it's a scam. this guy is pro'ly calling from india. you can do as much as you can do about a nigerian scammer - not much. but an air horn works magic. next time he calls just blow it on the phone. these indians are the latest nigerian scammers on the block.

ordinarily $40 is ok. but these scammers don't stop there, they keep pushing to see if you are a soft target from whom they can extract more and more $$$. so what you needed to do is attach the money order copy to the $40 bill and mail it to them as proof it was cleared with a cease and desist letter.
btw did you check with your bank if they had passed on this bouncy fee to these scammers? or will the bank come later and tell you that you have never paid the fee?

The onus to prove the debt is on them, not on you. By demanding debt payment proof they are fishing and hoping you don't have and you will panic and pay. Write them and request for proof of debt per the Fair debt collection practices act. They have 30days to comply. Failure of which you send then send them a cease and desist letter (Google those). Then lodge a dispute with the C/B. After it's resolved freeze your credit report, about $10 i think. Finally do you have any documentation about the loan forgiveness? Can you re-request it? Even after you get it you can still play hard ball with them-don't give it to them. Even if they sue you no problem. Just show up in court with it. Then sue them if they disregard your cease and desist letters/if they violate the Federal law. Have fun with it!

BTW these crooks are in india and beyond legal reach so you really can't sue them. so the best thing to do is get yourself an air horn. once you get the call just blow it on the phone. it seems to work very well and no one will be calling you back, they need the other ear intact you know.
You can do a couple of things. If they were calling for x and you are y but they won't believe it tell them your phone is out of bounds for them else you are going to blow an air horn on their ear. and really carry out the threat.

Dude I shop at home depot, pay with my debit card and I hate debt collectors! It's $12 bucks just pay it and get rid of it. It's a waste of time writing about $12 here. I am sorry you lost money. But this case is being prosecuted currently, don't you know this? We invented google but don't use it and our ubiquitous news outlets hardly bother to tell us what is largely happening around us i.e. in other countries and sometimes in other states. No wonder they take advantage of us. I have never heard of Nigerians losing thousands of nairas to americans but it's always the other way round.
This is a scam. I hope you cancelled your debit card immediately upon realizing you've been had, on the phone before you even made time to go the bank. If you haven't and they realize you have outed them they will attempt to clean your checking acct, and you better believe it they will. Secondly stop applying for payday loans online - that's how they get all your info. Perhaps stop it all together, those are predatory lenders anyway. Thirdly, how in the world do you pay some debt you don't owe? And paying with western union was not a big enough red flag for you?
