refinance scam
Received notice from citi to refinance my 5/1 arm into a fixed rate in early Sept. 2009. After working with their represenative, and being assured that it would be approved on our second home in Texas, I gave them the $470 for an appraisal to start the process. After getting the appraisal and with credit scores of over 800, I was advised that they had turned down the refinance on a judgement call. I feel the real reason was the reduced revenue and the $470 should be refunded. They said sorry but it is our call and nothing could be done. I think they are misleading customers only to keep their employees and apprasers working.

Since February, I applied for Mortgage Assistance with Citimortgage to get a mortgage lower due to being divorce and having to paid the mortgage, car notes, bills, and insurance on my own and not getting behind just to save money. Had to wait for five months to see if a got approved.
I had to call Loss Migitation department several times to find out what was going on and who was handling my loan mofication if I was approved or not. I did get a letter in April saying I was denied and called Citi for reason for denial. They said to ignore the letter and they were still working on my account. I finally called at the end of June and they told me I was approved for a Modification trial plan. They told me to pay mortgage for $907 which was less than mine usual $973 note and I did not have to until September. Then I got another call saying I will get paperwork sent by UPS for fill out paperwork for Modification, but payment was just $720 and was not due until September. I'd explain I was told to pay the $907 instead of $720 in July instead for September. The representative on the phone said that was OK and that will cover August payment and only have to paid on second installment for $553 due to overpayment. I did fill out the necessary paperwork and made the payments on time and had October payment for $720 ready before trial period ends.
But something did not seem right with getting collection calls and collection notice in the mail back on September 14th. I called Citimortgage about why I'm getting collection calls if I am on Trial Modification plan? The reps told me not to worry and ignore them since I was on the Modification plan. I was getting my account handled by different reps. The last person handling my account only left voicemail on my home phone instead of calling on my cell phone like the last rep contacted me.
I left voicemail that same day, but he did not call my cell phone. I called the next morning before I left the house to take my kids to school before I went to work. I told him I left him a voicemail about getting misleading information from another rep who took my call since he was out of office or away from desk. He I was denied by the underwriters but I then said it was a error and was working to correct this. I told him I call him when I arrive at my job. I called him back and got the usual voicemail. I called again asking for his manager to explained I was not satisfied with service and runaround I was getting from Citi handling my mortgage. He did call me back and explain he can put modification plan that will make me more money over a thousand dollars? I said that was increasing my bill even worse than $973 I was paying every month. He tried to that was including real estate escrow taxes and insurance I was paying separately at the beginning of the year and I was not satisfied that I was denied while on trial period have not ended before I made my last payment. We started arguing that I wanted I speak to his manager. His manager was just repeating the same excuses without explaining how they can help me? It was like I did not pay them anything the last three months and the payments did not go to my mortgage?
I called collections two hours later. I rep first told me not to worry regarding the late payments should be posted on my account since I was on the modification trial plan. Then he said numbers he was seeing was not matching what I recieved in July for only $720? I told him who I talk to and now I said change from correcting this or he could not do anything? I feel that they messed up my payments I was making on time since 2007. Right now I going to check with attorney dealing mortgage problems and show them the paperwork and payments I made to Citi to just to lower my mortgage, not to mess me up more with late charges and increased payments?!

You must consider a shortsale most people do not realise that the bank does not care about the homeowner and there are millions of boiler room scams offering loan mods popping up every day . Out of 4 million homeowners facing foreclosure only 135, 000 have been helped thru a modification, companies are no longer allowed to charge for modifications so anyone offering their services at a price is a scam . I suggest talking to a licensed real estate agent about your case.

i had same problem with citimortgage. I was first put in a trial program. also was told that i would be send letters by mail . I did not get anything. making my payments and recieving letters still showing as if i havent applied to mortgage program. after 2 payments i stopped maikng payments and first i recieved a mail saying i was denied. I called them ask for the initial papaers they had to send never came and if you have the intention to take my home i would try to keep money to myself. I was told by rep that this waws a system error and i was still in program, then 3 days later i recieved a email from citimortgage that i was approved for modification and would recieve paper work within 5-7 days. after that email i immediatly made payment also tolked with representative. I called 2 weeks later because i didnt get anything in mail. I get the answer that i was denied. I asked how does thinks change in 2 weeks no answer. itried to aply with bank directly but i guess the games played in this area is more than i can imagine. would tolk with a lawyer. if anyone has a stiuation like that and can email ayazoglu_78@hotmail.com i apriatate it.

Please listen to me if citimortgage is stealing, harrassing and abusing you and you family, I can tell you how to fix the problem, very easily..
We need to stick together and create accountablity in this company called citimortgage... They are hurting us all in the us and we have to stop it.. Please just do these simple steps and we will as a unit stop this company from abusing another customer...

In your subject line write something like "help" "please can you help us", etc.
Ask for help, tell them what is destroying you and your family from the inside out..
The problem in full detail with some feelings but no swearing or too much hatred.. Because higher up people won't listen to that stuff... But, please put your feelings in and what this company has done to you and your family in detail..
Again ask for help, put the mortgage number in at the end of your letter again..

We received an email stating we had a balance over 2000. The current months dues plus 1000 from last month. We had sent them 2 money order for the month previous over two weeks ago. So, my fiancee called and asked them what was going on and they told him that their machine only takes out one check at a time from the envelope? My fiancee asks them where the other check is then and they say I don't know, could be anywhere even though we have sent our payments in this way for over 7 months with no problems! Ok so, then we look at putting a stop pay on the check and we call them back and they said well if it went to Urbandale it should be fine (just another example that no one has any clue what they are doing). We tell them um ya we have a copy of the fedex airbill and that's where it went. So they tell us well, you might need to see if it was cashed because it could have been applied to another account-even though our full name and account number was clearly on the front. So, we call the bank where the money order was drafted and they tell us the check was cashed. Now we have to pay for another money order to send to the bank then they will send us a copy of the check front and back. Of course Citimortgage is taking no responsibility for any of this and now we are having to jump through hoops because of their incompetence. I am so mad about this and cannot believe what idiots they have running this place. Not to mention their customer service, well they have absolutely none! I agree with everyone, this company is horrible and I cannot believe they are still in business.
I have been paying on time and sudenly my statement shows delinquency fees. I called and told me that that due to late payments in 2004 that they never applied to my account. A rep Ms. Tesa gave an ID number 8702 which I believe is bogus treated me very disrespectfuly and hanged the phone on me, told me that I have to pay the delinquecy fees even when she was unable to explain to me why they were posted to my account. For the last few month they have been taking my monthly payments holding them for up to 2 months and applying them to the delinqunecy fees created by them holding the payments. As a shareholder of Citi I feel ashamed of been part of this company and the way they treat the customers.
I got sick and got behind on my mortgage with citimortgage. I paid the ENTIRE amount due (3 pmts.) on the 16th of April( the third payment was for the month of April). On the 19th I got turned over to foreclosure AFTER I WAS PAID IN FULL. I called Citimortgage and was told that even though I made the payment on the 16th and GOT confirmation of payment, the payment hadn't actually processed until the afternoon of the 19th and that by that time they had already filed for foreclosure.
Now If I don't pay the attorneys fees they will continue foreclosure Even though I am currently paid to date.
Well folks there seems to be a number of us. What are we going to do?
The exact same for me too. 18 months of stressful insanity. For six months I have paid HAM payments and listened to Citi agents tell me my documentation is incomplete ( I have provided it in triplicate, with proof). The only reason it is incomplete is because of thier incompetence. The only modifications Citi gives is when the homeowner owes way more then the home is worth. If there is any equity or possibility of Citi getting their money back, they will sabotage your modification, take your home, keep the payments you made, and get a nice tax advantage on the forclosure as well!. They are doing it to me! The same day they told me on the phone " your account is in review...don't worry the forclosure is on hold while the account is in review", is the same day they posted the 'Notice of Trustees Sale on my do0r! I am a single father with two kids, no help, and 20 days left.

