Mr. Cooper - Loan modification

We purchase a house in 2006 and in 2008 we apply for the loan modification program, they had us on trial pmts for 3 to 4 months and they did this 3 times... They are still unable to help us... I received a letter 3 wks ago stating that we dont qualify for the making home affordable program because of exessive forbearance that they will see if they can...

Mr. Cooper fees

Nationstar Mortgage is one of the biggest rip offs ever! If you can avoid using them, do so...AT ANY COST! Forget them working with the consumer to try to get on track, they freakin screw you every chance they get with every fee they can. This nation is going to hell in a handbasket, because of corporate America's greed. No matter how you try to make a payment, with the exception of using a check, they charge you! You make a payment with a rep to avoid a late fee, they charge you! You make an internet payment, they charge you. You try to breath, they charge you!

Mr. Cooper Home Modification

I contacted Aurora at the end of 2009 when my mortgage payment was going up by @300 dollars. At the time my husband was out of work and had lost his business. I was told that they couldn't not help me until my payments where past due. I waited a couple of months and stated I needed some help, that at the current time could not afford the payment increase. I then went into a forebearance agreement which was to go through July 2010. During that time I sent document after document paid my forebearance payments on time and did what was asked of me. At the end of the contract, Aurora stated my loan was still in review and to continue to pay my forebearance payments. I called periodically to check on my workout status only to find out my loan was still under review. I occasionally got letters stating that Aurora needed information which was already sent to them previously but sent it anyway. It has been 14months since I started this process and just found out that I was denied a HAMP because my gross income is more than 31% of my 1st mortgage, insurance and homeowners dues, etc. Now, this is based on a simple math problem that takes only a moment to calculate, meanwhile my past due payment are accumulating. Now I am told I am approved for a tradional home modification for an amount that is greater than my payment was before I started this whole process over 14months ago! This to me is insane and should be illegal! I have gotten conflicting information from every representative I talk to at Aurora. I need advice on what to do. Does anyone know at this point whom I turn to? Thank you for reading.

We are in a similar situation with Aurora. My husband lost his job over a year ago, we agreed to the HAMP Up forebearance plan in December (not knowing how it would devastate our credit), and jumped through hoops to hold onto the house. In the end, we have decided to file for bankruptcy because they sent us notice stating we were in default and owed all the back payments and late fees (even though we were NEVER late on the modified amounts) -- without even stating why we did not get approved for a full HAMP modification or trial period (as is required). When we called, every service representative we spoke to gave us a different answer of what we should do. We are tired and just don't have the energy or ability to continue fighting. The house is worth less than we owe, so... We are hoping the bankruptcy gives us (a) a fresh start (b) puts a stay on the foreclosure until after the bankruptcy if finalized (Aurora seems to one of the banks that files a relief from stay, so chances may be slim) and (c) then we can put the house up for sale as a short sale. This is all assuming they will be smart and lets us short sale...which will net them more $$ than a foreclosure. But of course, they could have modified the loan with us and made more $$ -- yet they did not do that. The government feeds them money the longer you are in some form of HAMP mod is what I heard, so it really does not behoove them to help the homeowner into a permanent stable situation. If they allow us to short sale, at least the neighbors won't be as affected by our situation...sad the ripple effect of just one job loss.

Mr. Cooper collection agency

Nationstar (Ns) is debt collector... They service nothing!

Ns reps refuse to identify themselves by more than a first name, sometimes a bogus extension number. You can never reach the same person you spoke with previously. Hold times are ridiculous... Then we must identify ourselves all over again.

Ns failed to produce payment history on my account for life of loan as I requested (Citi mtg previous lender). My loan was established 7/07 with citi mtg and ns took over my loan 11/10. Ns only provided history since that time (11/10).

They refuse to walk me thru fannie mae loan look-up process. I've tried numerous times to look-up my loan via this bogus internet service to no avail. I even tried contacting fannie mae direct and they referred me back to the servicer and released the call.

Banks and the american government should be ashamed of themselves... Losers!

