Can't get all my stuff
Gatelys has filed for bankruptcy and the attorney handling the claim is Jeff Weinman, [protected]. The problem I am having is that Gatelys shipped my stuff, but since they owe White Moving and Storage they are the ones who have and will not release my stuff. So basically White Moving is stealing from me. This is my stuff. I paid for it and the issues that they have with Gatelys are not my fault or my problem and I should be entitled to the furniture I paid for and they are holding in storage. Anyone needing information on Gatelys is to check the website cob.uscourts.gov early next week (11/5/07) for further information.

Run Away! Run Away! Do not do business with this sham outfit. After six weeks of waiting I tried to call a real person. I was put on hold for over 45 minutes and then told someone would call me back. After two weeks without the call back, I called again. Same story. After the third attempt I gave up and had my credit card do a chargeback. All told, Gately's had my money for over three months (they charge your card on the day of the order) before I got a refund.
They should be shut down!

I ordered the Bowflex SelectTech Dumbbells with Chrome Stand on 08/18/06. To date, I have received the Bowflex Dumbbells but I have not received the chrome stand. I have received 3 separate ship dates for the chrome stand but only after I send e-mails asking for status. They (Gately) do not offer status unless prompted to do so. The last promised ship date given was 10/11/06. I sent an e-mail asking for status on 10/12/06 and still have not received an e-mail reply. I called Gatelys Shopping Network @ [protected] this morning (10/17/06). I finally talked to a "live" person 48 minutes after being placed on hold. She claims to have no status but will "research and get back to me".
I find it totally unacceptable that I was charged the total amount on the date I placed the order yet two months later I have still not received my total order nor any decent explanations.

On May 4, 2007 I placed an order for a $1300 dining set through designdining.com (part of Gately's Shopping Network). By late May I had still not received the set, though they charged my credit card for the full amount. I sent numerous emails to customer service, only to be told they were "investigating". It is now June 18 and the company has not responded to my last 2 emails. It is impossible to get a live person on the phone at the company. This company is a complete fraud!
BUYER BEWARE!..Gately's has filed for bankruptcy and is now operating new sites. DO NOT purchase from these sites! www.vitaclassica.com, www.hometanningsalon.com. Or any other site with the same design.
This company was run on poor business ethics and lies. They are crooks of the worst kind. If you have purchased from them before and still have not received your money back call 866.443.0867, this is a new number for their new sites. I suggest calling your credit card company and filing a charge back and possibly consulting a lawyer!
I ordered gym equipment from Gately's Ninth Street Gym store, I ordered it for my husband's birthday so I ordered it 5 weeks in advance. They charged my card and sent me an email saying that my order had been processed. Two weeks later still no confirmation that my order had been shipped. Five weeks pass and no present for my husband's birthday. So he ends up calling them to cancel the order. They cancel the order and tell him he is all set. Two weeks late I still do not see a credit to my account. So I call and have a conversation with someone after being on hold for 1 hour. He assures me that I will see a refund in 5-7 business days. He told me the reason I did not receive a refund right away was because someone forgot to process it. This is the email below:

Now everytime I try to call I get a message telling me that they are experiencing phone difficulties and to email all inquiries to customerservice@gatelys.com, which I have 4 times and have yet to hear back. It has almost been 3 months.
This company is a total hoax, they stole $240 from me, and I don't know how to get it back.
I ordered an elliptical trainer from Home Fitness Club (or Gately's Shopping Network) on August 20, 2007 and a month later, I have not received my product. My card was charged in full and I continue to get the run around from Gately's every time I contact them. It is impossible to get a live person on the phone or to leave them a message. I have filed a dispute with my credit card company and will be contacting the better business bureau.
After not receiving my futon bed and mattress (and noticing that my credit card had already been charged for the item) I called the company to inquirer the status of the shipment. After being on hold for 20 minutes on 4 different occasions and leaving a voice mail each time, I went to the website to cancel my order. I eventually talked to a person who informed me that the company was having difficulty with their distributor communicating with them. (I told them that they seemed to be having a hard time communicating with me.)
I canceled the order in person (the gately employee said he would remove the charge off of my credit card) and thru the website.
I received my credit card statement and did not see the credit to my account. I am left now with contacting my credit card company and disputing the charge.
This company took my Amex payment and never sent me trampoline pad. They even acknowledged the order on the phone and then hung up.
They are purely 100% rip off artists.
Ditto the above. ordered through NAtional Table Tennis and found Gateleys was behind the non-shipment, received the runaround and no order-- ever.
They are now up and running at vitaclassica.com. Same location, same people, same company.
I purchased a futon from the Futons Store on line on 9/10/2007 using my credit card. The amount I was charged was $619.99. On the 9/15, I decided to cancel the order. I called Gately's 1-800 number - that was a joke. I have called again and again repeatedly, I have tried emailing Gately's website, with NO RESPONSE. Are these people related to the Enron Corp?
No product, no money, and the run around!
I ordered some gym equipment from Gately's Shopping Network. The next day I received an email confirmation that my item had been shipped out that morning and I should expect my product in 4-6 weeks.
7 weeks later I called the company asking where my product was. I was told that they hadn't shipped out the equipment and would email me confirmation that it had been shipped out that afternoon. 2 days go by and no email confirmation. Irritated I call back. I was then told I could have a complete refund and that it would take 5-6 business days for my money to be refunded. 9 business days later and still no refund. Called them back and they acknowledged that the money had not gone through and put me on hold in order to work things out. I was assured that the money would be in my account the next day...

