Holiday Inn Club Vacations Incorporated Worst experience in my life

I’m the sucker who bought in. Once you’re in, it’s just about impossible to get somebody on the phone and when you do, you can’t get into the resort as they are booked up. The marketing group will continuously call you and give you rooms as long as you listen to the spiel. If you listen to the spiel, don’t buy in, run away. If you want in, I’ll sell you mine

Recommendation: Runaway, runaway fast.

We got offered a deal at a hotel as long as we attended a timeshare presentation. We showed up for our presentation and they didn't let us attend because mine and my partners IDS didn't match. That was never explained to us to begin with and then since we couldn't attend they charged us full price for the hotel. Don't let these people fool you they just want to take your money if I could give them a 0 zero star review I would

Holiday Inn Club Vacations Incorporated Do not buy holiday inn club vacation timeshare its a scam!

DO NOT BUY HOLIDAY IN CLUB VACATION TIME SHARE ITS A SCAMM! Its a waist of money! We bought and initial 50k points. They made it seem like the best investment ever. Its not no way to actually book anything. All the dates and times are apparently booked by grandfathered members. But if you want to pay out of pocket they will gladly take your money. You can never book anything. We financed this because we are a family of five. So we thought this was a great investment to save money on all the family vacations. Turns out we just *** it all away. Then we went back for a member meeting. We wanted to say NO because of our experience already. They would not take no for an answer we were there for 8 hours back and fourth saying no and they kept digging until we gave in and upgraded. The finance manager assured us we can call with any questions and book what we needed and we try but never pans out. This is a major scam they pray on the families that don't have money and are on a fixed budget. Worst experience ever. Nobody ever helps. They make it seem like the best vacation package so easy. So many locations to go to and still have not ever been able to book a vacation with the holiday in club vacation club. IF YOU GO SAY NO! They just keep getting you with yearly maintenance. I would not mind paying maintenance if it was something I could actually enjoy. Now with out fixed income I have to try to hire a lawyer to get out of this horrible position I put my family in. Monthly payments that could actually go to a real vacation not the dream they trying to sell you. And when you ask them to buy it back they say no it is yours forever until you pay it of then they tell you that you can relinquish the shares and only then you will no longer be accountable for the maintenance fees. So no I have to pay over 20k to holiday in just because they got me to believe in their product. Its all lies its a way to generate income for their lavish resort. Worst thing I have ever done!

Holiday Inn Club Vacations Incorporated Please just read the reviews and take it for what it is

Please just read the reviews and take it for what it is. This is by far the shadiest company I have ever dealt with. Aside from the pushy sales tactics, the salesmen have no problem straight up lying to you. In my case, my wife and I decided to sit down after the presentation to just see what they had to offer. We decided that we did not think it would be a good decision at that time. We were concerned that if anything should happen financially, we wouldn't be able to make the payments. The salesman assured us that we could exit the timeshare at any point if it became to much to handle. For the most part, everything was good to go for the first year. Fast forward to the following year, we tried to schedule a vacation and we wanted a unit by the water park. I should mention that we were told that they only allow a small amount of non-owners to stay there so that there is always units available for owners year round. Low and behold our first time trying to use the time share, there were no units available where we wanted. Still extremely aggravated, we chose to stay in the closest village to the water park that we could get (which was literally on the opposite side of the community). We arrive to check in and are offered free tickets for the water slides along with a few other perks, we just had to sit through a short presentation to get the updates on what had changed since our last visit. Once again, we were pressured into buying more points. This time we were told that due to our level of membership which was the bottom of the barrel, we were missing out on certain benefits that was promised during our first purchase. And if we didn't at least buy a few more points, we would loose the rate at which we were supposedly locked in at meaning if we wanted to buy more time in the future rather than right then, we would have to pay the going rates at that time. Back to the first purchase, one of the "perks" was that at anytime in the future, we could buy more time at the same rate as our original contract. I have since learned that a timeshare is unlike owning a house, there is no appreciation or depreciation, it was simply a lie to pressure us into our second contract. At any rate, life went on and of course, kicked us in the rear. We were now at the point where we could no longer afford the timeshare. I called our point of contact, the guy who closed on our contract. He did not answer and did not return our calls. I then started to research how to exit my timeshare, remember that was our biggest concern and we were told that we could exit any time we needed. With no help from the office, I found their exit program that's called Horizons by Holiday Inn. I called and explained my situation, all to find out that I did not qualify for their program. I was told that to qualify, one must have the timeshare paid off fully. So basically their program is you pay the timeshare off, then you can give it back to them for free to sell to another unsuspecting consumer. Currently, I am so much worse off than I could have ever imagined, to the point where I will most likely have to file bankruptcy. It is ashamed that things played out like they did. Orange Lake Resorts was a fun place for my family to spend our vacations at and we have a lot of great memories from there but the way that Holiday Inn conducts business is far from professional and borderline criminal in my opinion. Please take it for what it is, do your own research and don't get caught up in their lies.

