I hired the Morgan and Morgan law firm, 2014, for a rearended truck accident.i had 5 doctors involved in my treatment, (4 were specialist) I had agreat case.i did all the work copied and kept all medical records anything involving my case, I was on top of it.The assigned att.Peter Gee was the most incompetent, unorganized lawyer I have ever met. He cannot function without his para-legals. He did not understand my medical problems and never reached out to my doctors for help. We went in depacetion after that it was decided there would a mediator hired to settle the case, he was horrible. He did not understand because my lawyer did not have glue to help him.He came in looking very impressive (with these files) he was so unorganized he could not find anything I had to fine many documents to fight hard for myself as this process went on with my ineffective lawyer and horrible mediator I knew my case was doomed.i begged for case to be heard in court with judge and jury. Peter Gee insisted this was the way to go.When this circus was finally over I was forced to sign a settlement agreement with the bulk of my medicals dropped or dismissed.Peter a Ghee promise to contact Doctors and medical professionals for help months prior to us going into the mediators meeting he only tried to call at the last minuit . My son- n - law & daughter where envolved in this accident with me, my son- n- law was driving the impact was so great it severed his rotator culp he had some serious surgery. They were in a separate room with there very compataint att. Their lawyer really worked for them and knew what he was doing. With everything handled so poorly for I was told I would never this offer again and let's settle get it over with he(Peter Gee ) wanted his money this case had gone on long enough, (the case July 25, 1913) ended Feb 2016) all Peter Gee did was go back and forward to my children's atts room being knowsy as to how things were going with them and what their settlement was going to be, he was obsessed with them but he had no interest in helping me. I had fight to get my money from him his staff gave me all kinds of excuses he did not submit all of my medical records and information so that cut out my payment and he did a lot of inflated charges of fees . I asked for files what I received where all of the files that I left medical mir's and many things are missing.Peter Ghee kept funds for medicals that I have worked out payments plans and paid.Later because I ask question he return half that money later. I am due to get my court filing my, my children already have theirs that law is refusing to cooperate with me or refund the money they had a young para- legle trained to do noting but give you the run around I dealt with her all day(6-8-2016) she finally emailed me another itemized list of wher all the money went it will make you cry.i wish someone could help me it really bothers me I hired the wrong help what can i do to them, report them, and get my money back.i just looked on line for complaints on Morgan& Morgan it all reads as if I wrote it. To give more insight to this case my medical bills were more than $50, 000. The case settled for $22.000. Over half the medicals were left off because of the unprepared att Peter Gee I wanted to walk out I was told the offer would be voided. Ther is a lot more to this story than I can share..I had no idea I would have to even. fight for the award, this law office Morgan and Morgan are known for this type of tactics I did not know who I was dealing until after the fact. The over charging is unbelievable, they never paid any of my medical bills I did not know until I pulled my credit report and saw almost all the bills in collection. The att Peter Gee had gotten everything transferred to ther office, they have the law office address listed as my home. The different medical agencies and hospitals will not speak to me because the law office will not release themselves off the files. I will fight this tooth and nails, it is so wrong to consistently take advantage of trusting clients.until you are in my shoes you are glueless. It was never about the para-legals to began with. No attorney can function without their paralegals, If attorneys had to do all the paralegal work themselves, they would never have time to talk to you, let alone visit a courtroom.
No one forced you to sign anything. You could have fired this attorney at any time and hired another.
Of course attorneys need paralegals but the purpose of having them is to be prepared. Which this attorney was not. The attorney wasn't knowledgable about his clients case. This client had questions and concerns and she wasn't able to get answers. Yes, she could have fired the attorney at the 11th hour. But the fact remains that he sounds like an ineffective attorney. He really wasn't equipped to actually fight the case. With Morgan & Morgan it's like an assembly line. More quantity of cases rather than quality.
What I am trying to say is that if the attorney was as unreliable as the poster claims, and since cases like these take months, if not years to resolve, she could have fired him way before it got to the point that she is now posting about it. The first time he did something she did not like or understand, she could have addressed it. Had it not improved, she could have fired him or brought it to the attention of the partnership of the firm.
And the settlement can NOT be accepted unless you agree, OR you give the attorney written permission to make that decision for you. It sounds to me more like the poster was uninformed, and just did not know how to be a plaintiff. I am sorry for that.
When my husband had his motorcycle accident a few years ago, we fought the insurance company, and read every line of every piece of paper they tossed at us. When it came to the settlement offer, WE made the decision, not the attorney, since we never signed any agreement that he had the power to do so. Our settlement paid ALL his past and future medical bills related to the accident, and paid for the replacement of his bike.
You just have to be proactive and get a bit of knowledge when dealing with things out of your comfort area. Most people have no clue about legal issues. We didn't at the time. We have a better understanding now. It all comes down to NEVER signing anything you do not understand.
As for the attorney not releasing the documents to the hospital, you probably signed a non-disclosure agreement, OR, the terms of your settlement prohibit it. BE careful. If you break the terms of the settlement, you could be sued for breach, and be liable for every dime you got paid in damages. You should have been given a copy of the settlement agreement. READ IT. Or take it to another attorney and let them peruse it.
Call the BAR. or go on line www.ca.gov, the state agenices an it will be under BAR. there is a complaint form. an tell him if i do not get my check with in 24 hours i will summited it. That if found guilty of over charging and ect. like your saying he will have to answer to all your allegations you put on the complaint form. that is what i would do.. good luck.
