O'donovan et al. V. Cashcall, inc.
United states district court, northern district of california - case number c 08-03174-mej
Case type: consumer class action
Status: class action complaint filed october 10, 2008

On october 10, 2008, the sturdevant law firm filed a class-action lawsuit on behalf of cashcall borrowers in the united states district court for the northern district of california. The lawsuit filed by krista o’donovan and eduardo de la torre accuses defendant cashcall, inc. Of engaging in predatory lending by making loans to consumers at exorbitantly high and unconscionable rates, without regard to the borrowers ability to repay the loan. Additionally, plaintiffs allege that the high interest rates, oppressive loan terms, and protracted repayment time make it impossible for most consumers to pay off their loans within any reasonable time period.

The lawsuit also challenges cashcall’s aggressive and abusive debt collection practices, which include making frequent and repeated harassing telephone calls to consumer’s residence and places of employment, as well as revealing personal financial information to third parties.

THE INTREST RATES THEYARE CHARGING ARE OUTRAGEOUS AND NEED TO BE LOWERED TO A REASONABLE RATE. PEOPLE THAT ARE TRYING TO PAY THEIR LONE WILL BE PAYING THERE LONES SIX TIMES OVER FOR THE NEXT SEVERAL YEARS.

I borrowed $2600.00. I've paid one year and nine months of payments totaling to $3897.90. My balance is now $2416.14 and only $183.86 went to the principal. I refuse to give them any more money. What should I expect that they will do to me?

I have contacted several sites to get more insight into why cash call harrasse and overcharge for loan. The statement of paying of rates sooner to reduce interest does not seem to apply. I had they stop ACH my bank account several times during a two week period, costing me over a hundred dollars, plus they charge me or NSF $30 each time. I have a total of $4oo dollars fees. Please contact me to be part of this lawsuit.

I have a loan with cash call and I told them not to take money out of my account which i didn't authorize, but yet they still took money out. I borrowed $2, 000.00 and I have already paid back $7, 000.00 something. This has to be illegal! If there is a lawsuit I would like to be apart of it. Someone please contact me. I need to know what I can do. This just seems criminal to me. E-mail [email protected]

    It would be great appreciated

I want to be apart of the law suit. I just finished paying my loan with cash call. When I first took out the loan with them they told me that the 99% interest rate did not apply to me and it would only apply if the loan was not paid in a year, but they immediately started charging me the 99% rate. When I confronted them they denied every saying that. My e-mail is [email protected]

I needed this money to help pay my daugther's rent who was out of state and unemployed at the time. It took quite some time for my to obtain the loan because my computer would not allow me to process the information. I finally went to a pulic school there was a fire wall I still could not, to may a longer story short the money was finally forward to my account. After paying the loan for a period of time I decided to call Cash Call and find out my balance when they quoted the amount I ask how coukd this be possible they told me to read the contract I never receive a contract. The amonut the quoted was far more than the amount i received. I know how a payday loan work and I was told that this was not the same. On September 24, 2010 I have been summoned to court. The Cook County Sheriffs served me on the job a 10:57p.m. I was told that I had guest in the lobby when I saw the sheriffs I became weak because I just knew that something had happen to a family member. They should have served me at home I'm there all day. If there is a lawsuit please include me.

I took out a loan with Cash Call in 2007 for 5.000 dollars and they automatically withdraw 254.00 out of my account every month with the basis of that going to intrest i will not be finished paying them off until 2014 and if the funds are not available they try to go withdraw the funds again then charge a 15.00 fee. It is a sick disgrace to pray off inocent people who get caught up in bad situation with these easy no collateral loans. They also call you up and treat you as if you are *** if the funds are unavailable don't they relize if people had money they wouldn't of borrowed in the first place. They should be stopped or at least have another way of billing for the loans

I applied for this loan since 2005 and they told me the balance is still $4000. I couldnt believe it at all. I recieve a bill and have it to pay by the 15th. during the grace period between the 1st and 15th, they are constantly calling me all day at home, few times that i have called myjob. they even have the nerve to call the operator to track me at my job. I couldnt believe. In fact they called on april 1st that morning. I am being frustrated with Cash call. they are dirty. They even took my mother to court and that ruined her credit. I amnot sure if it is not late to add me to the lawsuit. Please contact me [email protected] they need to stop call and harassing at my house. I have until the 15th to pay it. Usually the bill comes in, the bill company doesn't call you unless the payment was overlook but Cash Call calls me nonstop from 1st thru 15th. What the hell. I stand that company. How dare they put iton advertisingon the tv commerical. this is a damn rip off

This company is heartless. I borrowed $2500.00 8 months ago, been paying $300.00 a month through an automatic bank draft they required me to set up, my current balance is now over $2900.00. I call the get a one week extension and was harrassed with many questions, even after I answered those questions they kept on. I told them my husband died, they wanted to know when he died, how did I make last months payment, how much money I was going to get paid friday, what am i using my money for, I told them car payment, they kept asking well what are you going to do with the rest of your money. On and on, all I asked was for a weeks extension, then the next day I talked to a supervisor LORENA WELCH, because I wanted to change from bank draft to moneygram. I was on the phone for 15 mintutes with her asking me personal and harrasssing questions.
Don't deal with this company. I have paid $2400.00 so far on a $2500.00 loan and my balance is over $2900.00 now.

I am going throuhg the same thing with this horrible company. They have violated the terms of thier own contract which in essence means that I am no longer under any contractual obligation to pay them back. They constantly call and harass me on a daily basis. They are nothing more than loan sharks, con artists and ripoff bullies! Dont ever get a loan from these people they deceive you from the very start!
