ASF Payment Solutions cancellation policy

Cancellation of membership with asf
I enrolled asf international in august 2009 and was told that my contract could be cancelled if I moved at least 25 miles away.in october, I asked asf staff what was necessary to cancel my contract if I moved and was advised that I needed a lease or rental agreement to prove residency elsewhere.
When I was accepted to college out-of-state, I also leased an apartment and sent the lease agreement into asf. Apparently asf does not honor what they promise to members. I have now been told that I must submit a utility bill. However, the utilities are not in my name. They have told me that they will continue to charge me monthly for a membership I don’t even use as it is over 400 miles away.
Asf states that they do not have a telephone number to their “cancellation department”.in other words, the cancellation department exists but will not accept outside calls from members! What I can take away from this most unpleasant experience is that I will never do business with asf again and advise anyone thinking of doing business with asf — not to.

ASF Payment Solutions billing after my cancellation

ASF International is a very unethical business. I have cancelled my membership at a local boxing club 4 times and they have continued to bill me with outrageous late fees of about 80% of my fees for the boxing club. After I lost my credit card and they were no longer able to bill my card, they sent me bills. When I wrote in about the cancellation and documented my cancellation, they claimed they could not honor my cancellation and would in fact keep billing me until I paid the late fees! The late fees were from services after I had already cancelled and for which I had never been initially billed, so how could they be late. This is a scam. When I called, I was treated in a very rude manner and when I asked to speak to a supervisor, I had the feeling I was speaking with a co-worker. I am not paying these bills and will go to small claims court if necessary. I hope it does not hurt my credit. Do you not ASF International

Yes ASF is a company that should be closed down. I am in the same boat as many of the other users have posted here. They have been billing me for a plan that was cancelled over 6 months ago. I was never informed of the 90 day notice to cancel but even when I did that they told me I had not cancelled and unless I had anything in writing they had to continue to bill me. Someone there finally gave me their email address to cancell my account but this was well after 1 year of the first cancellation. To anyone reading this SPAM this company with random cancellations and acount numbers.

The automatic renewal clause is in the contract that Anna signed. We are simply enforcing the terms and coditions of the agreement.

ASF Payment Solutions refused to cancel membership over a bogus $5 fee

My gym membership had an auto renewal clause. At the time I bought membership it was monthly so I gave the gym my account info to debit each month, but I decided it would save me money to pay for a full year. Then when my year was up asf int'l sent me my first statement. Since signing up for my membership I had lost the orginal debit card and my bank issued me a new one. When I received the statement I had noticed a manual billing fee of $5 along with the current month and the next month for the $29 monthly membership costs. I immediately called and tried to cancel the entire membership, but the customer service rep kevin (who apparently is the only rep that seems to work at that call center because I had called 3 times during different days and hours) told me I owed $68 instead of what my current bill indicated of $63. I was prepared to pay the $63, but he refused to close my account unless the additional $5 was paid as well. I was not happy at all, but he proceeded to tell me that it was a legitimate fee that I indeed owed. I asked what was the bill specifically for. He explained it was a fee charged for having to send the physical paper bill versus debiting the my account. This was the first and only bill I had received and I knew that was a bogus charge. Furthermore, it did not appear on the bill. He justified the incorrect amount as a "data entry error". They under no circumstances would wave that fee. This incident occurred last monday and I am still disgusted by this customer service rep and how he treated the whole situation. When I told him I was going to only pay the amount on my bill he warned my that the account would stay open and continuously incur these charges. I could care less about the $5, but it's the principle. They were not the company that I had signed my gym membership contract with, and therefore did not see me as their cusotmer at all. Unfortunately, I swallowed my pride and paid the $68. I am still upset about this though. What kind of company refuses to waive a fee that they admittingly did not add on my bill or provided the service to which the fees are applied in the first place. Asf international and kevin have a lot to learn about customer service and respect.

The $5 manual billing fee is not an ASF International fee. I would suggest Kristine review her membership agreement. That manual billing fee is referenced in the agreement stating that if the member should go off of the autmated form of payment that they agree to pay the manual billing fee.

ASF Payment Solutions billing after membership was cancelled and they don't have a record

My membership was cancelled over a year ago at Lifestyles fitness center which I paid in full with ASF. After one year I have had no contact with them and then I receive a bill in the mail for three additional months and was told my membership was never cancelled. I wrote them two letters and the matter still hasn't been resolved. They are adding late fees and told me it would be thirty days and it would not be cancelled until payment was received. I asked for a letter from the company which I sent to Will McDonald the manager and I have not spoken to him. We have played phone tag a few times but the last time I called Ashley told me he would call back in a few and there was not a phone call. The matter still hasn't been resolved and all they need to do is look at the payment history from the last year because there hasn't been one.

You guys are full of ###! ASF International are a bunch of thieves and what is really disgusting is that their clients don't like their practices either! I have talked to the original creditor about my issue with ASF and they have told me that they are having trouble with them as well. This company is so shady that they cancelled their membership with the BBB because they didn't have the personel to keep up with the complaints. Check out their BBB rating, "F" My company is a member of the BBB in good standing and honestly it doesn't take a whole lot! Integriy, Honesty, and true customer service is something that you don't really have to put a whole lot of effort into. These guys actually put forth more energy into ripping people off than it would take to be legit! My hope is that the Colorado AG closes these crimminals down!

ASF Payment Solutions they won't stop drafting my acct!!!

I received a flyer in the mail about a 36 week weight loss program at a nearby gym. I went in and discussed the program with a gentleman from Amerishapes. He laid all the details of the program out and I signed up for it. One of the perks of joining the program was a discounted membership to the gym where the program was being held, but I was told in order not to have to pay the full 36 weeks up front they were going to draft my acct. I was also told that I would be offered the chance to sign a contract with the gym after my 36 weeks at the discounted rate if I so chose. We are now past the 36 weeks and they are still continuing to bill my account. I've called NUMEROUS times and have been told that I signed a year contract with the gym, then I call the gym and the OWNER tells me that they have nothing to do with ASF. In the past 3 days I have called SIX times and spoken with different people. Every time I am told something different but to the same affect that they will not stop drafting my acct b/c I signed a contract (BUT THEY WON'T FAX ME A COPY OF THE CONTRACT I "SIGNED" WITH THE GYM, even though they say they have it on file and are looking at it as they are talking to me). I have also left 4 messages for 4 different "supervisors" and have yet to be contacted. As of today, I have been billed once again and again was told by them that there was nothing they could do about it.

