My mortgage was sold to ASC on October 20, 2006 by New Century. After reading the letter, I jumped on the net only to be totally amazed at the poor reputation this company has. After a few phone calls, I totally understand why.

Everyone on here has basically all the same complaints, interested in doing something legally?

I just started researching ASC because of numerous problems with them. I would love to do something legally to get my problems solved. I am going to first send letters to the State of Florida Consumer Affairs but would love to know other places to send letters of complaint. ASC now because of property tax and escrow issues got my payment $1198.00 monthly payment at 1700.00. That is my whole take home pay from one job. I now have to have 3 jobs to live! Help!

Husband was injured, fell behind on payments. The State retrained him for a new job. Trying to manage was tough in between. In touch with the mortgage company numerous times. Instead of a Fresh Start due to hardship... they threw us under the bus "Foreclosure" Our Hud agreement an peace of mind has been taken. There is no negotiating a reasonable settlement amount. There definitely is no rolling over to the back of the loan nothing. The company won't even talk with the Foreclosure Alternatives Co. we hired to save our home. Not one response, but their quick to let us know about the Sheriffs Auction coming next month.

I can not believe this company! First they have no online payment plan and now the one they have cost me to use?!? What are they? It seems the whole place is operating in the 80's or something! I once mailed a payment in and 14 days later it cleared my account and I was charged a late payment. I started tracking them after that and sure enough everyone I sent by mail was late! They tried to blame it on the U.S.P.S. but none of my other bills took that long! I worked for a Title Co. for years and we had a 3 day turn around!

I want to refinance my house just to get away from them but now I have late payments showing! That is all.

Wow could this company be any worse. I cant even talk to anyone. Ive met three people online today who are very passionate about how horrible they are. Do they have any interest at all in trying to resolve the problems. I am confused maybe someone with someone experience could let me in on whats going on. I was at a site earlier dedicated to how bad they are... pretty funny.

Stop complaining its everyones fault that asc has your loan ... why you ask because you have bad credit and asc is a NON PRIME loan servicer, which means it services loans for people who have bad credit ... i bet all of you are on an adjustable rate either because you have bad credit or because you bought a house that you cant prove you can afford (cuz you cant) and had to go on a stated income ... and all the people who say i have a fixed for 2 years and then it changes ... yeah thats an adjustable rate too .. so stop complaining because all you people your self in this situation ... and how do i know all you you may ask is im a collections rep for asc the calling your homes on the 3rd of the month ... one last thing yes asc is a wells fargo subsidiary company and the reason for that is wells fargo does not want to have it reputable name ruined by being labeled the company with all the bad credit loans

First of all i am a collections rep for asc out bound collections... and first let me tell everyone do you know what asc is... its a NON-PRIME Loan servicer for everyone who doesn't know what that means it services bad credit loans, wait let me rephrase that horrible credit loans, and it makes me laugh when im talking to you and your there talking about how perfect your credit is and i see when im calling you and i see your true double digit credit scores... also your payments are due on the 1st not the 16th people who have bad credit seem to find this confusing thinking the 16th is your due date because thats when you get your late fee... also have you ever wondered why you get stuff from wells fargo with your mort. payment stuff , because asc is affiliated with wells fargo but wells fargo just doesnt want to be labeled the company with all the bad credit loans... how does asc end up with your loans... companies suck as freemont, countrywide, emc... etc companies originate loans the, prime loans (excellent credit) sub-prime (mediocre credit) and non-prime(bad credit)... the originating company keep your loan for 2 months if your lucky ,then thats where the fun starts the prime loans get sold to a company the non prime loans get sold to a company and then asc get all the non-prime loans get sold to asc... so i hope all this info answers your questions to why you have this horrible company servicing your loan... all because you all have horrible credit no one to blame but yourself!

Oh yeah i know asc is a screwed up company but i also find it funny when i hear people talking about sueing asc... and winning... yeah right when you walk in the court room with your bootleg lawyer and then asc/wells fargo comes in with its all-star team of lawyers who get paid more in 1 day then your lawyer will make in a year... do you really think your going to win your lawsuit.