Holiday Inn Club Vacations Incorporated Timeshare ownership

We are looking for help to exit our timeshare contract with Orange Lake. Unfortunately, we are very disappointed with our purchase and need help promptly resolving this matter. Despite our attempts to contact the resort directly, they have refused to assist, suggesting instead that we sell or transfer the timeshare to friends or family, which is not a burden we are willing to impose on others.

We feel deceived by representatives Aurora Eason and Walter Iaxon and believe they should be held accountable for misleading us into this decision. Based on the information given to us by these representatives, we deserve a refund and an opportunity to be released from the contract immediately.

Desired outcome: We would like to have the timeshare contract canceled, immediately.

I'm reaching out because my family and I have been dealing with some frustrating issues with our timeshare. We jumped into this with high hopes after hearing all the great benefits that were promised during the sales pitch. Sadly, things haven't turned out as expected. We sat through a long session where we were convinced this was a perfect fit for us. But it turns out, to get what we actually want, we had to spend even more money. Even after that, booking a vacation has been a nightmare. The experience hasn't matched up with what we were told, and it's costing us more than anticipated. When we tried to discuss getting out of this agreement because it simply isn't working for us, we hit a wall. We were told that we needed to pay everything off first before any assistance could be offered. This just doesn't sit right with us, especially after everything we've already been through. We really need this situation to be resolved in a way that doesn't put more financial pressure on us. We were hoping for a straightforward, enjoyable experience, and it just hasn't been that. Holiday Inn Club Vacations Incorporated Timeshare Ownership

We are not sure we made to right decision to do business with Holiday Inn, Orange Lake. We feel we have been tricked into buying a vacation package that was not supposed to be a timeshare. We were told many times that it was not. We were told several different stories about what getting involved with this program would do for us. We are now paying several fees for different things and we can't use it. They told us it would be a great investment that would give us money. They told us we would be able to sell it later for a profit. We can't give this away. It has not grown in value like they told us it would. We now see we have been trapped like many others after we called to try and give this timeshare back to them. This has been a huge mistake for us. My spouse and I are retired with a fixed income and this company does not seem to care much about their members. Unless you have money to throw away to a company that will never deliver on their promises, don't do business here.

I have recently attempted to contact the office of Holiday Inn Vacation Club to discuss my options for terminating my contract. However, the responses I received were disheartening and unhelpful, directing me to pay fees for contract termination. Regrettably, I do not possess the financial means to pay these additional fees, which could exceed thousands of dollars. This demand is not only burdensome but feels exploitative given my current circumstances.

The idea of continuing to incur costs that I am unable to meet is causing me significant stress, compounding my existing health issues. This situation has left me feeling trapped and hopeless, as I desperately seek a way out of this contract without incurring further financial devastation.