There are many, many similar stories if you do a Google search for ASF. Buyer be warned---ASF is engages in unethical predatory business practice. DO NOT DO BUSINESS WITH ANYONE THAT USES ASF! THEY ARE THEIVES!

ASF Payment Solutions asf int is a scam - la boxing is in

These people are crooks in every sense of the word. I have had the misfortune of having them for two different gyms I have been a member of (the gyms don't inform you they use ASF). I canceled the account for the first gym and found out two years later that they were inconspicusously taking money from my account...for two years! The current problem is that I got a membership to LA Boxing (yea you guys are part of this too) for a new job that I got. Signed a two year contract for the gym because it was a great job and wasn't planning on leaving it. I should say the job is more than 25 miles from my house and the gym is around the corner from the job. After a year on the job the economy crashed and I was laid off permanently. They won't let me out of my contract. Please call the Better Business Bureau and the Attorney General's Office and complain about these crooks. They are flat out crooks.

ASF Payment Solutions expired debit card

I am a member of Bodyplex gym and my debit bank card expired. Well I never received a notice from ASF International but I did receive a bill full of BS fee's plus the membership and other misc late charges.

A return Item billing fee of $29
A duplicate manual billing fee of $25 for a total of $50
A Late charge of $9

So I paid more in late charges than what I pay in a 6 month period for gym membership.

Is this legal? Im reporting to BBB>...

We always need two proofs of move. You can try to be dishonest and not follow what your contract requires, but we generally find out if it is a true move or not. Genrally a utility bill, mortgage settlement statement or a lease would need to be provided as well.

It is legal. The manual billing fee is most likely a fee that is due once a year. That is a maintenance fee the club charges you annually for upkeep of the facility. The other charges would not be charged, if you were not late and did not have invalid auto-payment information on file. I would suggest that you contact the member support line [protected]) and discuss the issue with a representative. If it is a situation that has not happened in the past, we would be willing to help out with some of the fees.

ASF Payment Solutions invoice for services not rendered

I received an invoice today for a membership to World Gym, with a total balance of $330 of which $60 is past due. My problem with this, is it is for a gym in Glen Burnie. I wouldn't drive THROUGH Glen Burnie, let alone drive TO Glen Burnie to work out. I could explain to the customer service / accounts payable rep that this is NOT my account. The town is an hour away. I've never lived there, nor anywhere near there.

But, what infuriates me is the shoddy business practices on the part of both World Gym AND ASF International. Who decided that because they could not find the right person (who shares the same name... and by the way, there are at least 3 of is in MD, alone), to just pick ANYONE they could find with the same name and start billing them? My only comment to them, 'produce the contract, do your research"...and then send me the contract along with an apology and a statement excusing me from the charges. And if they harass me any further, I'd be willing to pay an attorney $5k to sue them over a $330 bill. Enough of these desperate, bordering fraudulent, billing practices and schemes.

Of course I did, as soon as the fraudulent invoicing began. I called ASF on 6/8/09, 6/10/09, 6/16/09, 6/18/09, 6/23/09 and then finally engaged legal council after ASF claimed the burden was on ME, to prove I wasn't the other Amanda in Glen Burnie.

I also personally WROTE you, Chris Peterson, on 8/1/09. It was the most absurd experience -- and the shoddiest business -- I've ever encountered to-date. It's 6 years later, and I still vow to NEVER work with ASF. Never did. Never will.

ASF Payment Solutions giving false billing information

After many calls and attempts on my part to make the cancellation process as complicit to the unstated and uncontracted "policies" of ASF International, I have received yet more misleading information. I was told in a phone conversation with customer service manager Danielle on Friday April 24th that I would receive an email documenting that my account has been closed and that I will not be charged for the month of May when my final payment has been processed. I was told that upon the payment being posted, I would be sent an email - I was assured that this note was in the "system" and would be carried out at the time of payment. Well, my payment has come out of my checking account and I've not received an email. Perhaps if this was the only time I was given faulty information I would not be concerned, but this is, in fact, the third time I've been given costly and misleading information regarding the closure of my account. I have done everything I have been instructed to do by ASF to close my account, I have paid unfair and uncontracted payments in an effort to simply resolve any issues. None of this has mitigated the continued charging (and even double charging) of my account, nor has it facilitated the prompt closure of my account. It is now my strong assumption that my account will be charged for the upcoming month of May, even though I have done every single thing I have been told to cancel my account.

I was told that my account was completely paid and closed by Elmer on April 21st after I paid what I was told was the full and outstanding balance due on my account. And I received notice the following day that, in fact, my account owed still more money. Part of the further outstanding balance was a double charge for the month of February. The customer service representatives confirmed on multiple occasions that my account was genuinely being charged twice for February. Two monthly payments due for one month - this was admitted openly by ASF International representatives. How double billing could possibly be considered fair or according to contract is an issue that I strongly dispute. Nothing on my contract stipulated an alteration of billing cycle upon the roll over renewal terms. I wanted to dispute this charge, and I pursued disputation of the charge the very day I was made aware of the issue. Once again: the very day I was alerted to the issue. Upon speaking with Danielle after being told that only a manager could help me, and after placing 10 calls seeking such assistance, I was told on Friday April 24th (the first opportunity I was given to speak with a manager) that investigation of such a claim would take 10 days. Thus, 10 days later my account would be considered open for the month of May and I would have to pay for May as well. So I was left with the choice of paying an unjust, and double charged, month's fee and the current month's fee to close the account, or to dispute and (at best) pay two month's fees (April and May). As the dollar amount was the same I chose to simply pay the unjust and double charged month's fee - once again, to promptly resolve any issues and eliminate any further charges. I could have understood how this could be chalked up to a simple scheduling difficulty that was not in my favor - as Danielle said it was - but, the fact that I pursued all claims, all issues, and all payments within hours of being notified makes that completely unreasonable. Every email notice I received and every phone call I received was responded to within hours of receipt. How could it be a scheduling misfortune if I was never even given the chance to challenge the payment on the very day I was told of the payment?