For those of you who can't seem to find help with ASC, their address is P.O. Box 1820 Newark, N.J., [protected] Their phone # is [protected], option 1 will connect you to their customer service, and their web address is www.mortgageaccountonline.com. If you make your payments on time by mailing in your payment, you wont have to worry about a fee. If you use their online service, theres a fee. Welcome to big business. I hope this is helpful to all of you, as it was to me. Respectfully.

I also had the same things happen to me by ASC from the first month that the loan was transferred to them. Ditto to all. My credit has always been good. I've had several homes and mortgages that were always paid on time. I acquired an SBA loan to buy a small business and paid that in full in 5 years. There is no excuse for poor customer service, no matter what kind of lender ASC is. They hold up payment checks to electronically withdraw them the last due date or the day after. They tack on hidden fees. They pay city property taxes or insurance premiums even when not agreed up. All their tactics are geared around adding fees and making money by harassing, intimidating and being greedy. A class action lawsuit would be a good start to end this madness.

All the complaints we have just read about is absolutely the truth! We have been dealing with ALL the same things exactly for 3 years now and cant get refinanced do to our payment history being so messed up from them... we are in Missouri and are very interested in anyone with complaints contacting us to see what we can do about this awful so called company.. if enough of us are out there with the same complaints surely this situation will open up some eyes then... something has to be done about this... even though this company is owned by wells fargo it does not mean its out of reach of the attorney general...the things that this company is doing to us should be illegal... because someone doesn't have the best credit doesn't mean you can steal from them and kick them around... i for one have had enough... the more of us there are the more attention we will draw to this matter... we are interested in anyone who is also interested in doing something to stop these thieves... my email address is santagrl@yahoo.com

Sue ASC absolutely!

I wouldn't wait for the class action-although this should be done too!

Sue them individually! You should be able to find an attorney to do your case on a contingency basis, which means they get a percent of whatever they win. An attorney won't take a contingency unless they are sure they will win. Go to the Federal Trade Commission web site and look at the Fair Credit Reporting Act and you will see that it is a Federal law that creditors report information correctly - if they don't they can be fined "per occurance" plus damages! Go for it! These laws are in place for a reason.

My mortgage through New Century was sold to ASC in December of 2006. I had an insurance deferment because I had been hurt at work. The deferment was for 8 months, but based on my doctors' letters to continue full medical disability. I am considered disabled now due to my injuries. I can't find a job, and worker's comp isn't the most reliable in sending checks. Sometimes I get one check a month for one weeks worth of pay, other times I get two.

On June 28th I was served with foreclosure paperwork from ASC. I didn't know ASC bought my loan, I wasn't informed on any level. I contacted them right away to explain to them my situation. What I got was a person that wanted $6000 right then and there even after I explained my financial predicament.

I asked about loan modification through loss mitigations. They wouldn't even put me on the phone with them. I asked for a package to be sent out to me from that department to rewrite my loan--I haven't received it. I have asked on 4 occasions--once a week since the date of the letter.

They tried to work out a forbearance with me, but said I couldn't afford the payments. Of course not, I am getting $200 a week less than I was when I was working--when they send the money...

These people are rude, interrupt you when you're talking and keep asking you the same questions over and over again as if you are lying to them. They call all hours of the day, every day--like my situation will change over night!

They will not work with me, they don't care about me, or my four children. They keep asking me if I want to keep my house--of course I do! They keep asking me why I fell behind with my payments, and each week the cost goes up a thousand dollars--I am at $9000 now!

I haven't talked to a lawyer because I am not sure they will be able to help me. I am filing chapter 13 bankruptcy. I really don't have any other choice because they refuse to let me talk with loss litigations, or modify my loan so it is affordable.

New Century was a better company--they were a little more understanding and the insurance deferment took a month to get underway. But now, my other 20% loan was sold and I don't know who has that one either--I haven't heard anything.

