I filed a claim 8/22/23 after work separation on 8/19/23. As of this writing it has been 10 weeks with no determination. The employer has not responded, and I have called almost every day to check status. All I was told is they work them in the order received and it takes a minimum of 8 weeks before it can be reviewed or even escalated. I even reached out to the office of the current secretary Sarita Nair 4 times and they have yet to return my phone call. This is the 3rd secretary the department has had in less than 3 years. First, it was Bill McCamley, then Ricky Serna, and now currently Sarita Nair. The department was approved to hire more personnel since the pandemic, they have revamped their system along with implementing fraud detection, and Governor Grisham has replenished their trust fund with over $170 million dollars. (mind you with federal money) My point in all of this is they are more prepared then ever to handle these claims in a timely manner. On average a claim takes about 21 days with sometimes reaching up to 6 weeks. The department is worse now than it was during the pandemic with an astronomical amount of claims. I was given the perception that they have been trained to delay claims or try to deny as many as possible given their lack of empathy and reluctancy to assist expediting claims. The department was given multiple more resources to handle claims and calls and now that claims are less than they were before, they are far more behind. I think at this juncture its time to contact the Attorney General Raul Torrez and maybe seek legal counsel for a lawsuit, given that I am being ignored. They have been sued several times for withholding benefits recently and multiple times in years past. Yet they continue their antics which harms the public. I am fed up with them.