The exact same thing has happened to us out here in California. Our mortgage is 2349.07 per month our mod payment was $1899.55. I paid all trial payments on time with lasted from June to Nov. They then said you don't qualify for the h.am.p mod but we can qualify you for the in house mod. We made those payments on time as well. Now, they said you don't qualify for any modification and you are behind 2 payments. I asked how and they came up with some crazy story. I am still paying my original payment of 2349.07 current this month. We received a notice of default saying we are still behind the two payments and foreclosure proceeding will begin 5/31/10 if we don't pay the 2 payments that they say are behind. We are so frustrated! I didn't know they can do that!
Oh my GOD, it sounds exactly like my story except I applied for a mortgage modification in June making all my payments through Jan, seven months on time and the amount they requested which was 134.00 less than my regular amt. then was told that my modification was denide in Dec.and now they tell me that I owe three months in arreas over 4, 000.00 my account is delinquent which means that my credit is ruined after owning my home for 16, years and maybe lose my home. I am at wits end I'm going to the main branch tomorrow 01-16, -09 to see if somehow I can talk to someone or should I say BEGGG... someone to look into ny account and give me back my dignity, credit, and possibly my home.
Citimortgage is absolutely the worse company I have ever dealt with and there is no question in my mind that they are ripping all of us off as consumers. Read the numerous complaints about Citimortgage on consumeraffairs.com. I applied for the Hardship Assistance Program last March (2009), but prior to doing this, I had good credit and had been laid off from my job due to my company downsizing and eventually folding. I accepted a less paying job and have been depleting money from my 401K and my savings to make ends meet in order to keep my home. It has been nothing but horror in dealing with Citimortgage in getting paperwork processed and receiving harassing calls that I never should have received because their departments do not communicate with them. I can go on and on about the rudeness and complete incompetency of this company in dealing with any department within their company in numerous offices in different states. They lost 3 faxes and misplaced over 10 pieces of paperwork from original documents that were fed-exed off to them that I had to fax or scan to them "immediately" many times. I have owned my home in Orlando since 1995, and I received a phone call from one of their offices in Arizona to call them back right away at 8pm eastern time last night (Dec. 20, 2009). I was not at my phone when they called and immediately called them when a family member told me my phone had rung and I heard a voice message from "John" with Citimortgage in an Arizona office to call back ASAP because they needed more documentation for the final process of my hardship assistance loan. I need to state that I hadn't heard from them since October, 18, 2009, and I was in the "final stage" of being processed as of the October 18, 2009 date. I was also informed that I would know something in no more than 2 weeks from that date of Oct. 18, 2009. I was given a 3 trial payment period for the new "supposed" loan modification from them and made the requested payments for October and November. The phone call I received tonight from "John" who is in the HAM (Hardship Assstance Mortgage Department) in that Arizona office informed me that they needed paperwork, which again, was not even a part of my loan process. I explained this again, for the 20th time (this is an accurate number) to "John", who asked me to hold while I explained that I had sent in all necessary documents requested via a scanner to email from my accountant about a business I opened and am making sufficient money for expenses. "John" told me that I was correct and that the they had made another mistake in not looking at my documents thoroughly enough. "John" informed me that he would request the underwriting team (Now I've transformed myself from the tears to calmness in knowing that they are totally inefficient, uncaring, and I now have ruined credit that will take me years to get repaired.). However, I was told on Oct. 18, 2009 that they needed proof of my self - employement earnings and expenses ASAP and that this information could not wait. I paid my accountant to help me expedite what Citimortgage needed "right away" in October only to receive another phone call last night (Dec. 20, 2009) stating that they needed more information that had nothing to do with my present employment situation. They had "misread" my file and case again, and that it would not be longer than a week for me to know if I would be "approved" or "not approved". I didn't lose my temper but went into a bit of tears of frustration again and told "John" that I needed to know what was going on before the end of this month and that I couldn't take anymore of Citimortgage's incompetence of not doing what they have been promising to do from their side. "John" told me that I had "his word" that he would get right on top of it and ask the underwriters to please look at their mistake in not seeing the 9 pages of documents that were drawn up from my CPA that were in my file from Oct. 18 and that this is Citimortgage's fault in this "oversight". How could this be an oversight? "John" also asked me to please understand that they had tons of loans to process and that errors can occur. Now, it is to the point that their countless errors of my over 100 calls of holding from departments from Maryland, California, Texas, Missouri, and there are a few other states and time zones that I haven't mentioned because I don't have my "War and Peace" documentation about my dealings with Citimortgage in front of me as I am writing this. I will make my third payment to Citimortgage in this "trial period" and if I am denied, I read on the consumeraffairs.com complaints from other Citimortgage consumers that legal action works against Citimortgage along with reading about a person who wrote to one of their senators in their states in their horror of dealing with Citimortgage. I am calmed down now at this point and will write the senators and legislatures in Florida, our governor, and I will send a letter to President Obama about this also. This is what seems to work, in my opinion, because like you and countless others who are dealing with Citimortgage, we aren't getting processed and they don't care. I don't read or hear of people getting help with their mortgages from this company. People are losing more homes and are sending in information to Citimortgage, but they aren't doing their part in processing it correctly, and again, they don't care! This company received one of the largest "bailouts" to help us and they rudely deal with us, put us on hold, give us wrong answers and then get our hopes regenerated only to find out that the information we fax, scan, email and directly mail ends up lost or not added to our files and / or the information is "overlooked" or "misread incorrectly". Citimortgage is not abiding by a direct order of President Obama in helping us. I'm not even beyond suing them for all of the emotional and psychological mistreatment they have done to me in addition to owing me a great sum of money for large cell phone hours with them and ruining my credit. Fight these ###s who are taking our money again after being "bailed out". I would like to hear from any success stories that anyone has had from fighting this monster of a company. I have gone through painstaking efforts to get my mortgage paid on time since Citimortgage bought my mortgage form LaSalle Bank (now called Bank of America).
For years I simply went to LaSalle Bank and paid my mortgage on the 15th or 16th (or the following Monday if the 16 landed on a Saturday or Sunday) since I got paid on the 15th.
Citimortgage informed me that there is no physical location that I can pay my mortgage within 173 miles of my home. I can't mail my mortgage because it must get paid after the 15th, but before the 16th which is the last day I can pay my mortgage on time. For several months I was forced to call in my mortgage for a $20 fee.
In order to stop these $20 fees the Bank of America branch manager helped me set up an account that receives my mortgage payment from my employer's direct deposit on the 15th and automatically wires my mortgage payment to Citimortgage on the 16th. In August, September and October of 2008 my Bank of America account wired my mortgage payment on time, however Citimortgage shows that my payments were received one day late and added a $57. 87 late charge each time.
After meeting several times with the branch manager at Bank of America to establish the exact time that the mortgage payment is wired to Citimortgage, it was determined that my mortgage payment was wired to Citibank before 3AM on the last day I could pay my mortgage in time. However, it turns out that Citimortgage needs time to acknowledge the wire transfer and always receives it one day later. After spending hours talking with Bank of America and Citimortgage customer service no one could come up with a way that I could pay my mortgage on time.
A coworker suggested that my mortgage be direct deposited directly from my employer. I spoke with Citimortgage customer service and they said it is possible to do this and gave me the routing number, citimortgage account number and other required information to do this. This will get the mortgage payment to Citimortgage on the 15th (one day earlier) and hopefully will be acknowledged by Citimortgage on the 16th and on time. My mortgage will be payed this way starting November 15, 2008.
At the request of a Citimortgage customer service representative, I faxed a this information to have the 3 late fees removed. I just got their response today that they will not remove the late fees so I am going to have to cough up another $173. 61 and possibly more if my new method of payment isn't satisfactory to Citimortgage.

I am his new wife I have 3 people interestes in buying the house now since may and no one will listen to us. Now my husband has passed away so I am your only source of info. I have poa over all assets. flood insurance scam
I have mailed proof of Flood Insurance for our Condo in Boulder to CitiMortgage Inc Insurance Center, Box 7706, Springfield, OH [protected] on four separate occasions since our former policy expired in early June 09. The flood insurance policy is also available on-line. In spite of this, Citi has taken out Flood Insurance on the property. We received the most recent demand today, August 15th. Citi has never answered any of our communications. This is clearly a scam to intimidate and harass the motgage holder. The mortgage covers only 20% of the value of the property and we assume Citimortgage would like us to pay off the loan. As a shareholder of Citibank, I am at a loss as to why this Company would try to alienate a client paying 8% interest.

I have the same exact problem. My insurance is 3 x's the value of my loan. The problem I had...Original loan papers only required me to insure the value of the loan...but after winding up at Citi after the loan being sold on two previous occasions, they demanded the full amount allowed by FLood Insurance program or the value of the home.
This was and is not located on my loan papers...HOW DOES THIS HAPPEN TO HONEST CITIZENS who pay their mortgages? BECAUSE OUR LOANS ARE OWNED BY THE FEDERAL GOVERNMENT...FREDY/FANNY

In the last 3 years citi mortgage has been an absolute nightmare to deal with. In the last segment of the disaster to get a Home Modification approval we finally got a huge package to fill out and send back with a timeline of 4 days to complete. I did so and was very excited about the lowered payment and gathered every thing requested. After contacting the company Citi hired to handle this to see if everything is ok and if they need anything else I was told each time they need this, they need that, they did not get this... so and so forth. Stalling tactics. Only do I find out if I call. We never get any info unless we call. Hours upon hours spent on phone and nothing ever gets done. Then, the last straw came today, when I called citi they told me to disreguard the payment they agreeed on for us that is must be an error and our new payment will be such and such. About $700.00 more than the agreed amount THEY sent us. I am so devasted I cant function today. We need help from the GOv!

All of these Citimortgage HAM complaints are legit! I have been dealing with Citimortgage since the program began last year (over a year) and still have not been accepted. Just recently, they said that I was $5.00 over the limit and didn't qualify. After I got layed off from work and started to receive unemployment. ... they said that I still didn't qualify.
Citimortgage is so dishonest to work with... I will not get another mortgage with them in the future!
i sympathize with all of posts. I began the ham (home assistance modification program) in May 09. After sending in every document, paying every bill, and calling repeatedly, I got absolutely nowhere. In fact, I ended up worse off than when i began the process.
When I started, I was current on my payments. I had taken in a roommate to make ends meet. I had good credit and a tiny bit of savings in my account. Still, my job cut my pay and I had a super bad loan (10 years interest only @ nearly 7% interest rate).
On March 15, I checked my account online. A message read "Your account is in the final stages of review. We expect to approve your modification in three business days." I phoned on March 19th and discover that my modification had been denied.
The denial was rough enough. But, on top of that, I now 0we $20k for the reduced payments that I made while on the trial period, my credit score dropped more than 50 points and I have NO recourse. Plus, since I am still behind on payments and now have bad credit I can't even b e considered for a refinance with another company.
On top of all of this, the Citimortgage rep that I spoke with recommended that I put my home on the market as a short sale.
DO NOT DO THIS PROGRAM!
I have just received at least the fourth request to send documents to CitiMorgage. They are also asking for documents that do not even exist center as the tax records for 2009. I have tried to call there on several occasions and there is no answer. I also received a letter from CitiMorgage not the ham program, saying that I was in forbearance in foreclosure was eminent. I have made my monthly payments timely and I have done it a electronic flight so there is a document trail showing that. When I called them and they said all year in the modification program just disregard the letter there sent out by computers. I don't know who to call about this horrendous mess or whom to write. I don't know if the congresspeople or the secretary in Washington would do any good. I am just so frustrated and ticked off that consumers are getting shafted this way. If I was on Wall Street I could get a bonus for this ignorant behavior.
My husband lost his job 10-08 due to the economy. We were not late on our mortgage or any of our bills. We were being proactive in March 2009 when we applied for our Mortgage Modification. It has been a nightmare. I just got off the phone with them, after sendin documents by fax and mail six times, they are requesting them again! Our credit which was excellent has taken a dive even though we were assured in the beginning that our credit would not be effected. I am not sure what to do that this point. I know people that don't care about their credit that now has better credit scores than us. I am so upset.
I can't even begin to say how frustrated I am. I have been in this process since February 2009! 2 programs...of course after I completed the first one they said this one is no longer active I had to start another one! I completed the second program in November '09 and finally receive my final modification letter today (1/13/10). And guess what they did for us! Our mortgage has been reduced by $227 per month and my principle balance is now $9100 more than when I started. I have 5 late payments on my credit report and the mortgage is still more than we can afford. I have done everything I was suppose to. Sent in documents multiple times, made every payment on time and it has gotten us nowhere but further in debt. I have no idea what to do now. Maybe if I would have done what people who don't give a crap do and just not pay my mortgage, save my money, live in my house for free and wait for them to kick me out We'd be better off now! Thanks!
this is true .i provided citimortgage with all documentation 4 times certified mail and faxed -i kept track of it and they still say they never got it and sent me a letter stating help would be canceled under the hamp program if they did not receive, -i wrote my senator, congressman, attorney general and made complaints citimortgage.i kept the pressue on till i was too weak mentally to continue-these people are ###! i believe they do not want to participate in this it is costing them billions.there customer service (before their dropped calls, mistatements, and lies w/names ), were all carefully documented -i have a file of over 200 pages since my ordeal started-not until you hound the ### out of them -call them on their own mistakes, record and document everything do you even have less than half a chance to get loan mod completed that you qualify by law.everyone keep the pressure on complaincomplain complain to every government entity-most of complaints can be done on line.
I have been trying to get a modification since March 09. When working with them on my own they turned me down said I didn't have enough income. I got a HUD Counselor and 2 weeks after he contacted them I got my trial packet. It said pay this amount for 3 months then you are approved, well it's 6 months now and I get excuse after excuse. In November they said I don't have enough income, I corrected that, then they said they found something in my credit report, I confronted them on this and they said it was probably an error but the real reason is I need 9 months left on my unemployment, and they stated they want me to pay back all the money for the last 6 months ( the difference between the new and the old mortgage) but the letter they sent that said I was in default demanding payment did not even deduct what I had paid over the last 6 months.

