LCM Property Management - The Shiloh HOA terminated management with LCM in December

The Shiloh HOA terminated management with LCM in December. Their last day of management was December 31,2019. Per our agreement with LCM, section 2.4, para 4 "Upon termination of this agreement...all records and property of the association held by agent, should be turned over within 30 days of termination..." This would call for all documents to be received by 01/31. Our new management company has made numerous attempts to get these documents. They have reported LCM to be be "unresponsive" and "uncooperative", they have never seen such a poor transition. On 03/25, an email was received from our management company stating that the flash drive of documents was on the desk of ***, but due to COVID-19 closures, the office was close and the documents couldn't be send. Since the documents are on a flash drive, there is indication that they should be able to be remotely accessed and that digital copies are available. LCM does after-all, fall under an "essential" business and therefore should be prepared to provide services. On 04/28, a board member spoke with the receptionist at LCM since as of 04/27, offices were allowed to have 50% of their personnel present. The receptionist informed the board member that the managers had always had access to the office, even during the COVID-19 stay at home order. As of 04/28, none of the documents have been turned over. We do not understand why they will not provide our documents/records, they are the property of the association and not LCM. It would appear that they are retaliating against our HOA or that there is another reason to withhold the documents.