I genuinely wish to resolve this matter amicably and promptly. I believe that a compassionate approach to my situation can lead to a resolution that reflects the values of Holiday Inn as a reputable establishment committed to customer care. I am hopeful that my request will be taken into serious consideration. It is important to me that this be settled very soon.

Holiday Inn Club Vacations Incorporated Timeshare package

We are not happy with the decision we have made to purchase a timeshare membership with Holiday Inn Club Vacations. We feel that we have been misled and scammed by the sales representatives we have dealt with, and the experience has left us with a sour taste in our mouths.

Our decision to purchase the timeshare was based on the promises made to us by your salesman Luis. He convinced us that we would be able to access discounted rates on rooms and travel if we joined your program. However, upon trying to use the program, we quickly discovered that these promises were nothing more than empty words. We were unable to use the program as we had been told, and we were left feeling frustrated and misled.

To make matters worse, when we spoke with another one of your salespeople, Zorro, we were told that Luis had been dishonest with us. Zorro told us that Luis no longer worked for your company and that he had sold us something that would not work for our needs. This was incredibly frustrating to hear, as we had put our trust in Luis and believed that he was acting in our best interests.

The issues that we have encountered with your company have not been limited to the sales representatives we have dealt with. The customer service that we have received has been subpar, to say the least. We have repeatedly tried to get answers to our questions, only to be told that we have called the wrong department or to be transferred to another line and then disconnected. This has left us feeling ignored and frustrated.

The financial burden that this timeshare is placing on us is significant. The fees that we are being charged are draining us financially, and we have found that we have better travel advantages outside of the timeshare membership. Given the issues that we have encountered, we have lost all trust in your company and would like to request your assistance in getting out of this contract as soon as possible.

Holiday Inn Club Vacations Incorporated Timeshare

I am writing to express my utmost dissatisfaction and anger with the way Holiday Inn Club Vacations has treated me regarding my purchase of a timeshare. I was lied to from the very beginning about how the timeshare works and how much money would be needed after purchasing. I now find myself in a situation where I am unable to use my timeshare as I had envisioned, and I believe this is entirely due to your misleading representation of the product. In particular, I was told that I could get a condo with my points, but now I find out that I can only get a bedroom with twin beds. This is significantly different from what I was led to believe, and I feel that I have been taken advantage of. I trusted this company to provide me with accurate information, and I feel that this trust has been betrayed. Additionally, I was told that I could sell the timeshare if I wanted to. I went through the company and paid the fee of $500 to do so, but I have not received any profits from the sale. Furthermore, you were supposed to rent it to someone, but it seems like nothing was done in the end. I am deeply disappointed with this company's lack of integrity and honesty. I believe that I have been intentionally misled, and this has resulted in a significant loss of money and time on my part. I would hope that they will rectify this situation and provide me with an appropriate solution. We were coerced into purchasing a timeshare that we were led to believe would bring us endless benefits and vacation opportunities but instead has turned our lives into a nightmare.

Since acquiring this timeshare, we have experienced nothing but trouble and disappointment. The promises that were made to us during the sales pitch never became a reality, and the additional fees and expenses that came with the timeshare have left us in financial hardship. Despite our efforts to contact someone with the authority to help us cancel the agreement, our concerns have been ignored. We believe that Holiday Inn Vacation Club has acted unethically and disregarded our rights as consumers. Their tactics were intentionally misleading, causing us to believe that we were receiving something of value when, in fact, we were being scammed. We are exhausted from the added stress and anxiety put on our family as we continue to bear the consequences of our decision to trust this company. Holiday Inn Club Vacations Incorporated Timeshare