its been a year now that I have been calling and trying programs for re modifiying my current home loan. I had the same experience. I complete the forms necessary as instructed, mail, fax and get no response until I hunt them down for an answer. Then the same thing happens, they say they need time to get back to me, are not clear if they received the paper work when I ask for a confirmation, months later get a denial letter. I wnet thru just about every program they rolled out, spoke with every tema they have, called all numbers and departments. I leanrned they pocketed all of our current and future tax dollars, the gov. loans or bailouts where not to help us, the primary home owner, and will only entend the help if your request is presented or represented legaly. This is done to retain the highest of the dollars and dispurse the least amount they can in order to stay afloat. I think the media should take my phone recordings and throw it back in their face for what they are doing to hard working and struggling american fathers like me and every other family or home owner out there going thru what they call hardship. I spoke with the HAT team for the HAM program, loss and litigation team, was assigned a councler without an extension, got the name Don Alexander but good luck getting in touch with the wiZard of Oz. I have sent in applications twice for hardship, given my hud for all the new tools as they roll them out for a over the phone approval, and get denied every request. They seem to find a excuse from any angle they can. I am up to 100+ pages of notes now, sent them everything but blood samples and sick to my sould as to what they are getting away with. The classic move & I know anyone who experiences this is going to get a chill down there back when I say this is "WAITING ON HOLD AFTER THE PHONE BLENDER & THEN THEY HANG UP ON YOU", THEM CALLING YOUR HOUSE TO SPEAK WITH YOU & HANGING UP ON YOU WHEN YOU ASK IF THEY CAN UPDATE YOU WITH YOUR CASE.
insurance check
After storm damage to my house, the insurance company made the settlement check out to me and the mortgage company. It was our understanding that we would endorse the check and send it to citimortgage, along with requested documents, and they would immediately send us a check for half the amount so we could begin repairs. Two weeks later we are still waiting for the check, and now they have informed us it will be made out to us and to the roofer. I explained to them that the roof is only one part of the damages. We need to money to pay for other repairs. The roof won't even be done for several weeks. We have already had electrical work done for over $3, 000. The electrician is still waiting for payment. We sent the invoice to citi, and they said they don't know why we sent it! We are also supposed to be reimbursed for tree cleanup for $500. We sent a statement on this and again, they act like they don't have to pay us. Very frustrating. We need a lot of other repairs done and they will not release the money! Who do I complain to?

in my situation, citibank allso told me I would get half of the 13000.00 + thousand. I sent in along with the indorsed check the estimates and paper work that I down loaded from there site. Now they want estimates on material cost to put my house back together, the cost to cleanup the storm damage.they were not interested in, this will need to be paid before I order any parts to fix my home.I will get them there estimates, but I need the check written out to me, not the bidder, I am quite capable of doing the work myself. would like to know if anyone ever got all of there money.looks like a lawyer to me.
escrow mishandling
This has got to be the worst and most incompetent mortgage company out there. I used to think it was Countrywide but perhaps their record has been topped. CitiMortgage, during the poor transition of my account from Countrywide, made duplicate payment of my insurance and tax payments after Countrywide had also paid and as a result, my escrow balance went into the negative. Rather than acknowledge and fix the error, they pointed fingers at Countrywide. They further compounded the problem by telling me they were going to base my 2009 tax payments on what was paid in 2008. How stupid! They said they were doing so b/c they did not have access to 2009 information. I've told them repeatedly that I have the information but they fail to consider it. I have since sent in $1481 for escrow and they have yet to appl;y it to the account, rather it is sitting in an "un-applied funds" pot. They have literally turned routine mortgaging into a nightmare.

I HAVE ALWAYS HAD EXCELLENT SERVICE FROM CITIMORTGAGE, BUT THIS IS NOT VERY GOOD AT ALL. THERE WAS NO NOTICE THAT THE CHECKS WERE COMING AT A LATER DATE. NO EXPLANATION ON THE WEBSITE OR ON MY ACCOUNT ON THE WEBSITE. YOUR CUSTOMERS DESERVE BETTER THAN THIS. I EXPECT BETTER THAN THIS. I DOUBT IF ANYONE WILL LET THE PUBLIC KNOW WHAT IS GOING ON, BUT IT WOULD BE NICE IF SOMONE WOULD LOOK INTO THIS. THANK YOU.
bi weekly and loan modification issues
Everything has been fine with CitiMortgage for years. We have had no issues for 6 years, of course, we have not had to deal with them over the phone in that time. The last month has been unbelievable though.
First off, we applied for the Bi-Weekly advantage plan. Three bi-weekly payments had been taken out, with $25 of the $300 initiation fee taken out of each installment, before we had received the first monthly statement from CitiMortgage. Only two of the installments had been entered into our CitiMortgage account, the third was still being held by FNC Insurance. We noticed the bi-weekly installments were nothing more than a third party company taking $200 extra per installment and paying the payment in full once a month with $400 extra towards the principle. We looked at this and thought, "why do we need to pay a company to do this for us?" I called CitiMortgage and they said they had nothing to do with this and I needed to contact FNC Insurance company (should have read the fine print which states it is a third party company). CitiMortgage provided the number. I called FNC Insurance and asked them to cancel my policy... The gentleman said no problem, and faxed me a "notice of cancellation" to sign and return to them. I also requested FNC Insurance company to return my third installment, which they were still holding. The same guy said, "no problem, just sign and return the "notice of cancellation" and we'll gladly return your money. I looked at the form and it clearly states "FNC Insurance Co. reserves the right to keep any fees not yet collected." I told the guy I would not sign this form unless I was guaranteed FNC Insurance Co. would not keep any of my third installment they were holding on to. I also asked for them to return the $75 of startup fees they had already collected because I did not want to keep the Bi-Weekly plan. The guy said to write up a complaint letter, sign it and fax it in and they would look over it. I wrote the complaint letter and faxed it in. I called back and the same guy said they looked over it and would be returning my payment in full, without the $75 of startup fees already accumulated because we were three installments into the plan. I agreed to this. He said all I needed to do is sign the "notice of cancellation" form, send it in and the check would be sent out immediately. I signed the form and wrote a note on the bottom stating "my signature does not authorize FNC Insurance Co. to take out any additional fees as previously agreed upon." I called back the next day and they stated the check had been mailed. I asked the amount and the rep stated it was $300 less than we had agreed upon. I spent the next 2 1/2 hours on the phone pleading my case to no avail before losing my temper and of course any hope of getting my $300 back.
A few days after this, I find out I have a 25% reduction in pay at work. A few days after this I have CitiMortgage calling me to find out where my monthly payment is. The one I am now scrambling to figure out how to pay. I tell the rep that I have all but $300 of the payment and they would have to contact FNC Insurance Co. for the rest of it. Of course this wouldn't happen with CitiMortgage because they have NO IDEA who this 3rd party company is and only refer to them as an "acquaintance." So now I'm out a monthly payment. Great.
I transfer to the Loan Modification Department to see if maybe I can get my payment reduced. The minimum federal requirement is 31% HTI ratio. I provide my newly adjusted income and find out by their calculations I am at 30.34% HTI and I don't qualify. I do my own calculations and find myself closer to the maximum, at 36.5%. I inquire as to why our calculations are different, the guy could not explain it. So I check a little more and find out his calculation works perfectly if you do not include the impound account. I let him know the federal qualifications include the impound account. He puts me on hold to talk to his supervisor, whom I am eventually transferred to. They state CitiMortgage DOES NOT include the impound account in their calculations and ARE NOT required to!
Oh, and I also tried to get my past due balance added on to the end of my loan and CitiMortgage DOES NOT IN ANY CASE allow this either.

Same just happened to us! We received a letter they are without notice canceling our biweekly plan! No refund ( yes we were stupid enough to pay a fee for to start up the biweekly plan!) I hate citimortgage and so do all the realtors I have spoke with . We called to ask why they cancelled the plan to an agent who I can hardly understand since she had issues speaking English! We asked for a refund to be told someone will get back to us! Yea right! When pigs fly!
Same here. After 6 years they cancelled my plan with no refund. When I asked when they were sending my refund back the woman, that maybe spoke English as her third language, once she understood me, asked if my contract said they would refund it if they cancelled it. I told her I didn't know but it did say they would provide a service they were no longer going to provide. So mad i could spit.
FNC insurance ageny contacted me through Citibank mortgage to enroll in biweekly payments. Wanting to pay my mortgage down quicker, i enrolled and paid a hefty enrollment fee. Two years later I am now being cancelled with no refund of my enrollment fee.

My mortgage lender is B of A and I'm going through a similar issue. Two years ago I refi'ed my home and at the time they offered me a Bi- weekly program with a one time fee. I paid the extra month in mortgage and I think a fee of 400 dollars. From time to time I called and checked to make sure this program was working. It sure was until last week I received a Payment Enrollment Form from B of A. I called the Rep at B of A and He tells me I have to re-enroll in the plan and pay an addition month mortgage with a $5 bi weekly fee. But why do I have to do this when I already paid the upfront fees over 2 years ago? He replied I never was on the Advanced Payment Plan. I was on a plan designed for people who could not afford their mortgage. Um, so maybe this is an error. So what happened to the extra mortgage I paid? REP: What extra months mortgage? What happened to the interest I saved by being on the program? Rep: What saved interest? What Advanced Payment Program? Sir, The program never existed! But if you would like to sign up for the program I can help you with that. All you need to do is pay Octobers mortgage now(sep. 1) and $4.90 in additional fees bi weekly. Me: Wait a sec. why would I do that again when I already did this two years ago? Wait a minute; earlier you said the program does not exist! Rep: Sir, there is no advanced Payment program. Me: [Click], [Click], [Click], [Click], [Click] - repeat! Now my head hurts so bad.
You should have never paid anyone to do a bi-weekly mortgage payment. You can do this yourself. You could have sent as little as $50 per month extra principal and reduced your mortgage yourself, with no out of pocket cost. When ever I see bi-weekly mortgage programs, that you actually have to pay to set up I think, are there really people this stupid that would pay to do this? Yes, there still is.

After years of medical and legal hardships resulting from brain injury that caused dementia, my children's father finally died on May 4th. Last September I knew that I would not be able to keep paying the mortgage payment which had been at a fixed rate of 7.4% for 2.5 years, "because you need to establish credit." This is what the corrupt mortgage broker had told me just before he was found guilty in a mortgage scam and fled for Australia. Yes, we're had a streak of bad luck. After one payment, Homecomings sold our loan to CitiMortgage. For more than 2 years I paid the high mortgage payment. Then in September 2008, I completed CitiMortgage's Hardship paperwork, requesting either a lowered interest rate or deferrment or forbearance. I was ignored. Between September and December, my written communications were ignored, my phone calls were not taken (or if taken, were passed off into oblivion = disconnected), and no one returned my voice messages. Finally, I got their attention by making a partial payment in December. They cashed the check, but have never applied that money to my loan. Immediately I began receiving harrassing phone calls and mail. I responded to every one with, "do you see that I completed the hardship paperwork in September? here is a copy..." I was never able to speak to the same person twice, and no one could find the paperwork even though I sent copy after copy to various people in various departments at CitiMortgage. In February, I finally got someone with at=uthority on the phone "Mary Zigler." She granted me what they called a forbearance, where I would make about half the prior payment for three months, and then be able to refinance. She said, "when you get the paperwork, you'll see that there is a lump sum payment in June. but don't worry, we'll roll that into the new loan." I complied with the "forbearance" terms, but during the next three months, I received constant harrassing phone calls and mail. When I'd call about the mail, they'd tell me it was an internal mistake and I should ignore it. Then a "free-lance" private invetsigator started trespassing on my property and the neighbor's property. He took photos of the house and my children. The beat up truck he drove had a removable license plate just thrown on the dash board. He did not ever come to the door to explain he was working for CitiMortgage, and he hid behind trees and fences. I called the police to file a report. They determined he was hired by Citi, but when I called Citi, the "supervisor" there denied it. The second time the investigator was sited photographing my house from the front lawn of my neighbor's home, I went over to my neighbor and told him. My neighbor came out and ran the guy off and told him not to come back or he'd file trespassing charges. On May 18th, I decided to be proactive and start requesting the refinance paperwork so that the ball could get rolling before mid June when the "lump sum" was due per the paperwork, but not due per Mary Zigler. I just didn't trust Citi. All of my mail and phone calls have been ignored since May 18th. I have filed complaints with supervisors at Citi and with consumer affairs and other agencies. I've received absolutely no communications from Citi. Two weeks ago I spoke with Citi rep who said that Mary Zigler was the only person who could help me. I was given her extension, and tried to call her 4 times in the past week. She doesn't return my phone calls. Last week I was contacted by an attorney who is suing Citi on behalf of 100's of their screwed-over clients. He asked if I wanted his help. I wasn't sure until today. This evening, while I was doing laundry on the lower level of our home, my children came running to me frightened out of their wits. We had propped the front door open to get some cool air in the house. A man "who looked like Elvis" walked into our home, univited and without my knowledge, spoke with my 11 year old daughter and gave her a crudely written note, written in both English and Spanish, which demanded that I call a phone number written on that note, but had no identifying information as to whom the note had come from. I ran outside just in time to see a man in a red sports car driving away. I believe that he saw me in the driveway, but he still drove away. I called the number on the note and reached CitiMortgage! I immediately asked for a supervisor and then told the supervisor what had happened and exactly how I feel about Citi's unprofessional, unethical and ILLEGAL business practices! I am a single mom with two young children. My kids' dad died just 10 weeks ago. Citi has been aware of our hardships for almost a year, and has not ignored my pleas for assistance (all I wanted was a 4.8% interest rate rather than 7.4%), but has actually been ruthless in obviously trying to take our home away from us. At this point, they won't even allow me to make payments. The Federal Government SHOULD NOT HAVE BAILED THEM OUT! Tax dollars have been wasted on this company which cannot and/or willnot do business ethically nor even professionally. Their representatives have shown consistent incompetence. The right hand of the company doesn't know (nor care) what the left hand is doing. They are devestating people's lives and the stability of our country by undermining homeownership.

