To Whom It May Concern:

I am writing to formally demand compensation for damages arising from the repair and subsequent recurring mechanical problems involving my 2015 BMW X5 xDrive35i, which was serviced by Tires Plus Store #240059, located at 15401 SW 137th Avenue, Miami, Florida.

This letter is intended to provide Tires Plus with an opportunity to resolve this matter without litigation. I am providing supporting invoices, photographs, service records, and other documentation with my initial email. Additional documentation, including a mechanic's inspection, diagnosis, invoice, and repair estimate, will be provided when available.

1. Initial Repair — June 6, 2025
On June 6, 2025, I brought my 2015 BMW X5 xDrive35i to Tires Plus Store #240059 because of problems involving the vehicle's belt and tensioner.

I specifically requested that the drive belt tensioner be removed and replaced.

Tires Plus performed the requested work, including replacement of the belt and tensioner. I paid $584.20 for the service.

The vehicle was subsequently returned to Tires Plus because the belt/tensioner problem did not appear to have been fully resolved.

2. Repeated Belt and Tensioner Problems
On August 16, 2025, I returned to Tires Plus because the belt was still making noise.

The Tires Plus service documentation states:

“BELT STILL MAKING NOISE”

and:

“NOISE COMING FROM BELT AREA”

The documentation further states:

“BELT TENSIONER BOLT IS NOT TIGHT ENOUGH.”

The documentation indicated that the shop that had serviced the part should address the issue.

The vehicle was again brought to Tires Plus on September 30, 2025 because the problem continued.

The September 30 service documentation again states:

“BELT STILL MAKING NOISE”

“NOISE COMING FROM BELT AREA”

and:

“BELT TENSIONER BOLT IS NOT TIGHT ENOUGH.”

This repeated documentation is significant because it establishes that Tires Plus was placed on notice of a continuing problem involving the belt/tensioner assembly and specifically documented that the tensioner bolt was not tight enough.

3. October 10, 2025 Service
On October 10, 2025, I returned to Tires Plus again because the problem continued.

At that time, the vehicle had approximately 131,000 miles, and I reported:

“BELT IS MAKING A TICKING NOISE.”

Tires Plus again performed work involving the removal and replacement of the drive belt tensioner, this time without charging me.

Despite the repeated service visits and the documented concern regarding the tensioner bolt, the vehicle later experienced a significant mechanical failure.

4. Vehicle Became Inoperable — July 10, 2026
It is important to clarify that the vehicle did not become immediately inoperable following the October 10, 2025 service.

The vehicle remained driveable after that service and continued to be used until July 10, 2026, when it became inoperable.

The subsequent failure involved damage associated with the bolt/fastening point and engine insert. I am in the process of obtaining a professional mechanical inspection and documentation establishing the precise nature and cause of the failure, the repairs required, and the associated costs.

The mechanic's invoice, diagnosis, repair estimate, photographs, and related documentation will be provided to Tires Plus as supplemental evidence when available.

The documented sequence of events nevertheless raises serious concerns regarding whether the original repair and subsequent repair work were properly performed and whether the recurring belt/tensioner problem, including the repeatedly documented issue that the tensioner bolt was not tight enough, caused or contributed to the later mechanical failure.

5. Damages and Losses
As a direct result of the vehicle becoming inoperable and my inability to use it for its normal purposes, I have suffered and continue to suffer financial losses.

My damages include, but are not limited to:

Vehicle diagnostic and inspection costs;
Necessary vehicle repair costs;
Potential engine and/or related component repair or replacement costs;
$160 in towing expenses;
Loss of use of the vehicle;
Lost income from Uber and Lyft;
Transportation expenses;
Other out-of-pocket expenses;
Consequential damages; and
Any additional damages supported by the evidence and permitted under applicable Florida law.
Lost Uber and Lyft Income
Before the vehicle became inoperable, I regularly used the vehicle to generate income through Uber and Lyft.

As a result of being unable to use the vehicle, I have lost rideshare income.

Based upon my historical rideshare earnings, I estimate my average lost income at approximately:

$700 PER WEEK
beginning July 10, 2026, and continuing for each week that I remain unable to use the vehicle for rideshare work.

My actual lost-income amount will be further documented using Uber and Lyft earnings records. Supporting screenshots and earnings documentation are being provided with my initial correspondence, and additional records may be provided as necessary.

Because the vehicle remains unavailable for rideshare use, these losses are continuing to accrue.

6. Tires Plus Refund Offer
I understand that Tires Plus has offered to refund the original $584.20 that I paid for the June 6, 2025 repair.

While I appreciate that offer, I do not consider a $584.20 refund to be sufficient to resolve this matter.

