After 13 years of ownership and $8400 worth of payments, Silverleaf foreclosed on my timeshare. For the past 5 years Silverleaf has been trying to get me and my ex-husband to upgrade on our current deed because under the new management we have much more benefits than the new owners. They have tried many tactics to get us to upgrade so when I fell behind on the maintenance dues by $200 they took the opportunity to foreclose. Also, upon my divorce to my husband the Court awarded me the timeshare and Silverleaf told me that I had to get a sealed and certified Divorce Decree to prove my ownership solely. I did as they asked and drove over 100 miles to take the document and once I got there they said no that's not sufficient and I had to turn around and drive back to Dallas. Since they did not remove Shawn as owner he should have been the one who was served with the paperwork for the foreclosure but he had no idea what occurred until I informed him. I spoke with the legal dept at Silverleaf who asked me if I had the $200 to pay which I told her I did; Bobbie (her name) told me that she would call me back and give me the information which she never did. What she did do was just send me a copy of the foreclosure letter. I'd like to sue them and would like to know what document to file. I will do research myself as I am a graduated Paralegal with over 5 years of experience and education. I
wanted to file here as well. Please help, I will be truly grateful.

My fiance and I bought into Silverleaf, we tried calling and canceling the contract but they would not respond. When they finally returned my call, I was told it was passed the date. Plus they did not receive the correct information for cancellation. Now my husband and I cannot buy a home because of silverleaf. We hired a company called resort relief to fight but they have yet to defeat silverleaf. I don't think it's fair that silverleaf can ripoff so many people and get by with it. Now my husband and I have to live in rent houses because no one will finance us.

I would also like info on a law suit - they told us they filed foreclosure and it's on our credit as such BUT nothing was filed with the courts in the county of Galveston TX where the property is located. I think it's a scam but it is royally screwing us now that we are trying to buy a home. sharris1229@yahoo.com

Hello Laura & T. Herrera.

I too have been a victim of foreclosure. I have been notified that Silver Leaf has a new management company and after only acquiring the original contract as point of contact, they were unable to reach me or my wife to advise of backed payments and foreclosure. They say there is nothing to do at this point because the unit has been sold. The original contract had old contact information and they were unable to reach us to let us know. I set up a auto draft back in October but it didn't go thru, therefore payments weren't being made. after not being able to get a hold of us for 2 months they filed for foreclosure and they said the court decided their case. We weren't even served since they sent their letter as certified, and we were never home to get it or sign for it. Seems very convenient that they would file for foreclosure over 2 months of maintenance fees because we had just finished paying for the balance of the deed.

I too, have been the victim of foreclosure. I was behind in payments and made 3 of the 4 requested payments. As the fourth payment didn't make it. They sold my week 8 days after a missed payment. I am sick that this happened. I have been paying on that unit for 16 years. I would be happy to join any class action suit against this company. I also was told there was nothing I could do. I am looking for a lawyer to at least get a comparable unit back. T. Herrera [protected]

You didn't have to drive. Just fax...and yes if you are in foreclosure, then ask for paperwork...they are only going to send you foreclosure paperwork.