You need to take CitiMortgage to Federal Court. On your original loan Note, who held the note at that time? FNMA probably or Lehman Brothers or MERS. What assignments have you received or has been filed in city or county records? Do the assignments follow the trail of the people collecting from you? Nationstar is not considered a debt collector, don't know why not but so be it.Sue under the FDCPA 13 U.S.C.$169 which is Fair debt collection practices also for damages for violations of the Consumer collection Practices Act for your state. I have been fighting 10 properties in Florida since the crash. Federal Court is the only way I've been winning. My Mortgage people were Aurora who sold to Nationstar, BofA and Citimortgage. State court doesn't work.

Mr. Cooper servicer hell

After being approved for a HAMP loan mod through Suntrust Mortgage, we got sold to Nationstar in December 2010. Nationstar is even worse than people are talking about. They lie, cheat, and mislead you. They are horrible. The first thing they sent to us was foreclosure paperwork. They said that they had no record that Suntrust modified our loan and that we were 7 months behind. They have added outrageous fees to the sum of around $5, 000 in the last 2 1/2 months and cannot account for ANY OF IT! We are now fighting them in court over this foreclosure because of the fraudulent paperwork and missing documents. They have no proof they legally own our loan but are still trying to foreclose on us. If you ever do business with these people, RUN! File as many complaints as you can! They need to be put out of business before they take all of our homes!

This company is composed of liars, cheats, and rude employees. I think that all they want to do is rip off customers and add on unnessary fees. They lie to you after they put you on "hold" for hours, or they cut you off and promise to call you later. They are predators. Obviously, they must pay someone off in the government in Texas. Sixty Minutes and CNN needs to expose this company to the Federal Government. With all of the complaints, I don't understand why the Federal Government isn't investigating them.

Entered into HAMP program with Nationstar and sent them everything that they asked for in the way of paper work. After 4 months they said "didn't sent them the required information." So we did not qualify for the program. A girl called from under writting, told use what we needed to say in the letter, then fax it to them. Done that. They lie to you, mislead you, every chance they get. Nationstar is a company that should be put out of business. They talk and treat their customers like they are nobody.
MR. AND MRS. NO CUSTOMER SERVICE. They don't no the meaning of those words. I wish there was a way for everyone on here, that filed a complaint, could be involved in a class action lawsuit. I hate this company.

Mr. Cooper Cr*p company

Well I see I am not the only person that thinks Aurora Loan bank is crap. I have been, with the aid of a short sale specialist, trying to short sale two properties in Georgia. The customer service is crap their phone people are less than helpful and even when the paperwork is produced there is not a sole able to review it or make a decision. PLUS the attorneys Aurora uses get paid so much per foreclosure so guess what folks they have no incentive to try and work things out. I also own another property in California with Aurora, (not by choice they bought my loan)and guess what if things get worse that's the first thing I am going to do dump it. I will not bother to short sale because I now know the corrupt system aurora uses, I have sent letter to the State requesting that that bank no longer is able to do business here in California as they are so corrupt. I also am informing everyone I know all over the united states (I am part of a huge animal rescue) not to use this bank as they are fraudulently offering short sales and then do nothing to help it's all about insurance for their investors why short sale when insurance will pay for losses. they are rude ignorant of the system and have ulterior motives. I had a cash buyer for two properties and couldnt get to first base using an experienced short sale representative from REMAX.I originally tried to consolidate the two loans (first and second)and was told $15000 plus costs, who in the *** has that kind of money to get rid of a 2nd. Do yourself a favor stay far away from this bank. I now have a forclosure on my record and my wish for them is to have everyone read this and dump them. There were 8 nurses that bought in this tract in Goerga and they all are in trouble my advise to them has been just walk away do not try to short sale Aurora doesn't give a dam.

Mr. Cooper claim there is a shortage in my escrow account

I knew I smelled a rat when my loan was sold to nationstar from dovenmeuhle mortgage company. I received a letter stating my mortgage is going to go up because of a low escrow balance and the state laws says there should be an escrow cushions *blah blah blah* i'm now convinced that these banks try to set people up for failures. Not me! Thank god I keep all of my documents for proof. When they purchased my loan they claim I had a much lower amount in escrow than I really had, but I have a statement from dovenmeuhle that states differently. It's only a matter of time before this bank falls like the rest. I believe in god and if anyone else knows the power of god they know not to mess with his children because he will deal with you! For the other people whom this back is robbing blindly hang in there. There is always light at the end of the rainbow. God bless. [protected]@aol. com.