Appellant will also prove to the court that all Appellants legal rights to his property were illegally taken away; although it was this Appellant who purchase the property in question; as no one including Appellant ex-wife was ever giving power of attorney over this Appellant, at any time, most importantly Appellant purchase the property in question by himself and only added his wife name to the documents regarding the note and the mortgage; while using his credit only; which is a matter of material fact.
In as much Appellant will also show to the court that both McElroy, Deutsch, Mulvaney & Carpenter in addition to Morris/Hardwick/and Schneider; Law Firm, and including Wittstadt, both law firms had full knowledge that this was an illegal foreclosure attempt, additionally both law firms used the powers of their office to assist their client in committing fraud against this Disable defendant; becoming partners in an illegal racketeering scam against this defenseless appellant as appellant has no legal counsel to protect him.
Appellant will also show that this Predatory mortgage was targeted towards Appellant base on Appellant race and his disability along with his education; in as well as his ability to retain counsel.
Additionally Appellant informs the court that appellant was hinder from defending himself when his motion to come out of this Rem Scire Facias action was denied; received by the Court on April 14, 2015 in as much as all of appellant documents submitted to the court was not address that included material facts.
Appellant will also provide evident to the Court proving Appellee has knowingly committed perjury in the SUPERIOR COURT OF THE STATE OF DELAWARE IN AND FOR NEW CASTLE COUNTY; When Appellee stated this this Appellant was not on the note to the home that he purchase, as appellant initials are a legal signature; which also was never address by the Superior Court; although Appellant brought this matter to the Court attention; in addition it is illegal to remove a spouses name from their mortgage in order to be granted a refinance; especially a spouse who was suffering from mental problems at the time of this refinance.
Appellant will also show that the SUPERIOR COURT OF THE STATE OF DELAWARE require this appellant to refinance his home while it was in a foreclosure matter; something, impossible to do, as no lender in the United States of America would consider this as an option while Appellee is seeking a Summary Judgement against the property.
Appellant will also show that the Superior court had to recognize that appellant was indeed on the note as per the Courts instruction to refinance the mortgage; as it is impossible to refinance a home if your name is not on the note.
Appellant will also show the court were the Honorable Judge herself hinder this Appellant from defending his position fully as there are only three defenses to a rem action; therefore denning this appellant request to move to a judicial court estoppel this Appellant from bring in key material facts; most of all as initials are a legal signature which bears this appellant mark on the note in question, and not for the reason stated by Appellee; to show appellant being aware of the matter.
Appellant will provide for the court evident of title fraud; as there is no title insurance on the property in question; although this Predatory mortgage listed it as being on the property; as title insurance protect both the buyer and the lender; which would have help this appellant with proper representation to defend appellant title against all encumbrance.
Appellant will also provide for the Court evident of appellant putting forth vigorous effort to prevent this illegal attempt to foreclose; as most of his communication to Appellee went unanswered, by Appellee and both of their racketeering attorneys law firms,
In their attempt to help their client steal the property in question; while appellant pleaded, with appellee and all of their attorney to communicate with him regarding problems with this predatory mortgage; as payment of this mortgage was never a problem for this Appellant, even offering to make rent payment until this matter could be rectified; however Appellee never gave this Appellant any rights to his mortgage or note from the beginning of this predatory refinance; nor would they communicate with Appellant even when appellant was making payments on his mortgage and note.
Appellant will show that as require by law, the appellee estoppel appellant from receiving his mandatory mediation as appellee went as far as to commit perjury in court as well as causing appellant and his children to be put out of their home for 8 months by the Family Court Judge; because, appellee illegally took all of his rights to his property away from him and stated to everyone that this appellant was not on the note to the property that appellant purchase by himself; additionally even if there was some fraud by this Appellant ex-wife committed against him, Appellee had no legal rights to remove this appellant from his note or mortgage as this appellant was the one whom purchase the property in question, so how did this appellant lose any of his rights to his note and mortgage.
The same Family Court Judge 8 months later, reverse his ruling, and granted appellant and his children all rights to the property in question; in addition to allowing this appellant to quick claim deed the property in hope that it will help keep the property from being foreclose upon.
Appellant will show that appellee and both of their racketeering attorneys law firms with criminal intent did everything they could do to prevent this appellant from receiving help from any were; most of all from the offices that the United States government has put in place to help prevent illegal foreclosure; as appellee did everything they could think of to keep this appellant quite, are in other words shut up while we take your home away from you and prevent you from defending yourself or position.
Appellant will show that the SUPERIOR COURT OF THE STATE OF DELAWARE did not properly address serious material facts brought to the Court attention by this appellant such as Racketeering allegations, Perjury, Sub contracting attorneys allegations; in addition, to damages done to appellant and his children due to the Perjury committed by Appellee and their attorneys; whom had full knowledge that this appellant was always on the note in question; but because appellant was not represented by counsel, appellee and their racketeering attorneys continue with this illegal attempt to foreclose on appellant property, as appellee’s attorneys used their knowledge of the law to assist their client CitiMortgage with another illegal foreclosure; while hindering this appellant from defending himself as appellees attorneys knew that material facts was indeed an issue.
Even after being advise by appellant to stop and review the note and all documents, as they were put on proper legal notice, that this action was an illegal attempt to foreclose on appellant and his children home; however because Appellant was not represented by counsel, these Racketeering attorneys continue to assist their client with this illegal foreclosure, therefore both McElroy, Deutsch, Mulvaney & Carpenter in addition to Morris/Hardwick/and Schneider; Law Firm, are both guilty of illegal racketeering, by using the powers of their office and abusing the trust they have been granted as officers of the court, in addition to being a legal law firm; whom both were issue power by the state of Delaware; as both law firms sold their office and its powers and repartition for illegal profits, in their attempt to assist appellee CitiMortgage in committing fraud and thief of appellant home.

They operates their title company, Land Castle Title, in title states. Management of the firm and title company is vested in the Managing Partner, Mark Wittstadt.
Illegal foreclosures can be beaten and put to an end by a few Pro Sa Appellant or John Q Public; but as per my experience; A lot of Judges do not give non attorneys victory’s over an establish Attorney, regardless, how good the Appellant prove their case; it is the justice system, though the means of it Racketeering attorneys who are supposed to be officers of the Court, whom are breaking the laws every day, these racketeering attorneys are giving innocent home owners like myself the problem not as much as the corrupt banks; as the Racketeering attorneys and their law firms are the ones whom are doing the final part of this illegal scam; assisting Appellee with their illegal foreclosures.