We have not had a very good experience with Orange Lake/ Holiday Inn at all. We have attempted for a few years to have them cancel our timeshare ownership. This experience has been nothing but one disappointment after another. We are not really sure what to do at this point. We feel that we have been taken by this company and we want nothing more than to be free of the contract. We were offered the standard 4 days 3 nights at the resort in exchange for attending a presentation. We were told it was about an hour or so long, 5 hours later we had made the purchase. We were told what a good investment this was, our family would have it for a long time. We could go anywhere they had property, including RCI. Only to find that when we tried to book something it was not available. Our salesman told us about all the places he had been and all the places he could take his family. We denied the offer but the salesman kept pushing. Eventually we gave in and signed the contract just to get out of the horrible situation. Now we are stuck with a very expensive bill that we can’t benefit from. Our attempts to get help from Orange Lake/Holiday Inn have been unsuccessful. They refuse to take responsibility and help us out of this mess.

Desired outcome: Cancel the timeshare and let us out.

Holiday Inn Club Vacations Incorporated Timeshare

My husband, who is a diabetic, and I were offered a weekend stay for $150.00, and being enticed by the attractive package deal, we decided to attend a 90-minute presentation. However, what we experienced was a sales pitch that lasted approximately 5-6 hours, with no regard for my husband's medical condition, or the fact that we had a special needs child at home with a caregiver. Throughout the presentation, we repeatedly requested to leave, but the representatives insisted that it would only take a few more minutes. It became evident that the sales tactics were manipulative and highly deceiving. The salesman promised us a trip to Greece for $500.00, which sounded irresistible, but he failed to disclose the fact that we would be charged a yearly membership fee and processing fee for every point we used. The information provided in the paperwork was vague and lacked crucial details that we needed to make an informed decision. When I tried to contact the resort to clarify the information, the provided number was nothing but a voicemail, and I never received a callback. Seeing how a reputable brand like Holiday Inn can deceive its customers with false promises and unethical sales tactics is disheartening. We feel that Holiday Inn Club Vacations has exploited us and taken advantage of our situation. I strongly believe that Holiday Inn has breached its duty of care towards us, and we are growing increasingly frustrated that we were not given the opportunity to make an informed decision. We would like our contract canceled as soon as possible.

Holiday Inn Club Vacations Incorporated Timeshare membership

From the beginning, we were coerced into buying with persuasive language and manipulation that made it seem like an easy and profitable investment. However, the reality has been a nightmare.

We were never properly educated on how to use our timeshare, and as a result, we have struggled to even book a single vacation that meets our needs. Despite upgrading several times, as your representatives have suggested, we cannot seem to access the benefits and special access that supposedly come with these upgrades. Instead, we have been left with mounting financial burdens that are impacting our ability to purchase a home.

The limited availability of dates has made it nearly impossible to use our timeshare as intended, and each time we do attempt to book a reservation, we are met with frustration and disappointment. We are often forced to rearrange our schedules to accommodate whatever is available, which takes away from the perceived benefits of vacation ownership.

Perhaps most concerning is the fact that we have consistently been pressured to upgrade our timeshare, with promises of easier access and priority booking. However, these promises have not been fulfilled, and we are left with a sense of betrayal and anger towards the company.

At this point, we would like to end the agreement and cancel the timeshare membership. We would like to have this resolved as soon as possible.

Desired outcome: We need them to cancel our contract and free us from any financial obligation currently and moving forward.

Holiday Inn Club Vacations Incorporated Cancel the timeshare that I purchased

My Wife & I are writing to submit a complaint regarding the timeshare We purchased from Holiday Inn. We were initially offered a $200 gift card to attend a 90-minute presentation, which turned into a six-hour ordeal. During this presentation, We were promised a vacation ownership that would allow Us to travel anywhere, at any time, for free. We were also told that the timeshare would not only cover the cost of our vacations but would also increase in value, making it a wise investment for Our children.

However, since purchasing this so-called "investment," We have yet to use Our timeshare once. The resorts We were promised are always booked up, and the travel expenses are a financial burden We cannot afford. Moreover, We have yet to benefit from this so called “Vacation Club”.