The other issue is the fact every time I speak to ASC, I am asked for all of my information over and over again, it is almost like they are updating the system every time I call them.

Do I have a case? I don't know, but as soon as I get my settlement I am thinking about refinancing with another company.

Anyone want to sue this company?

With the posts we have on here from the so-called ACS customer service people, we have a case--it does show their lack of intelligence and respect to themselves and their company. If I was the PR agent for ASC, I would be on this strand apologizing for their behavior. This made me ill reading their replies. What kind of mortgage company are we dealing with here?

I did have a good credit score of 720 when I got my loan with New Century, and I had 100% financing through an 80/20 loan--which Sarah Martinez stated above--they aren't sub-prime because they are bad credit. Well, since the sale of my mortgage to these UNDERDOGS, my credit score has fallen to a 426. I wasn't aware ASC bought my loan because I didn't receive a letter, a phone call or anything until the sheriff knocked on my door with the foreclosure paperwork.

I did report ASC to the NY Banking Institute, and they are investigating the matter. It just doesn't seem right. I also forwarded this link to the NY Banking Institute so they could read everyone's statements--including the ASC Customer Service employees' statements.

Something needs to be done here. This isn't fair to the consumers, and with comments from employees of the UNDERDOGS, we have confirmed they don't care about their image as a mortgage lender, or their customer service skills.

I work for a very large, probably well known mortgage company that for privacy's sake shall remain nameless... and I want to clarify on the topic of getting that lovely phone call on the 10th for your mortgage payment. My present mtg company is Wells Fargo, and not that long ago, I was getting these hang-ups on the answering machine during the day from an unknown number. When I was finally able to snag that call one day, it turned out to be a Wells Fargo rep. 'wondering' if we had sent in our mtg payment yet since it was after the 10th.

Caught off guard, I fumbled through the call, and hung up but vowed to research this more fully if they were to call again. A couple of months went by and sure enough, I get another call asking about the status of my mtg payment. Not in the best of moods, I see red, and while making the Wells Fargo rep. hold for me, I went and got a copy of my note and mortgage, and then asked for her to tell me where it states that I'm supposed to get this 'friendly' reminder phone call about a payment due.

The rep. fumbled, stumbled, and finally had to admit that the precise wording she had used earlier of "because you agreed to this when you signed your note and mortgage" wasn't on my documents. Which led to the other lie of "well you must have signed an addendum at closing agreeing to this."

My friends, I keep all the mortgage documents in one file folder and I am a mortgage underwriter - no where did I or my DH sign /anything/ agreeing to this harassment. When confronted with that startling bit of news, she passed me on to her superior who agreed with me, it's not on any of my documentation but they're making the phone because of the investor for my loan.

He claimed that the investor required this phone call after the 1oth day of each month, but quickly offered to put a 'do not call' note on my file for the computer so I wouldn't have to deal with this any more.

Bottom line is?

When you signed your note and mortgage, the wording should have been along the lines of you agree that your payments are due on the first of each month, but you have a grace period of 16 days to send it in before late charges are assessed. Again no where does it say that you are required to send it in prior to the 10th, and quite honestly if your living from paycheck to paycheck, it just doesn't always work that way.

To further clarify, while most investors would love to have that mtg payment in by the first, it's not against any rules if you send it in by the 15th. No investor that I know if has ever complained, and I work closely with them... it's the LENDER who is prompting the phone call, and it's the LENDER who is harassing you for the payment. It may be stressful, and irritating, but if you want to fight it, you can as long as you understand your mortgage documents.

Finally, there is a document that most if not all of you signed, and it's basically an agreement that stated you were aware that the servicing of your loan would be sold. It just stinks that you have no control of who buys it next...

As many of the other complaints I have read about, it is impossible to pay a bill on line or by phone, without a high fee. My loan too was sold to ASC, and it has been a problem ever since. Not only when you call their toll free number, do you sit on the phone waiting for anywhere from 15 to 20 minutes to talk to a live person, but when you do it costs you money to do so.