I consider all these practices to be seriously concerning, and it has cost the gym (your client) a customer. You have hurt your client by misrepresenting your own billing practices. I cannot be a member of a gym that uses a billing agency that cannot be trusted. After I followed all steps of the contract to close my account in a timely manner, and even after I have followed steps not outlined in the contract, but (dubiously) reported to me by your representatives, I still have no confidence in the closure of my account.

I will be reporting this exceedingly poor service to the gym I belonged to and that uses your services, and I will also be reporting a claim to the Better Business Bureau. As I have no confidence in pursuing even the meagerest means of resolution through your "customer service", these are the only options left to me. Your company has be untractable and has demonstrated no desire to work with me even on the simplest requests.

Update by Josh Bero
Sep 23, 2009 3:32 pm EDT

I have already attempted on many occasions to show proof to ASF regarding their double charges on a one-on-one basis. That time has long past. The whole point of this board is to help other potential customers to avoid going to gyms that use your company's services. So, to simply send you proof privately won't aid the discussion one wit. Besides, like I've said, I already went round and round with ASF. All the proof was discussed and ASF continued in its underhanded billing practices.

As for your commons sense comments: apparently common sense has actually not won over you. The common sense in a public forum is to present proofs - if challenged – TO THE PUBLIC in the forum. That's what all this is all about. That is the common sense that has escaped you. I do not misunderstand your request for proof; I (using actual common sense) find it ridiculous to give personal banking info to the public. The many instances of private and professional discourse have long past. ASF had those chances, and ignored my justified claims. So, it really is you who lack the common sense for not knowing the media in which the discussion is taking place.

Continuing... you ask why you would lie on this public board. There is a very simple and common sense (because you are so interested in common sense) answer: to defend your job and your company. You would lie because it's your job. That's actually what I've been saying. You actually answer your own question yourself; you lie on these boards because you "feel that our corporation should have a voice." Common sense.

As for the personal attacks: you are actually trying to feign the high ground in this, but you don't understand what a personal attack is. I have never attacked you personally. I have discussed the content of you communication and your company's underhanded billing practices. To say that the defense of your practices is a lie is not a personal attack. To say that you are lying in giving false information is not a personal attack. To further call a person who is employing lies a liar is not a personal attack. I'll give you a little logic help here: if I were to call you stupid, or say I can't trust you because you're a white guy (I don't know your race), then that would be a personal attack. I'm attacking the content of your communication, not your person, and I'm making judgments based on what you are saying, not on who you are. So, really you are trying to use perfectly direct and correct instances of engagement as leverage to make it seem like I’m being mean or unfair. All the while I’m just addressing the content of the discussion and making no ad hominem attacks.

In the end, I still don't blame Chris. The best advice I can give to others is to avoid ASF.

Update by Josh Bero
Sep 09, 2009 5:59 pm EDT

Chris Peterson's comments on my original comments are a complete falsehood. No letter was sent at any time. I would be more than happy to show the double charge for February. The people at ASF even admitted this. Just read how ridiculous Chris's response is. How exactly should I show my account being double charged on a public forum board?! How about I give you all my bank account numbers and let you have access to my personal records. Ridiculous. It must be really awful to have to work for a company and have as part of your job the duty to lie on public complaint boards.

How exactly did I decide to no longer be a member before contacting ASF? You say that I have no proof for my claims. I absolutely defy you to prove that I no longer wanted to be a member before I contacted ASF. The simple reason you cannot proved it is that you HAVE to contact ASF to cancel your membership. Logically, contractually, and fundamentally, you've proved yourself a liar in your own statement. Your pathetic rhetoric of "long before he even contacted..." just continues to show how trite and inconsiderate your response is to a legitimate complaint. Everybody who wants to deal with ASF should just consider how scornful and vindictive your response is here. That's a great way to win customers pal. You have no idea how long I wanted or didn't want to be a member. You have no idea who I spoke to regarding my membership. You really have no idea what you are saying at all. I would return the challenge to you: prove anything you've said to be true.

You say that my comment that your practices cost the gym a customer is questionable. How so?! It is exactly because of your company's underhanded billing schemes that I no longer wanted to be a member of the gym. It had nothing to do with the gym. I liked that gym, I would have stayed a member. It was ASF that made staying a member prohibitive because of their overcharging.

I'm a very passive and considerate person, but you, Chris Peterson, are a liar. I don't blame you so much as the company you work for. It's just your job to lie for ASF. Sad really. I actually feel bad for you. You should be pitied more than despised.

Anybody that wants to check what I've said is welcome. Email my personal email address and I'll give you scoop. joshlbero@yahoo.com.

Regardless of the "validity" of the complaint, it is glaringly clear that Chris Peterson is not putting any customers first.

In terms of customer service, sir, you have no idea what real customer service is. You are not "relating" to anyone but yourself when you speak to a customer like you do on these boards.

If Mr. Bero's claims are true, why would he not send a complaint to his State's Attorney General rather than continuing what he is doing? I am the party that responds to those complaints as well. We have never had any action taken against us by any one of the State's Attorney General offices. Why is that? It is because we conduct business the way it is supposed to be conducted and, typically, individuals like Mr. Bero like to complain on this type of forum because their claims are invalid. So, Mr. Bero... If you feel you have a valid complaint, please report it to your State's Attorney General. We will be required to respond to them within a specified period of time. Once we have responded, you will then be required to provide any and all proof that would support your complaint. This is the end to responding to any further rebuttal's Mr. Bero may have in this forum.

ASF never charged Mr. Bero in the month of February. The challenge to prove that ASF did charge him meant that the proof should be sent to us directly, not to show proof on complaints board. However, I guess common sense didn't win over on that one. My statements are accurate and truthful. Why would I even put my information on this board if I was going to lie. It would be easier to ignore the complaint itself. However, with these types of forums, that cater to consumers, I feel that our corporation should have a voice and make sure that the "facts" are truly out there.

Unlike Mr. Bero, I will not stoop to personal attacks. I will simply state the facts and let the public form it's own opinion...