What do they care, these people have no one to represent them and have very limited knowledge of the law and the rules of the Courts; so, it’s easy money for the attorneys and the Banks; and by continuing allowing these corrupt Banks and their attorneys to file Non judicial Rem Action foreclosures motion to estoppel Appellants from defending themselves; allows the racketeering attorneys to used the Non Judicial rem Action as a means to keep the innocent home owner quite; as they help the banks steal innocent people home; as the Non judicial Rem Action foreclosures motion gives the racketeering attorneys an open door to continue committing these crimes against the poor and estoppel the innocent home owner from defending themselves.
Regardless’ of how many fines the United States Attorney General gets against these big banks like Citi mortgage, their profits over weigh their fines by one thousand percent, are more; as they are teaming up with Law Firms though out the United States to use their knowledge of the law against innocent home owners; henceforth the attorneys are racketeering partners with these corrupt banks and have never had to answer for their role in illegal foreclosures; until the Honorable Supreme Court accepted this Appellants appeal.
In the racketeering attorneys attempted to help their client Citi Mortgage get away with thief by deception, by use of force, in addition to filing a untrue Rem Action against appellant and appellant children home, ; it is important for appellant to inform the court that appellant, did reach out to others agency; for help; and most of all payment of this mortgage was never a problem for this appellant.
On March 24, 2014 Appellant attempted to file criminal charges against Appellee and their racketeering attorneys; Morris, Hardwick, Schneider; Appellant went to the U.S. District Attorney’s office at 1007 Orange Street in Wilmington, De 19801 Suite 700 and was told that Appellant would not be able to file criminal charges there, and was advise to file his criminal report at the New Castle County Court House; upon arriving there at the New Castle County Court House again, Appellant was told that he could not file these criminal charges at that location; and once again Appellant was advise to move on, this time to the Attorney General Fraud Dept., located at 820 North French St, Caravel State Building.
At first Appellant was told by the receptionist that Appellant could not file charges because Appellant was not an attorney and that he had to be an attorney in order to file a complaint; after refusing to accept this answer and explaining to the receptionist that he was a Pro Sa attorney, the receptionist finally allowed appellant to fill out a complaint statement received on March 24, 2014 by the Fraud & Consumer Protection Division; how is Appellant expected to win his case as a Pro Sa attorney when the scales of justice or unbalance; and the Pro Sa attorney is not giving the full benefits or the respect as a qualified attorney? I am sure as an attorney Appellant would have been settle this matter; but as a Pro SA attorney the deck is truly stack against me; it’s like me expecting help from the other team to win.
Appellant had little faith or confident that his complaint would be taken serious or even look at; as appellant explain to the Honorable M. Jane Brady Judge for the Superior Court for New Castle County 500 North King Street, Suite 10400 Wilmington, De [protected] whom was assign this case; (C.A. N13L-02-021MJB) and to this date Appellant have still not received any correspondent are assistance from the Attorney General office.
On April 2, 2014 Appellant filed a complaint with the OFFIC OF DISIPLINARY COUNSEL located at the Carvel State Office Building, 11th floor 820 North French Street, Wilmington, Delaware 19801, I received their reply dated May 5, 2014 in a nice way appellant was told to shut up, by the Bar, or they would make it worst for me if I bring this matter up again, as I stated above attorneys looks out for their own especially against a Pro Sa Attorney.
On March 31, 2014 I filed a Motion to change Plaintiff Rem Scire Facias Action, Motion From A Non-Judicial Hearing to A judicial Hearing; Case No.: N13L-02-021 MJB because plaintiff could not and has not proving that this mortgage was in default; additionally, they refuse to settle this matter as advise by the Honorable M. Jane Brady; Judge for the Superior Court for New Castle County on 3 to 4 different occasion though out this matter; however it was denied for some reason unclear to me, therefore, this decision hinders Appellant from defending himself against this Rem Scire Facias Action; as it estoppels appellant from bringing in key facts; since it is a non-judicial hearing, this decision has allow the scales of justice to remain unbalance and in flavor of Citi Mortgage and their Racketeering Attorneys; since appellant is not allowed to bring in any of his arguments, as there is only three defensive to a Rem Scire Facias Action.
Just as some police officers look out for each other it seems to be the same way in the court system; these attorneys are highly decorated; and know each other, and the judges (I am not accusing this Judge of any wrong doing in this matter as she have giving me more opportunity to get my affairs in order to move out of my home, then most judges would have) however you tell me where do John Q Public or a Pro Sa Appellant stand a chance against a system already purchase by the Banks with their wealth.
I have reached out to almost every organization for assistance but received none; most of all because appellee committed perjury and stated that this appellant was not no his own note to his home.
More Material Facts
. On April 13, 2005 doing a refinance; Plaintiff Charles Pickens and his now ex-wife executed and delivered to appellee and/or its assignors a Mortgage on the property known as 36 Osage Road, Claymont, Delaware 19703, Tax Parcel No. 06-070.00-109 (the Mortgage’’)
2. The Mortgage provides that upon the failure of the borrowers to pay when due any obligation of any portion thereof when due, the loan shall be in default and Plaintiff, upon thirty (30) days’ notice, may accelerate the sum secured by the Mortgage and may foreclose upon the mortgage property for the collection of the obligation together with the costs of suit and reasonable attorney’s fees plus any sum hereinafter expended in the preservation of the property and Defendant security.
3. Appellee has falsely accused Appellant Charles Pickens of being in default with this mortgage; when Appellant made every attempt to pay this mortgage and to rectified issues regarding this mortgage as payment of this mortgage was never a problem for this Appellant.
4. Additionally; Appellee and their former attorneys Lisa Hatfield; Managing Attorney, Christina Pross, and Chase Miller, all of MORRIS/HARDWICK/SCHNEIDER has committed prudery; and attempted fraud, against this appellant.
On November 14, 2013 Appellee stated in the Superior Court of Law that Appellant Charles Pickens was not on this note; however the note clearly shows Appellant mark/initials on the front page of the note provided to the court by Appellees own attorney’s; as their own exhibits; including on the Prepayment Rider to Note. Additionally, regarding the Mortgage itself section (D) provide information regarding the Note; were Appellant initials are clearly mark as being on the Note in question.
5. Since April 13, 2005 Appellee has violated this note/Mortgage against this Appellant and has denied this Appellant any and all right’s regarding his note; and his Mortgage including; refusing to communicate with this Appellant on behalf of his Mortgage; which Appellant was clearly entitled to. Appellee Citi mortgage was even advise four different times by the Superior Court Judge, Jane Brady; to settle this matter with this Appellant and Appellee still refused to do so; even after receiving an order, by a Superior Court Judge for the State of Delaware; to sit down with this Appellant and settle this matter; On December 19, 2013; There was no negotiation at all with this Appellant;. As a result, any damages that the Appellee are claiming are of their own doing and Appellant claims for damages are still continuing.
6. This predatory mortgage was targeted towards this Appellant base on his race and his disability; in addition to his limited education, on the record; and most importantly the lack of being able to attain counsel.
7. The reason Why Appellee Citi Mortgage refuse to give Appellant a Mortgage/Refinance after being a vise 4 different times to settle this matter by the Superior Court Judge; was because Appellant already had a Mortgage with Appellee Citi Mortgage, and Citi Mortgage with the help of their Racketeering attorneys did everything they could do to hide this information; including committing perjury in the court of law; although, Appellee Citi Mortgage has denied this fact for over 8 years to this Appellant, to the Courts, and to various offices that the United State Government has put in place to help prevent foreclosures against home owner’s; violating this Mortgage and this note from its beginning with this Appellant.
8. The Real Estate Settlement Procedures Act (RESPA) requires the servicer to acknowledge your request within 20 business days and to try to resolve the problem within 60 business days. Giving Appellant such right’s as to file a civil lawsuit against the servicer since the service violated the RESPA requirements.
The Fair Housing Act, 42 U.S.C. 3601 et seq., prohibits discrimination by direct providers of housing, such as landlords and real estate companies as well as other entities, such as municipalities, banks or other lending institutions and homeowners insurance companies whose discriminatory practices make housing unavailable to persons because of race or color religion sex national origin familial status, or disability.
In cases involving discrimination in mortgage loans or home improvement loans, the Department may file suit under both the Fair Housing Act and the Equal Credit Opportunity Act. Under the Fair Housing Act, the Department of Justice may bring lawsuits where there is reason to believe that a person or entity is engaged in a pattern or practice of discrimination or where a denial of rights to a group of persons raises an issue of general public importance. Where force or threat of force is used to deny or interfere with fair housing rights, the Department of Justice may institute criminal proceedings. The Fair Housing Act also provides procedures for handling individual complaints of discrimination. Individuals, who believe that they have been victims of an illegal housing practice, may file a complaint with the Department of Housing and Urban Development [HUD] or file their own lawsuit in federal or state court. The Department of Justice brings suits on behalf of individuals based on referrals from HUD.
Discrimination in Housing Based upon Disability; The Fair Housing Act prohibits discrimination on the basis of disability in all types of housing transactions. The Act defines persons with a disability to mean those individuals with mental or physical impairments that substantially limit one or more major life activities. The term mental or physical impairment may include conditions such as blindness, hearing impairment, mobility impairment, HIV infection, mental ###ation, alcoholism, drug addiction, chronic fatigue, learning disability, head injury, and mental illness. Appellant was made to feel like appellant only choice was to commit suicide as appellant stated to Appellee’s attorneys, Chase N. Miller; on November 15, 2013 while having a mental break down after the Summary judgment hearing; also several times to appellant therapist; in addition to calling the Delaware Help line number 211 were a operator there had to call appellant back several times; in the month of August of 2013 to make sure appellant would not harm himself; as appellant was willing to take his own life in order for his Children to have a better life; because appellant would not be able to provide for his children; and failure as being a parent would be unbearable for appellant..
Appellant has been under doctor’s care since August 4, 2004 for mental conditions and was in no condition to protect himself against this attempt to steal appellant property nor did he know or understand what was happening to him at the time of this predatory refinance.
Appellant have been diagnosis as a Paranoid Schizophrenic which is appellant claim for appellant disability; approved by Social Security Disability.
Most importantly; Appellee Citi Mortgage, and their attorneys are not in compliance with the American Disability Act; regarding their actions and unethical business practices towards this disable appellant as appellant disability made it easy for appellee to take all of this appellant legal rights to his property unnoticed.
Appellant made every effort to prevent any kind of foreclosure action to appellant and his children’s home, even offering to pay rent or make good faith payments (like appellant had done in the past) until this matter could be rectified as payment of the mortgage was never a problem for this Appellant, and now because appellant have been able to expose MORRIS/HARDWICK/SCHNEIDER Law firm racketeering practice they were granted permission to bring in corporate attorneys to protect them and their client Citi Mortgage from federal racketeering charges.
So in comes McElroy, Deutsch, Deutsch, Mulvaney& carpenter big corporate Attorneys to protect MORRIS/HARDWICK/SCHNEIDER from Federal Rico charges; whom never proven that they represent appellee CitiMortgage and was not hired by MORRIS/HARDWICK/SCHNEIDER as per sub-contracting Attorneys to clean up this situation cause by MORRIS/HARDWICK/SCHNEIDER in there illegal racketeering scam to help their client appellee CitiMortgage get away with thief and illegal foreclosure; as this matter was also brought to the courts attention but not properly address.

Applebaum (See Fraud and Hacking 2015) in appendix; because of the mental stress and appellant disability that this matters regarding the illegal attempt to steal appellant home away from him and (his two Honor roll R.O.T.C) sons, has place on Appellant, appellant was unable to deal with any other problems; as appellant continue to consider suicide as an option to bring this morally repugnant, destructive, Unacceptable discrimination to an end; with that in mind; Appellant place the email into a folder on his computer in case he had to recall upon it again.
On September 16, 2015 Appellant attempted to log on to Appellant Yahoo account; when appellant went to place his user name in, to log on to appellant account Attorneys Aaron S. Applebaum name appeared as a user on Appellant computer; as no one name would ever appear in that user box unless they have been on Appellant computer and used a pass word to excess all information on Appellant computer. Appellant; remembered the email Appellant saved and located it in his folders; after further review of the document Appellant place his pointer in the area were the email is address to and it highlighted more damaging criminal information regarding Fraud, and internet criminal activity, the contact information was Appellants name and email address however, the phone number listed as Appellant contact number Cleary belongs to Appellees Attorneys McElroy; Deutsch, Mulvaney & Carpenter, LLP

On are about September 18, 2015 Appellant took his computer to Geek squad to have a professional opinion and to confirm for the Court the illegal criminal action and behavior of appellee CitiMortgage and their Racketeering Attorneys; On September 21, 2015 Geek Squad confirm that the driver was indeed install on appellant computer. On September 29, 2015 Appellant filed a Request for an extension of time; for reasons set forth in the matter; Due to the fact that Appellant is acting as Pro SA Appellant was unaware that appellee had an additional 3 days to respond to the matter at hand; (For responses being answered though the mail or by computer) therefor Appellant filed a Motion to Compel; in addition, to requesting that the Honorable court order Appellee’s Racketeering Attorneys to produce the information Appellant requested in Appellant Request for production of Documents; dated October 13, 2015
The information that appellant was requesting would clearly show further proof of Appellee’s racketeering Attorneys criminal actions and behavior unbecoming of an offer sir of the Courts, and this Great State of Delaware; therefore appellant respectfully request that this honorable Court order appellees attorneys to produce the production of documents as requested by appellant, as per appellant Yahoo account; it shows the logging on to appellant account from various places appellant have never taken his computer to, or been, appellant never had this problem until appellees attorneys illegally hack into appellants personal computer.
On October 14, 2015 Appellant received Appellee’s Racketeering Attorneys answer to Appellant request for an extension of time; Appellee’s Attorneys Unequivocally denied all of the allegations of wrongdoing; once again committing out right perjury; so that McElroy; Deutsch, Mulvaney & Carpenter, LLP Law Firm can continue assisting their client CitiMortgage with illegal foreclosures and save their Law firm from being disbarred and investigated by the F.B.I and the United States District Attorney’s Office but most of all protecting their Law firm from having to turn over all moneys made with CitiMortgage in their Racketeering scam over to the United States Government as per the Rules/Laws governing racketeering actions and behavior.
Appellant Contacted Driver Support several times in the month of September and was told that someone would return his call; however this never happen nor would the representative or sales rep giving Appellant any information after Appellant inform Driver Support that appellant did not order this driver and wanted to know the credit card numbers use to purchase this driver and name; so on September 22, 2015 Appellant called for the last time; appellant informed Driver support that appellant had a ticket number which is indicated on the email address to Mr. Aaron S. Citi morgage never served our family forclosure papers either. Citi morgage lied on documents stateing that they could not reach us and had to appoint representation on behafe of my husband saying he was in the services and in fact he was never in service. The Suffolk County court libary helped me with the papers and they said there was odd things not adding up. I then called up Citi Mogges lawyer who were trying to collect the debt from us and they tell me they don't know anything. But, mean while there companies name is on the documents. Milberg LLC in N.Y. has filed a class action lawsuit for exactly the same reasons you are talking about. I was told to pursue my loan modification disaster on a personal level as well. Have you called the OCC? Hud? I wrote to both and have a case with the OCC who have contacted Citi - lets see. I wrote to the President, House of Representative Banking Committee and my local congress man. I am not sure if this will help, but at least I feel like I am doing something.
If we all unite, we can fight those crack heads. I am in a good mood and sue each and every rep I ever spoke with individually for misrepresenting information about my file, which lead to the denial.