Despite multiple attempts to cancel Our membership, We have been met with nothing but silence from Holiday Inn. We have reached out to customer service, attempted to use the online portal, and called numerous phone numbers, but nobody seems willing to help Us. It is incredibly frustrating; especially given the financial strain this unnecessary expense is adding to Our lives.

What angers Us the most is that We were lied to during the sales pitch. We were never informed that the resorts are frequently booked up and that the "free" vacations We were promised would require significant travel expenses, resort fees, etc. Additionally, We were told multiple price points on multiple occasions when the information could have been presented upfront, saving us all time. Every single person we spoke with that day said “oh, yes, I am an owner as well.”

Holiday Inn needs to take responsibility for their misleading sales tactics and refund Our investment, and We urge you to take Our issue seriously. We are requesting that Our membership be canceled and that a full refund of all expenses paid to date be issued promptly. If this issue is not rectified, We are willing to take legal measures to resolve it.

We are beyond frustrated and disappointed by the experience that We have had with Holiday Inn, and We hope you take this matter seriously. As a paying customer, We deserve honesty, transparency, and empathy, none of which We have received thus far.

I was initially offered a $200 gift card to attend a 90-minute presentation, which turned into a six-hour ordeal. During this presentation, I was promised a vacation ownership that would allow me to travel anywhere, at any time, for free. I was told that the timeshare would not only cover the cost of my vacations but would also increase in value, making it a wise investment for my children.

However, since purchasing this so-called "investment," I have yet to use my timeshare once. The resorts I was promised are always booked up, and the travel expenses are a financial burden I cannot afford. Moreover, I am yet to receive my membership card, which adds to the frustration of the whole experience.

Despite multiple attempts to cancel my membership, I have been met with nothing but silence from Holiday Inn. I have reached out to customer service, attempted to use the online portal, and called numerous phone numbers, but nobody seems willing to help me. It is incredibly frustrating, especially given the financial strain this unnecessary expense is adding to my life.

What angers me most is that I was lied to during the sales pitch. I was never informed that the resorts are frequently booked up and that the "free" vacations I was promised would require significant travel expenses. Additionally, I was sold multiple price points on multiple occasions when the information could have been presented upfront, saving us all time.

Holiday Inn needs to take responsibility for their misleading sales tactics and refund my investment, and I urge you to take my issue seriously. I am requesting that my membership be canceled and that a full refund of all expenses paid to date be issued promptly. If this issue is not rectified, I am willing to take legal measures to resolve it.

I am beyond frustrated and disappointed by the experience I have had with Holiday Inn, and I hope you take this matter seriously. As a paying customer, I deserve honesty, transparency, and empathy, none of which I have received thus far.

Holiday Inn Club Vacations Incorporated We need our timeshare contract canceled emmediately.

We are not sure what else to do about this timeshare contract. We can't seem to get the help we need from anyone at this company. We have had nothing but trouble since we purchased it. We were given lots of information during a long four to five-hour presentation, but they failed to give us the real details of what we would be in store for. We have never received any of the discounts promised to us and we haven't been able to book any vacations. This is not the investment we were expecting and now we can't seem to get anyone from the company to settle this. We would like to have this entire timeshare contract canceled and would appreciate our money back. This is not something you want to throw your money into because it does not work in your favor.

We were initially drawn in by the promises of luxurious and affordable vacations, but as soon as we signed on the dotted line, everything changed. We have attempted multiple times to speak with your agents and seek help, but instead of solutions, we were met with more demands for money. This is not what we signed up for. We are concerned with the feeble attempts made by this company to resolve an issue that has been chipping away at our peace of mind for what feels like an eternity. The lack of urgency displayed by their team is shameful, and the complete disregard for the well-being of hardworking customers like ourselves only amplifies the severity of the situation. Let me begin by recounting what led us to invest in this timeshare program. The sales representatives promised us that we would be gifted with access to luxurious vacations at a discounted rate, allowing us to travel in style without burning through our savings. We were hopeful that this opportunity would be a blessing, but boy were we wrong. We have paid thousands of dollars to this company, only to be met with incompetence and false promises. Despite our repeated attempts to resolve the issue by trying to contact someone from the resort, we have been left feeling helpless and abandoned. Rather than providing assistance, the representatives have the audacity to demand more money from us. It is clear that Holiday Inn Club Vacations has taken advantage of us, and our trust in this organization has been grossly misplaced. We refuse to continue pouring money into a program that has failed to deliver what was promised, and we request that they take our grievances seriously and assist us with relinquishing our membership. We were told our 2 bedroom unit would be available when we needed it. We have only used a 2 bedroom unit once never been able to use it since.