My comment on Mr. Bero's inaccurate comments will be brief. The terms of cancellation are outlined in his agreement. Mr. Bero's membership was cancelled. He was sent a confirmation letter that same day. Mr. Bero did not pay anything beyond his March payment. Mr. Bero was never double charged in February. If he was, I would challenge him to show us all the proof.

As for his comment that, "our practices are so concerning to him, that it cost the gym a customer", is questionable at best. Isn't Mr. Bero's complaint about what he had to do to cancel. He had already decided on no longer being a customer long before he even contacted ASF International.

ASF Payment Solutions eft billing after cancellation

I called to cancel my account bc of a move; sent them the email confirmation I recieved from USPS; was told it was not valid proof, and that I had to fax the actual letter. Cancelled EFT and received confirmation emails from them.

Faxed original letter the day after I got it (on the 10th), and they told me on the 14th they hadn't received it. Faxed ANOTHER time, received confirmation of receipt this time, but since my bill is due today, they charged me AGAIN!

I told them I had done what they asked; they said their cancellation department was still reviewing it, so I would have to pay the monthly fees AGAIN, or the acct would go into arrears and I wouldn't be able to cancel.

This company is using EFT to take my money, and is not letting me out of this contract by using their cancellation department reviews and mismanagement of Fax's to do so.

I will never ever do business with another company using ASF for their dues.

I have told at least four close friends, family members, and sent out an email warning everyone I know against entering into an "agreement" with any club that uses ASF as they are dishonest, rude, and definitely do not care about good business practices. If they truly cared about good practices, they would allow people to speak directly with their cancellation department.

Nobody ever enters a contract with ASF International. That is the great understanding of all of this. Member's enter into agreements with the health clubs or martial arts studios that we do business with. We simply enforce the terms and conditions of those agreements.

I am having similar difficulties with them at this time. I faxed AND sent 3 forms of "proof" that my husband and I are moving to South Africa. I specifically requested a phone call if they were not sufficient as we have very limited time before we leave. I never had a phone call, let alone a letter in the mail "within 10 days" as it states on the contract. I finally called and they informed me that they sent a letter (doubtful) and they said my information was not enough information. I faxed them again even MORE proof and specifically requested a call back. Still no word and it's been a week now. I called to check on the status as our mail is already being forwarded to our family and I won't receive another "letter" before we leave. When I called a spoke a really rude customer service rep and she kept trying to talk over me as I was explaining my situation to her. This company just keeps getting worse and worse and I told the three other girls that are thinking about starting a contract with ASF to NEVER enter a contract with ASF.

Without Deborah's information is quite difficult to answer her comments. However, I can tell you that the cancellations department does work from the date the initial request comes in and not the date they actually start processing the request. I would imagin that Deborah's membership is cancelled at this time.

ASF Payment Solutions continued to charge after cancelling/wouldn't &let& me cancel despite following protocol

I have spoken with many customer representatives, and none of them have been pleasant--much less helpful. I have attempted to cancel my account, but I continue to be charge--even though I have faxed the documents requested. I was first charged for first & last months dues at a Health Club (The Gym Downtown in Norfolk, VA), so I have now paid twice for the last month, and paid for a month after I had already submitted my cancellation. I would strongly encourage you to avoid this company at ALL possible costs. I asked to speak with a supervisor, and I was sent to voicemail (I have not heard back). Again, AVOID this company at all costs--or it WILL cost you!

I'm not sure about NonnieMouse's experience, but I just wanted to follow up to "Chris Peterson"'s (of ASF International) comment--ASF International continued to refuse to take action on my account, and finally I got in touch with my Gym--just to let them know what was going once, since I had been having a wonderful experience with the gym itself--and the manager quickly took charge of the situation and was able to "manually" cancel my account. Again, to reiterate, ASF International itself had nothing to do with the final resolution to this issue--don't be fooled.

ASF Payment Solutions billing policies

When we signed on to a year of tae kwon do for 2 people, we chose to be billed month by month. ASF sent us a coupon booklet for payment purposes. However, each month, well before the payment is due, they send us a bill with an extra $5.00 charge on it for their trouble, I suppose.

We have called them and tried to get their written policy on payments, but they refuse to give it to us. They say that their policy should be stated in our contract with our tae kwon do center. The contract for our school simply states that we are to follow the policy of the billing company. The billing company won't comply.

I guess I will be contacting the Colorado Attorney General's office.

ASF doesn't even keep copies of the contracts they enforce. They told me I am bound to a contract I signed. It took them days to produce the document - a document that has holes in it. But, that's not the purpose of this post. The point of this post is to point out that ASF claims ENFORCE contracts when they do not even know what the contract states! Not sure how that's legal. A company that plays such hard-nosed tactics should be required to keep copies of all contracts it is involved with.

ASF profits from raking the consumer over the coals. That's their mission. When you signup for a gym contract, karate contract, etc. ALWAYS ask if the company in charge of "billing" is ASF. If it is, walk away. Sign nothing. Give NO information about your social security number, your checking account, etc. ASF is a dirty business.

ASF International deals with thousands of companies throughout the United States, Canada and Puerta Rico. Each company has it's own contract. We are not in control of most of these situations. The amount of complaints we receive are minimal compared to the size of the member base we service. People fail to realize that a contract is signed in these cases. Regardeing After Burner's comment on the amount of complaints we may have with Attorney General's offices; there has never been any action taken against ASF International. Why is that? It is because all of the "facts" regarding a member's obligation are confirmed. Regarding "K George's" comment on the $5 manual billing fee; That is not an ASF International fee. If we charge a manual billing fee it is because the Helath Club/Martial Arts Studio has a clause in their contract stating that a member is required to pay that fee if they are not on any form of an automated payment.

Doesn't the simple fact that there are so many complaints to the General Attorney's office, the BBB and other sources compel you to see that your company's practices are wrong?

Absolutely, contact your state's attorney general. I would prefer that to happen. In the complaints that I answer from attorney general's offices, all of the facts come out and the issue is resolved.

As for our BBB acreditation, we cancelled our membership with them, and have chosen to not answer any complaints from them. Our priority is to resolve the issues with the consumers directly.