My original loan was sold to these thieves in April 2010, the mortgage company I had was awesome - my Home Insurance had already been paid before Nation-star was to officially take my account. I find myself paying 200.00 more than my old payment, due to escrow shortages and it is because they decided my insurance was not enough to cover my mortgage amount. However, my property taxes and value dropped more than 1/2 -

This was that latest of my issues with them, for the first 5 months I could not access any information on line pertaining to all my accounts, could not view a statement and they were not mailing my statements to my home. It took threats of holding my mortgage to finally get it done. Then, as I look to see where this shortage occurred -- Ironically, the only months missing from the escrow information is the month in which they stole more than 300 dollars out of my escrow.

Who do we go to when banks are stealing and being dishonest? ... is there some place to turn?

Mr. Cooper refuse to honor term of my mortgage modification they purchased from citimortgage

After completing a Loan Modification with CitiMortage Nationstar purchased my loan. Even though I have the loan modificationn documents that were signed off by Fannie Mae and CitiMortgage, the acount resolution manager Michele states they hve decided not to HONOR the terms of the loan modification. They are threatening that if I do not make the payment I missed, even though I have documentation from CitiMortgage proving the payment was made according to the terms of the modification, they will begin foreclosure procedures. They hace ruined my credit! They are now acting more like a terrositic collection agency. I need any advice and assistance available. I am filing a complaint with the Federal Trade Commission, the Attorney General and Fannie Mae!

Same thing happen to my wife and I. We were in mid modification process with Flagstar then it was just sold to Nationstar who did not know a thing about it. We fought and fought and they finally re mod our home loan but after submitting a foreclosure to our credit and tagged on a bunch of unexplained fees and charges. What a joke. My home is so up side down in value I'm ready to give it to them.

Mr. Cooper terms of loan

Just purchased a house and wanted a loan that was assumable, without pre-payment penalities and no origination charges. I was told by Wells Fargo that they would do that, but calling around, I talked with Leasha Johnson and she said she would match that. All along there were problems with her story changing, rates changing (which they do) but it usually included a change in cost, adding in origination cost, or discount fee if I wanted a certian %. Well a long story short, I stressed my frustration and continued on as I was on a deadline to close. Final papers came and guess what...
there was an origination fee, a discount fee and the kicker... its not assumable!
As an investor looking into other property, I assure you I will not use them again and I hope this helps someone before they use them!

Mr. Cooper doris able

My mother paid her Feb. 2011 Mortgage Payment to '"Mor Equity". After sending it she got a letter stating her mortgage was Now with "Nationstar Mortgage'". So she called them and asked that they return the check and she would rewrite it to them. They (Nationstar) refused to return the check, they said they had know idea where it was, "could be in a file or on a desk some where" They were extremly rude. So Mom stopped payment on the check to "Mor Equity" and sent a new check to them with Nationstar on it for Feb's payment and Marches payment too(2weeks early). Now 2 weeks after Feb. & Marches payments cleared she gets a letter that they are charging her next payment a $20 fee for the stopped payment to Mor Equity. Which they said they could'nt find or use. the letter heads look like they are from a rubber stamp. I'm afraid these guys are going to start trouble for my mom who is in her 70's and on a fixed income. Who do I contact to stop these Bozo's from ripping her off?

Nation star is a complete rip off - we signed a fixed rate of 3.5 and payments were 2750.00 they send us a bill for 3200.+ and one year later has not stopped after months of calling and promises of call backs that never happened we were told that they paid my insurance co's twice ... I can't understand why they Wouldn't fix their mistake So now we struggle monthly to get the extra $500 and then they charge me hundreds of dollars late fees my mortgage never was late until they did this they are unprofessional and I cannot stand this company