I have had a very similar experience. I ordered a piece of furniture last October and have never received it. My order went through one of Gately's affiliate websites: sleekspaces.com
The website is now disabled, and I have had no luck reaching them by phone. I am in the process of disputing the order through Bill-Me-Later, a third-party payment service. This sounds like the makings of a class-action suit!
So... my husband and I placed an order in April 2007 for 6 teak patio chairs. To this day, Nov 29, 2007, we do not have a complete order!?! One of the chairs was delivered damaged. They told us to take some pictures and email them. We did that. Then they said they would arrange for the broken chair to be picked up and that they would send a new chair. None of that ever happened. Also, we placed our order in April, got charged right away (almost $1300!), but did not receive the chairs until August!
This company is a joke, no wonder they have filed for bankruptcy. This is on their "Guarantee" page:

I guess we'll have to go to our credit card company and see what they can do for us. We'll definitely be filing a complaint with the Denver and CO business bureau.
I ordered some gym equipment online from Fitnessbob.com.This is a company that is part of the Gately's Shopping network. I was charged for the product immediately after ordering it, but never received the product. I tried SEVERAL tines to get up with Gately's and was givin a statement twice that I would receive my order in 7 days. After that, I was never able to get another response from them. I started to complain with the BBB and found that Gately's is no longer in good standing w/ the BBB b/c of outstanding and unresolved shipping issues. I also found a name and number on the BBB website to contact Gately's Bankruptcy lawyer! So I contacted the lawyer only to find out that Gately's filed bankruptcy BEFORE they took my order. Anyway, the secretary told me how to get the forms to file to get a refund (or try to) through the bankruptcy courts. But I took the easier way and just disputed the charge with by credit card company.
By the way, I searched online and found more reputable companies that carried my order, like target, wal-mart and Dick's sporting goods. Though they only carry them online, not in stores - at least they are somewhat trustworthy. Gately's is no longer running there website, but that doesn't necessarily mean that subsidiary (sp?) companies aren't running there's. So be cautious this Christmas season.
Scott here again... My thanks to Chase Bank Credit Card for quickly & professionally crediting my account $230. Chase will now go after Gately's bank for reimbursement.

I placed an order on 10/2/07.. they took my order and money immediately yet 5-1/2 weeks later still no product. There was no follow up with a delivery expectation email. I got a hold, finally, of a customer service rep 2+ weeks ago and she said the order should ship shortly. Well, still no order. I went back to the web site to check my order status and, not to my surprise, the web site is under development to better serve their customers so they say. I emailed customer service twice this week and still no reply. They state a follow up will come within 24 hours. Right. I called their tel. number several times and left messages and still no response. [protected] thought I would put that on here for everyone since I had a hard time finding it). I am currently on hold (15 minutes, glad I have a speaker phone) awaiting a customer service rep. Based off this complaint board I assume I am screwed and out of $230.00.
I assume this company is a scam. Can anyone recommend how to report this?

I also was screwed out of my product from Gately's, however I called my bank which is Bank of America. I filed an Electronic Funds Claim because I paid for my product with my debit card. They gave me permanent credit on my checking account while they researched Gately's. In the meantime I called Gately's and spoke with a lady there who said they filed for Bankruptcy in September 2007 and all the refunds that they were going to do, they have already processed. Anyhow, moral of the story, call your bank or credit card company and see what kind of protection they can offer you. I hope this helps!