This company needs to change how it operates! They are making millions off of the various fees that they charge to people, and have really nothing to offer or show for it. You would think with what they do, they would have the means to have a better web site, and easier ways to make payment arrangements.

Great info...but I wanted to add that there is a way to stop this company's illegal way of doing business! and it is illegal of most of the complaints that I have read. I am a realtor and fed up with ASC's harrassing phone calls and letters, especially the ones I received on the 2nd day of the month if they had not received my payment! Now that the market is in the dumps, I am having trouble making ends meet. When I filed for a rate modification, twice NOW! with only them telling me I didn't meet the requirements..WHAT? I finally decided to fight back! No I will not let you take my home ASC, after all you know I have enough equity in it that you are certain that you will get what is owed on my mortgage! So listen up people...I have done my research and here is where we, "the little people "can get some justification. Complaining on these message boards are a way of venting but let's start making our voices really be heard! By the government that is suppose to be working for us! to protect us from these illegal doings. First of all...3 words...THE FEDERAL TRADE COMMISSION! They have a website that is sooo easy to file your complaint that it was shocking! www.ftc.gov. When you finish writing that complaint, go a head and send your complaint to your state Attorney General's office and your state representative. They HAVE to keep records of all complaints and act on them! Here is the magic word...complain, complain, complain! but complain where you can be heard! This is where you can find your addresses for e-mail's and snail mail for your state...www.house.gov & www.senate.gov. Spread the word and the message that we will not let a company like ASC strong arm us out of anymore made up fees or more importently, OUR HOMES!

I AGREE WITH ALL OF THE ABOVE, WHAT CAN WE DO ARE PAYMENT STARTED OFF AT$774.00 NOW THEY MADE US GET A ESCROW ACOUNT THAT SEEM GOOD AT FRIST TILL THIS FRIST PAYMENT CAME IN WITH ESTIMATED GUESS ON OUR TAX AND THREE TIMES HIGHER ON THE HOUSE INSURSE. YES LIKE THE OTHERS WE FELL BE HIND AND THEN ONE DAY GOT A SETTELMENT AND ALL $8000.00 WENT TO ASC TO MAKE US CURRENT, BUT WE WE WENT AND GOT OUR ON INSURANSE AND WANTED TO PAY OUR OWN TAXS, WELL NOW THEY SAY UNLESS WE ARE NOT LATE FOR 12 MOTHS WE HAVE TO PAY THEM THE ESCROW MONEY FOR TAXS SO WE HAVE NOW ARE OWN HOUSE INSURCENSE AND THAT SHOULD HAVE BROUGHT ARE PAYMENT DOWN BUY OVER $280.00 AMONTHE BUT NO ARE PAYMENY WENT DONT AT ALL ANDE THE REFUSE TO LET US PAY ARE OWN TAXS BECAUSE THEY GET THE INTEREST ON OURS AND YOU MONEY AT TIME IT IT DO AND 9 TIME OUT OF 10 THEIR ESTAMATED GUESS ON TAXS IS WRONG AND WERE BACK TO SQ. I have been waiting for an escrow refund since 08-15-08. I recieved a letter from them dated the 08-02-o8, saying that i would recieve my refund in approximately 15 days. It is now 08-23-08, no refund check. When I called they said the check was mailed on 08-18-08, but it would take 7-to 10 days for the mail to get to me. WHERE IN THE WORLD is this check coming FROM ? They said the 15 day period WAS THE LAW. My account was paid off on the 1st of August. I want my REFUND NOW______There is something wrong with this company.