Mr. Cooper incompetence

This company is horrible. They recently assumed my mortgage from a real bank. The mortgage has never been late, not even a day. It has come out electronically for years on the same day, right on time, never bouncing, never rejected, etc. Yet Nationstar subjected me to a barrage of personal and electronic robo calls. It was relentless and they were calling me at work, in meetings, at dinner - basically at all the time. And for no reason. I called back and complained regularly and would get "we'll stop calling when you get your payment in." Upon checking, they always already had my payment. Another problem is that you simply cannot get anyone competent on the phone with them to resolve any issue. Months ago, I paid my homeowners insurance myself, in advance, to a new company. I kept calling NS to tell them not to pay again on the old policy, but they did anyway, and now it has been doubled paid. No one from the insurance or escrow department has ever returned a single call or online submission. A month too late, I got a letter basically saying "too late, your problem now."
I suggest two things if you have a serious problem with Nationstar. One, contact the Bailey Glasser law firm and let them know you found online where they were suing this company over illegitimate fees and ask them if you have a case with your problem. Be prepared to provide as much of your complaint to them in writing. (BTW, I work with trial firms but don't know or have any connect to these guys - just googled "suing Nationstar mortgage" and found them). The second is to start recording all of your calls with the company. Many cell phones will allow you to do this. Note that you need to let them know you are recording the call at the beginning of the call (law varies from state to state) for it to be admissible.
Hopefully this helps. I think mortgage companies like this are going to be subject to class action litigation for years to come for the the things found on this site (especially the whistleblower stuff). If they are not, then it's a crime and shame on our legal and financial system.

Mr. Cooper horrible, thieves, liars, crooks!

Me and my wife have just gotten a letter in the mail that our loan was sold to nation star mortgage. And soon as everything was done all hell broke lose on the the very next week. We get harrased with default and pink slips left in the mail for forclosure notices and we always pay on time. What the hell is going on.We call and they say disgard the letter.Huh? you tell me that I am in default and don't worry about it. Liars. My loan stays the same after I citi mortgage sold my loan to them. I never had problems with citi. Never! These people do not know what they are doing and they tried to get me to modify my loan. I told them no I am staying with the contract I have. So they add money on to my loan calling it a accessment fee I said what! Then they say they will not pay my homeowners insurance because they do not want to. I said it is in my contract that I pay it together. They refused and added the insurance on top of my mortgage and then said I was behind because I have to pay that up front! I said that is what I am paying the mortgage for. What they hell is wrong with this company. They are horendous! Its always something every month and my wife makes sure she keeps every payment cause she sends it with a money order. So they can't say she did not send it cause its in the money order with the stub. I feel for people who do not keep records they will screw you.So I am praying we get out of this loan cause they are horrible. I mean horrible! Never knew they were this bad. I knew it when they sent the modification loan. I am glad we did not do it cause they were trying to bait us in saying we can lower you loan. As soon as you sign that thing they will default you and sell your home. Cause then they will say you have not paid them and make rediculous money appear on your loan for nothing to make you pay it.And if you can't they sell your home. This is rediculous people. I hope they get what is coming to them. They are the dirties loan company I ever known and heard of.If you got a complaint board with this many people just think when someone not saying what they are doing.Never ending headaches every month it's something new! I hate! this company! HATE THEM! THIEVES AND CROOKS TAKING PEOPLE HOMES STEALING THERE HARD EARNED MONEY! GOD IS WATCHING YOU ! BELIEVE THAT WHAT DONE IN THE DARK WILL COME TO THE LIGHT!

We have worked on many successful loan modification cases v. NationStar. However, it is not easy. You must challenge the validity of the debt to increase leverage on your case. You also need to file the necessary Federal and State level agency complaints to stop the foreclosure process. Battling NationStar is a tough task to handle solo...we can definitely help those in need of help. Please see our success stories at http://thefreshstartfirm.com/success-stories or call 877.297.7011 for more information.

NationStar Mortgage is the worst company anyone could have a loan with. me an my family feel on hard times and applied for a modification to only find out the modification only helped with one of the loans, regardless that we have two loans with the same company. When we decided the modification wouldn't help us we begin recieving letters about a Deed of Lieu. The Deed of Lieu would give us cash for the keys to our home, all of that was a big Lie. We started working with a representive in April of 2013 and was told a tiltle of the home need to be secured before they could preceed, every week I either called or emailed my represenative and was told a few documents needed to be sent in, with in a few days I sent in what ever was asked, hoping this would help with the process. Well it did't because they really had no intentions of helping us but instead taking our home right from under us. In the mist of working with the Deed in Lieu they allowed our house to go into foreclosure and was told by a manger of Nationstar that me nor my husband did not need to call their company any more, but yet they call us and we chose not to answer. From April to July we did all that was aked an on July 16th our house went in forclose. This company deceives people, lies and has no intention of helping them . Best advise stay clear of Nationstar Mortgage.