I agree with everyone that we should contact our credit card companies and dispute the charges. I'm ok with a charge and communication but ordering something with no info and communication gong on 2 months is ridiculous. This is a problem for more people than just us.
I always wondered how long it would take before I got burned on an internet order. Ordered a trash can on September 15th and still haven't seen it. Got one response that they would look into it and respond within 48 to 72 hours. Nothing after that. And what a scam with the phone number! Just sent another email request for a refund. I'll stop payment on my Visa tonight and hopefully they can put a stop to Gately's.
The same thing happened to me! We purchased Barstools at Barstoolhouse.com for $336 and have not received them! I called and left messages with about 4 of the people today and have canceled my card and filled a dispute with my credit card company. Do not buy from them!

I ordered 2 barstools that were supposed to ship in 2 to 4 weeks, after 4 weeks I emailed to ask about my order and they canceled it but never refunded my order. I have the email documentation but no satisfaction. The phone number is no longer a working number and the email site is "down". Guess I got ripped off! Buyer beware!
I ordered a Janis Sleigh Bed for $299.99 last 10/08/07 at bedroomking.com and got an email confirmation the next day. They got my money (visa) on 10/11/07.
Last Monday, 10/22/07, I called the office at [protected] and spoke with a gentleman regarding the status of my order. I told him that I'm so disappointed and wanted to cancel my order. How come no one has answered my email. But he said, "We have to wait for the company to give us the confirmation of the shipping, then we will email you. You will be receiving another/ second email today or tomorrow." When asked if it is sure, he said,"Yes". I told him that I will give it another chance, that I would wait for that email, but if not, then I will cancel my order. When asked what his name was, he said,"MY LAST NAME IS SLIDER, I'm the only Slider in here". He even spell out his name. But the email that he said didn't come. I again called the office but no one was answering. I tried opening the website several times, but it wouldn't open. Today, 10/29/07, I called again and the same thing happened. No one was there to answer the call.
It is very frustrating!
I agree this company is a scam. It took two months but Visa took care of it and reversed the charges for me.
You are not a creditor, but their merchant processing company is. Get your money back from the credit card company via chargeback.
I'm a Gately's dupe, and one of those who placed my order and had email contact with them well after they declared bankruptcy on 9/17/07. I placed my order on 10/7/07, and they confirmed it and took my money (debit card, alas) the same day. I got their email on 10/23/07 responding to my query about where my order got to, since the "tracking" they still offered at the time couldn't find the merchandise. They said they'd be sending it out in 7-10 days from then. Like most of you, there were more emails from me (no response) and calls to them (on hold 20 minutes then told they couldn't take the call after all), after which I chose an employee from their proffered phone list (hitting keys until a name came up) and left a message on his voice mail. No call back, of course.
I followed the link provided by someone else on this site, and I got all the information about Gately's bankruptcy proceedings. There's going to be a creditors' meeting on December 13, 2017, at 11:00 AM at the U.S. Custom House, 721 19th St., Room 125, Denver, CO 80202. I certainly can't make it there, but I am going to send a letter to the Bankruptcy Court and put myself on the list of creditors.
The Bankruptcy Court's notice states that the debtor (Gately's) has a stay against collections or other actions for 30 days or more. It also has this entry:
Do Not File a Proof of Claim at This Time
There does not appear to be any property available to the trustee to pay creditors. You therefore should not file a proof of claim at this time. If it later appears that assets are available to pay creditors, you will be sent another notice telling you that you may file a proof of claim, and telling you the deadline for filing your proof of claim. If this notice is mailed to a creditor at a foreign address, the creditor may file a motion requesting the court to extend the deadline.
This is why I'm going to write to the court. I may not be able to have financial recourse at this time, but I want to have every opportunity that I can to do so. It won't be a "proof of claim"; I will merely try to put myself on the list.
I will also be sending a copy of my letter to Gately's attorney.

I didn't lose that much, but I think there have to be as many claims as possible against Gately's to make sure they can't try to do business again.

I purchased a piece of dining room furniture from GATELY's. When ever I tried to contact them via their toll-free number, I received a recording that the phone lines were down. As an alternative, I sent an email, only to receive a generic response from GATELY's that my order would be shipped within 7-10 days and that they would send me a notice once it is shipped. Well, nothing has ever been shipped and I am stuck to deal with my credit card provider's risk management department. It amazes me that VISA, MASTERCARD, etc would maintain a relationship with a company with such a bogus operation. I can't count the number of complaints that I have read about this company from people, just like me, who were scammed.
Hopefully, if you are reading this note, that you are not one of GATELY's victims.