This guy Chris Peterson is an obvious ### clown.

He shows up on several web blogs trying to make it sound like ASF International aren't a bunch of crooks. The company has a Better Business Bureau (BBB) rating of C.

Their BBB accreditation expired on 4/3/2009 at which time there had been a total "627 complaints about this company in the last 36 months...", mostly for "Billing or Collection Issues", or "Contract Issues".

The BBB details are at URL:

http://www.bbb.org/denver/business-reviews/billing-service/a-s-f-international-inc-in-highlands-ranch-co-2105#ratingdetails

If you're reading this because of billing or contract issues with ASF International, I stronglyurge you to contact your state's attorney general, and the attorney general's office of Colorado where ASF Intl is located.

These SOBs need to be shut down!

The $5.00 Jennifer speaks of sounds like a manual billing fee. That fee can only be charged if it is stated in her contract with ATA. This fee is charged to individuals that are not set-up on an automated form of payment. Hence the name, "manual billing fee". If that clause is not in her contract she should contact ASF International's customer service department at [protected]. She should then send a copy of her agreement for ASF Intarnational to review. If the clause is not in her agreement, those fees will be removed from her account.

I charge ASF, and its enforcement of "child contracts" as indifferent, negligent, reckless child endangerment.

ASF utilizes bullying tactics, through binding "contracts" that force children to remain connected with programs even when the programs demonstrate a negative impact on the child's well being.

Case in point deals with karate "schools". ASF collaborates with such schools to implement such contracts with students, minors, and their parents. While even the smallest bit of research on your part will bring this to light, I can use my own young child as an example.

I enrolled my six year old boy into a karate program while he was in kindergarten, at the age of six. I did fill out paperwork dealing with payment for my son's participation. I admit, I was naive, I did not recognize the tenacious money grabbing contractual obligations involved with my son's participation. I had no idea that such binding contracts could, or would, exist in relation to minors...especially small children.

Karate schools, and the relationship held with instructors, are an intimate form of education for children. Bad schools and bad instructors may not be obvious at first - but can have a significant detrimental impact on the health and well being of a developing child. Even good schools and instructors, if the program is not a good fit for the child, can have equally negative impact on the child's development.

In the case of my little boy, it took a few months before the negative impact the karate school was having on him. I had enrolled my little boy into a program that I had hoped would build self-esteem, self-confidence, strength, and the ability to defend himself if the need were ever to arise later in life. I hoped these positive impacts would be with my son both in school academics and within his social life as he grew.

However, a few months into the program it finally became clear. This program was having the reverse impact on my son. My son demonstrated...

-exhaustion with school and academics

-anxiety

-sadness/depression

-bouts of anger

-general distress and a decline in self-esteem

Once it became clear that these social, academic and emotional issues were connected with karate I wanted to cancel participation. Initially, this would be temporarily, so that we could gage what was going on with my boy, and perhaps (reluctantly) permanently if necessary. I spoke with the karate instructor. He insisted a "freeze" on the account. In my nativity, I thought this was simply the instructor hoping to keep us connected, so I agreed.

Apparently there was a technical glitch (at least that's what I'm told), and the freeze did not go into effect. ASF tried to bill me. Fortunately, I had had a problem with my debit card and had just had it replaced...so the charge didn't go through.

I called ASF, thinking it would be a cordial conversation where this charge would be corrected and everyone would be happy. Turns out, the representative was quite condescending. She insisted the instructor would never have done such a thing. I insisted she contact the instructor and she replied "they don't contact the instructors". Further, she insisted that we were bound to this contract for TWO YEARS!

From there, I continued communication with ASF arguing that contracts involving minors were unethical and immoral and, should be, illegal. Every step of the way, ASF insisted that this contract was binding and, unless I moved, the contract would not be terminated.

Finally, after extensive arguing and standoff, another representative (Chris Peterson), suggested a one month freeze. Later, the karate instructor contacted me and stated that there had been a technical glitch and that ASF had contacted him, and the two month freeze was now in effect. I still demanded that ASF end this contract on the grounds that contracts involving small children was immoral and ethical. Of course, they refused my demands.

Now, a few months later, my standoff with ASF continues. I want to stress, again, my little boy demonstrated...

-exhaustion with school and academics

-anxiety

-sadness/depression

-bouts of anger

-general distress and a decline in self-esteem

I can't believe my little boy is not the only one to demonstrate such things. I know there are others out there like him, some younger - some older.

Parental concerns, and the health and well being of the child, are not the first, and foremost concern of ASF and the karate schools...er "businesses" they connect themselves with. In fact, as ASF has proven, there is a total apathy and disregard for the health and well being of children.

On another thread, one poster argued that he was upholding a contract that a mom was objecting to, related to her boy (in another state, with another school). This person argued that the contract was for the betterment of the child. That such contracts place motivation (or should we call it bullying and pressure?), prevent a quitter attitude among their participants (that, he states, is prevalent in this day and age). Read that again, please and consider the meaning. This karate instructor is making it clear that the expensive contracts are meant to essentially pressure the poor kid into continued participation. Essentially, that he is saving the child from the poor parental decisions made by this mom who wants to withdraw her child from the program. Talk about arrogance.

I thought that statement was made by Chris Peterson (because the guy did not identify himself as an instructor, but did appear to identify himself by the name of "Chris"). When I brought this up to Mr. Peterson, he made clear he was not the one to make that post, but that the instructor of that school did.

However, the point it made - and cannot be denied. These contracts place pressure on families for the continued participation of a child with a karate program, even if the parent has determined that the program hurts the child's well being. And, at least in some cases, are meant to place pressure for the child to continue to participate. I know I feel pressured...forking out $150 per month for two years will influence many parents to continue to have their child participate and receive these damaging services that are being paid for. And, lets face it, not all parents will recognize that they have the option of paying without their child participating. Forget the parent for just a moment...what about children's rights? These contracts violate the rights of children! Children are left unprotected while ASF squabbles to milk the parents for all they can.

Follow me here for a moment. I want to repeat the symptoms my son demonstrated a third time...