Mr. Cooper I do NOT trust

My mortgage was bought by Aurora Loan Services from Sovereign Bank a few months ago. I pay my monthly mortgage online at the company's website. My mortgage is paid on the day due, since that is the day I am paid, and is directly debited from my bank account. However, Aurora has sent me a statement showing me as two months late. When I finally got a human being in the Customer Service department, the representative claimed that my payments were made after the cutoff time for the day, 7:00p.m. Mountain time, which means that I would be making my payments after 9:00p.m. my time. I certainly do not pay bills in the late evening! So far, the company hasn't tried to report me to the credit rating agencies for making late payments, but I do NOT trust Aurora!

If you are in any postion to refinance I would try that. I unfortunately went through a bankruptcy a year ago and cannot refi at this time. I wish now we would have put our house in the bankruptcy. The stress Aurora has caused me is just about unbearable. I am at my wits end.

Mr. Cooper refinance

Nationstar called me out of the blue, offering a refi at a half percent lower than what I was at, 30 yr. fixed, etc. Very skeptical at first but finally felt comfortable after going through the process with them. Paid for the appraisal, non-refundable of course. Appraisal comes in at $20k less than what's needed to secure the loan...Of course it did! Now I'm out $400 without a new, lower mortgage. I believe Nationstar defrauded me in that they called & wanted my refi loan business and they should have or know more information on the estimated value of the home. They put me through the whole process only to pull the rug out at the end, with no new mortgage and no savings. I had no choice in who the appraiser would be, Nationstar chose for me. Are they working together...? Nationstar says they receive nothing from the appraisal fee, yet I'm thinking differently... Amazing that my value comes in at $20k less than what's needed, so close! It's not like I expected $500k when the value was $250k. I know the market is rough, but I know my home is worth more than what the wonderful appraiser marked it as. $20k difference! I think Nationstar should provide me a refund for all of this nightmare. I think they do reap a benefit from the appraisal as Nationstar wouldn't just call & offer a mortgage out of the goodness of their heart! No business, especially a mortgage lender does that! Sad thing is like most Americans, our mortgage companies have us bent over the counter & are doing whatever it is they please with us, and we have no say or recourse. BEWARE of Nationstar & their schemes!

Nationstar Mortgage called me to see if I would like to refinance for a fixed rate in April 2007. I agreed and paid them $350 for the apprasail which was done. I called them for an update and Chris at Nationstar told me everything was good and I good miss my April payment and start in May. May came and I never received my appraisal and I called NationStar, they said they didn't know anything about it and I guess your out of $350. They reported me to the three credit agencies as delinquent and it has ruined my credit.

I have been trying to refinance since August 20th, 2012 after NationStar called me. I have been set up to close 4 different times now & everytime they cancel for a different excuse. After I played relay station between title co and NationStar I can tell that the company has no idea what they are doing. I am getting away from NationStar ASAP!

I too have been trying to refinance through Nationstar...and the appraisal came back lower than my house is worth. I have since canceled the refinance but I, too am out of about $400.00. I would love to get in on a class action suit. They make it almost impossible to refinance. The information the ask for is way more than I had to have to build my home. Thank you for you story. I got out ...but I'm $400.00 poorer.

I had the same experience with Nationstar but they have not pull the rug out from under me yet. They have, however, been stringing me along since Dec. 2010. It is now April 23, 2011 and we are to close on Mon. 4/25 or Tues. 4/26. At this point and after reading about others problems with this mortgage company, I am afraid to proceed with Nationstar, if we actually get as far as the closing. I will definately read every word in the fine print before signing.

