Use extreme due-diligence before doing business with Mexia Enterprises, Inc. dba R-V-Stewart Rentals

In Oct 2013 my wife and I needed to make a quick trip to Houston over the course of a week. We contacted Stewart about an RV he had listed on his web site. Since our departure date was 3 days hence, he verbally quoted $2602 for the week's rental and read me his BofA account info. I drove to BofA and deposited $2602 to his account. Immediately after returning from the bank, new circumstances dictated that we cancel the trip. Phoned Stewart and told him I wasn't going to rent the RV and to send the refund to my home address. **No refund or communication from Stewart** Four months elapsed and I e-mailed him about the refund. He replied that I would have it the following week. **No refund or communication from Stewart** Three months later I filed a lawsuit with Metro Court. The trial was held on 7 Mar 2016. This case resulted in a JUDGMENT against Stewart. I received the final amount of the refund on 19 Mar 2016. Reference Metro Court Case No. T-4-CV-[protected].

Stewart replies: A number of circumstances, both verbal and written, caused the delay of the RV-rental balance of what [this reviewer] believed was owed to him, and they are detailed in the above referenced Albuquerque Metro Court Case Number. It is in my company's firm belief, however, that it had a good case in earning the client's reservation deposit, but the presiding judge ruled otherwise; the day after the trial, Mexia Enterprises, Inc., a NM company that has been serving the RV-rental community for more than 40 years, mailed a check to [this reviewer]'s lawyer for the amount the judge ruled upon.

There are two sides to every story in reference to written Internet complaints against RV rental agencies. What is troubling, however, is that these boards do not contact the RV rental agencies with an offer to post a reply to these expressions of dissatisfaction. Every rental dealership cannot avoid complaints, but, without a doubt, the few that R.V. Stewart Rentals has received can easily be backed up by more than one thousand very satisfied customers over a period of forty years in the business. These complainers, who say they were dealt with unfairly and who disagreed with the settlements, chose instead to unfairly bash R.V. Stewart Rentals without revealing their identities thereby omitting the opportunity for the company to take another look into their grievances. R.V. Stewart Rentals is always willing to revisit a dispute to see if anything was missed that could help the past clients’ complaint. It is in the opinion of R.V. Stewart Rentals that anonymous posters, who angrily write vicious complaints against R.V. Stewart Rentals or any other rental agency, should, in no way, be considered credible, because it eliminates the ability to post their side of the story. After all, the poster(s) could, in fact, be someone who was paid by a RV competitor to post the negativities. Until they reveal themselves, nothing can be resolved nor their complaints considered credible.

We agreed to a rental RV unit, he mentioned in our original conversation that it was his "partners" RV. It appeared very simple and clean. We sent him the deposit, then months later he's making up some kind of fabricated story about why we couldn't have that particular one (and that RV happened to be the only one we'd signed a contract on) but that now he didn't know when it would be available and that we needed to choose another from his selection. Also another factor was that our insurance (State Farm) wouldn't cover us driving a rented RV in that State- so he offered to have one delivered to the site (3 1/2 hours away) *just not the one we wanted) or he would refund our money. Once again we looked through his meager assortment of RV's but couldn't find one that would meet our needs, my husband and I agreed that all the other options would be problematic for me as I have severe ambulatory issues and couldn't deal with multiple levels as so many 5th wheels have. So- we opted to have him refund our money and he refused. Just flat out refused! It was very unprofessional as we had given him ample time with our cancellation...3 entire months in advance- and HE was the one who told us RV we had originally contracted to rent was unavailable, but that was a lie because in our final email he said it had "become available again"...*how convenient!
He also kept trying to push us to rent his son's motor home and his son's motor home was the ugliest one in the bunch and smaller to boot! He is a thief, a liar and a crook. I'm begging you to use a reputable nationwide dealer who has accountability and save yourself the shuck and jive. We ended up buying a camper, and our entire affair with this jackal left a bad taste in my mouth.