-exhaustion with school and academics

-anxiety

-sadness/depression

-bouts of anger that had not been seen before (or since, after he stopped attending). This one was quite a surprise. He was always a boy who sought out friendships with others, but now was in frequent conflict with others children...even strangers (i.e. at McDonald's play centers).

-general distress

Take this little boy (and also apply this to any child - we know there's others out there), and follow these symptoms down the road as the child continues to develop at such an impressionable point in his or her life. What do you imagine? How do you see things turning out for this child? At best, a dysfunctional life - a child who someday never lives up to the potential he could have. But...that's at best. I stress again, karate schools and instructors are a very intimate form of education for a child. These symptoms my son demonstrated from his experiences are real...and very concerning. Step back and imagine these very real symptoms a second time. Other than dysfunction, how else do you see this turning out for a child as he grows and matures under the intimate influence of a damaging karate program? It's a bit scary. I have a hard time saying the word. Suicide.

It's speculation of course. But, you follow those symptoms...those kind of things can lead a child in that direction. All because of an intimate, and very damaging, program the child was pressured to continue. Now, I will stand up for my son. I will watch out for him. That's why this contract dispute is occurring in the process. Let's face it. Not all parents will do that. Many will feel defeated from the very first moment they are told they cannot cancel the contract. And, many parents, especially those who do not connect with their child well, will simply bow to the pressure they feel from the contract and require their child to continue participating...due to the pressure of high payments they are forced to continue for these services.

Now, I will stress, Chris Peterson and ASF do not comment one way or another on whether these contracts are fair for the children. Whether these contracts are good, or immoral and evil...violating children's rights (children, those which are most helpless and need such protection). Chris Peterson, and ASF simply state that the parent is obligated to continue the payments that "they agreed to". (If other parents are like me, they were naive, not realizing that these "contracts" were so binding - especially due to the fact that they involved young children - that one could not cancel).

What ASF has essentially demonstrated is indifference. Indifference to the health and well being of children. Indifference to children as a whole - as long as they can siphon money over an extended period. But, is it even simply indifference we are talking about here? Is this blatant negligence? Negligence is likely the better word choice here.

I argue that contracts involving children are methods of entrapment, indenture and enslavement of a child and should absolutely never be allowed. They should be illegal in our nation - especially here in the 21st century. I never would have imagined that, here in our country - a nation that protects the rights of children - would see a situation where children's rights are ignored. Are we in the United States, or are we in a third world country here? Binding, long term contracts such as this, are things I would have imagined in a third world nation. A nation that cannot, or will not, protect children's rights.

These contracts should never be. Not with my son, or with anyone's child. Children are unpredictable and their growth and development can go in many directions. Their needs change. Whether a program is recognized to be detrimental to a child within a day, within a few months (as it took my child), or within a year, there should NEVER be a binding contract on a child with such an intimate educational program. Once a parent recognizes that such a program is detrimental to a child's well being, ASF and that karate program should immediately, when requested, cease all relations with that child and that family...that INCLUDES payment. As I have already demonstrated, the continued enforcement of a "contract" keeps the connection alive. All relations should cease for the betterment and rights of children.

But, again, I stress. ASF (and Chris Peterson - who's defense of ASF are all over these boards), makes very clear - they are only concerned about the money. Never, ever - when ASF is defended on these boards - do they express concern for the child. In all cases, they seek to enforce the contracts and collect the $$$$

I will state this. After a significant standoff on this issue, Chris Peterson (months later), has finally offered an alternative. He has blessed me with option B: a buyout of the contract. There is no such buyout option stated in the contract. So, this has been created out of "nothing". So, this buyout has been artificially inserted only after extensive arguing. The buyout is $450. Honestly, I don't have the money for the buyout - I'm still trying to figure out how I will do it while still feeding my children. But, that's beside the point. It should not have taken months as I demanded a cancellation of the contract for this buyout to finally be offered as an option. Further, a buyout option should not even be necessary to begin with - when a parent recognizes that a karate program is having a significant negative impact on his/her child's health and well being and development, ASF should be ready to immediately cease relations with that child and family and simply end the "contract". How many other parents have tried, and felt despair at ASF's obsession to enforce long term payments they felt they had to fold? These aren't cell phone contracts or a direct tv contract we are talking about here. These are living, breathing, impressionable, developing young people...who are at critical points in their lives as they grow and mature.

I love my son. My little boy. I'm sure you love your children. When I send my son to school I feel that his teachers love and care for him. I feel like the school administrators watch out for his well being. When dealing with ASF and my son's karate program I recognize that one thing has been demonstrated here. To them children = $$$$$$. Nothing more. If they cared about children, these contractual agreements they enforce would cease. That's a shame. Business is one thing. But, one should never go into business involving children without also having a love and care for...children, and children first. This is America.

This is indifference. This is negligence. This is reckless child endangerment. ASF, end all ties to my child. Now. End all child contracts. This is America. We love our children here. We believe in children's rights here.

I have had a contract with this company now for almost two years. I have tried to pay out my contract but my balance keeps going up. I sent them a check for 200 dollars but only 170 was posted. I asked them where is my payment I sent? I was told there were some fees that the rest of the check was used to cover. These were not posted on my account where I could see them and my 200 dollar payment never showed up in my payments. I just want to pay this out and never go back. I am willing to join a class action lawsuit against this company. I joined a gym last november. I signed a contract for 2 months membership. My contract expired in january of 2011. This evil people auto renewed my contract in febuary (according to the customer service rep I just talked to) when I asked why my contract auto renewed. I was told it was because I didnt cancel. Which I did talk to the gym and let them know I couldn't continue my membership due to changes in my work schedule. They were fine with that and told me that it wasn't a big deal because my contract was up anyway. I was never told or shown anything about any auto renew on my contract. I have family that works for the district attorneys office. I am going to contact them and see where I should go from here. They sent me a bill for $296.00 I asked how I cancel this contract so that the bill dont get any larger. I was told I have to be current on my bill to cancel. Then was told I have to pay $415.00 to get current and cancel. I am not paying for a service I did not receive and I plan on taking this matter to court.

John,

"Wake up." they ARE doing it in America... every day, to people all over the country. I have seen many posts by Chris Peterson... not one of them has ever expressed remorse for someone's problems. All he does is pop in and make some lame excuse or throw blame back on the poster.