Mr. Cooper foreclosue/modification

My husband and I built our dream home in August 2007. We had the home financed with CitiMortgage. First our loan officer was very shady she told us when we prequalified that our pmt would be $1100 per month. The payment amount was perfect for our family however, after the house had been built on the land we already owned we went to closing only to find out that the rate was not locked in and we were now going to have a $1580 house payment. The amount was way out of our budget. Needless to say we moved in and were never able to sale our old house. We contacted the Citi Mortgage about 12 months into the loan and advised them that we were really struggling to make ends meet and needed to refinance. They pulled our credit and told us that the debt to income ratio would not allow us to get a new loan and thus no lower pmt/ interest rate. The agent did however tell me that I could apply for a loan modification. We applied and it was approved. The modification was great for the first 12 months but now my pmt's are back up to $1500+. We continued to make the $1200 pmt because that was all we could afford. My husband spoke with someone in customer service and let them know that when we did our taxes and he got his bonus he would send extra money. In January our mortgage was sold to Nationstar and I came home Tuesday to a letter in my mailbox that states my home is in forclosure. I immediatly picked up the phone and called Nationstar. The representaive I spoke with told me that the last 2 pmts had not been applied to my account they were in a holding account when I asked why he couldn't explain only saying that I needed to send in $9700. I told the man that my husband had spoke with someone and set up a pmt arrangement and the man said he saw no note of that. I asked the man why my money was in a holding account again and he told me that I needed to either send the $9700 in before April 4th or be out of the house. I again told the man I didn't have the money and he told me that they would be sending me a check for the two pmts I made that were in the holding account and hung up. I called the next morning and made an appointment with an attorney because we have no choice other than to file Bankruptcy. I don't know if this will save our home or if we will be out on the streets but I do know that there was a lot of shady lenders and brokers out there during the housing boom. I feel that we were taken advantage of and I have never been able to enjoy my home. I am now having to up root my children out of the only home they have ever really know and possibly move. This has been a very hard week for my family and I fault myself for signing the documents that led to this but I also fault this company. There are more that a hundred homes for sale in the community I live and 25% of those are foreclosures. I just don't understand why these company aren't willing to lower the interest rates and adjust pmts so that we can stay in our homes and they still get their money back plus a large profit. FIGHT THESE PRACTICES!

I fully understand what you are going through. My husband and I are going through the same thing with NationStar. We were with Morequity for 10 years, and in Feburary, I too came home to a letter in my mailbox, that our mortage is with NationStar. We qualified with Making Homes affordable with our orgianl leander, but now with NationStar, our 3 month trial payment went for $1500 to $2200. When we speak to NationStar, we get differnet stories...(it says that they record conversation, they need to review them)! Now they want to do a Deed In Liau, and I have appraisers calling me. I want to fight and save my home. This is my childrens home and their security. I really wish there was help out there for us. It has been very difficult. Best Wishes to you and your family.

Mr. Cooper breach of contract

Had loan modification with Sun Trust since May 2010, loan sold to Nation Star December 2010. Nation Star claims to have no knowledge of modification even after I have faxed them copies of my original mod. Was told to reapply, have done so and was told that my payment will be $3, 222.10 up from the payment of $1, 687.73. When we first applied in May, my wife was working, she has not worked since October due to health issues. When I asked how our modification could go up so much, I was told that they had to include my wife's income because if and when she goes back to work that will be income she is making. I have been told to just make my three months payments as a act of good faith, and that it doesn't mean that is what my permanent payment will be. My net income is only $3, 900.00 a month for five people there is no way I can afford that. They kept and cashed (1) payment then sent (1) payment back because it was insufficent to cover delinquency. I have never been notified by mail or phone about any delinquency. I have been given four different auction dates in three months. I work monday through friday which leaves my wife who has health problems to deal with these people. It doesn't seem like any one can help, I have contacted the Attorney General, my congressmen, and everyone else that I can think of. We the taxpayors have spent trillions of dollars to bail these companies out and we get nothing in return, except the heartache and the bill.