I have my 2nd mortgage with Citi Mortgage and I spend in extra money each month with instruction to be applied to the prinicpal but each month even after I call to remind them to please put the extra towards the principal these company continue to apply the extra money towards an extra regular payment. This has been going on for 18 months now. These has cost me alot of money due to lost of princpal. I have been paying bills for over 30 years and I have never dealt with a company that is so badly ran.

I refinaced with Citi Mortage and took out money from the equity of my house. They took out money to pay of my propertry taxes up to the end of 2009. Then proceeded to charge me again for those taxes so I was double charged for the taxes. Trying to get to talk to anyone at CiTi is almost impossible. When you do get a human, who is usualy in India they run around in circles because all they have in front of them is you account deatails. They cannot even pull up the original agreement. I recently refinaced with another comapany. And received my last escrow refund, I have no idea how their maths works but it does not add up.
Citi Mortage took my husband's home in foreclosure, he only had 7-8 more years on a 30 year loan.
Didn't try to help him get modification on loan
My husband and I bought a condo three years ago and the lender was Citi Mortage. To give a little background I worked full time as a therapist and my husband worked as an analyst during the day and worked towards his MBA in the evenings. Our sitution changed after the birth of our lovely daughter a year ago and I made the choice to be a stay at home mom. My husband got laid off and that begun our financial challenges. For a year we stuggled (unemployment and student loans) but paid our moratge, never missed a month. The ONLY problem was CITI MORTAGE was getting our payments three days later than their grace period and that was a problem for them. We started to incur late charges and at that point I called them to talk about our options. I asked them if it was possible to give us three days extra to make the payments. I told them how we struggled BUT Never missed a mortage payment. I told them about our infant, financial obligations and how we were living off student loans and unemployment. They did not Care. They told us our options were to continue paying late and CONTINUE to incur late fees OR they will give us a break BUT will have to report us to the credit Bureau & that would affect Negatively on our Ceredit ! So in other words continue to pay us late fees or we can help you at a cost.
NEVER EVER GO with CITI Mortage, Never Bank with CITIBANK. Its funny how the banks got a break from the Government but we the people get NO Breaks !
Well maybe your husband should have paid his bill or called them when the problem started? Why do you assume that the mortgage company is obligated to let you live in a house for free? The mortgage company isn't your daddy. Why didn't you try to sell? It takes a lot to get to foreclosure. If you can't pay, then don't take out the mortgage! Be responsible!
I've survived during a really horrible IT job market in Chicago as a divorced mom and have struggled to keep my home. The company where I worked went out of business a few months after I moved into my house. I changed careers, worked two jobs, and sold things to get money to pay my bill. I have no sympathy for people who whine "poor me" when they don't pay their bills!
I am not surprised. We had a medically forced, saved the home, bankruptcy. We paid it off several months early. Citi agreed to all the terms, but now won't even return my calls to get a correct pay off amount, have our mortgage insurance removed (over 80% paid off) or even explain the mystifying array of bizarre answers I get from their gate keepers. We were responsible and paid bills that were not even our own. We were responsible and paid off the resulting bankruptcy (after loosing our life savings), but being responsible isn't rewarded like walking away from one's debts.

I have been unable to drop my PMI to date. I am at 77% LTV based on original purchase price of 2 Unit Rental Property. At origination with Reunion Mortgage, we discussed removing PMI after 80%, but there is no documentation noting this. Reunion sold the loan to CitiMortgage. Citimortgage now tells me it has to be 70% LTV of original price! I have asked for Managers over the past 3 months and get the same old answer each time.
I filed suit against Citimortgage in small claims court. CitiMortgage attorney contacted me. After discussing, he agreed Citimortgage should have released me from PMI. He sent me a check and I dismissed the lawsuit.
Update: I have found the original PMI disclosure which shows automatic PMI removal at 80%. I sent CitiMortgage the document and they still refuse to remove the PMI!

refinancing loan
It is almost a relief to see that we are not alone in experiencing the unprofessional and inconsistent work at CitiMortgage. We filed for a loan in April, and any feedback of information needed was given us when we called them. NEVER have we received any documentation after the initial Loan Application was sent to us in April with many errors that needed correcting.
We have spoken with many phone operators, who are doing their jobs nicely. They apologize for incompetence that is not theirs, and vow to get to the bottom of the problems that they have no "jurisdiction" over.
I have read about Sanjiv Das, CEO and President of CitiMortgage. He is apparently basking in the glow of his words but not checking to see if they are being put in to practice. Mr. Das, I have never had a more completely negative experience with a loan process than I have with this CitiMortgage "team".
Today I called to request information on filing a complaint about our experience with their company...and there was no one who could help me.

Citimortgage is running some type of scam for refinance quotes. My husband and I called to get information about refinancing our home at a lower interest rate. The loan officer started giving us rates and figures over the phone, he told us the only out of pocket expense was $15 for a credit check and an appraisal was not required. I asked him to fax or e-mail me the quote he was giving us, he said NO he could not do that, it had to be done over the phone. I was traveling and lost phone service and had to call back a couple of days later. I was told the only way to proceed was to pay $250 application fee upfront, which I did and a week later I finally received the good faith estimate and related paperwork. With the additional fees Citimortgage was taking on, the new loan would be for more than what was originally financed 4 years earlier. I said I was not told this over the phone and I wanted my $250 app fee back for being mislead. Citimortgage informed me that was non-refundable. I asked what the $250 was for, they said $15 for credit app and $235 for an appraisal that was not done. I believe if you take money for services not rendered, that is a fraud and a scam!

Letter to BBB:
On June 11, 2010, I initiated a mortgage refinance with Brad Hatmaker (tel: [protected]) of Citimortgage. He asked for my credit card number so that he could bill $425.50 for the appraisal of our home. On July 1, 2010, I cancelled my loan application with Citimortgage and personally called the appraiser to cancel his services. The appraiser assigned to me was Steve Rogers (tel:provided to BBB). On July 26, 2010, I left Mr. Hatmaker a voice mail requesting a status on the $425.50 for the appraisal that was never performed. He left me a voice mail on the same day saying "The Appraisal Fee, which is $370 is refundable to you, if it was not done, and that will be refunded to you automatically within 45 days of withdrawl of the loan, which I believe took place on the 2nd. Within 45 days you should see a refund of $370 for the appraisal that was not completed." and "What is not refundable on that $420.50 is going to be $55.50, which will cover the application fee, the flood certification and the credit
report." Although he did not previously disclose that $55.50 was for the application fee, flood cert (if performed) and credit check, I accept those as reasonable. However, Citimortgage has still not issued my $370 refund.
Discover Card took Citimortgage's word and refused to reverse the charges.

We paid CitiMortgage - our current mortgage holder - an application fee of $640 for a refinance that we were told would take 30 days. As soon as we signed the papers and paid the fee the time frame suddenly went to 60 days. After 70 days of not hearing from them I began calling and no one would return my calls. I was told by the people on the 800 number that there was 'no acitvity' on the file for the last month but someone would call me back. Eventually someone did get back to me with a list of info they needed and I promptly sent it back to them. Then the loan processor suddenly stopped returning my emails. After several phone calls and 5 emails he replied that he was no longer handling the loan and again...someone would get back to me. Then I received a letter telling me to call CitiMortgage to set up the closing as everything was approved. When I called they again asked for the same information that I had already given them! I spoke to a supervisor who then gave me another loan processor who was handing the account. She assured me that they never received the information that I sent even though it was emailed and the original processor said he received it. She assured me that if I sent her the info requested she would put a 48 hour rush on the loan. Of course they were not able to get it done in 48 hours so after countless phone calls, emails and $640 we moved on to another lender who was able to close on the loan with no problems in less than 3 weeks.
I will NEVER EVER use CitiMortgage or any division of CitiBank for anything again.

Summary of situation
Due to financial hardship as a result of an unexpected divorce at the end of 2008, I contacted citimortgage, inc. at the beginning of january 2009 to explain that I needed help getting my loan modified.
on january 14, 2009, I faxed over my citimortgage workable solutions application which consisted of fifty-eight pages.
On january 26, 2009 I called citimortgage, inc. they stated they had received my fax but were still working on reviewing it. they would call me back soon. I never heard from them.
On january 23, 2009, I called citimortgage, inc. and spoke to representative “mark”. he stated that the fifty-eight pages of my citimortgage workable solutions application had not been “scanned” in yet and he would have to transfer me to “whitney” with citimortgage, inc. loss mitigation department. “whitney” explained to me that I would need to do a “trial run” of modified payments of

$ 995.00 for four months to prove I could afford them and pay on time. after paying these four payments I would then qualify for a permanent modified mortgage program. she stated that she would be mailing the documentation regarding this arrangement to me for my review and signature and then for me to return them to citimortgage, inc. “whitney” instructed me to call citimortgage loss mitigation department back immediately after paying my june, 2009 payment to complete the process. I never did receive any documentation during these four months even though I had made several telephone calls requesting them. I did pay the modified payments of $ 995.00 on time in march, april, may and june 2009 as requested.

Listed below is a summary of important details that were covered in telephone conversations with “ms. rachael, supervisor” of citimortgage, inc. and myself on monday, june 29th, 2009 and with “ms. aaron, supervisor” of citimortgage, inc. along ms. ivy with the hope for homeowners organization and myself on wednesday, july 1st, 2009 regarding my pending home affordable modification for the above referenced loan number.
• on monday, june 29th, 2009 “ms. rachel, supervisor” of citimortgage, inc. gave me information regarding the payments I would have to pay under the home affordable modification program. I stated that the amount citimortgage, inc. was requesting from me as a monthly payment was higher than I had been paying for the past four months and did not reflect a modified mortgage payment of 31% (thirty-one percent) of my gross income (as specified in the home affordable modification program guidelines). “ms. rachael” stated “we don’t have to do anything for you but this is what we are offering. you can review and sign the modification agreement or you can pay a balloon payment of approximately $ 3, 400.00 which is due july 25th, 2009.” she stated that I was never on a trial basis for a modification program but in forbearance. never at any time since my conversations started with citimortgage, inc. on january 23, 2009 did anyone state to me forbearance or a balloon payment being due in july 2009.

