I signed a deal with Amato Homes in April to close on July 16. The builder said the house was ready and we scheduled a walk-through for July 23. When we got there, we found out that the house was not finished. The trim, fireplace, paint, and porch/driveway were not done. The builder rushed to close even though the house was not finished. They accused us of delaying the closing and threatened to charge us $500 per day. We rescheduled the closing for August 13. We did another walk-through on August 11, and found out that the issues from the previous walk-through were still not fixed (paint and trim issues, fireplace, yard not graded, porch concrete is a mess). We told the builder about these issues, but they refused to fix anything. They said that we had our final walk-through a month ago, even though the house was not finished. They told us to either sign the closing papers or release the home. A new construction home should be free of defects, but we now have to make all the necessary corrections on our own.

I'm buyin' a house from Amato Homes in Parma Heights. Ain't moved in yet, but the drywall's up and there ain't no floorin' yet. The drywall mud ain't done and there ain't no paintin' done neither. We're closin' in a few weeks and we just found out that the house ain't gettin' the fireplace we was expectin'. The floor plan the sellin' agent sent us showed a fireplace in the livin' room, and the builder's website brochure for the property showed one too. I asked for the fireplace to be added in 'cause that's what the floor plan showed, but the sellin' agent said it's too late in the process to add one. They gave me the floor plan that showed a fireplace and I expect one to be installed in my home. I tried workin' with the broker and even left a voicemail with the builder, but nothin' yet. I just want what was promised in the floor plan. If they don't give it to me, I'll have to take 'em to court. I need help gettin' this resolved without goin' to court.