Check out the responses from other business' complaint boards. They are full of manager-types saying, "We're truly sorry for your bad experience. We'll look into this matter and be sure to correct it. We appreciate your business." But you won't hear anything like that from ASF International.

Here's why:

ASF International doesn't "do business" with you and me. They sell their services to gyms, do-jos and the like. That service is simple... they pay the gym up-front for your full contract length amount, minus their "cut". No problem. This is America and they have a niche that makes money. Great! Contrats to them.

Here's the problem... they absolutely have no motivation to "please" the gym's customers. They simply want to collect their money. The more money they collect, the better. Still... no problem... until; if you want to cancel, they work overtime to find an excuse to prevent you from it. If they can possibly find some reason to tack onto your bill, they will... and DO NOT THINK that you can simply call them and ask nicely to remove any tacked on fees... because they have ZERO motivation to do that. Why would they? What are you going to do if they don't? Stop using the gym? Woohoo! Big deal! They don't care if you ever SEE a gym again... they will take your money for as long as they can, and make it is difficult as humanly possible to get them to stop.

Ok. Here's the deal. They might screw a few extra dollars out of our pockets... but let that buy them this: Tell EVERYONE you know to avoid doing business with ANY organisation that uses ASF International for billing. AND MAKE SURE you explain to the gym management that the VERY REASON you refuse to do business with them is because of ASF International's pracitces.

That is the ONLY thing you can do to ASF International. So, be loud, be long and be persistent. KEEP telling everyone you know, with every media available to you. Any business that uses ASF International is off-limits.

Have a GREAT day, Chris Peterson. You're our HERO for SUPER DUPER customer satisfaction and respect. Hope you get employee of the year and your name on the wall there at your offices.

ASF Payment Solutions secret to cancel and get rid of these crooks

In order to cancel you need to forward your mail to a family or friends address located over 25 miles and tell these guys you moved as proof present the postal service confirmation that you forward mail to the new address, then you can change address back also some cases they want two proofs just have a family member or friend add and print a utility bill with your name on it just temporally and also tell them you move.. This is the only way out of any contract with these crooks.. You can make it if you follow exactly these instructions

First off, you have to eat and pay the rent. In hard times, if you can't pay all your bills, prioritize. Some will make you feel guilty for not paying this gym what "they are owed". But if that means you can't eat or pay the rent, there's no shame in stopping payment. If it's what you have to do because times are tough, it's what you have to do.

I don't know what the repercussions would be. Maybe just annoying creditors sending you letters. Maybe they'd sue for "their" money. Unlikely, but possible.

If the contract is expired I can't see how they could keep billing your more though. That sounds dirty.

Bw persistent. Be a nuisance if you have to. You'd be surprised what you can get accomplished with a little persistence. Find out who the ranking person in charge at this facility is and demand to speak with that person. Write letters. Etc.

Just don't give up.

I am on disability I fell behind on my payments to the gym a few months ago. I owe 90$ to the gym. I have silver sneakers and can get a free membership with my insurance. I tried to switch to the free membership months ago but they wouldn't let me. January was the last of the twelve months for my membership i was told to come in and cancel it. I went in today and they told me I couldn't cancel my membership because I owe money. They will continue billing me. I can't afford to pay til March and it will cut into things I need like food. What is the point of them continuing to bill me. I'm sure I can't use the gym because I am past due so what am I being billed for I already tried to cancel and they wouldn't accept it. My disability is I have Schizophrenia and I had a brain injury from a hit and run driver. If anyone on this board works at fitworks and can get my membership canceled let me know. My name is Martin Malloy

I was told that to cancel my month to month, all I have to do is write them. I really AM moving and if they bill me in February, I'll put a stop payment on them. I'm notifying them the end of November, so I should have to pay Dec. and maybe Jan, but definitely not beyond that.

This company is GREAT for the seller and MISERY for the customer? Shouldn't be like that.

Will let you know if it doesn't work the way it should. Count on it and count on my complaining to my Congressmen, too.

Everyone here is just pissed off because they FAILED to understand that THEY probably SIGNED UP for a 12 month contract which CAN be canceled any time, HOWEVER, YOU ARE STILL OBLIGATED TO FULFILL your 12 MONTH AGREEMENT! If it is a month to month contract and IT STATES "month to month" (typically with a 30 day billing clause) in the paperwork, AND you send in a proper cancellation (which if contract terms are met and followed should be as easy as a phone call OR letter of cancellation)...you should have no problem canceling! You people simply do not read, understand nor have the ability to follow directions...you are directing your anger at this company because you are incompetent and forced to pay for what you have committed to! It is no-ones goal to screw you...however gyms MUST put you under contract in order to function long term...or else they would have to charge INSANE monthly dues which noone would want to pay! And sorry, but if this companies practices were illegal AND doing business over state lines, they would have been in A FEDERAL COURT long ago and now out of business. I have NO RELATIONSHIP with ASF however I have been a gym member for 20+ years and have managed gyms for nearly 10. Take responsibility for your actions and decisions!

This so called company ASF International is CRAZY! Me and my husband opened up an account together ath the world gym. My husband never had a contract with them. He was on a month to month agreement. My husband was told that he could cancel his agreement at anytime. My husband canceled his agreement back in 09 of december. Why are ASF Internation trying to bill me now? I was under my husband agreement. They took money out of my husbands account every month for both of us. They took there last payment out in decemeber for both of us. Now they are attacking me! This is so crazy,
I keep trying to explain to them that my husband canceled the aggreement and they show that in there system but they are trying to say my husband didnt cancel both accounts. Are they serious?
It was only one account. The reps at this company are horrible and so is managment. They are so rude. The hold time to speak with someone is inpossible! I am definately taking this all the way. They are trying to say to say that I am 40 days late. Companys like this are scary, I feel they are a fraud. I have spoken to 3 different managers they all are rude. The customer service level is horrible. The bad thing about it is the read all my husbands info to me including his credit card # that they were billing every month and still continue to say I had an agreement. My husband added me on his account. People like this make me so mad because they try and mess up your credit. What if I would of never opened the mail from these people they would have been able to just slap this on my credit. What sucks for them is that they will never be able to prove this is my account because I never signed anything. But just the thought of there poor customer service makes my stomach turn, and LEGAL action will be taken against these people. It just so happens that I am an attorney, and at this rate a PISSED one!

