Duri Homes My house was built by Duri Homes in 2020 as part of a new housing project

My house was built by Duri Homes in 2020 as part of a new housing project. I got the house in August with a single contract for the house, garden landscaping, and a boundary fence. The lot next to me was empty until another builder started construction in April . They asked me if they could dig onto my property, which meant removing the fence and disrupting the landscaping. They promised to restore my property once finished. In September 2022, they found the grading between the two houses was incorrect. Both builders claim they followed the provided grade slip and want me to resolve the issue before reinstalling my fence. I spoke with two representatives from the housing project who informed me about a local bylaw. This bylaw states that builders must obtain an as-is grade certificate within 12 months of occupation. Duri Homes admitted they didn't secure this for their customers, claiming it wasn't mandatory. However, it is indeed mandatory, with a potential fine of up to $10,000 for non-compliance.