• on wednesday, july 1st, 2009 ms. ivy with the hope for homeowner’s organization and myself contacted citimortgage, inc. again regarding this situation. when speaking with “ms. aaron, supervisor” at citimortgage, inc. regarding the issue of my modified payment not meeting the 31% mortgage payment goal “ms. aaron” stated that “these are the figures our computer system is giving us”. we pointed out once again that the figures where not correct. according to the guidelines of the home affordable modification program, the borrows’ monthly mortgage payment, including principal, interest, property taxes, property insurance, etc. should be set at 31% of the borrows’ gross income.in order to reach the target affordability level of 31%, interest payments can be reduced down to as low as 2%. if at that rate the debt to income level is still over 31%, then the lender needs to extend the term or amortization period up to 40 years and finally if needed, forbear principal at no interest, until the payment is reduced to the 31% target. “ms. aaron” then placed ivy with the hope for homeowner’s organization and myself on hold to discuss this problem with her supervisor. she came back and stated “my supervisor has informed me to tell you there must be a glitch in our computer system. he will have a technician look into it. you will have to call back in two weeks”. I was advised then by hope for homeowner’s that we should end our telephone conversation with citimortgage, inc.
I will be calling back in two weeks along with a representative from the hope for homeowner’s organization. I can only hope the “glitch” in citimortgage, inc.’s computer system that is giving incorrect information will be fixed in order for myself and possibly other citimortgage, inc. customers to get accurate modified payments equal to 31% of the borrows’ gross income as outlined by president obama’s home affordable modification program.
Meanwhile, I sit for another two weeks with this so called “balloon payment” hanging over my head and my children and I wondering what is going to happen to our home. I have honestly done everything citimortgage, inc. has asked me to do

For the past four months and have researched the u. s. department of the treasury’s guidelines for their “making home affordable” program to the fullest extent only to find myself in an unfair business situation.
I clearly understand that lender’s, including citimortgage, inc., are receiving funds from the u. s. treasury for participating in this program. I would like to believe that citimortgage, inc. is following the making home affordable guidelines accurately since they are financially benefiting from the u. s. government. I guess in two weeks I will know the answer to this.
I would also like to state I have also been advised to call the state of florida attorney general’s office regarding this “glitch” in citimortgage, inc. computer system and also discuss with them the details of my situation. We are the exact same thing tons of paperwork for 3 mths always a different person on the phone, all payments have been mad and on time by western union and the now see the payments but none have been applied? I too am a victim of Citi mortgage! I received a package in the mail for a 3 month trial Payment of about $580. When my husband comfirmed this with Citibank they told him that it was a mistake and they were send us a new package. So yesterday it came and I just cried they want almost 4 times as much! Was like $2100 and change. The $580 was doable even if it was $1, 100 but come on over $2100 and that's more then the payments were originally!
How is this affordable? My husband is unemployed and can't make that kind of payment!

I started my loan modification in Dec.2009 with balance of 96, 919.45 finally in July 2011 I was able to modify my loan with balance of 96, 467.22. when I asked them what happen to all payments of $ 695 I have made over 19 months. they send me payment history I barely understand any entry. I call them and they told me it apply toward the interest and late charge. My credit score was near 800 now it went under 650. Citi Mortgage lied overtime of period about late charge and I was told that every 2 payment they receive they will mark 1 full payment.Since I was under forberence plan my new principal balnce grew after making all partial payment . 695*17 went toward late charge and interest. Citi mortage modification is just a joke. If any one out there going through modification do not send any payment until you received modification document. they did same thing with my second mortgage. it took them over 27 months to modify, even making $199 paymnet over 24 months my balance grew form 26, 703.51 to 24, 889.06+ accured unpaid interest 2, 756.27 total in 27, 914.92 can we get together and file class action or law suit for breech trust.

We used their service help to deal with the bank one on one for 3 days back to back. They needed some documents we went home or where we needed to go and got them. On Monday Oct. 3rd 2011 through the Naca website I rejected the offer for 2 reasons. First the up to date balance is $35, 505.94 not $41, 192 which is on the proposal. Second the amounts on the taxes are suppose to be on the insurance and the amount on the insurance should be on the taxes. I called Citimortgage and informed them of these discrepancies. They said the underwriter working on my case is working to find out why the balance is what it is. I clearly let them know that I owe absolutely no backed taxes or backed payments. This can be proven by my recent mortgage statement and my current tax statement which I went ahead and resubmitted to them through the N.A.C.A website. I cannot beleive Citicorp is still in business. I too wanted to help relieve some financial strain by lowering my interest rate to lower my payments on my mortgage through what I thought was government assistance. This is a true story. For three months I was on a trial payment program of about 270 dollars less then my current mortgage required. After 3 months I was rushed this contract to sign and called and told to hurry and sign it or I would not qualify for the modification. My existing mortgage was at 7.59 percent and I had 15 years left to pay. The new modified mortgage was as follows, 1-2 years 5.59, 3 yrs. 6.59, 4yrs. 7.59, and 5-24 years at 8.01 percent. I was enrolled in a SMART LOAN before and was told to modify my loan at these rates and the SMART program would kick in and lower everything by .5 percent. I called the SMART program rep. and he stated that I could not re-enroll in the SMART Program and the payments would be as the contract read and would not be lowered. This would have cost me 9 more years on my mortgage and over 51000 dollars more if I would have trusted the Citicorp representative (Orquidea). What a joke! Now I am sure my credit went bad and am sure I will be unable to re-enroll in my last mortgage program. Any suggestions on attorneys would be great. I am in the same situation as above...I have had my mortgage "modified" twice only to have it taken back and the payments go up to more that previously. They will not deal with short sales, deed in lieu of foreclosure or the presidents HAMP program that is supposed to allow companies to set a short sale price ahead of time to help the seller and the realtor. Have had absolutely no luck in getting them to be reasonable. Now they have a law firm harassing me with 4 letters coming a day! If anyone does start a class action suit, I want in. Elizabeth Thomas

Is there anyone out there who really believes that our government has no idea what Citimortgage is doing, or not doing? Does anyone read this problem on the front page of ANY newspaper? Has anyone ever heard anything about our problem with Citigortgage on ANY radio? How about this one! Has anyone heard or seen ANYTHING about this situation on TV? After 14 months of dealing with Citimortgage and their mortgage modification assistance, they now say that I am behind on my payments by one month. There is approx. $800 missing in my account that CitiMortgage can't seem to find. Maybe that's where they get their bonuses for their upper management! If that isn't enough, they tell me that they have now sold my loan to another company. I think we need to deal with the government who created this problem and refuses to do anything about it.
so I call them this morning and they tell me that they can't take my mortgage payment because my mortgage has been referred to foreclosure for payments dec 09-dec 10. I've been making the payments. they told me that the program was terminated in august and they shouldn't have been taking the modification amount. I'm going to have to get a lawyer now.

On June 10, 2009 our home was seriously damaged by a severe storm. The total claim amount received by State Farm was $38, 000. We received the funds from State Farm, immediately sent the endorsed check to CitiMortgage as instructed since the check is made out to both us and our lender. I called CitiMortgage as soon as we received the check to follow their process. I went to their www.mylossdraft.com site as instructed by a recording to complete the necessary paperwork. The one page website was vague and lacking in clear information, but I printed the necessary forms, completed them, and called for further clarification. After finally reaching a person, I was given the web address again. I explained twice that I had the mental acuity to get that far but would like personal assistance and clarification. They provided none. I faxed the forms into the ether (no confirmation of receipt provided). I followed up later that day and was told it takes 48 hours to get a fax. This is where the stonewalling tactics began to become apparent. I asked about the process again, hoping another rep might help. She did give more information than the site (accidentally, I assume) and told me with multiple contractors to pay, I should complete the self-contracting form instead of the waiver of lien form. That form includes the following statement: "I (We) will be self contracting repairs to the property, and will provide paid receipts for material and/or sub-contractors used in completion of those repairs." 1. I had no choice but to complete this form since I had multiple contractors. 2. I said I would obligingly provide receipts upon receipt of the funds from CitiMortgage since I cannot pay $38K out of pocket. 3. I HAD to agree to this to get ANY of the funds from CitiMortgage. The rep said that was all understandable and fine. A week later, I had their required inspector out to confirm repairs. He confirmed and they acknowledged that 95% of the repairs had been completed. This step I understand as they have an obligation to ensure their collateral is at least worth the value of the loan. So this is completed, and according to their website, the remainder of funds will be released. That's not happening. After more than six more phone calls, they are insisting they need receipts from me showing I have paid the contractors. What? That's what the money is for, to pay the contractors. I even asked the automaton on the other end of the line if he (different unempowered call center employee every time) had $38000 lying around and if so, he can pay them, send me the receipts, and I promise I'd pay him back. Not surprisingly, he didn't get it. They are obviously trained to stonewall in order to hold on to the money as long as possible. Finally, I called the mortgage customer service department and after 3 tries, got a manager. She was seemingly helpful, but I was mistaken. I told her in no uncertain terms that I would cash out investments to pay off the loan and they could give up the possible hundreds of thousands of interest, or she could make a call to get my funds released. She made the call, got back on the line and GUARANTEED my money would arrive by July 16th. I got all the info, including her extension (if it's real) and a case number and said thank you. An hour later, I got a call from the insurance department demanding receipts again and explaining no funds would be released until they had them. I had the same, maddening circular argument to no avail. Since we had FINALLY received a third of the funds, I sent her a receipt from a contractor (this after sending two receipts prior - money paid out of our own pockets) showing that exact amount paid. She made all kinds of huff and puff about having to escalate for approval - again, obvious stonewalling - and I said I could care less. I said, "We have done more than is required by your documents and incomplete instructions and varying stories from different employees there. Your document does not in any way legally bind me to pay contractors and provide receipts BEFORE you send me MY money. It does not state a contingency for release of my funds to me. It does not state a specific percentage or number of receipts (by the fourth call, they were saying 100% and/or 50% of the amount of the repairs according to whom I spoke with. Blatant lies spoken as absolute truth without any supporting documentation.). I do not owe you anything based on your own documentation other than two paid receipts, and even then, I don't owe them to you before you send me the funds. You do owe me my money. Your inspector already confirmed the repairs are complete and your concern in this is alleviated. You have no right to continue to hold my money to earn interest and to bolster your reserves, which is obviously what you are doing. Have I made myself perfectly clear?" She said, "yes" and that the funds would be released upon receipt of the fax (again, 48 hours with no follow-up). That's the third time someone has "guaranteed" that and I have no reason to believe them. In the meantime, I have contractors who deserve their money. What recourse is there? It is obvious that their arrogance makes them feel entitled here as illogical as it seems. It's a scam, plain and simple. It is obvious to any thinking person they are holding homeowners' insurance funds for their own use. It is blatant thievery. What miniscule power do consumers have in such an oligarchy?
Thank you for your comments. I did get my issue resolved - eventually. It took countless hours of tenacity, calling every number I could find for CitiMortgage and demanding to speak with someone who had the power to get us our money, filing complaints with the FTC, the TX AG, the TX Insurance Commission, the BBC (waste of time, really), and other agencies.
If you have the time, please pester everyone. We are fortunate enough to be in a position to handle the problems, but many people are not. While we all deserve fair and honest treatment, it's especially important that we bring this to light and demand regulations and enforcement for the people who don't have the time, money, and resources to fight back. The huge banks need to be put in their place before we're all screwed.

