modification decisions that were made on your file but you generally must do so within 30 days from the time of the denial
2. You have the right to reapply for modification at any time in the event your financial situation changes and the lender or servicer must provide you with options to assist you based on your current situation
3. You have the right to hold Chase accountable for modifying (or not modifying) your loan because they took part in the National Mortgage Settlement where they have agreed to be held accountable for robo-signing and mortgage servicing wrongdoings
4. You have the right to challenge the debt and your servicer or lender must answer the challenge to your satisfaction before they proceed with collection of the debt to include foreclosure

Here are some basic rules to remember when requesting assistance:

I too have had dealings with CitiMortgage on behalf of a client that experienced the same abuses that you all have experienced. He was granted a trial modification and made all his payments on time (they even drafted an extra amount that he did not dispute). Once the trial was complete, they told him to keep paying the trial amount but that no permanent modification has been granted. They further tried to hold my client accountable for trial payments after the trial was complete stating that he was "past due". His representative was named Jandry Fernandez and he was so abusive that even the managers agreed that his actions were in violation...but they never took him off the file even after violating the cease and desist countless times. We began filing complaints to both federal and state oversight agencies and what do you know, the full modification finally showed up after flexing our muscle!

You are unfortunately in good company with many distressed Nationstar customers that have been abused just like you all with regard to incorrect and manipulated account statements, misapplied payments, and modification games. You are unfortunately in good company with many distressed Nationstar customers that have been abused just like you all with regard to incorrect and manipulated account statements, misapplied payments, and modification games. Regarding your complaint, both Nationstar Mortgage and Bank of America have violated your rights afforded to you (at a minimum) by the Dodd-Frank Act enforced by the CFPB with regard to mortgage servicing. On January 10, 2014, the CFPB implemented stronger protections for struggling borrowers via the Dodd-Frank Wall Street Reform and Consumer Protection Act (and ultimately RESPA) to include no surprises by the lender or servicer, greater transparency, no runarounds, and employing fair business practices. With that said, there are a few uncertain items that MUST BE addressed before you can proceed with holding them accountable as follows:
~ Did the modification that was entered into with Bank of America get recorded? This is important because if it did that it takes precedence over the prior note or mortgage terms and Nationstar MUST abide by those terms or they are in breach of contract just as they hold you to it when issuing a NOD
~ Where did the payments that you made to Bank of America get applied and have you made any payments that were accepted by Nationstar Mortgage? Neither Bank of America nor Nationstar can hold your payments in a suspense account unless it is clearly states on your trial modification or permanent modification paperwork (you will need to determine if you have a trial modification or a permanent modification and the terms will be key here that are stated on the paperwork as well as who signed the paperwork).
~ What exactly are you paying on at this point (your original mortgage or your trial modification)? If you nor Nationstar can come to an agreement about what you are paying then I would caution you to continue to pay on an agreement that Nationstar is not honoring because the monies might be funneled into a suspense account without being applied, which is in direct violation of the Dodd-Frank Act as well as other laws and statutes that are in place to protect you.
Again, you have rights and both Bank of America and Nationstar Mortgage are clearly violating those rights and they need to be held accountable for their actions as well as refund you any monies that were collected and not applied to your mortgage. You have to become your own detective to unearth the true story and motives behind the actions of servicers like Nationstar and lenders like Bank of America. dmmurphy, your complaint was one of my favorites because it truly sheds light on the fact that Nationstar representatives blatantly violate homeowner's rights on a daily basis without even knowing that they are doing it, which does not excuse the behavior. Also, there are so many violations compounded into one it is as if they just were trying to see if you were paying attention by throwing at you every violating thing that they could possibly do at once given your situation. How ignorant and abusive! Unfortunately, I have the privilege of dealing with Nationstar on a daily basis and I truly feel that they drain good brain cells from my head as they violate my client's rights under my nose.
Rachel Purkey Brown, I would first call the news to see if they will do a story because Nationstar is ridiculous and then I would look seek the assistance of your military legal assistance to get Nationstar to behave and utilize the Servicemember's Civil Relief Act (SCRA) if needed. That is just so violating let alone unfair and abusive! You have rights and you need to assert your rights either by yourself or by utilizing the resources you have at your fingertips immediately to hold them accountable.
Texas Chickie, your complaint is valid but Nationstar may also have the right to assess up to 1/6 or 2 escrow payments depending upon your state laws so I would check there first with your Department of Financial Institutions or ask a friend in the mortgage industry as they should know the parameters of the law. Inaccurate and unfair reporting is a violation of the FCRA so if they report you in error and refuse to change it then report them immediately to everyone.

Now that you have evidence that neither your taxes or insurance have increased, it would be best to know the exact laws that Wells Fargo has violated (start here with HUD & RESPA http://portal.hud.gov/hudportal/HUD?src=/program_offices/housing/ramh/res/respafaq) then to put it all together in a qualified written request (QWR) to Wells Fargo so you have it all documented for now and in the future in case you need to do it all over again, which is too often the case. The actions of Wells Fargo are a violation of your consumer rights as well as Federal law. Our firm presently has many files that we are working on at Nationstar with many more coming in daily complaining of the same mortgage servicing fraud and abuses such as yours.