I haven't been able to get caught up and pay due to not working in 6 months. I don't feel comfortable talking on the phone. They do not help me out. This is a very tough subject honestly. We have not been able to use the timeshare because it is either make the mortgage or make a reservation. Thats not including trying to pay all the fees every year on the property and not to mention the taxes. Honestly any time I wanted to book it no matter where I would make my reservation would always be booked up at least a year in advance. We were told that we should have no problem booking any time during the year where ever we wanted to go there should always be something available. Another issue I have with holiday inn is that after the sale they would go out of their way to make me feel like crap when calling me on the phone. They would call at least one a month from the sales department offering me a wonderful stay at a great price. When I explain to them I don't have the money its either book the stay or pay the mortgage the only response is this is the last time we are going to call and make you a offer if you refuse it. I explained how it made me feel when they said that as I would love to book but they could care less as I was just a number to them. Like I was just a number when signing my contract. Also I understand that it is there job to collect the monies owed to the property but they put it in overdrive. For three years I always, always paid the mortgage payment never missed one but the fee I get charged every year I sometimes can't make because it's a lot of money owed on top of the mortgage. Some years its just the ownership fee I believe it's called but then other years it's the ownership fee and taxes and property fees. So those have sometimes taken me months to pay off. But as I slowly pay them off they hit me with a 50.00 late fee a month but I still tried to pay as soon as possible. I have not been able to get caught up and pay due to not working in 6 months under the current pandemic and I don't feel comfortable talking on the phone as they are always rude and looking out for themselves and finding a way to make a payment work in their favor even if I dont have the money and making me feel like a piece of crap if I can't pay them. I have tried to do my part with holiday inn club resorts and even when I try to get out of this timeshare they do not help me.

I purchased a package in March 50000 club points. I was told the points could be used in RCI without extra fees so I could travel wherever I needed. I just tried to use it as I need to travel for my business. There are $269 fees for exchanging anywhere! The reason I purchased was to make things more affordable. This isn't more affordable at all and I need a full refund of my purchase. I tried reaching out to Robert T, the real estate agent who sold to me. I called customer service and was directed to their horizons program. I was on the phone for over an hour and a half to be told these three options- Gift the package (no one else will want a fraudulently sold timeshare) Sell through their program (I was deceived and haven't used anything so I need a full refund) Forfeit the whole thing (NO, I need all my money back) I need a full refund or I will involve legal counsel for fraud.

My father purchased a timeshare at the Desert Club Las Vegas location with Summer Bay. In 2008, when Desert Club took over they changed the deed from floating week to week 36 without any notification. My father has passed and my sister and I are trying to transfer the deed to our names. We questioned the week 36 on the deed and what happened to the season 3 floating week that was originally purchased. No response to our emails and when I called all the guy could tell me is it is on the deed from 2008 and he has no other information and can not give me anyone else to contact for the information. As you can see in the exhibit A attachment of the deed signed by my parents in 2007 and filed 3/19 that this timeshare was not a fixed week.

