Good day,

My name is Pauline Barkhuysen, I am a sales representative in Cape Town for Penmark Hospitality.

Penmark Hospitality is a linen supplier for the hospitality and other industries. If we do not manufacture the products ourselves, we source and buy them from different manufacturers or suppliers and sell them to our clients.

I received a request from my client for table clothes on 11th of November 2021.

As I tried sourcing this request from all over the country and couldn’t manage to get any manufacturers or suppliers to help me because they are busy with last orders that needs to go out before they close in December I was recommended to try and contact a company called B.V Hiring and Catering to see if they might be able to help me.

On the 15th of December 2021 I contacted BV Hiring & Catering via telephone asking the lady Ms. Beverley Weiss if they manufacture table Clothes and serviettes as I need a few for a customer of mine. She asked me if it is possible to send my request through on email at [protected]@telkomsa.net so I did at 09h43 after speaking with her on the phone.

Ms. Beverley Weiss never replied on my email.

After many attempts trying to get a supplier to help me in such a short time being the holidays and everyone closing for the holidays, I left it until all companies opened again.

On the 14th of January I followed up with Beverly again at BV Catering and Hiring on my email request I sent her on the 15th of December 2021, and she replied, saying she has tablecloths available, but not in all the colors I need and not in the napkins. So, my search went on after I concluded that there is a big shortage of material in the country and that my only option is to make use of the suppliers and manufacturers that can help me as my client is in desperate need of tablecloths.

On the 16th of February at 11h59 AM I contacted Ms. Beverley Weiss at BV Hiring & Catering again via What’s App as none of the other suppliers were able to help me. Asking her if she have stock available in table clothes or can make for me table clothes in Black, White and Beige in 3x3meters in rectangular shape at the price we have discussed in December 2021 and if she perhaps has samples available to show my client whom I have an appointment with on the 18th of February 2022.

She said that I am more that welcome to send my courier, she is willing to send me two tablecloths; one white and one black in 3x3 meters in Mini Mat material to show my client as that is all she can help me with and if my client is not happy with it, I can send it back to her.

On the 18th of February 2022 I went to my client to show them the samples that Ms. Beverley Weiss from VB Hiring & Catering send me, and they were very happy with it, and I did let Beverley know via What’s App Voice Note Message at 10h30 AM after I was at my client.

On the 22nd of February my client ordered 25 black Table Clothes 3x3 meters in Mini Mat Material that we ordered NEW from VB Hiring and Catering and paid for on the 22nd of February 2022 in full that was R5000,00 into their Nedbank Account. And I have sent back her white tablecloth with our courier, tracking number was: [protected]. She said I must keep the black tablecloth and she will then only send us 24 more so I send the black one also with the courier Tracking no.[protected] to be delivered to our Head Office in PE so that when the other 24units table clothes get delivered at our Head Office all must go through a quality check process before we send it out to our clients.

On the 25th of February 08h48 I followed up with Ms. Beverley Weiss again via What’s App asking her how far our order is so that we can send our courier to collect the order, she replied we can schedule collection on Monday the 28th of February 2022.

Marinda at our Dispatch Department only made the collection for the order to be collected at BV Hiring & Catering at address 27, Betsie Verwoerd St, Goodwood, Goodwood, Cape Town on the 1st of March to be delivered at our Head Office in PE at Address: Broad St, North End, Gqeberha (PE), 6001.

On the 2nd of March 2022 the delivery was done at our Head Office late afternoon.

On the 3rd of March 2022 As our quality check department went through the items / table clothes they discovered that some of the tablecloths had burned ironing marks on them, some had holes in them and some had loose seams and were faded, all these 24 items/tablecloths were old used stock and not NEW once as we have ordered and paid for.

Marinda from our dispatch and quality check department at our Head Office informed me about this situation immediately to take up with the supplier VB Catering & Hiring and send me pictures and I mediately contacted Ms. Beverley Weiss at BV Catering and Hiring via What’s App Voice Note to inform her about this and send her pictures and that she must send her courier to come and collect the stock and send us new table clothes as this is unacceptable.

She Phoned me on the 3rd of March at 4h08 PM being very rude and keeps saying that the two tablecloths she sent me to show my client was new, and the more I tell her that it is not the one I have an issue about it is the 24 table clothes she sent us afterwards that is not new stock the more she goes on that is not her stock. She afterwards said she will refund us, but we will need to send it back and that is not how it works. If a supplier sends us faulty stock it is their responsibility to collect, it and replace it. She refuses to do so and after numerous emails, phone calls, and proof that was send to her from Marinda at our head office and me and our CEO Christine she just keeps on ignoring this situation. She even started to not take our calls and do not respond to any of our emails.

The last attempt I made to contact her was on March 16, 2022, at 08h46AM giving her one last chance to collect her old stock and to refund us as we had to make another plan to get our client stock. She said that they never signed a contract with us, but that is where she is wrong. We have proof of all our communication via email and What’s App messages that keeps them bound to the consumer's act.

Desired outcome: We want BV Catering & Hiring to come and collect their faulty stock at our head office at Penmark Hospitality and to refund us for all 25 Table clothes and the courier costs.
