Hi. My complaint is as follows.. On October 26th 2023 at 3:15pm while getting off from a gig my phone screen totally blacked out and I could nolonger see my screen. I had to get the business (Hilton Garden inn North airport) to clock me and out in order to complete the gig. The next following day I sent instawork an email through the use of my tablet informing them that my phone was down and that I was not able to confirm my gigs for the Sunday October 28th and Monday October 29th. According to instawork confirmation time which is a 12 hour time span 2 days prior to the start of the gig. I used my tablet and went online to the instawork website to send them an email stating to them that my phone screen had blacked out and that I couldn't see the screen at all in order to confirm the gigs and I ask them if they could with my permission confirm the gigs manually. I sent them this message at 2:05pm on October 27th way before the expiration time allotted for gig confirmation. Instawork didn't send me a response back until October 28th at 4:54am. The message stated that they couldn't confirm it from their end and it informed me that the business had removed me and blocked me as a gig worker partner this removing my platinum status and reducing me to no status at all. I was able to get a new phone on Wed 1st at 1:30pm and had to go to the phone store and have it activated. Upon finishing the activation I opened up instawork who by that time had blocked me and suspended my account but upon opening the app it stated that my appeal was excepted however my platinum status was removed. I then sent instawork an email through the in app chat asking them why they had excepted my appeal but not restored my status and I even sent them snapshots of the email I had sent them on October 27th and the response email sent to me on October 28th. The response email said nothing about my platinum status being revolked but it stated a lie saying that the business had removed and blocked me from excepting gigs but upon looking further into the my shifts section of the app I still have even now all of my gigs for the business for this month of November. I then sent another in app chat to the operator. The operator agreed that the email I sent them on October 27th was in enough time to inform them of my situation. But their was nothing he could do in restoring my platinum status which requires the working of 15 gigs the month prior in order to receive the status for the following mont. I have an exemplary work history with instawork including being at platinum status over 13 times last year 2022 and have worked over 522 gigs and over 13 likes from 13 businesses I have worked. I have noticed along with other gig workers in my network that instawork make changes to their policies on the whim in order to protect their interests but not in the interest of the subcontractors who not only work through the app but also advertise and promote instawork. It's the gig workers who promote instawork and its off of our backs that instawork even have made it this far. Instawork look for anyway to reduce the subcontractors wages or status to keep them from achieving the bonuses and other perks of higher statuses. This isn't the first time this has happened. In 2022 I had to send snapshots of instawork own policies in order for them to do the right thing. Many gig workers have complained about this very thing. I'm seeking litigation against instawork (Garunda labs)

Claimed loss: $100

Desired outcome: $500 and a full investigation into this agency and full transparency of funds that are supposed to be paid to the subcontractors who make the agency what it is.

have you thought about a class action lawsuit against them. I lost $4000 in income because they blocked me and cancelled every thing going forward an then reinstated, I won the appeal but already lost the income. This was at Christmas of 2023. I've gone head-to-head with them and they have at times reinstated my platinum status. I ended up getting on LinkedIn and sending the CEO and his other top executives emails until i finally got an answer. After that i finally talked to someone that actually listened to me and helped with ALL of my issues but even that wasn't immediate. Good Luck