Prior to the COVID shutdown in 2020, I purchased one of the vacation club's packages to tour their resort. Unfortunately, I was unable to use it due to issues of my own. I chalked up the loss. Earlier this week I received a call requesting to survey me about my experiences with IHG in exchange, I would receive 500 reward points.I was then transferred off to someone intent on selling me the same package I had already purchased...promising the sun, moon, and stars that I was already promised. When I explained what happened previously and that I had effectively lost the money that I had already spent and I was unwilling to do that again he became belligerent. I ended the call, as being harassed in the middle of a workday is not my cup of tea. However, I was never granted the reward points promised for the initial survey.

On August 6, I contacted my local hotel to reserve a room for the night and had selected to be transferred to the brief survey after my call ended. After booking my room, I was told by the local hotel employee to "Please hold, I will transfer your call now" with no further explanation. After I got transferred, an employee from the Holiday Inn Club Vacation answered the call. I was confused about the transfer since I had never dealt with a survey managed by a person. The HICV employee soon started to ask how my experience with the booking was and then went on to say along the lines of "we are holding a special for new members who sign up for our Loyalty rewards program since we are approaching a million members." And then, I was told I can stay at any of the select "resorts" in certain cities for two rooms and four nights for $100 (I will get a $150 refund upon my arrival at the resort of my selection). I was hesitant, so the HICV employee offered me a full refund upon arrival. I felt this was too good to be true, but I was made to believe that I was one of a few lucky chosen ones since I signed up for the Loyalty rewards program. I, unfortunately, paid the $249 on the call. After doing more research and looking at the email from the HICV, I realized this is no special offer; instead, it is to solicit for the HICV timeshare. I was not made aware of any timeshare or going to any special presentation to use this offer. During the call, I was made to believe that I was speaking to an employee of the hotel (executive corporate, survey, or loyalty line) and not HICV, which is not affiliated with the hotel. I am a young person and really see no use for timeshare. I am please asking to be refunded the $249 that I paid. Thank you.