My Americas Servicing Company disaster …. if someone can advise on what I should do

On February 23, 2008, I went into my spare room and noticed I had water, mold & damage all throughout my closet. After inspecting the contents I had to throw away many of my possessions. I looked up on my roof and noticed and shingle uplifted, and had my father check it out and noticed a section of my roof had caved in. I immediately called my homeowners insurance New Jersey Manufactures to put in a claim and was told that my policy had been canceled in may 2007 due to non payment ! I freaked since I pay escrow every month for my taxes, homeowners &flood insurance. I immediately called Americas Servicing Company (ASC) and after speaking to NUMEROUS very unhelpful people, I was finally sent to a customer service rep named Laura. She could not figure out what happened since she can see the account noted for escrow the name & policy # of NJM etc, so she said she would check into and get back to me .. I do not recall how many days but she finally did get back to me and stated it was an “oversight”, with no explanation of why the failed to pay.. JUST AN ERROR … I of course at this time still freaking because I have no homeowners insurance now or for the past year and I had a hole in my roof !I was assured that this would be taken care of by asc. I obviously could not receive my coverage again with NJM until the roof was fixed, so I was screwed waiting for them.

On May 27, 2008 after MANY, MANY unreturned calls I finally got claim # for the policy they provided me. Luckily, my father was able to temporarily fix the hole since it has been months ..

June 10, 2008 the adjuster finally came out to my house and wrote up the claim.

Also during the month of June, unknown exact date I received a letter from my flood insurance that it was canceled due to non-payment. I again immediately called ASC and was assured it will be paid and again an “unexplainable oversight”.

June 12, 2008 check issued and payable to ASC and myself was sent to me for the claim.
A few days after that, I noticed my monthly payment went up over $200. I called again and spoke to customer service Laura and was told there was an escrow shortage - I just assumed that my taxes and flood insurance went up and did not think much of it. Until … I receive a statement from American Security Insurance company (the insurance that was provided to me via ASC because of their error) and they charged me $1894.59 for the policy ! My homeowners insurance is only $445.00 per year for the past many years - I freaked out ! Again a call was placed to Laura and was told, “I will check into this and call you back “

Early July I receive forms from ASC and a letter stating they will not release MY INSURANCE CLAIM money for MY HOUSE, that I need to endorse the check payable to myself and ASC and they will put into a secure escrow account and pay the contractors . After fighting that issue with no results for weeks I finally said screw it and agreed after being assured they will pay the roofing company.

July 29, 2008 numerous calls again placed over the past weeks to ASC reference to the insane amount they charged me, and finally Laura calls. She leaves a message on my home answering machine that the $1894.59 will be refunded once I obtain my own coverage and the repairs are complete (are u kidding me! I saved that message)

August 25, 2008 roof contract signed and w9 forms completed by the contractor
August 26, 2008 contractor faxes over the forms & contract to ASC .. Now waiting down payment

September 8, 2008 called ASC for an update & was told, “Oh we never received the fax” so my contactor re-faxes the stuff.. Later that day I call and get a Diane - they never received the new fax either.. So she had someone from the tech. department research the fax history.. And sure enough “I am sorry it was an oversight we have the copy of the original fax right here” check to roofer should be mailed within a week.

Now, over this weekend we were hit with a tropical storm and plenty of rain. During the storm, pieces of my kitchen ceiling sheetrock were falling down and rain was leaking all over my floor and my attic stairs in the living room. Sunday or Monday, I noticed mold creeping all over my kitchen ceiling, and more water in my spare room closet (the original claim).

September 9, 2008 I call ASC & ASIC (coincidence ) to advise them of new issues, 2 more leaks, original hole leaking bad & mold - also the fact that I went to doctor since I had been having difficulty breathing and was diagnosed with asthma - something I never had . Possibly related too all the mold in my house. I was told to call adjuster to see if he would prefer to put in a new claim or reopen the previous claim, so I did and - hey left a message on his voice mail (see how long it takes for him to call back). Also, while on phone with ASC I was told the w9 that was faxed over was “denied” because the contractor had a po box listed as address and that was not acceptable. I told them the street address and that was not good enough, so the roofer had to refax again. They patiently sent the original one they faxed over because under the PO Box it listed the street address.. Seriously idiots!

