If you have a receipt that you paid for it and proof it wasnt delivered take them to small claims court. You dont even need an attorney

Its a business. Get over it and either pay for your car, get help by borrowing the money elsewhere or give up the car.

I would bet no where in your contract is a "hardship clause" but you might want to check or perhaps call back and speak to someone else.
I would guess that it would depend on your previous payment relationship with the company. If your constantly late, I would say that they probably arent going to help much.