Thank you for contacting Holiday Inn Club Vacations Incorporated (the "Company") in connection with the complaint filed with your office by Mr. ("Owner"). We appreciate the opportunity to respond to the concerns set forth therein. Our records show that Owner attended the Company's timeshare sales presentation on March 31, at which time he elected to purchase a biennial timeshare interest at the Smoky Mountain Resort located in Gatlinburg, Tennessee (the "Ownership"). The Ownership entitles Owner to 107,000 points every odd year in the Company's points-based exchange program, the Holiday Inn Club ("Club"). Availability / Financial Obligations. Owner claims that he has been unable to utilize the Ownership due to lack of availability and the financial obligations applicable to the Ownership. Please be advised that Owner may utilize his Club points to towards (i) reservations at any of Company's twenty-eight (28) resort locations; (ii) reservations at resort accommodations through RCI's external exchange program; (iii) reservations at hotel accommodations at thousands of IHG-branded hotels worldwide through the IHG One Rewards Program; and (iv) airfare, car rentals, cruises, and more through the Company's Club Partners Program. Provided that (i) Owner has the requisite number of Club points for the requested reservation, (ii) his accounts with Company are current, and (iii) he abides by the applicable booking windows, then there is nothing in our system that would prevent Owner from booking a reservation. Please also note that Owner executed the Owner Clarification Form which expressly provides that from time-to-time Owner may be required to make alternative choices to confirm a reservation if his first choice is not available. To the extent that Owner was denied a reservation on the basis of availability, he was reminded that all reservations are subject to availability, and that it is best to book reservations as far in advance as possible in order to maximize his chances of securing his desired resorts and dates of travel. Upon review of Owner's usage history, we show that he has not utilized his Ownership. Notwithstanding Owner's choice to forego use of the Ownership, this is not a basis for contract cancelation and does not invalidate the financial obligations Owner agreed to on the date of his purchase. In connection the financial obligations, Owner was provided full disclosure of the financial obligations on the date of his purchase. Please note, once Owner advised the sales consultant that he wanted to purchase the Ownership, he was provided with a one (1) page Purchase Proposal setting forth the key terms of his purchase, including without limitation, the purchase price, amount financed, term of loan, monthly payment, maintenance fees and interest rate, in order to confirm his understanding of the same. Only after Owner signed the Purchase Proposal were contract documents prepared for his review and execution, which further disclosed the financial obligations attendant to the Ownership (i.e., maintenance fees, real estate taxes, Club membership fees, etc.), and the fact that he must timely remit his payments. To the extent that Owner allows his accounts to become delinquent, he is subject to receiving (i) collection calls, (ii) collection notices, and (iii) incur additional fees such as, late fees, and additional collection costs. Furthermore, as part of the sales process, Owner was required to meet with a Quality Assurance Officer to review the contract documentation and the details of his purchase to ensure that he had a full understanding of the terms and conditions associated with the Ownership. Owner was handed each document and was provided the opportunity to review each in detail prior to signing, as well as the opportunity to ask for clarification regarding anything he did not fully understand in connection therewith. If Owner did not agree to the financial obligations or any of the terms associated with the Ownership, he was welcome to decline to execute the contract documents or to rescind his purchase within the statutory rescission period. Customer Service. The complaint states that the Company's agents have exhibited "rude" behavior to Owner. Owner further states that he has previously emailed the Company and has not received support to his request for assistance. Please note that satisfying our customers' needs and providing effective and timely assistance in connection with account inquiries is important to our company and we apologize to the extent that Owner has experienced any frustration in this regard. Please note that we have no record of Owner previously presenting concerns regarding the customer service provided by our agents. Notwithstanding the same, we sincerely apologize to Owner to the extent he felt that our agents were discourteous to him during any phone calls, we certainly do not condone such behavior. Additionally, if Owner did not receive response(s) to his emails, we sincerely apologize in this regard as well. We thank Owner for his feedback, and we will continue to work with our agents in this regard. Timeshare Solicitation. The complaint states that Owner has received phone calls from the Company's marketing department to purchase deeply discounted mini vacations. Please note that to the extent prospective purchasers are invited to purchase a mini-vacation through our marketing department, the terms of the promotion may include payment and the requirement to attend a timeshare presentation to receive the reduced rate for the accommodations and/or a refund of the purchase price for the mini-vacation, depending on the applicable promotion. Please be advised that owners and non-owners are not required to participate in the Company's marketing promotions nor consummate a purchase at a sales presentation, as both are at the discretion of the prospective purchasers. Notwithstanding the same, pursuant to the request in the complaint, the Company placed Owner's telephone number on the account on our internal do not call list and as such, he will no longer receive solicitations from the Company at that number. However, such action does not preclude the Company from contacting Owner for collection purposes. Cancelation / Refund. Owner requests contract cancelation on the basis that he can no longer afford the Ownership. Our records reflect that Owner was provided with all applicable disclosures related to his purchase, including his use rights, benefits, financial obligations, and right to rescind, which he failed to exercise. Notwithstanding the foregoing, prior to our receipt of the complaint, our records reflect that due to the severe delinquency under his account our Capital Management Department agreed to extend Owner a one-time offer to surrender his Ownership pursuant to a Deed in Lieu of Foreclosure ("DIL"). This offer would allow Owner to surrender his Ownership back to the Company, without refund, and relieve him of any future financial obligations under the Ownership. Owner accepted the same and later returned the executed DIL. We have confirmed that the Company has received the executed DIL attached to Owner's complaint. Please be advised that the Company previously submitted the executed DIL for recordation in public record; however, the same was rejected by the public records office due to a minor error. After review of the same, the Company has resolved the issue with the DIL and the same is being re-submitted for recordation. As soon as the Company receives the recorded DIL from the public records office, the Ownership will be canceled in our systems, and Owner will be relieved of the outstanding financial obligations attendant to the same. We appreciate Owner's continued patience during this process and a member of our Legal Department will notify him once his Ownership has been canceled.