I have placed a complaint with the MI atty. generals office against NAtionstar. The problem I have is similiar to yours. They are well know for escrow issues. ( I was told that by Fannie Mae - on another complaint.) I also suggest contacting TARP people. The more complaints the more investigation gets done. The Atty general is required to response to any inquires. Just an FYI

Mr. Cooper deed

My complaint is pretty much the same as everyone else's .. about the incompetency of the employees to resolve problems. I went through the trial payment program for a loss mitigation option. Like the others, I was told at first that it was to be a 6 months trial payment. I kept calling in after the 6 months and was told they didn't have any records of my paperwork or some reason like that. Oh, they had my income and expenses info incorrectly too and insisted that I had given it to them but when I asked them for a detailed of what they had, noone could provide it. At any rate, I started the trial payment program again and it must gone on for more than a year or so until someone was willing to escalate it for final processing. My loan was modified but in the process, Nationstar Mortgage had apparently recorded a SPECIAL WARRANTY DEED before they finalized my loan mod, conveying the title to the investor, FNMA. This was done without me knowing anything about it until I started inquiring in Dec 2010 about my property taxes and why I had to pay more from my escrow acct, yet, the property value went down. Come to find out, because of the Special Warranty Deed recording a couple of years ago, the county no longer can give me my homestead exemption as a homeowner/occupied principal residence. I have been going back and forth with Nationstar.. with the supervisor of the Escrow/Insurance Dept and they kept insisting they had never done a deed change. I asked FNMA for assistance but was sent back to Nationstar. Finally, on my last call (last month, I think), they told me to have my attorney contact them and they were no longer going to talk to me. I sent them an email, requesting some docs and it hasn't been responded too.. it's been a month now. Oh, I forgot to mention, I had to obtain a copy of the Special Warranty Deed from the county's website and sent to Nationstar to prove they did sign and recorded the change with the County.

I'm needing some help as to how I can go about taking them to court myself as I don't have the money to hire an attorny and/or I'm willing to cooperate in a class action lawsuit.

Please contact me.

Thanks.

Hello Michelle and Lisa,

While I am sorry for the abuse that you both have suffered at the hands of Nationstar, it is not surprising as we have the unfortunate pleasure of dealing with Nationstar on a daily, if not hourly, basis for our clients that have experienced the same or similar mortgage servicing issues that you have stated in your valid complaints to include CFPB violations for payments not being promptly and properly credited, restricted dual-tracking, fair review process, no runarounds, notification of foreclosure alternatives and most importantly; unfair, deceptive and abusive acts and practices (UDAAP). Can I say that there are multiple consumer rights violations under Federal law that I found in your complaints and I am on a mission to educate consumers on their consumer rights.

I routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks like Bank of America, Chase, Citi and Wells Fargo that are "too big to fail" but yet don't appreciate the bailout that we provided in their time of need. The debt collectors like ASC, SPS, SLS, Green Tree, Bayview, Caliber, Ocwen and Nationstar are simply just piranhas but they can be beat at their own game too just like the big banks can be defeated.

It pains me that you have fallen victim to the illegal, unfair, deceptive and abusive acts and practices of Nationstar but I commend you for seeking help; too often homeowners do not fight for their consumer and constitutional rights! With that said, you have overlooked a key aspect to your fight, which is putting it in writing in the form of a proper QWR and submitting a formal complaint to the FTC or CFPB for immediate response; it’s sad that it takes regulatory muscle to affect change but it is true. My firm routinely seeks out complaints online so that we can educate as to how to fight back on our weekday show called "The Daily Complaint" where we review a complaint and how to tackle it successfully.

We reviewed your complaints on the show today if you would like to listen, visit www.TheDailyComplaint.com.

Let me point out that Nationstar has violated your rights under the "Strong Protections for Struggling Borrowers" section of the CFPB's new mortgage servicing rules as afforded you under the CFPB and Dodd-Frank Act. Here is a link to the CFPB's new mortgage servicing rules http://www.consumerfinance.gov/newsroom/consumer-financial-protection-bureau-rules-establish-strong-protections-for-homeowners-facing-foreclosure/

In the event you have further questions, you can contact me via email at Dana@ConsultingEND.com or via the website at www.ConsultingEND.com or via phone (my full contact information is below) as I would be more than happy to contact Nationstar on your behalf or with you to determine the status of your loan as well as what options exist for you as a borrower/homeowner...free of charge to you!

Every new beginning comes from some other beginning's END
