My 5 ton heat pump condenser quit cooling and I contacted Cinch for repairs the first of July 2026. They dispatched a technician which report the compressor was out and was obsolete and also the freon type was being phased out and it would have to be replaced. Remember this was in July and I live in Texas. Not only that I made sure they knew it was a emergency repair I a lung cancer survivor with 1/3 of my lung removed and both me and my wife are 76 and copd. Later a week or so they send another technician which told us the same thing outdoor temp reaching 111. I contacted Cinch ask what was going on and they said they had to send another technician to verify what the other two had reported. Long story short July 30th I received the following email "I spoke with the owner and the technician who was onsite, as well as the other service providers who were dispatched to your home. First, I want to apologize for the multiple reassignments and the inconvenience this has caused.
The system you have is a Pioneer communicating system, and unfortunately, none of the service provides within our network are able to service or replace this type of unit.
I reviewed the terms and conditions of your service agreement and confirmed that your HVAC contract benefit (cap limit) is $5,000. The cost to repair or replace your system exceeds this amount. To avoid any further delays, we have processed your maximum contract benefit of $5,000.
Your check has been processed and will be shipped overnight via FedEx to the property address on file:" The next day I received another email saying for all my problems they were sending $350 so I could purchase some relief. Anyway I call a local service company and had unit replaced at the cost of $12,500. I contacted Cinch and requested the difference in the amount of $7,500 because they also had to replace the evaporator also to match the new condensers freon type. They refused to pay and said since I cash the $5,000 check the case is closed. They keep calling my evaporator a furnace which yes, it is in the winter but a a/c component during the summer and it was their techs that said it had to be replaced also. Again, moving on I sent Cinch a Intent to Sue and have filed all court paperwork too the County Clerk. So my advice to you don't let them bully you get what you paid for.

Claimed loss: $7,500 and 30 days of complete Hell

Desired outcome: I'm suing for out-of-pocket cost and health indangerment.