So now, I sit and still wait 7 months later with no repairs, a $200 plus increased mortgage payment, short escrow, more damage and now asthma!

Oh cant leave this out, tonight after reading so many complaints via the internet on ASC I decided I better recheck my account history, and noticed even more how they are ripping me off .
5-7-08 $1894.59 homeowners insurance taken out of escrow
5-23-08 $1431.00 flood insurance taken out (which my premium is only $1298.00)
6-27-08 $1891.79 HOMEOWNERS INSURANCE TAKEN OUT AGAIN
7-20-08 $174.00 FLOOD INSURANCE PAYMENT AGAIN ?

So now my escrow is short over $4, 000.00 NO EXPLANATIONS why the hell they keep taking so much money from me, and the answer to my very angry call this evening to asc …”WE’LL CHECK INTO IT ABD CALL YOU BACK “ yeaaaa right

you payment is DUE, per you note, on the FIRST, of the month. not the 2nd, 3rd or the 16th, but on the FIRST. yes, you are given grace days, but those grace days do not change the fact that if you make your pmt on the 2nd or the 3rd...IT IS STILL DELINQUENT, therefore you will get collections calls. those phone calls are not made for anyones enjoyment. as far as a loan modification, noone technically HAS to assist you. the government cannot force a comply to comply with any rules or regulations set in force years after a signed contract has been issued... aka your note. that assistance is strictly voluntary, & there would be requirements that would have to be met. sorry that you cant get a free ride

I agree with the employees here. Most people want special treatment and or to take their anger out on someone. Start with yourself, the originator, RE agent and loan [censored] that sold you too much, too easily.
ASC has been fair to me, but I have a fixed rate. The bigger picture is you are playing by rules that don’t apply anymore.Your stupid FICO scam score will be worthless in 2 years as hyper-inflation, 20% unemployment, gold at $10, 000 makes your score what it is now, worthless. You’re dream home will be worth 30% less in 2 years.
You’ve played by the rules and looked what happened? You’ve been had. Suck off the Hussain Obama teat. Him and Pelosi had inherited a mess and will make it worse by printing 30 trillion fiat dollars.
STOP buying on credit. My 16 yo car runs great.Too much house? Jingle mail. RENT.
Its all crashing folks .Salvage what you have and hunker down.

I have been trying to modify my loan since July 2008. I couldn't afford my taxes and mortgage due to an unexpected medical and auto expense. When they agreed to pay my back taxes for me and slightly increase my monthly payment I thought I was rescued. My statement now says I owe $5, 028.54 they added those onto my payment along with almost $500 in fees and I don't even know what they are for. When I called them said my account is in review so they are placing my payments in a unassigned account and, will continue to do so as long as my account is in this status. I've completed the same paperwork 3 times because they claim they don't have all the proper documents to proceed. When I went over it with the loan mod dept they said why do I have $300 in entertainment on my expense sheet. I have a copy of it here and it's not stated anywhere on the paperwork I never put that on the documents. Cory informed me that errors are made which can effect their decisions. So I have to start all over again. After reading all these complaints, I figure what is the point. It's clear they have no intention of helping me at all. I've gotten no where with this company. The customer service dept who I've gotten to know over the past 8 months could care less and they encourage me to leave the property if I can't afford to keep it. I've finally accepted a tenant thinking I'm saved and can make my payments no problem. I'm afraid to send them anymore money since they aren't even applying it to my account. I fear they are going to take my home anyway. Now that they expect me to pay all the taxes now. If I had it I would of paid them myself directly like I have always done in the past. I'm so confused. I've put everything into making my home nice for my son. If they think I'm not going to go down without a fight their crazy. If I have to move I'm taking everything including the drywall with me. This is B.S.

Vanessa and all the other complaints are true we also have Americas Servicing Company and have had worse happen to us. My wife was diagnoesed with cancer in 2003 and I with seizures. I couldn't begin to tell you the things they have put us through it would take 10 or more pages. If there is something that can and is being done please inform us