The refund does not account for the subsequent documented belt/tensioner problems, the eventual loss of use of the vehicle, towing expenses, lost Uber and Lyft income, diagnostic expenses, necessary repairs, and the other damages resulting from the situation.

Accordingly, I am seeking compensation for my actual documented damages, rather than merely a refund of the original repair charge.

Any acceptance of a refund will be subject to review of any proposed release, waiver, settlement agreement, or other conditions attached to that payment.

7. Applicable Florida Law
The conduct described above may implicate provisions of the Florida Motor Vehicle Repair Act, including provisions concerning unlawful repair-shop practices and the remedies available to an injured customer. See Fla. Stat. §§ 559.920 and 559.921. Section 559.920 includes, among other things, a prohibition against a repair shop willfully departing from or disregarding accepted practices and professional standards. Section 559.921 provides a civil remedy to a customer injured by a violation of the Act, including potential damages, costs, and reasonable attorney's fees as provided by statute.

I expressly reserve the right to assert any applicable statutory, contractual, negligence, warranty, consumer-protection, or other claims supported by the facts and evidence.

8. Preservation of Evidence
You are hereby requested to preserve all documents, records, communications, electronic data, and physical evidence relating to my vehicle and the services performed on it.

This preservation request includes, but is not limited to:

All repair orders and invoices;
Technician notes;
Diagnostic records;
Inspection records;
Warranty records;
Records concerning the belt and belt tensioner;
Records concerning the tensioner bolt and associated hardware;
Records identifying the technicians who performed the work;
Internal communications concerning my vehicle;
Communications with me concerning the vehicle;
Photographs and videos;
Parts removed from my vehicle, to the extent still retained;
Records relating to the June 6, August 16, September 30, and October 10, 2025 visits;
Any quality-control or inspection records;
Any warranty or claim records; and
Any other documents or information relating to the diagnosis, repair, inspection, or recurring belt/tensioner complaint.
Please take reasonable steps to ensure that relevant evidence is not discarded, altered, destroyed, overwritten, or otherwise made unavailable.

9. Supporting Evidence
With my initial email, I will provide supporting documentation, including:

Exhibit A — June 6, 2025 Tires Plus Invoice
Documentation of the original belt/tensioner repair and $584.20 payment.

Exhibit B — August 16, 2025 Tires Plus Service Record
Documentation of the continuing belt noise and statement that the belt tensioner bolt was not tight enough.

Exhibit C — September 30, 2025 Tires Plus Service Record
Documentation of the continuing belt noise and repeated statement that the belt tensioner bolt was not tight enough.

Exhibit D — October 10, 2025 Tires Plus Service Record
Documentation of the continued ticking noise and additional tensioner replacement.

Exhibit E — Vehicle Failure/Towing Documentation
Documentation relating to the vehicle becoming inoperable on July 10, 2026 and the approximately $160 towing expense.

Exhibit F — Uber/Lyft Earnings Documentation
Documentation supporting my historical rideshare income and my estimated average lost income of approximately $700 per week.

Exhibit G — Photographs and Other Evidence
Photographs and other documentation relating to the vehicle, components, damage, and condition of the vehicle.

Supplemental Evidence — Mechanic's Inspection and Invoice
A mechanic's inspection, diagnosis, invoice, repair estimate, and related documentation will be provided when available.

10. Demand for Resolution
I am requesting that Tires Plus investigate this matter and provide a reasonable settlement that compensates me for the damages caused by the improper repair and/or failure to properly correct the recurring belt/tensioner problem after Tires Plus was placed on notice of it.

Because the full extent of my damages is still being determined, particularly the cost of repairing the vehicle and the continuing loss of rideshare income, I am not presently limiting my demand to a fixed final dollar amount.

My current overall damages are estimated to be in excess of $3,000, with lost income continuing at approximately $700 per week, in addition to the towing expense and other documented and anticipated losses.

The $3,000 figure is a preliminary overall estimate and is not intended to double-count individual expenses that may already be included within that estimate. I reserve the right to update the amount of my demand as additional damages are documented.

11. Opportunity to Resolve the Matter
I would prefer to resolve this matter directly and without litigation.

Accordingly, I request that Tires Plus provide a written response within fourteen (14) calendar days of receiving this letter.

If Tires Plus is unwilling to provide reasonable compensation for my documented damages or otherwise resolve this matter, I am prepared to pursue the remedies available to me under Florida law, including filing an action in the appropriate court.

Nothing in this letter constitutes a waiver, release, limitation, or abandonment of any claim, right, remedy, or cause of action. I expressly reserve all rights and remedies.

I look forward to your timely response and a good-faith effort to resolve this matter.
