My house was built by Duri Homes in 2020 as part of the *** development. I got the house in August with a single contract for the house, garden landscaping, and a boundary fence. The lot next to me was empty until *** started building in April . They asked me if they could dig onto my property, which meant they had to remove the fence and disrupt the landscaping. They promised to restore my property once they finished. In September 2022, they realized that the grading between the two houses was incorrect. Both builders say they followed the grade slip provided by the developer and want me to fix the issue before they can put my fence back. I talked to two people from the *** who told me about BYLAW *** (***). It says that builders must get an as-is grade certificate within 12 months of occupation. Duri Homes admitted they didn't do this for their customers because it's not mandatory. But it is mandatory, and there's a fine of up to $10,000 if not followed!