I am having the same problem with CENLAR, which is actually Freddie Mac. They are refusing to release the money required to pay the contractor, which is a large company and requires money upfront...I can not start repairs without the money and they refuse to contact me...looking to get an attorney and file with the hopes of forcing them to pay not only the funds to repair the property but pay the lawyer fees for any legal action to recover insurance monies.
I have been with Citi for many years and have some insurances with them. My payments are made on time, but every month I receive a letter that certain policies are a month behind. I contacted the companies and they are said that the policies are up to date. I have call Citi and the are saying that the policies are behind. Back in 2005 I missed one month payment and the policies that I have now was not on the loan.
I am having the same trouble with Citimorgage right now.has been 1 month and promises and lost paper work & still no check & no repairs done, we all need help to stop them
It should be illegal what they are doing to homeowners - we had the same situation. On July 22, 2009, our kitchen flooded, damaging our wood floors. State Farm immediately issued us a check for the repairs (approximately $15, 000). Wells Fargo Bank has done everything in their power to hold on to our money as long as possible. We have had to pay most of everything out of our own pocket and haven't received a dime yet even though our job is 100% complete. Inspections keep getting mysteriously canceled, errors keep being made by the Bank, or they keep requiring additional documentation. It makes me wonder what would happen if we didn't have the money to do the repairs. How long would they hold on to our money then? And why should they have the power to determine what we put in our house and who we contract with for the job? They don't pay for the insurance, we do!
the federal goverment should require mortgage companies to release funds in a timeley manor. if tax dollars are used to keep them in buisness. as an insurance contractor i chose insurance claims that i will acept by who holds the mortgage, as i have had funds held for six to twelve months before they would pay me for a job that was 100 percent complete.as a small buisness man i can not support multi-million dollar companies out of my pocket.There is no bailout for my buisness if i go broke supporting others who mishandle theirs

Citi foreclosed on my home due to their incompetence working my modification
I fell behind in my payments due to oral surgery, numerous car repairs, very high utilities bills, legal fees after divorce etc...
I called Hope and talked with a counselor James Wells who got all my info and sent off a hardship package to citi mortgage. James was sure that I qualified for the making home affordable program since my income is at 39% of my mortgage . I called Hope in the middle of April 2009.
I called Citi and asked them had they received my Hope package and I was told by the rep that a foreclosure date had already been scheduled for June 2.
The Citi rep on the phone told me that in his notes he sees that Marcus Byrant is assigned to my case and that he is sending him a email to get that date moved. The rep explained that it takes a while for the loan modifications to go through so moving the date was imperative to my case and that he has emailed folks before and they have moved the dates for the same reasons. He gave me Marcus Byrant telephone number and told me to talk with him as well. I called Marcus Byrant [protected] several times I got no answer so I left several messages. I didn't receive any call backs from him. I gave him my email address, home and cell. Nothing was received. I talk with Kevin [protected] and Ken [protected] one of these Citi Reps sent off the email to Marcus Bryant.
I called Citi mortgage back about every other day or so. I was told to ask the
Citi reps to look at the DRI noting system to see what notes where added to my account so I could be informed on where my case was going. I received no calls no emails no mail from Citi.
I called on May 20 and the rep pull the notes up on their system and I was told that they are needing pay stubs from me to show my income. I faxed them to James Bryant like I was told on May 21 2009
I called Citi again and again to check the status. I was told that I had been approved for some kind of modification but all they were needing was my home value information. I offered to send what I had or to get that to them. I was told that they would need to obtain that info themselves.
On May 31 or June 1 I called to see what was happening the Citi rep Ashley Tarron [protected] her rep number is 34236 told me that was my home was still up for foreclosure on June 2. I was SHOCKED. She placed me on hold and got with her manager and she said that she saw notes that I was approved for some type of modification on May 13 but the property value info still had not come in yet but her manager was indeed moving the date of foreclosure to make time to get the needed information they were waiting for to get my new payment amount.
In the meantime, I am still waiting on modification information and finally on June 23 I get a letter from Citi letting me know that my file was forwarded to the loss mitigation team. See attachment
I also get a yellow envelope that has a card noted 6-23-09 to call Citi mortgage. see attachment
I call the number [protected] and the message says " If you are calling about the status of request for mortgage assistance the review process will take approximately 30day's. sign in to your account at Citimorgage.com for status update
I go on line and I can't access my account so a number pops up for me to call.
The rep tells me that my home was sold for foreclosure on June 2! I lost it asking why and what because I am getting information from rep after rep, I got this letter dated June 19 saying that my modification was being worked.
The rep told me that the date was never moved, then more excuses: they had received a incomplete package from Hope James Wells. They hadn't received the property value information they had requested. I informed her that the date should have been move long before and they where responsible for the property info.
She told me that since I leave in Texas that I couldn't do any thing about the house being sold and that a eviction letter was mailed out on June 26. I got it on June 29. see attachment
I called back on Sat June 27, I spoke to a rep and asked her who bought the house, she explained that couldn't find that info and that since she was in Loss Mitigation that there is nothing she can do for me and gave me yet another number to call for REO [protected]. I left a message no phone call has been returned.
I got 3 days the letter says. Citimortgage inc. has purchased the house now. I have no where to go!

over two yrs and payments $1901. Back in May, 2017, i had applied for modification to lower my payments, and supposedly it was approved and was told that my first payment was on July 1st for $1295 by Melinda Bennett, which now she is no longer with Citi & just to find out that the payments were 1901, higher than my actual payments. I got behind cause i was told to pay in July, 2017. After that my acct has being a mess. Between Mary J Bencon and Ramon A Goodman, i felt discriminated the way they treated me and spoke to me. They told me that if i can afford my house to sell it or give it back to the bank. I have worked so hard in this country and have a family for them to talk to me like that. If they do not know how to talk to people and give a good cust mer service, they are in the wrong place of work. I need those conversation to be escalated it and some one to call me so we can try to bring my account current. DUE TO CITIMORTGAGE MY ACCOUNT IS DELINQUENT
Mortgage with Citi for 10 years. Bank of America sent 3 auto mortgage payments in error, and Citi said they could not reverse the 2 overpayments. They did, then charged me $30 for NSF, and refused to waive the $30 "based on my payment history", which has ALWAYS been auto debited on the 1st of the month, and never late.
Citimortgage owns my mortgage. I have NEVER been late on a payment. I ALWAYS pay between the 1st and the 15th. Citi now calls me to tell me to pay before the 15th or I will incur a penalty.
Stop already. I know this and I pay on time EVERYTIME. Stop calling me and harassing me. Enough.

People: ITS ALL BANKS! i lost my home of 35 years to the crooks of zions first national. My senario would read ditto of posts just different bank. OOOhhh zions accepted bail out money as well and the occ fined them 8 million for money laundering How sweet it is.
I have reached the end of my Rope with Citi Mortgage having had my mortage with them since 2006' and a customer in very good standing I honestly could kill the person or people that continue to call me YES 4 to 6 times a day, morning noon nite, while I am at work home driving I at first thought they had the wrong person NO they are simply harrassing me and in the state of california there are some prettty strick consumer protection laws How do we ban together in a class action law suit to fry these people. I am a very conservative business man and do not want the Govt in my life but what do I do seriously I am getting dangerous over the anger this continues to build If I could find another loan company and refinance I would do this tonite I cannot stand this company and the people that they have doing their work for them. These stories bought me to tears. THIS IS STUPID! Why is Citi Mortgage and other banks allowed to take government money and misuse it, while we all suffer the raft of their greed and stupidity!
I was planning a move out of town so I put my home up for sale and it was on the market for months with no offers. At that time I was not behind on my mortgage. I found a renter moved in with my mom and moved out of state. The renter stopped paying my property manager "use the term loosely" stopped answering calls and basically screwed me. When it came to paying my rent where I currently lived and paying my mortgage my mortgage got paid but it was a little late. In the midst of it all I FINALLY got the deadbeats out of my home AFTER they stole checks that were sent to my old address and the police got involved. This was months later and at this point the house was empty. I could no longer pay everything so I fell behind in my mortgage payments. I contacted Citi repeatedly and left messages with EVERYONE but no one knew anything. I was transferred from department to department to department... it was ENDLESS and unproductive. I finally got a renter in the house and I was finally told I could do a modification then was put on a payment plan ... paying about 150 over my mortgage amount. I was told to make the extra payments for a few months sending by certified check then I'd get some paperwork giving me my final amount that I'd begin to pay. I NEVER heard from my "counselor" again. He never answered my calls and never returned my calls again. I've called over and over and over and over and OVER! Each time I've been told I haev to talk to a different person and I've called and left messages. Today I FINALLY hear from someone who tells me since I don't live in the house they can't modify my loan and I'm now 8 months behind because the payments I was sending in technically didn't count. If it wasn't so HORRIBLE it would be funny! LOL So basically the lady tells me ... my new payments will be $250 over what my normal payments were. However... if I put a couple thousand down... lol I told her she could STOP talking right then! She told me my only options were to pay what she said or do a Short Sale. This is just RIDICULOUS and at this point I don't give a d*mn anymore. My only concern is... I own my own home now (for what it's worth) the way the banks are holding onto the money they are supposed to be lending... I'm scared I won't be able to get another home loan in the future (couple years). However, this WHOLE process is just a massive headache...
Yeah, they have been working on my modification since march, I have given them the same information 4 times and they still call. They send things in the mail saying they can help but when I call they can't help, they have no intentions on helping. They got bailed out for bad loans, but they won't help the people with the bad loans. Now, they have given pay raises. Isn't that money supposed to go to help us?

This company held my mortgage to 11 years, & I am proud to say never once was I late with my payments. March 2008 I had to file bankrupsy but my home was not listed, but was listed as an asscess . March 2009 I notified the mortgage company bankrupsy department at citimortgage that due to slow work I was going to be late with my payment, and was told by the staff that was taking my call "while you are in bankrupsy you are not charged late charges", I was pleased, but to my saddnes with the payoff made June 2009 from the sell of the home I had been charged late fees.

I am so upset, the way citmortgage has handled my loan, #[protected]-2. I have been working hard as a single mother with 2 daughters in college to pay my loan every month. This past May my taxes went up without my knowledge, who would have thought with most homes under water that there could actually be an increase. I travel for work and pay bills online, when I finally got the notice it came from UPS that my loan was in default. Wanting to lower my interest rate and get the PMI insurance off, I am not able to do this because it looks like I was late, when in actuality you were holding my payment of $1, 500. I always made more than than the actual payment, and not applying the money. Your staff of managers that take calls, a Chris #23339 extremely rude and insensitive to my issue. For the amount of $259.00 that was increased or owed I am no longer able to refinance. For those of us that sacrifice each month to pay our bills, it is companies like you that continue to gouge for every dollar.
My history will reflect that payments have always been made and never late until the tax increase. I am asking you and your company to please take this default or deragatory implication off my record so that I am able to refinance this loan.
I will send my letter to everyone, especially the television stations that want to say there is help for people that pay their bills.
I replaced a cunstomers roof due to storm damage. The home owners insurance paid to replace the entire roof approx. $15, 000.00.
The fhome owners insurance compny issued a 2 party check with his name and also Citimortgage's name. It took at least 3 weekd for the the mortgage company to send the check back to the home owner. Then the home gave me a 2 party check issued to him and in my company's name. I deposited the check on the 9th of the month and on the 14th the check was returned UNPAYABLE! It is now the 28th of the month and the check has been sent back kto my bank for the second time unpayable.
And the new excuse is that the insurance company's check is bad.

I went through them to refinance my home. We paid them $500.00 + up front for service fees and appraisal. We went through the entire process and when it was in underwriting they stated could not refinance us after all. I advised them I provided all of the required paperwork and this mistake was not our fault so we should get reimbursed the money we gave them when this whole thing started. They have been giving us the run around for several weeks now and still have not contacted us about it. When I called the person I was working with from Citi he did not answer my calls and just sent me an email that he was still discussing the refund with his manager and would get back to us on it. It has been several weeks and still nothing. This is the person we dealt with. He seemed really friendly and was in constant contact with us (phone & email) until things fell through and we wanted our money refunded. This really seems like some type of SCAM they are running on people.

I discussed refinancing with Citimortgage to go from my current 6.58 interest rate down to a 2.75 interest rate. I only owe 57, 700 on my mortgage for the next 17 years so it makes sense to go down to a 15 or 10 year refinance. Well, I got the numbers back and it appears instead of saving, my total I owe will be 59, 600k. So that means Citi is stealing all the savings and trying to con me into paying them 3k so they can steal it. What kind of scam is this? Are people really that uninformed? I was told I would save 100-200 per month note. Really? And rather than use the tax value of my house I am to pay them 650 for an appraisal? Nonrefundable of course should the loan not go throuth. They should be put out of business for theft. Of course I declined. Had I not asked for the entire 15 year payout schedule I would not have known they were stealing the savings. I guess they expected me to go for the 100-200 per month savings, which is not really savings since I would owe more.