I disagree.

My experience with ASF Int was great! I had a one year membership with Fitworks on my contract it stated it would renew to a month to month agreement and i could stop it with a 3o day notice in writting. I decided to go month to month and when i was ready to cancel the account I was able to call in an do a verbal cancellation it was fast and easy...I will continue to use gyms that use Asf as their billlling company.

I would like to say to Chris, though you feel people are being rude it does get really frustrating when talking with your agents and they are so rude. But more to the point my husband is in the US Army and was sent overseas. Now I am sure Chris you have never spent a year alone with two children and no family, but I have. This time I decide to go stay in NY with family. Now Chris, I sent in first my husbands orders from the united states government! I was told that didn't count do to it being in my name and not my husbands. Ok, fine Chris we see your company's views on the men and woman who give you your right to cheat everyone, but whatever. So second i sent in a lease, showing that all my utilities are included. No that wont work either. Then I sent in my change of address form, no I understand you have a problem with P.O. Box's but I have no other choice not to mention it is in NY and my contract is from GA. So Chris don't you think this is getting a little frustrating that I have to deal with all this? Now they want me to send in my daughter school records, I don't think so. That is her personal info. So now what Chris? I will say that I am done, alot of kids here on base use the same company I did I will be reporting it to the office here on post and having you put on the black list. Also I plain on seeing the JAG office as well because as your agent told me they are within there contract, though they do not have a copy of it. Well Chris I am with in the laws of the military to be removed from a lease or agreement such as this when my husband has orders from the military!

Here's a big one for you, i signed a membership with the rep stating "oh since you live 50+ miles away you will have no issue canceling if you need to" i tried today and they literally told me i have to move because my current address, which is 50+ miles away is the same address i wrote when i signed up and i need to move. I couldn't believe this, the contract doesn't stipulate that the move has to be done after i sign up, it just says if i permamnently move more than 25 miles from the gym location that i may cancle. This is propostreus..!

This company barely operates in a legal manner. They make it as difficult as possible to cancel a membership. They are rude and always want more and more paperwork. They should be shut down.

BTW everyone, you can request a paper bill be mailed to you. You DO NOT have to give them credit card or checking account info. That way they can't get their filthy hands on your money when ever they choose. They do charge a $5 fee for paper bills but at least you keep track of what money they get and when.

Wow! Dr. Lawsuit couldn't be more wrong. ASF International is not being investigated by the FBI nor is there any class action lawsuit. It is apparent that "Dr. Lawsuit" did not read his agreeement when it pertained to a $5 manual billing fee if he were not set-up on automatic form of payment. I would also like to mention that ASF International is not the author of any of it's client's contracts. It is reccommended to all of our clients that their contracts be in compliance with their specific state "health club consumer protection codes". We simply enforce the agreement as it applies to the specific terms and conditions within it. I certainaly have to question "Dr. Lawsuit's" motivations just by the language he uses in his complaint.

ASF Payment Solutions fitness

Seen hundreds of complaints on google and this web site..

Bottom line, I gave my gym 30 days notice in August 08 with a copy of my new lease and moving bill.
Sept was to be the last withdrawl, In Oct there was a withdrawl in the name of ASF International, not my gyms name. I bank canceled payment and I contacted ASF, The customer service rep stated they had no notice to cancel my membership ( But remember they changed the way they depted my account) she said to fax info over to the cancel dept, A few weeks later I get a notice that THEY denied the cancelation because I did not send it on their form and must keep paying dues until they approve. to make it easy i sent the balance due plus they cancel form and 2 weeks later they stated they have not recieved it yet, So I must resend a new check plus past due cost also...

So before you sign up with any fitness company nation wide or local, see who their billing company is and then search the web for complaints or complaments

Well my check made it to my bank on Saturday 12/20/08, Now lets see if they do what the ciustomer service rep told me over the phone
1. If I paid they last 2 months the extra fees would be waived, which is what my statment showed... and being my contract was non-renewable there would be no further attemps to charge my account...

So I dont who is really to blame, The gym stated they sent the info to cancel, ASf stated I was to give both notice for approval to cancel.

My Gym was North Ga Athlectic club off Ga400 in Cumming

ASF Payment Solutions terrible company

I signed a contract with Knuckle Up Fitness in Douglasville, GA, in May 2007 for Brazilian Jiu Jitsu classes. I was injured in a car accident in Sept. 2007. I did not try to cancel my contract until March 2008 because my doctor told me that I should be able to resume normal activities in 3-6 months. When I realized that it would take a lot longer for me to heal, I sent a letter to Knuckle Up to cancel my contract under the 'permanent disability' clause.

I received a letter from ASF International in April 2008 stating that they needed a letter from my doctor on letterhead in order to cancel the contract. I received a letter stating that I was injured in Sept. 2007 and was still undergoing treatment and that I could not participate in Jiu Jitsu classes. ASF repeatedly rejected this letter because it did not contain the phrases 'permanently disabled' and '45 days.' ASF continued to bill me a monthly fee.

I filed a complaint with the Denver Better Business Bureau (denver.bbb.org), of which ASF is a member (in good standing, if you can believe that). In response that that complaint, ASF sent me a letter stating that my contract was cancelled and that I had no further financial obligation. I also sent a letter to the CEO of Knuckle Up Fitness. This letter was referred to Knuckle Up's general counsel, who contacted me and arranged for reimbursement of all monthly fees paid since ASF received my initial cancellation request. I spoke with the general counsel yesterday and expect to receive a check in a few days.

I recommend that people having trouble dealing with ASF contact the gym they originally signed a contract with and ask for the name and contact information for their general counsel and file a complaint with the Denver BBB.

I sent ASF a letter and copied State of Colorado Department of Law. According to them, this company operates illegally - they are not registered with BBB. Don't pay! If you have direct debit, go to the bank and they will issue you a new debit card, which stops the direct debit. See the link to the Colorado BBB regarding ASF:
